Citation\nThese Regulations may be cited as the Sheriff Regulations 1967.\n3 Publicity of sale\nWhere the sheriff intends to put up for sale any property taken in\nexecution, he shall cause notice of the time and place and\nparticulars of the property to be given at least 14 days prior to the\ndate of the intended sale in such manner as appears to him best\ncalculated to give publicity to such sale.\n4 Place of sale\nThe sheriff shall cause any property taken in execution to be sold at\nthe place of levy, or elsewhere, as he deems most advantageous.\n5 Mode of sale\n(1) Unless the Court or a Judge otherwise directs, all property real or\npersonal taken in execution shall be offered for sale by the sheriff\nby public auction, and, unless directed as aforesaid, shall not be\noffered for sale in any house or premises licensed for the sale of\nliquor or licensed for racing or wagering.\n(2) The property may be sold in one lot or in several lots.\n(3) Unless the Court or a Judge otherwise directs, every sale shall be\nfor cash on delivery, conveyance, assignment or transfer.\n(4) Subject to subregulation (5), a sale shall be of the estate, right, title\nor interest only of the party against whom the warrant of execution\nhas been issued in the chattels or land put up for sale.\n\nSheriff Regulations 1967 2\n(5) With the consent in writing of any other person having any estate,\nright, title, or interest in the chattels or land, the sale may be also of\nthe estate, right, title or interest of that other person if:\n(a) the sheriff is of opinion that such a course is desirable in order\nto obtain a more satisfactory sale under the warrant; and\n(b) that other person and the judgment creditor and the judgment\ndebtor have agreed in writing upon the proportion in which the\nnet proceeds of the sale are to be divided.\n6 Payment over by sheriff in certain cases\nIn a case not within section 93 of the Bankruptcy Act 1924-1965\nwhen the sheriff, by virtue of any warrant directed to him, receives\nany moneys, he shall pay them on demand to the party entitled to\nreceive them, or that party's legal practitioner, deducting from the\nmoneys all lawful charges, whether the warrant is then returnable or\nnot, unless he has received notice to retain the moneys from some\nperson claiming to be interested in them.\n7 Notice to sheriff not to pay money to execution creditor\n(1) Where the sheriff has, by virtue of any warrant directed to him,\nreceived any moneys, and any person claiming to be interested in\nthem has served on the sheriff a notice requiring him not to pay\nthem over, the sheriff may retain the moneys in his hands, to abide\nthe order of the Court or a Judge thereon.\n(2) The sheriff may, at the expiration of 4 days next after service of\nsuch a notice on him, pay over such moneys in pursuance of the\nwarrant, unless in the meantime application is made by the party\ngiving the notice to the Court or a Judge, and notice thereof is\nserved on the sheriff.\n8 Suspension of execution\n(1) The sheriff shall not suspend the execution of any warrant or\nprocess directed to him, except upon an absolute order in writing to\nthat effect lodged with him by the person entitled to the benefit of\nthe execution, or that person's legal practitioner.\n(2) Any such person may at any time afterwards withdraw such an\norder, and lodge with the sheriff a written instruction to execute the\nwarrant or process.\n\nSheriff Regulations 1967 3\n9 Persons arrested to be lodged in nearest custodial\ncorrectional facility\nIf a person is arrested by the sheriff on any civil process of the\nCourt, the person must be lodged in the custodial correctional\nfacility (as defined in section 11(1)(a) of the Correctional Service of process by sheriff\n(1) The sheriff shall, if requested so to do by any party or that party's\nlegal practitioner, serve or cause to be served in the Northern\nTerritory any writ, notice, order, summons or other document\nissued, made or prepared in or in relation to any cause or matter in\nrespect of which personal service is required by law or by the\npractice of the Court.\n(2) Such a request shall be in writing and shall contain the instructions\nfor service.\n(3) The service of such a document may be proved by the affidavit of\nthe sheriff or officer of the sheriff effecting service, and no\nsubpoena to compel the attendance of the sheriff or officer in\nrespect of any matter arising out of the service shall be issued\nexcept by leave of a Judge or an Associate Judge, which may be\nobtained ex parte.\n11 Fees where sheriff does not execute process\nWhere process is directed to any fit person appointed by the Court\nor a Judge pursuant to section 12 of the Sheriff Act 1962, the fees\npayable in ordinary cases to the sheriff by the person against whom\nthe process is sued out shall be due and payable to the person\nsuing out such process, except the fees for registering the warrant\nand returning it.\n12 Taxation of fees\nThe amount of any fees or charges payable to the sheriff shall be\ntaxed by an Associate Judge in case the sheriff and the person\nliable to pay the fees or charges differ as to that amount.\n13 Expenses of sale\nWhere property taken in execution is sold through an auctioneer or\nagent, the gross proceeds of the sale shall, if the sheriff so requires,\nbe paid over to him by the auctioneer or agent, and the sheriff shall\nafter receiving them, or, in case the sheriff and the person liable to\n\nSheriff Regulations 1967 4\npay the fees and charges payable to the sheriff in respect of the\nexecution differ as to the amount of the fees and charges, after the\nfees and charges have been taxed, pay to the auctioneer or agent\nthe proper charges and expenses due to him in connection with the\nsale.\n14 Deposits on account of fees\n(1) Upon request being made for the execution or service of any\nprocess or document, or for any work for which fees are properly\nchargeable in the sheriff's office, the sheriff may require a deposit of\nmoney in respect of the fees for the execution, service, or work and\nan undertaking in writing to pay any further fees which may become\npayable beyond the amount so deposited.