Plain English Summary

2/10 complexity

This Specification determines what income is ignored when calculating the Pension Bonus Bereavement Payment.

What it does

When someone dies, their surviving partner may be eligible for a Pension Bonus Bereavement Payment (a one-off payment related to the deceased's accrued pension bonus). Usually, Centrelink counts your income to see how much you can receive. This instrument says that periodic compensation payments (regular payments received as compensation for injury or loss) won't be counted as income against this particular bereavement payment.

Who is affected

This applies to people claiming or receiving the Pension Bonus Bereavement Payment — typically the surviving partners of deceased pensioners who had accrued a pension bonus but hadn't claimed it before death.

Key detail

The compensation payments must be regular/periodic payments (as defined in the Social Security Act), not one-off lump sums.
