SHERIFF REGULATIONS 1967

The Regulations revolve around several repeatable operational concepts: execution and sale, service of process, detention on civil process, fees and cost allocation, notice and retention of funds, judicial oversight, and geographic limits.

Execution and sale: When property is taken in execution, the sheriff must publicise the sale at least 14 days before the intended sale (r 3). The sheriff chooses the place of sale (r 4) and, unless a court directs otherwise, must offer seized property by public auction (r 5(1)), sell for cash on delivery unless directed otherwise (r 5(3)), and sell only the estate, right, title or interest of the judgment debtor unless written consents and a division of net proceeds are agreed (r 5(4)-(5)).

Service of process: The sheriff will serve writs, notices, orders, summonses or other documents in the Territory if requested in writing with instructions (r 10(1)-(2)). Service is provable by the sheriff’s or officer’s affidavit (r 10(3)). Subpoenas to compel the sheriff or an officer to attend regarding service require leave of a Judge or Associate Judge (r 10(3)).

Detention on civil process: A person arrested by the sheriff on civil process must be lodged in the custodial correctional facility nearest to the place of arrest and detained there until lawfully discharged, subject to any court order (r 9). The Regulation cross‑refers to the Correctional Services Act 2014 definition of custodial correctional facility.

Fees and cost allocation: The Schedule sets fixed fees (e.g. item 1 and 5) and kilometre‑based increments (items 2 and 6), a 5% poundage on amounts levied (item 9), and allows recovery of actual reasonable expenses (items 10-13). The sheriff may require deposits and written undertakings to pay further fees (r 14). When execution is discontinued, poundage becomes immediately payable by the execution creditor unless full particulars of an arrangement are furnished to the sheriff within 14 days (r 16).

Notice and retention of funds: The sheriff must pay monies received to the party entitled on demand, less lawful charges, unless the sheriff has received notice to retain them from a person claiming interest (r 6). Where such a notice is served, the sheriff may retain the monies to await judicial determination; if no application is made within 4 days, the sheriff may pay out in pursuance of the warrant (r 7).

Judicial oversight and compellability: Fee disputes are taxed by an Associate Judge (r 12). Officers are not compellable to travel more than 60 kilometres from their office or residence for service, and more than 160 kilometres cannot be allowed without judicial order (r 17). The court has roles in permitting greater travel, permitting subpoenas to compel sheriff attendance, and in addressing defaulting legal practitioners (r 19) and defaults in execution returns (r 20).

Geographic anchoring: The Regulations explicitly reference costs for executing process “at a distance from Darwin” (r 18(1)), and require officers’ returns to state kilometres travelled to support claims for extra kilometres (r 18(2)). The Schedule operationalises these distance charges with per‑kilometre pricing (items 2 and 6).

These Regulations structure rights and obligations for a defined set of actors. Primary actors are the sheriff and sheriff’s officers. The sheriff is given operational discretion to determine place of sale (r 4), to require deposits and written undertakings for fees (r 14), to retain monies pending judicial determination (r 7), and to waive poundage (r 16A). Officers have travel‑compellability limits (r 17) and must record kilometres travelled in returns (r 18(2)). The Schedule fixes the fees payable to the sheriff and, by implication, to officers when acting under the sheriff’s authority (reg 22, Schedule).

Execution creditors and judgment debtors are directly affected. Execution creditors must observe the publicity and sale requirements when relying on the sheriff (r 3), and they face liability for poundage if execution is discontinued without furnishing particulars of an arrangement within 14 days (r 16). Debtors whose property is taken in execution are subject to the sale mechanics (r 5) and to the sheriff paying out proceeds after lawful charges (r 6). The sale provision in r 5(4)-(5) specifically affects third parties who claim an estate, right, title or interest in property subject to execution: their written consent and an agreed apportionment in writing can change the legal interest sold and the distribution of proceeds.