\n(2) Where any person has deposited an amount in excess of the fees\nwhich are found to be payable, the sheriff shall, upon the amount\nactually payable being ascertained, return the amount so deposited\nin excess.\n15 Fees where execution not proceeded with\nWhere an execution is withdrawn, satisfied, or stopped, the fees\npayable in respect of the execution shall be paid by the person\nissuing the execution, or the person at whose instance the sale is\nstopped, as the case may be.\n16 Particulars of arrangement where execution discontinued\nWhere execution has been levied upon any property and the sheriff\nupon request has withdrawn from the property, the poundage upon\nthe full amount which the sheriff has been required to levy under\nthe warrant of execution lodged with him shall become forthwith\ndue and payable by the execution creditor or the execution\ncreditor's legal practitioner, as the case may be, unless an\narrangement which renders the sale unnecessary has been\nreached between the execution creditor and the execution debtor or\na person on behalf of the execution debtor and full particulars of the\narrangement have been furnished to the sheriff within 14 days of\nthe making of the arrangement.\n16A Sheriff may waive poundage\nThe sheriff or an officer of the sheriff may waive poundage payable\nto him or her in respect of a warrant of execution.\n17 Service at a distance\nNo officer of the sheriff shall be of process at a distance\n(1) No greater expense shall be chargeable against any party,\nrespecting whom or whose property the execution of process is\nmade, for the extra cost of executing the process at a distance from\nDarwin, than the cost of transmitting the process by the least\nexpensive mode to and from the office or residence of the officer of\nthe sheriff nearest to the place where the execution is made and\nthe number of kilometres travelled according to the distance of the\nplace where the execution is made from the office or residence of\nthat officer of the sheriff.\n(2) No number of kilometres travelled shall be allowed under\nsubregulation (1) to any officer of the sheriff unless he states in his\nreturn to the sheriff the number of kilometres that the place of\nexecution is from his office or residence.\n19 Default in payment of fees by legal practitioner\nIf any legal practitioner, who has made a request for the execution\nor service of any process or document, or for any work for which\nfees are properly chargeable in the sheriff's office, makes default in\npayment of any of the fees or charges properly chargeable, for a\nperiod of 7 days after demand in writing by the sheriff, the sheriff\nmay report to the Court or a Judge the name of the legal\npractitioner so making default, and the Court or Judge may\nthereupon make all necessary orders to enforce payment of the\nfees or charges, and the sheriff may, with the consent of the\nAttorney-General, commit to the Crown Law Officer the matter of\nenforcing the orders.\n20 Notice to sheriff to return warrant etc.\nNo order shall issue for the return of any warrant, or to bring in the\nbody of a person ordered to be attached or committed; but a notice\nfrom the person issuing a warrant or When someone wins a court judgment (called the \"judgment creditor\") but the loser (the \"judgment debtor\") refuses to pay, the Sheriff steps in to enforce the court's decision.\n\n**Key rules covered:**\n\n* **Selling seized property:** If the Sheriff takes someone's property to pay a debt, they must advertise the sale at least 14 days in advance. Sales are by public auction (not in pubs or betting venues) and usually for cash. The Sheriff can sell the debtor's interest in the property, or with permission, sell the full property if all parties agree on splitting the proceeds.\n\n* **Handling money:** When the Sheriff collects money from a sale, they generally pay it to the winning party minus their fees. However, if someone else claims they have a right to that money (for example, another creditor), the Sheriff can hold the money for up to 4 days until a court decides who gets it.\n\n* **Arrests:** If the Sheriff arrests someone under a civil court order (not a criminal matter), they must take them to the nearest prison facility and hold them there until legally released.\n\n* **Serving documents:** The Sheriff can be asked to formally deliver court papers (writs, summonses, etc.) to people. They don't have to travel more than 60 kilometres from their office for this unless a judge orders it.\n\n* **Fees:** The regulations set out detailed fees for services—charged in \"revenue units\" (a standard monetary unit set by NT law) plus travel costs per kilometre. There are discounts when serving multiple documents or executing multiple warrants in one trip. The Sheriff can require a deposit upfront and can waive certain fees (poundage) in appropriate cases.\n\n* **Stopping execution:** If parties reach a settlement, they must give the Sheriff full details within 14 days, otherwise fees based on the full amount originally claimed become due immediately.\n\n**Who it affects:**\nAnyone involved in civil court enforcement in the NT—debtors having property seized, creditors seeking payment, lawyers requesting Sheriff services, and auctioneers handling sales.\n\n**Why it matters:**\nThese rules ensure court judgments are enforced fairly and transparently. They protect debtors from unfair sale practices, ensure creditors get their money, and make sure the Sheriff's office operates on a sustainable fee basis while having discretion to help parties who reach voluntary settlements."},"flash_summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"The instrument’s operational details have been amended over time though its core purpose (rules for sheriff execution and service) remains.
