This instrument makes payments under the Commonwealth "Relocation Assistance to Take‑Up a Job" program exempt from treatment as a lump sum for the Social Security Act 1991 (s5). It applies to individuals who enter a Relocation Assistance to Take‑Up a Job Agreement on or after 1 May 2021 and to amounts paid by or on behalf of the Commonwealth, including advances, reimbursements or direct supplier payments (s4–s5). Mechanically, it determines how those payments are treated for the Act’s lump‑sum rules (s3–s5).

This instrument is made under paragraph 8(11)(d) of the Social Security Act 1991.
In this instrument:
Act means the Social Security Act 1991.
eligible participant means an individual who enters into a Relocation Assistance to Take-Up a Job Agreement on or after 1 May 2021.
relocation assistance payment means, in the case of an eligible participant, an amount:
(a) paid by, or on behalf of, the Commonwealth in accordance with a Relocation Assistance to Take-Up a Job Agreement; and
(b) received by any means, including:
(i) an advance payment to the individual;
(ii) a reimbursement to the individual; or
(iii) a direct payment to a supplier who provides a good or service to the individual.
Relocation Assistance to Take-Up a Job Agreement means an agreement for the purposes of the program established by the Commonwealth and known as “Relocation Assistance to Take-Up a Job”.
For the purposes of paragraph 8(11)(d) of the Act, if an eligible participant receives a relocation assistance payment, that amount is an exempt lump sum.