Legal practitioners are affected in multiple ways. They may request service or execution (r 10(1)), must make those requests in writing with instructions (r 10(2)), may be required to provide deposits and written undertakings (r 14(1)), and face a specific enforcement pathway if they default on payment of fees for 7 days after written demand (r 19). Rule 11 deals with fees when the sheriff does not execute process because a fit person is appointed under section 12 of the Sheriff Act 1962: generally, fees payable by the person against whom process is sued out become due and payable to the person suing out the process, except registration and return fees.

Auctioneers and agents engaged to sell seized property are affected by r 13. If the sheriff requires gross proceeds to be paid over, the sheriff may pay the auctioneer’s proper charges and expenses after receiving and, if necessary, after taxation of fees. Those auctioneers therefore must be prepared to deal with the sheriff’s accounting and potential judicial taxation under r 12.

Courts and judicial officers , Judges and Associate Judges , are implicated through fee taxation (r 12), leave to subpoena the sheriff (r 10(3)), orders permitting travel beyond caps (r 17), and as the forum for applications affecting retention of funds and committal of sheriffs (rr 7, 20-21).

Other public actors include the Attorney‑General and Crown Law Officer, the former needing to consent to the sheriff referring enforcement of recovery orders against a legal practitioner to the Crown Law Officer (r 19). Custodial correctional facilities are brought into the chain of custody for persons arrested on civil process (r 9).

Finally, the Schedule’s kilometre and revenue unit structure impacts any party who instructs the sheriff for service or execution in remote places, because items 1-8 and related items 10-14 prescribe how fees are calculated and apportioned.

The Regulations impose a sequence of affirmative duties on the sheriff, officers, and parties undertaking execution or service. They simultaneously create procedural rights for affected parties to protect interests and seek judicial resolution.

Duties of the sheriff and officers

• Publicise sales: The sheriff must give notice of the time, place and particulars of property to be sold at least 14 days before sale in the manner he sees best to give publicity (r 3). This is an affirmative publicity duty prior to sale.
• Choose place of sale: The sheriff must cause seized property to be sold at the place of levy or elsewhere as he deems most advantageous (r 4).
• Mode of sale: Unless the Court or a Judge directs otherwise, sales must be by public auction, not in premises licensed for liquor or racing/wagering, may be in one or several lots, and be for cash on delivery unless otherwise directed (r 5(1)-(3)). The sheriff must sell only the estate, right, title or interest of the party against whom the warrant issued unless written consents and an agreed apportionment allow broader sale (r 5(4)-(5)).
• Payment and retention of monies: On receiving monies under a warrant, the sheriff shall pay them on demand to the entitled party or that party’s legal practitioner, deducting lawful charges, unless he has received notice to retain the monies from some person claiming an interest (r 6).
• Retain pending dispute: Where a person claiming interest serves notice requiring the sheriff not to pay monies, the sheriff may retain them to await an order of the Court or a Judge (r 7(1)). The sheriff may pay out after 4 days unless the person giving notice applies to the Court and serves notice on the sheriff (r 7(2)).
• Non‑suspension of execution: The sheriff must not suspend execution of any warrant except upon an absolute written order to that effect lodged by the person entitled to benefit or their legal practitioner; that person may withdraw the order and lodge instructions to execute (r 8).
• Service on request: The sheriff shall, if requested in writing by a party or their legal practitioner with instructions, serve or cause to be served documents requiring personal service in the Territory (r 10(1)-(2)). Proof of service is by the affidavit of the sheriff or officer effecting service (r 10(3)).
• Require deposits and undertakings: The sheriff may require a deposit of money and a written undertaking to pay any further fees that become payable (r 14(1)) and must return any excess deposit when actual payable fees are ascertained (r 14(2)).
• Lodging arrested persons: A person arrested on civil process must be lodged in the custodial correctional facility nearest the place of arrest and detained there until lawfully discharged (r 9).
• Fee waivers and delegation: The sheriff or an officer may waive poundage (r 16A) and may require payment arrangements including paying over gross sale proceeds then reimbursing auctioneer expenses (r 13).

