Service Victoria (Transfer of Registration of Building Practitioners Functions) Regulations 2022

The Regulations revolve around four core concepts: the transfer mechanism, digital delivery, identity verification, and narrow scope. Each concept is defined or operationalised in the Regulations themselves.

Transfer mechanism. The Regulations rely on the statutory transfer framework in the Service Victoria Act 2018, specifically section 5(5) for customer service functions and section 10(5) for identity verification functions. Regulation 5 declares particular customer service functions to be "transferred customer service functions" for the purposes of s 5(5) of the Act, and regulation 6 does the same for particular identity verification functions for the purposes of s 10(5) of the Act. The Notes appended to each regulation make explicit that the Service Victoria CEO is to perform a transferred function from the commencement of the regulation prescribing it as transferred.

Digital delivery. The Regulations introduce and operationally rely on the notion of a "digital token", defined as a digital version of an authority or official information document accessible through a software application on an electronic device (regulation 4). Schedule 1 confines the customer service transfers to the delivery of such a digital token in relation to a registration card issued under s 171GA of the Building Act 1993, and in relation to renewals granted under s 173, but only where the underlying application was made by input into an Internet site or mobile application maintained for that purpose. The instrument therefore pivots the transference around digitally-initiated applications and digital outputs.

Identity verification. Schedule 2 prescribes as a transferred identity verification function the collection of identity information provided with an application and verification of the applicant's identity for digital applications in respect of registration (other than provisional registration) under s 170 of the Building Act 1993, and renewal under s 173 (Schedule 2, item 1). The definition of "mobile application" in regulation 4 supports this by referring to software designed for personal electronic devices.

Narrow scope and exclusions. The Regulations are specific and limited. They transfer only discrete functions that meet three conditions: they involve the digital channel (Internet site or mobile application), they concern particular statutory registration or renewal steps under the Building Act 1993, and identity verification transfers expressly exclude provisional registration. The Regulations do not purport to transfer broader regulatory, disciplinary, or licensing powers under the Building Act. The instrument also preserves the reference points in the Building Act by using its terminology for "registration card", "provisional registration" and the identity of the Victorian Building Authority (regulation 4).

Definitions as operational constraints. The definitions in regulation 4 are operationally significant. The instrument ties transfer eligibility to applications made by "input into an Internet site or mobile application maintained for that purpose". The meaning of "digital token" requires practitioners to use a software application on an electronic device to access the transferred output. Those definitional choices constrain who is affected, how the Service Victoria CEO will need to process transactions, and the technological interface expected of applicants.

Temporal limits. The Endnotes record the date of making and commencement and note a statutory sunset: the Regulations will sunset 10 years after making on 24 May 2032 pursuant to s 5 of the Subordinate Legislation Act 1994 (Endnotes, general information). The Regulations themselves do not set an earlier termination date for the transferred functions.

The Regulations allocate specific tasks between three principal actors named in the instrument: the Service Victoria Chief Executive Officer, the Victorian Building Authority, and applicants or building practitioners using Internet or mobile applications.

Service Victoria CEO. The primary operational effect is to place responsibility on the Service Victoria CEO to perform the specified transferred customer service and identity verification functions from the date the respective regulation comes into effect (regulations 5 and 6, and the Notes to each). The Regulations do not set out procedural detail for how the Service Victoria CEO must perform those functions, but they do specify the functions in operational terms: delivering a digital token and collecting and verifying identity information associated with digital applications (Schedule 1; Schedule 2).

Victorian Building Authority. The Victorian Building Authority is the service agency from which the listed functions are transferred (Schedules 1 and 2, Column 3). The Regulations therefore remove the specified digital delivery and identity verification tasks from the Authority only in the digital application contexts described. Other functions and non-digital channels remain outside the transfer as the Regulations are narrowly drafted. The text repeatedly refers to the functions being "transferred" from the Victorian Building Authority (Schedules 1 and 2).

Applicants and building practitioners. The Regulations affect members of the regulated cohort who engage with registration and renewal processes by digital means. A "building practitioner" is used throughout and is given the meaning in the Building Act 1993 (regulation 4). Building practitioners who apply by input into an Internet site or mobile application "maintained for that purpose" will interact with Service Victoria for identity verification and will receive their registration information in the form of a "digital token" accessible through a software application on an electronic device (regulation 4; Schedules 1 and 2). The Regulations implicitly require applicants to provide identity information with their digital applications, because identity verification is transferred only for identity information "provided with an application" submitted digitally (Schedule 2, item 1).

