What it does
This instrument, the Social Security (Exempt Lump Sum - NSW Government Payments to Stolen Generations Survivors) Determination 2017, declares that specified NSW one‑off payments to certain Stolen Generations survivors are, for the purposes of paragraph 8(11)(d) of the Social Security Act 1991, an "exempt lump sum" (see s 1 and s 5). It identifies three distinct payment types made by the NSW Department of Education that are covered: (1) payments under the NSW Stolen Generations Reparations Scheme (one‑off ex gratia payments of up to $75,000), (2) payments under the Stolen Generations Funeral Assistance Fund (one‑off payments of $7,000 toward funeral costs), and (3) payments under the Aboriginal Trust Fund Repayment Scheme (ex gratia repayments of $11,000 made case‑by‑case as residual management) (see s 4, definitions).
Mechanically the determination performs a single legal function: it changes the statutory classification of the gross amount of those payments for a particular purpose within the Social Security Act 1991, by treating the gross amount as an exempt lump sum (s 5). It does not amend the Social Security Act itself; rather it is made under the authority granted by paragraph 8(11)(d) of the Act (s 3) and operates to specify that, for the limited statutory purpose identified, the listed NSW payments are to be excluded from whatever means or assets tests or treatment attach to non‑exempt lump sums under the Act.
Commencement is immediate in the sense set out in the instrument: the whole instrument commenced the day after registration on the Federal Register of Legislation (s 2(1) and the commencement table). The instrument also contains two procedural notes in the commencement section: the table relates only to provisions as originally made and will not be amended to reflect later amendments, and the information that may appear in the third column of the commencement table is explicitly stated to be not part of the instrument (s 2(1)-(2)). Those statements alter how one interprets the schedule/commencement table in published versions.