Rights and procedural protections for private parties

• Right to notice before sale: Parties who will be affected by sale of seized property are protected by the 14‑day notice requirement (r 3).
• Right to have money retained pending dispute: A person claiming an interest can serve notice to require the sheriff to retain moneys pending judicial determination (r 7).
• Right to require judicial taxation of fees: Where sheriff fees are disputed, the amount is to be taxed by an Associate Judge (r 12).
• Right to seek committal: A person issuing a warrant or obtaining an order for attachment or committal (or that person’s legal practitioner) who has given notice under r 20 and not received the warrant return or body can apply for an order for committal of the sheriff (r 20).
• Right for legal practitioners to request service: Legal practitioners have the procedural right to request sheriff service, subject to compliance with requirements such as written instructions and deposit obligations (r 10; r 14).

Financial duties of parties using sheriff services

• Payment of fees: Schedule fees (reg 22 and Schedule items) are payable to the sheriff. The sheriff may demand deposits and written undertakings (r 14). Where execution is withdrawn, satisfied or stopped, fees are payable by the person issuing the execution or the person at whose instance the sale is stopped (r 15).
• Particulars when execution discontinued: If execution is levied and then withdrawn on request, poundage on the full amount levied becomes immediately due and payable by the execution creditor unless full particulars of an arrangement that renders the sale unnecessary are furnished to the sheriff within 14 days (r 16). The sheriff may waive poundage under r 16A, creating conditional discretion.

Enforcement and oversight rights

• The Associate Judge taxes fee disputes (r 12).
• Leave is required to issue a subpoena compelling sheriff attendance over service matters, thereby creating judicial gatekeeping (r 10(3)).
• Judicial orders can authorise travel in excess of the caps in r 17.
• The Court or Judge is the forum for resolving notices to retain monies (r 7) and for committal applications against sheriffs (rr 20-21).

These duties and rights create a framework where operational sheriff choices are constrained by written procedures, monetary mechanisms in the Schedule, and recurring judicial oversight points for disputes over fees, travel and retention of funds.

The Regulations do not create a separate schedule of criminal penalties. Instead, enforcement relies on court processes, judicial oversight, taxation of fees and specified administrative remedies. Several provisions establish civil enforcement pathways and mechanisms that can impose consequences on sheriffs, legal practitioners, and other parties.

Taxation and judicial oversight

• Fee disputes: The amount of any fees or charges payable to the sheriff is to be taxed by an Associate Judge where the sheriff and the person liable differ as to the amount (r 12). That process can alter the quantum payable and therefore operates as an enforcement mechanism ensuring judicial scrutiny of claimed fees.
• Subpoena leave: A party cannot issue a subpoena to compel the sheriff or officer in respect of matters arising from service except with leave of a Judge or Associate Judge (r 10(3)). The judiciary thus controls compulsion of sheriff officers, shaping enforcement and evidentiary avenues.

Court‑ordered committal and return

• Notice and committal: No order shall issue for the return of any warrant or to bring in the body of a person ordered to be attached or committed; instead, a notice from the person issuing the warrant (or that person’s legal practitioner) calling upon the sheriff to return the warrant or bring in the body within a given time, if not complied with, entitles the issuer to apply for an order for the committal of the sheriff (r 20). This creates a specific enforcement path against sheriffs who fail to execute returns or produce detained persons.
• Ex‑sheriff liability: Even a sheriff who has left office can be called upon by a notice under r 20 to bring in the body within the time allowed by law (r 21).

Enforcement against legal practitioners for fee defaults

• Reporting and court orders: If a legal practitioner who requested execution, service or work for which fees are chargeable defaults in payment for 7 days after written demand, the sheriff may report the practitioner’s name to the Court or a Judge (r 19). The Court or Judge may then make necessary orders to enforce payment. This invokes judicial enforcement rather than automatic financial penalties.
• Referral to Crown Law Officer: The sheriff may, with the consent of the Attorney‑General, commit to the Crown Law Officer the matter of enforcing the orders (r 19). That brings executive legal resources into enforcement if the Attorney‑General consents.