Excluded cohorts and channels. The transfer explicitly excludes applications made by other methods. The qualifying phrase "if the application for the registration was made by input into an Internet site or mobile application maintained for that purpose" appears in Schedule 1, items 1 and 2. Schedule 2 likewise limits identity verification to digital applications. The identity verification transfer is also limited to registration other than provisional registration under s 170 of the Building Act 1993, so applicants seeking provisional registration are not included in the transferred identity verification function (Schedule 2, item 1).

Other agencies and stakeholders. Although the Regulations name only the Victorian Building Authority and the Service Victoria CEO as actors in the transfer, other public sector agencies, IT contractors, or third-party providers that operate or maintain the Internet site or mobile application "for that purpose" will be implicated operationally. The Regulations define "mobile application" and "digital token" but do not specify procurement, security, privacy or interoperability arrangements. As a result, any entity that hosts, maintains, or integrates the prescribed Internet site or mobile application will be affected practically, even if not named in the Regulations.

Temporal stakeholders. The Endnotes record the statutory life of the Regulations, which will sunset on 24 May 2032 (Endnotes, general information). That temporal boundary affects planning and investment decisions by agencies and digital service providers that must implement or adapt systems to the transfers.

The Regulations create duties in functional form rather than by prescribing detailed procedural obligations. They confer performance duties on the Service Victoria CEO and withdraw the corresponding customer service and identity verification duties from the Victorian Building Authority in the specified digital contexts.

Duties imposed on the Service Victoria CEO. The Regulations require the Service Victoria CEO to perform transferred customer service functions and transferred identity verification functions from the commencement of the respective regulation that prescribes the function as transferred (regulations 5 and 6, and the Notes to each). Those duties are described in Schedules 1 and 2 and are specific: delivering a digital token to a building practitioner where the application was made via an Internet site or mobile application maintained for that purpose, in respect of registration cards issued under section 171GA of the Building Act 1993 and renewals under section 173 (Schedule 1); and collecting identity information provided with an application and verifying the applicant's identity for digital applications for registration, other than provisional registration, under section 170 and for renewal under section 173 (Schedule 2).

Duties withdrawn from the Victorian Building Authority. Column 3 of Schedules 1 and 2 names the Victorian Building Authority as the service agency from which the listed functions are transferred. That means, in the digital circumstances described, the Victorian Building Authority will no longer be the body performing those discrete tasks. The Regulations do not expressly state residual duties that will remain with the Victorian Building Authority; they are limited to the functions enumerated.

Obligations on applicants. The Regulations do not create explicit statutory obligations for applicants in the form of penalties or mandatory conduct, but they condition the transfer on the application being made by input into an Internet site or mobile application "maintained for that purpose" (Schedules 1 and 2). Practically, applicants wishing to obtain the benefits of digital delivery and identity verification via Service Victoria must submit their application through the digital channel in the prescribed form and provide identity information with that application where identity verification is required. The term "digital token" presumes an applicant must be able to access a software application on an electronic device to receive the token (regulation 4).

Rights. The Regulations do not create express private rights, entitlements, or remedies beyond redirecting who performs particular administrative acts. For example, a building practitioner who applied digitally will receive a "digital token" as the digital representation of a registration card or renewal. The Regulations define "digital token" as a digital version of an authority or official information document accessible through a software application, which operationally gives practitioners a digital representation of their registration or renewal (regulation 4; Schedule 1). Any legal consequences attaching to possessing or presenting a registration card, registration certificate, or similar document remain determined by the Building Act or other governing instruments; the Regulations themselves simply prescribe who will deliver a digital version in the specified circumstances.

Discretion. The Regulations do not delegate discretionary powers to the Service Victoria CEO as to whether to perform the listed functions. Instead, they prescribe that the Service Victoria CEO is to perform the transferred functions. The instrument does not set out decision-making criteria, standards, or procedural steps for how identity verification is to be carried out, nor does it set out technical or security standards for digital tokens or mobile applications. Any discretion in implementation will arise under the Service Victoria Act 2018 and associated administrative rules, which the Regulations reference but do not reproduce.

