What it does
This instrument, the Social Security (Exempt Lump Sum - Certain Commonwealth Discretionary Payments) Determination 2025 (s 1), designates a narrowly defined set of Commonwealth discretionary compensation payments as "exempt lump sums" for the purposes of paragraph 8(11)(d) of the Social Security Act 1991 (the Act) (s 3). Mechanically, the Determination tells administrators that where a payment meets the definition in the Determination, it is to be treated as an exempt lump sum under that provision of the Act (s 6). The instrument commences the day after it is registered, according to the commencement table (s 2 and the table shown in the instrument).
Concretely, the Determination does two things. First, it defines the term compensation payment for the Determination’s purposes by reference to two specific Commonwealth payment sources: payments under the Compensation for Detriment Caused by Defective Administration scheme, and payments made under section 65 of the Public Governance, Performance and Accountability Act 2013 (s 4). Second, it prescribes the circumstances in which such a compensation payment qualifies as an exempt lump sum: where the payment is made in lieu of an amount under a defined list of laws, or where it is made to reimburse expenses incurred because of the administration of those same laws (s 6). The list of laws comprises the social security law, the family assistance law, the Student Assistance Act 1973 (including the ABSTUDY and Assistance for Isolated Children schemes), and the Paid Parental Leave Act 2010 (s 6).
The instrument also repeals the earlier Social Security Exempt Lump Sum (Certain Commonwealth Discretionary Payments) Determination 2015 in full (Schedule 1). Section 5 explains that schedules in the instrument operate to amend or repeal specified instruments as set out in each Schedule.