Monetary charge and contractual mechanisms

• Payment obligations: The Schedule fixes fees and poundage (e.g. item 9 sets poundage at 5% of the total amount levied). These monetary liabilities are enforceable as debts owing to the sheriff; failure to pay triggers the r 19 pathway when legal practitioners are the defaulting payers.
• Deposits and undertakings: The sheriff may require deposits and written undertakings to secure fees (r 14). Where deposits exceed the amount payable, excess must be returned (r 14(2)). Deposits function as an upfront security mechanism limiting exposure to unpaid fee risk.

Discretionary waivers and administrative relief

• Waiver of poundage: The sheriff or an officer may waive poundage in respect of a warrant of execution (r 16A), which is an administrative relief lever that can mitigate monetary liabilities in practice.
• Judicial orders for travel: Judicial discretion under r 17 to authorise travel beyond the prescribed kilometre limits can alter cost and operational obligations, allowing exceptions to ordinary compellability constraints.

Absence of criminal sanctions within the Regulations

• The text does not set criminal penalties; it relies on civil enforcement by the courts and administrative remedies (taxation, reporting, committal). The operative enforcement levers are therefore judicial orders, fee taxation and the procedural device of reporting to the court and referral to the Crown Law Officer where necessary.

Practically, therefore, compliance is enforced by having parties apply to the court for orders (including committal) and by using the fee taxation process to resolve disputes over amounts claimed by the sheriff. The sheriff’s capacity to retain funds on notice (r 7) and to require deposits (r 14) are also immediate administrative means to manage risk and enforce compliance.

The Regulations are explicitly made under the Sheriff Act 1962 and cross‑reference, incorporate or rely on several other legislative instruments and judicial mechanisms. The text itself contains internal cross‑references and the Endnotes record substantive interactions through amendments.

Primary enabling and cross‑reference

• Sheriff Act 1962: These Regulations operate as subordinate legislation under the Sheriff Act 1962. The Regulations give effect to operational aspects delegated from that Act (see heading indicating Regulations under the Sheriff Act 1962).
• Bankruptcy Act 1924-1965: Regulation 6 explicitly excludes a certain category when it refers to “a case not within section 93 of the Bankruptcy Act 1924‑1965” for the rule that sheriff pays monies on demand to the party entitled. The Regulations therefore recognise federal bankruptcy rules where relevant to receipt and payment of execution monies.

Correctional Services Act 2014

• Custodial definition: Regulation 9 requires that a person arrested by the sheriff on civil process be lodged in “the custodial correctional facility (as defined in section 11(1)(a) of the Correctional Services Act 2014) nearest to the place of the person’s arrest”. The Regulations rely on the Correctional Services Act 2014 for the statutory definition and operational placement of detained persons, aligning sheriff duties with the corrections system.

Court procedures and judicial officers

• Associate Judge role: Regulation 12 assigns taxation of fees to an Associate Judge. Endnotes record the Supreme Court Amendment (Associate Judges) Act 2017 as affecting provisions, indicating an inter‑instrument relationship altering who hears fee taxation matters (Endnotes list Act No. 18, 2017).
• Judicial leave and orders: The Court and Judges are given oversight roles (r 5, r 10(3), r 12, r 17, r 20). For example, sales can be conducted otherwise if directed by the Court or a Judge (r 5); subpoenas to compel sheriff attendance require leave (r 10(3)); judges control extraordinary travel authorisations (r 17); and committal applications against sheriffs arise through court process (r 20). This creates procedural interdependence with court practice rules.

Attorney‑General and Crown Law Officer

• Enforcement referrals: Regulation 19 contemplates the sheriff, with the consent of the Attorney‑General, committing to the Crown Law Officer the matter of enforcing court orders against a defaulting legal practitioner. This provision links the sheriff’s administrative enforcement mechanisms to the executive legal apparatus.

Fees and revenue units

• Revenue unit conversion: The Schedule uses “revenue units” for fee amounts (items 1, 5, 11, 14 etc.). Endnotes reference the Courts Legislation Amendment (Revenue Units) Regulations 2006 (SL No. 36, 2006), which implemented revenue unit usage. The Regulations thus interact with the wider statutory approach to indexing or standardising fees via revenue units.