Operational constraints and interaction with other rights. The Regulations do not address privacy, data security, retention, evidence status of a digital token, or dispute resolution. Those matters are likely governed by other legislation or policy instruments, but the Regulations themselves remain silent. The result is a functional reallocation of tasks without prescriptive obligations on process, leaving procedural detail and rights management to the administering agency under its governing statute and policies.

The Regulations do not create new offences, penalties, or enforcement mechanisms. The instrument operates as a prescription of transferred functions under the Service Victoria Act 2018; it is not drafted to impose criminal, civil penalty, or administrative sanction provisions within the text. The Regulations identify functions to be performed by the Service Victoria CEO and note the service agency from which those functions are transferred, but they do not attach sanctions or enforcement processes to non-performance or wrong performance within the Regulations themselves.

Enforcement by statutory framework. Because the Regulations are made under section 58 of the Service Victoria Act 2018 and operate by reference to that Act's transfer provisions (regulations 2, 5 and 6), any enforcement, compliance monitoring, or remedies for failure to perform transferred functions will arise under the Service Victoria Act 2018 or other relevant governance instruments rather than from these Regulations. The Notes to regulations 5 and 6 refer the reader back to the Service Victoria Act 2018 for the operative effect that a transferred function "is to be performed by the Service Victoria CEO from the commencement" of the relevant regulation. Enforcement levers, internal administrative accountability and any statutory obligations on the Service Victoria CEO are therefore matters for the parent statute and agency governance, not the Regulations text.

No penalties for applicants. The Regulations do not create penalties or sanctions on applicants who choose non-digital channels, or who fail to supply identity information in a digital application. The transfer is conditional on the application being made through a particular channel; it does not make that channel mandatory by the instrument’s terms. Any compulsion to use digital channels, or associated penalties for not doing so, would need to be found in other instruments which are not reproduced here.

Practical enforcement concerns. Although the Regulations do not set out enforcement tools, practical compliance will require the Service Victoria CEO to operationalise identity verification and digital token delivery in a manner that meets legal and administrative standards. The Regulations do not specify technical standards, authentication thresholds, audit trails or error-correction procedures. Absence of such provisions implies that enforcement of proper performance will depend on norms and procedures established under the Service Victoria Act 2018, internal agency policy, or other secondary instruments.

Sunset and review. The Endnotes record that the Regulations will sunset on 24 May 2032 under the Subordinate Legislation Act 1994 (Endnotes, general information). The temporal limit frames the period in which enforcement expectations attached to these transfers will be relevant under the Regulations, after which the enabling subordinate instrument will lapse unless remade.

The Regulations operate by reference to and in conjunction with two principal Acts: the Service Victoria Act 2018 and the Building Act 1993. They do not amend those Acts, but they reallocate particular administrative functions between agencies under the transfer provisions of the Service Victoria Act 2018.

Dependence on the Service Victoria Act 2018. The Regulations are made under section 58 of the Service Victoria Act 2018 (regulation 2). They expressly tie the status of a function as a transferred customer service function to section 5(5) of the Service Victoria Act 2018 (regulation 5), and the status of a transferred identity verification function to section 10(5) of the Service Victoria Act 2018 (regulation 6). The Notes to those regulations reiterate that a transferred function "is to be performed by the Service Victoria CEO from the commencement of this regulation that prescribes the function" (regulations 5 and 6, Notes). The Regulations therefore depend on the transfer powers, definitions, and administrative architecture in the Service Victoria Act 2018 to take operational effect. Any obligations, limitations, or review mechanisms embedded in the parent Act will shape how the transfers work in practice.

Interaction with the Building Act 1993. The functions transferred relate directly to statutory mechanisms in the Building Act 1993. Schedule 1 references delivery of a digital token in respect of a "registration card" issued under section 171GA of the Building Act 1993, and a renewal of registration granted under section 173 of that Act. Schedule 2 references identity verification for registration under section 170 of the Building Act 1993 (other than provisional registration) and renewal under section 173. The Regulations do not alter the substantive requirements, eligibility criteria, or legal effects of registration, provisional registration, renewal, or registration cards as set out in the Building Act. Instead, they reassign to the Service Victoria CEO the particular administrative acts of delivering a digital token and verifying identity in respect of some of those Building Act processes when they are initiated digitally.

Limits of the transfer. The Regulations are narrowly tailored and do not purport to transfer all Building Act functions or to amend the Building Act. For example, the identity verification transfer excludes provisional registration specifically (Schedule 2, item 1), and Schedule 1 confines the digital token transfer to applications made via an Internet site or mobile application "maintained for that purpose". Thus, non-digital channels and certain types of registration remain outside the scope of the transfers and will continue to be governed by the Building Act and the Victorian Building Authority's existing functions.

Absence of data protection or evidentiary provisions. The Regulations do not address data protection, privacy compliance, record-keeping obligations, or evidentiary status of digital tokens. Those matters are likely governed by other laws, including privacy legislation or the parent Act, but they are not specified here. The absence of cross-references to data protection regimes in the Regulations means that implementers must consult those other laws to ensure compliance when delivering digital tokens or performing identity verification.

Procedural and administrative law overlay. Because the Regulations redirect administrative functions between agencies, they will interact with administrative law principles and any procedural obligations imposed by the Service Victoria Act 2018. The Regulations do not themselves outline complaints, review or merits review avenues for administrative decisions tied to the transferred functions. Any such avenues will be found in the parent statute or in the Building Act where relevant.

Temporal interaction. The Endnotes indicate the Statutory Rule was made on 24 May 2022 and commenced 1 June 2022 (Endnotes, general information). They also note the ten-year sunset under the Subordinate Legislation Act 1994 (Endnotes, general information). The interaction with other laws therefore operates within that time horizon unless the Regulations are remade.

The Regulations are recent and, as published in this Version No. 001, show no amendments. The Table of Amendments in the Endnotes states that there are no amendments made to the Service Victoria (Transfer of Registration of Building Practitioners Functions) Regulations 2022 by statutory rules, subordinate instruments or Acts as at this version (Endnotes, Table of Amendments).

Creation and commencement. The Endnotes record that the Regulations were made on 24 May 2022 by the Governor in Council under section 58 of the Service Victoria Act 2018, No. 14/2018, and came into operation on 1 June 2022 in accordance with regulation 3 (Endnotes, general information). The formal authorising provision is regulation 2, which cites section 58 of the Service Victoria Act 2018.

Sunset provision. The Endnotes note that the Regulations will sunset 10 years after the day of making, on 24 May 2032, pursuant to section 5 of the Subordinate Legislation Act 1994 (Endnotes, general information). That sunset date is a statutory consequence rather than an amendment, but it is relevant to the lifecycle and any future amendment or remaking agenda. Any substantive change intended to continue the transfers beyond that date will require remaking the statutory rule or an amendment consistent with legislative requirements.

No explanatory details recorded. The Endnotes include a heading "3 Explanatory details" and state "No entries at date of publication." That indicates that, as published, there is no explanatory memorandum material attached to the instrument in the Endnotes that would record later adjustments, ministerial notes or further elaboration. The Regulations themselves are self-contained and short.

Amendments absent means implementation record small. Given the absence of recorded amendments or explanatory details at publication, readers must treat this instrument as establishing a narrow, static transfer of specific functions as at its commencement date. Any future adjustments to scope, technical detail, or procedural mechanisms will require amending statutory rules or primary legislation, and will be recorded in the Table of Amendments when they occur.

The Regulations themselves contain no material concerning litigation, and the Endnotes have no entries under explanatory details or amendments that suggest any litigation has been recorded against this statutory rule (Endnotes, Table of Amendments; Explanatory details). As Version No. 001 and as published with a "Table of Amendments" noting no amendments, there is no recorded litigation history, cases, or legal proceedings referenced in or attached to the instrument.

Consequently, there are no cases cited within the Regulations, no judicial interpretations of these provisions contained in the instrument, and no administrative decisions recorded in the Endnotes at the date of publication. Readers seeking precedent, case law, or judicial guidance on the operation or legal effect of these transfers must therefore consult later materials, primary statutes, administrative decisions, or court reports outside the scope of this published statutory rule.