Other amendments and consequential Acts

• Legal Profession (Consequential Amendments) Act 2007: Endnotes indicate amendments affecting r 6, r 8, r 10, r 16 and r 19 tied to Act No. 7, 2007. Those changes suggest the Regulations’ interplay with laws governing legal practitioners and their responsibilities when instructing sheriff services.
• Correctional Services (Related and Consequential Amendments) Act 2014: Endnotes show that r 9 was amended by that Act (Act No. 27, 2014), tying detention‑location rules to broader corrections legislative reform.
• Racing and Wagering Act 2024: The endnotes show an amendment to r 5 by the 2024 Act (Act No. 8, 2024), which removed the prohibition on offering for sale in premises licensed for racing or wagering (r 5(1) previously prohibited sale in premises licensed for racing or wagering; r 5 was amended by Act No. 8, 2024, s 337). The Schedule and such sale mode rules thus interact with evolving licensing statutes.

Absence of interaction with criminal statutes

• The Regulations set civil administrative duties and remedies and do not themselves create criminal offences; their enforcement occurs via court process and interaction with executive legal offices.

Taken together, the Regulations are tightly integrated with court structures, the Correctional Services Act for custody placement, revenue unit‑based fee frameworks, and amendments effected through statutes addressing court administration and the legal profession. The Endnotes map those interactions over time.

The Regulations have been in force since 15 February 1967 and have undergone multiple formal and substantive amendments. The Endnotes to this reprint provide a chronology of amendments, including consequential changes that reflect broader legislative reforms. The key documented amendments in the instrument are:

These entries in the Endnotes establish a pattern: periodic fee and procedural updates (2000s onward), alignment with court administrative reforms (Associate Judges, revenue units), and consequential amendments linked to changes in corrections and legal profession legislation. The reprint’s Endnotes are the only source for these amendment details and should be treated as the authoritative timeline within this analysis.

The Regulations as provided do not cite or record any judicial decisions, appellate outcomes, or named cases. The instrument itself contains no entries under a dedicated litigation or case‑law section and the Endnotes list only statutory amendments and formal corrections. Consequently, the Regulations do not supply a litigation history or judicial construction history within the text of this reprint.

That absence is material for practitioners: there is no recorded judicial interpretation embedded in the instrument to guide edge‑case readings of key provisions within this text. Where the Regulations create mechanisms that typically attract litigation, the pathways for such litigation are visible in the Regulations themselves but no outcomes are recorded. Examples of provisions that commonly give rise to court challenges in practice, and which therefore would produce litigation history if such cases existed, include:

• Fee taxation disputes under r 12 (taxation by an Associate Judge).
• Disputes about retention of monies where third parties claim an interest under r 7.
• Challenges to the validity of service or sufficiency of proof of service under r 10(3) where affidavits are tendered.
• Disputes over travelling allowances and whether judicial leave under r 17 was appropriately granted or refused.
• Applications for committal of a sheriff under r 20 where a party claims the sheriff failed to return a warrant or produce a detained person.

However, because the text contains no case citations, readers must look outside this instrument to court databases, law reports, and Northern Territory judicial records to find decisions that interpret or apply these specific Regulations. The Regulations make clear which judicial forums are involved (Associate Judges, Judges, Court), so searching those forums’ decisions would be the required next step for practitioners seeking precedent.

In short, the Regulations themselves present the procedural and substantive framework for enforcement, fee taxation and judicial oversight, but do not provide an internal litigation history or listed authorities. Any litigation history relevant to operational questions under these Regulations must be sourced from external court records rather than from the Regulations’ text.

Several practical traps and timing risks are embedded in the text. These are points where non‑compliance or misunderstandings commonly produce disputes, costs or lost entitlements if the written rules are overlooked.

1. 14‑day publicity requirement (r 3)

• The sheriff must give notice at least 14 days prior to sale. Failure to observe this timeline may jeopardise the sale process or create grounds for challenge to the sale’s validity. Parties who rely on auction timing must plan to accommodate the 14‑day lead time and ensure accurate particulars are supplied to the sheriff.