Potential issues that could generate litigation are not addressed in the text. The Regulations transfer identity verification and digital delivery duties to the Service Victoria CEO without prescribing procedural standards, technical specifications, or data protection measures. Although the Regulations do not themselves create litigation history, absence of specified processes could, in theory, give rise to disputes about proper performance, evidentiary weight of digital tokens, or data handling if contested. Such outcomes would be resolved under other statutes and general administrative or privacy law mechanisms, but there is no litigation recorded in the instrument to indicate such disputes have occurred as at this version.

Search and monitoring. Given the lack of recorded litigation in the Endnotes, practitioners and interested parties should monitor case law, administrative review decisions, and agency determinations after the commencement date if they require jurisprudential guidance on the legal effects or interpretation of these transfers. Any subsequent litigation affecting the practical operation of the transfers will not be reflected in this Version No. 001 Endnotes.

The Regulations are concise but contain several practical and legal features that can produce operational surprises if overlooked. The following items are grounded in the text.

Transfer applies only to digital applications made by input into an Internet site or mobile application "maintained for that purpose". The transfers in Schedule 1 and Schedule 2 are expressly conditional on the application being made by input into an Internet site or mobile application maintained for that purpose. That means if an applicant uses a non-digital channel, a paper process, or a different electronic channel not described as "maintained for that purpose", the transferred functions do not apply and the Victorian Building Authority will remain the relevant performing agency for those functions (Schedules 1 and 2).

Digital token, not physical card. The customer service transfer is to the delivery of a "digital token", defined as a digital version of an authority or official information document accessible through a software application on an electronic device (regulation 4; Schedule 1). The Regulations therefore shift delivery from any physical registration card to a digital representation where the digital conditions are met. Users expecting a physical card by default may need to seek a separate, non-digital issuance channel.

Identity verification excludes provisional registration. Schedule 2 specifies identity verification is transferred for registration "other than provisional registration" under section 170 of the Building Act 1993. That exclusion leaves identity verification for provisional registrations outside the transfer, so applicants for provisional registration remain subject to the previous arrangements.

No procedural detail for identity verification. Schedule 2 transfers the act of collecting identity information and verifying identity, but the Regulations provide no procedural rules, thresholds, authentication standards, retention periods, or appeals pathways. The absence of such detail means implementers must look to the Service Victoria Act 2018, agency policies, or other instruments for operational standards. This gap can create uncertainty about the sufficiency of particular identity documents or methods.

Mobile application and device dependence. The definition of "mobile application" and "digital token" assumes access to a software application and an electronic device (regulation 4). Building practitioners who do not have compatible devices or software may be unable to receive their digital token, or may need an alternative channel. The Regulations do not specify fallback arrangements.

No express treatment of evidence status. The Regulations do not state whether a digital token has the same evidentiary or legal status as a physical registration card under the Building Act 1993. The effect of presenting a digital token in contexts where proof of registration is required will depend on the Building Act, related rules, or agency guidance, not these Regulations.

Data protection and privacy not addressed. The instrument is silent on privacy, data storage, access controls, or security standards in relation to identity information collected or digital tokens issued. Data protection duties are therefore left to other applicable laws and agency practice. Implementers must ensure they align with privacy obligations under other statutes and policy frameworks.

Sunset date may affect long-term planning. The Endnotes note a sunset on 24 May 2032 under the Subordinate Legislation Act 1994. Entities investing in technology, integration or long-term service design should account for the Regulations’ ten-year statutory life and the need for remaking or amendment if longer-term certainty is required.

No penalties or remedies in the Regulations. The instrument imposes duties on the Service Victoria CEO to perform transferred functions, but it does not specify enforcement, penalties, or remedies for failure to perform. Any recourse will arise under the parent Act or other statutes.

Narrow scope may require dual systems. Because only some functions and only digital-channel applications are transferred, the Victorian Building Authority and Service Victoria will need interoperability or dual systems to handle digital and non-digital applications. The Regulations do not address operational coordination, leading to potential duplication, gaps or handover friction if not planned.

Terminology anchored to the Building Act. The Regulations repeatedly reference particular sections of the Building Act 1993 (ss 170, 171GA, 173). Implementers must check those sections in the Building Act for the substantive and procedural context of registration and renewal because the Regulations do not reproduce or explain the Building Act provisions.

Compliance with the Regulations requires identifying when the prescribed transfers apply and ensuring that the relevant agency or applicant follows the digital-channel process described.

If you are the Service Victoria CEO or part of Service Victoria's implementation team

• Assume responsibility for performing the transferred customer service functions and transferred identity verification functions from the commencement date of the regulation prescribing them, pursuant to regulations 5 and 6 and the Notes to those regulations. Operationalise delivery of "digital tokens" and the collection and verification of identity information for the precise Building Act processes referenced in Schedules 1 and 2.
• Ensure your digital platforms can deliver a "digital token" as defined in regulation 4, namely a digital version of an authority or official information document accessible through a software application on an electronic device. Design the token, its authentication, and its user interface consistent with that definition.
• Implement identity verification processes for digital applications that include collection of identity information provided with an application and verification of that identity for registration other than provisional under s 170 and for renewal under s 173 of the Building Act 1993, as required by Schedule 2. Because the Regulations do not prescribe verification standards, align your verification methods with applicable standards in the Service Victoria Act 2018, privacy law, and agency policy.
• Coordinate with the Victorian Building Authority to define handover procedures, recordkeeping, audit trails and customer support for digital and non-digital channels. The transfer is limited to specified functions and digital channels, so integration and clear operational boundaries are necessary.
• Establish privacy, data security and retention policies that apply to identity information collected via the digital applications and to digital tokens issued, consistent with privacy law and government IT security standards. Those obligations are not spelled out in the Regulations and therefore must be satisfied under other legal frameworks.
• Provide clear guidance for users about how to access and use digital tokens, including supported device types, mobile application requirements and fallback arrangements for users who cannot access digital tokens.

If you are the Victorian Building Authority

• Update internal process maps to reflect that Schedule 1 and Schedule 2 functions, in respect of applications made by input into an Internet site or mobile application maintained for that purpose, are transferred to the Service Victoria CEO (Schedules 1 and 2, Column 3). Retain responsibility for non-digital channels and for any functions not specified in the Schedules.
• Coordinate transitional arrangements, customer communications and record transfers with Service Victoria. Because the Regulations do not specify timing or transitional steps beyond commencement, a formal memorandum of understanding or operational protocol will be required to manage interface points and data flows.
• Maintain clarity for applicants about which channels lead to Service Victoria performing identity verification and issuing digital tokens, so applicants can make informed choices.

If you are a building practitioner or applicant

• To obtain the service outcomes described in the Regulations, submit registration or renewal applications by "input into an Internet site or mobile application maintained for that purpose" as the Regulations condition the transfer on that mode (Schedules 1 and 2). Where identity verification is required for registration other than provisional registration, provide identity information with the digital application because Schedule 2 transfers the collection and verification of identity information provided with an application.
• Ensure you have access to a compatible electronic device and software application to receive and present a "digital token", as the definition in regulation 4 ties receipt of the transferred customer service output to a software application on an electronic device.
• If you require provisional registration, note that identity verification for provisional registration is not transferred and will remain subject to the Victorian Building Authority’s arrangements (Schedule 2, item 1).
• Keep records of your digital transactions and any digital tokens issued, recognising that the Regulations do not specify retention or evidentiary rules. If a digital token is required as proof of registration in professional settings, confirm with the requesting body whether the digital token will be accepted in place of a physical registration card.

General compliance steps for all parties

• Map the exact triggering conditions in Schedules 1 and 2 to operational practices. The triggering conditions are: the specific Building Act provision cited, and that the application was made by input into an Internet site or mobile application maintained for that purpose. Where either condition is absent, do not treat the function as transferred.
• Review other applicable laws, including the Service Victoria Act 2018, the Building Act 1993, privacy legislation and any relevant administrative law obligations, to understand procedural standards, rights of review, and data protection duties. The Regulations reallocate functions but do not displace broader legal obligations.
• Plan for dual-channel processing and ensure interoperability between Service Victoria systems and Victorian Building Authority systems because the transfers are partial and channel-specific.
• Account for the Regulations’ sunset date of 24 May 2032 in business continuity and technology procurement decisions (Endnotes, general information). If long-term investments are required, include contingencies for potential remaking or amendment of the statutory rule.

These compliance steps are grounded in the Regulations’ operative text: regulation 4 (definitions), regulations 5 and 6 (prescribing transfers), Schedules 1 and 2 (enumerating transferred functions and the Victorian Building Authority as the transferor), regulation 3 (commencement) and the Endnotes (making and sunset information).