2. Sale location and licensing constraints (r 5)

• Sales must be by public auction and not in premises licensed for the sale of liquor or licensed for racing or wagering unless the Court or a Judge otherwise directs (r 5(1)). Recent amendment history shows r 5 has been altered by the Racing and Wagering Act 2024 (Endnotes). Practitioners should check the current text for any residual licensing constraints and whether judicial direction is required to sell in a licensed venue.

3. Limited title sold unless written consent (r 5(4)-(5))

• The sheriff normally sells only the estate, right, title or interest of the party against whom execution issued. If other persons have interests, their written consent and a written agreement as to the division of net proceeds are required for the sale to include their interests. Absent this, purchasers obtain only the debtor’s interest, which affects purchaser title and marketability of the lot. Where multiple interests exist, ensure written consents and apportionment are in place or seek judicial directions.

4. Immediate poundage liability if execution discontinued (rr 16, 16A)

• If execution has been levied and the sheriff withdraws from the property at request, poundage on the full amount levied becomes immediately payable by the execution creditor unless full particulars of an arrangement rendering sale unnecessary are provided to the sheriff within 14 days (r 16). Execution creditors who negotiate post‑levy arrangements must supply full particulars to the sheriff within the 14‑day window or face immediate poundage liability. The sheriff does have discretion to waive poundage under r 16A, but that is discretionary and should not be relied upon without confirmation.

5. Deposits and undertakings (r 14)

• The sheriff may require deposits and a written undertaking to pay further fees. Practitioners instructing sheriff action should anticipate upfront costs and be prepared to provide written undertakings. Deposits in excess must be returned, but only after the actual amount payable is ascertained (r 14(2)). Poor estimation can create cash flow consequences.

6. Distance limits and km accounting (rr 17-18; Schedule items 1-8)

• Officers cannot be compelled to travel more than 60 km from office or residence (r 17) and more than 160 km of kilometres travelled cannot be allowed without judicial order. Further, r 18 restricts extra expense charged for executing process at a distance "from Darwin" to the cost of transmitting the process by the least expensive mode to and from the office or residence of the officer nearest the execution location; officers must state kilometres travelled in their returns (r 18(2)). The Schedule sets per‑kilometre fees (items 2 and 6) and half‑fees when multiple documents or persons are served in the same locality (items 3-4, 7-8). Misunderstanding which office is “nearest” or failing to record kilometres in returns can lead to disputes about allowable claims.

7. Service proof and subpoena limits (r 10(3))

• Service is proved by the sheriff’s or officer’s affidavit. Subpoenas to compel attendance about service require leave of a Judge or Associate Judge. Parties expecting to subpoena a sheriff to testify about service should first seek judicial leave; failing to do so may delay proceedings.

8. Who pays when execution not proceeded with (r 15)

• If an execution is withdrawn, satisfied, or stopped, fees are payable by the person issuing the execution or the person at whose instance the sale is stopped. Parties withdrawing executions should be clear on who bears the costs and whose account the sheriff will charge.

9. Legal practitioner defaults (r 19)

• A legal practitioner who requests execution or service and then defaults on payment for 7 days after written demand may be reported to the Court, leading to orders to enforce payment and potential referral to the Crown Law Officer with the Attorney‑General’s consent. Firms should track fee demands and timelines to avoid escalation.

10. No internal litigation history in the instrument

• The Regulations contain no cited cases or judicial interpretations. Where questions of interpretation arise (for example, calculation of poundage, meaning of “nearest” custodial facility, or judicial discretion thresholds), practitioners must rely on external case law or seek judicial directions in the absence of precedent supplied by the instrument.

Each of these items produces tangible cost or delay risk if not anticipated. Operational checklists and early communication with the sheriff’s office on deposits, timing, and travel expectations will reduce exposure to disputes.

Compliance requires procedural planning, attention to timing, clear written instructions, and financial preparedness. The following checklist maps the Regulations’ operative obligations to practical steps for parties instructing or interacting with the sheriff.

1. Written requests for service and execution

• Ensure all requests to the sheriff for service or execution are in writing and contain full instructions (r 10(1)-(2)). Oral requests do not satisfy r 10’s requirement and may delay action.

2. Prepare for deposits and written undertakings

• Anticipate that the sheriff may demand a deposit to cover fees and an undertaking to pay further fees (r 14(1)). Provide a written undertaking where required and allow for the Schedule’s kilometre and base fees (Schedule items 1-8) when calculating deposit amounts. Retain evidence of payment and obtain receipts.

3. Publicity and sale timeline

• If reliant on the sheriff to sell seized property, notify the sheriff promptly to allow at least 14 days’ notice before sale (r 3). Supply accurate particulars of the property to be included in the sale notice.

4. Consider sale location and purchaser marketability

• Discuss with the sheriff the best place for sale (r 4) and whether any court directions are needed to sell in particular venues (r 5). If other parties assert interests in the property, obtain written consents and a written agreement about division of net proceeds before the sheriff attempts to sell additional interests (r 5(5)).

5. Protect third‑party claims to monies

• If you claim an interest in moneys held by the sheriff, serve a written notice requiring the sheriff not to pay them over (r 7). Follow up by applying to the Court or a Judge promptly; if you fail to apply within 4 days, the sheriff may pay out in pursuance of the warrant (r 7(2)).

6. Avoid triggering poundage liability

• If an arrangement makes sale unnecessary after execution has been levied, ensure “full particulars of the arrangement” are furnished to the sheriff within 14 days to avoid immediate poundage liability (r 16). If favourable, ask the sheriff whether they will exercise discretion to waive poundage under r 16A and obtain that waiver in writing if granted.

7. Track and verify kilometres and travel approvals

• For remote service or execution, confirm the office or residence of the officer nearest to the intended execution location, and ensure the officer records kilometres in returns as required (r 18(2)). If travel beyond 60 km (r 17) or beyond the 160 km cap is needed, seek a judicial order in advance to authorise the extra kilometres and costs.

8. Provide accurate instructions to auctioneers and agents

• If using an auctioneer to sell seized property, be aware the sheriff may require gross proceeds be paid to him and will then pay out proper charges to the auctioneer after receipt and, if necessary, taxation (r 13). Ensure auctioneer agreements account for this flow and for possible delay until fees are taxed where disputed.

9. Comply with fee taxation and dispute procedures

• If disputing sheriff fees, prepare to apply to an Associate Judge for taxation (r 12). Maintain detailed records of services requested, kilometres travelled, invoices and receipts to support your position in taxation.

10. Manage legal practitioner payment obligations

• Legal practitioners requesting execution or service should monitor fee invoices and respond to written demand within 7 days to avoid the sheriff reporting them to the court under r 19. Where disputes arise, seek to resolve them quickly and document attempts at resolution.

11. Arrests on civil process: custody placement

• When the sheriff arrests a person on civil process, ensure custody arrangements will comply with r 9 that requires lodging in the custodial correctional facility nearest to the place of arrest, as per Correctional Services Act 2014 s 11(1)(a). Practitioners should be ready to identify the nearest facility in instructions to the sheriff.

12. Preserve documentary evidence for service

• Because service is proved by affidavit of the sheriff or officer (r 10(3)), retain contemporaneous instructions, affidavits and any communication with the sheriff to support proof of service or challenge inadequacies.

13. Where urgent judicial relief may be needed, prepare notice and committal paths

• If a sheriff fails to return a warrant or produce a detained person, follow the notice procedure in r 20 to preserve the right to apply for committal. Ensure notices are served in compliance with r 20 and retain proof of service.

14. Fee schedule awareness

• Familiarise yourself with Schedule items 1-14 and calculate expected fees in revenue units and per‑kilometre rates in advance. Where revenue units are used, confirm their current monetary value based on the relevant revenue units instrument (see Endnotes referencing Courts Legislation Amendment (Revenue Units) Regulations 2006).

Following these steps reduces the risk of disputes, unexpected costs and delay. Where ambiguity exists , for example in defining the officer “nearest” to an execution location or whether sale in a particular licensed premises is permissible , seek judicial directions in advance to obtain authoritative relief and avoid subsequent litigation.
