Service Victoria (Transfer of Disability Service Safeguards Functions) Regulations 2020

Mechanically, the Service Victoria (Transfer of Disability Service Safeguards Functions) Regulations 2020 (the Regulations) move a narrowly defined set of customer service and identity verification tasks from the Board established under the Disability Service Safeguards Act 2018 to the Service Victoria CEO. The Regulations are made under section 58 of the Service Victoria Act 2018 (reg 2) and came into operation on 1 July 2021 (reg 3). The stated objectives in regulation 1 are to prescribe the customer service functions and the identity verification functions that are transferred to the Service Victoria CEO under the Service Victoria Act 2018 (reg 1(a) and 1(b)). The Regulations list the specific transferred functions in Schedule 1 (customer service functions) and Schedule 2 (identity verification functions) and attach those transfers to the relevant provisions of the Service Victoria Act by reference (regs 5 and 6 and their Notes).

The concrete transfers are these items in the Schedules. Schedule 1 (reg 5) specifies three customer service functions transferred from the Board: receiving and processing applications for initial registration as a disability worker under s 151(1) of the Disability Service Safeguards Act 2018; receiving and processing renewal applications under s 186(1) of that Act; and delivery to a registered disability worker, through a mobile application, of a certificate of registration given by the Board under s 199(1) of the Disability Service Safeguards Act 2018 (Sch 1 items 1-3). Schedule 2 (reg 6) specifies two identity verification functions transferred from the Board: collecting and verifying identity information provided with initial registration applications under s 151(1), and collecting and verifying identity information provided with renewal applications under s 186(1) (Sch 2 items 1-2).

Statutory operation is immediate upon the commencement of the regulation that prescribes the function as transferred: the Notes to regs 5 and 6 make clear that a transferred customer service function and a transferred identity verification function are to be performed by the Service Victoria CEO from the commencement of the regulation that prescribes it (see the Notes to reg 5 and reg 6, which refer to s 5(5) and s 10(5) of the Service Victoria Act 2018 respectively). The Regulations also define a handful of terms for the instrument: Board and disability worker take their meaning from the Disability Service Safeguards Act 2018, mobile application is defined for the purposes of these Regulations, and the Regulations adopt the shorthand "the Act" to mean the Service Victoria Act 2018 (reg 4).

The Regulations are time-limited by the usual subordinate-legislation sunset mechanism. The Endnotes record the making date as 15 December 2020, commencement as 1 July 2021, and that the Regulations will sunset 10 years from the making date on 15 December 2030 under section 5 of the Subordinate Legislation Act 1994 (Endnote 1). The instrument has been amended by the Service Victoria (Miscellaneous) Amendment Regulations 2024, S.R. No. 38/2024, which made several targeted changes including amending reg 1(b) and revoking reg 1(c), revoking reg 7, and revoking a Schedule 3 (Table of Amendments). The Amendment Regulations took effect for regs 11-13 on 29 May 2024, per the Table of Amendments in the Endnotes.

The Regulations are narrowly focused. They do not purport to transfer governance or regulatory decision-making powers that remain with the Board under the Disability Service Safeguards Act 2018, nor do they attempt to rewrite substantive registration criteria or the Board’s statutory powers. The instrument transfers specified customer-facing and identity verification tasks to Service Victoria’s operational head, the Service Victoria CEO, while otherwise relying on the primary legislation for definitions and the legal basis of registration and certification under the Disability Service Safeguards Act 2018.

The Regulations rest on a small set of organised concepts: transferred customer service functions, transferred identity verification functions, the Service Victoria CEO as the performing entity, and delegated definitions that pull substance from the Disability Service Safeguards Act 2018. The statutory framework is terse; the Regulations define only a mobile application and refer external definitions for core terms (reg 4).

Transferred customer service functions are tasks prescribed in Schedule 1 and declared to be transferred under section 5(5) of the Service Victoria Act 2018 (reg 5 and Note). The Schedule lists three such tasks: processing initial registration applications under s 151(1) of the Disability Service Safeguards Act 2018; processing renewal applications under s 186(1) of that Act; and delivering certificates of registration to registered disability workers via a mobile application where the certificate is given by the Board under s 199(1) of the Disability Service Safeguards Act 2018 (Sch 1 items 1-3). The wording preserves the origin of the certificate: it is "given by the Board" but the customer-facing delivery is a transferred function that Service Victoria will perform via a mobile application (Sch 1 item 3).

Transferred identity verification functions are those set out in Schedule 2 and declared to be transferred under section 10(5) of the Service Victoria Act 2018 (reg 6 and Note). Schedule 2 lists two identity tasks: collecting identity information provided with applications for registration under s 151(1), and collecting identity information provided with renewal applications under s 186(1), together with verifying the applicant’s identity (Sch 2 items 1-2). Both of these items are phrased as a combination of collection and verification performed by the Service Victoria CEO instead of the Board.

The Regulations adopt minimal internal definitions. "Mobile application" is defined as a software application designed for use on a portable electronic device such as a mobile phone or a handheld computing device (reg 4). "Board" and "disability worker" are not defined in the Regulations; each "has the same meaning as in the Disability Service Safeguards Act 2018" (reg 4). "The Act" is defined to mean the Service Victoria Act 2018 (reg 4). This structure means that the Regulations articulate process transfers but lean on the substantive definitions and standards in the Disability Service Safeguards Act 2018 and the Service Victoria Act 2018 for legal content beyond the procedural tasks enumerated.

The statutory notes attached to regs 5 and 6 are conceptually important. They make explicit the timing rule: a transferred function is to be performed by the Service Victoria CEO from the commencement of the regulation that prescribes it, and they reference the enabling sections in the Service Victoria Act 2018 (the Note to reg 5 refers to s 5(5); the Note to reg 6 refers to s 10(5)). This ties the practical effect of the schedules to the Service Victoria Act’s transfer mechanism rather than creating independent substantive powers in the Regulations.

The Regulations alter the operational pathway for a tight set of participants in the disability worker registration system. The primary groups directly affected are (a) applicants and registered disability workers, (b) the Board under the Disability Service Safeguards Act 2018, and (c) the Service Victoria CEO and Service Victoria’s delivery systems.

Applicants for registration as disability workers and applicants for renewal are the principal private parties affected. Schedule 1 items 1 and 2 transfer receiving and processing of initial and renewal applications to the Service Victoria CEO (Sch 1 items 1-2). Schedule 2 items 1 and 2 transfer the collection and verification of identity information that accompanies those applications to the Service Victoria CEO (Sch 2 items 1-2). Practically, these applicants will interact with Service Victoria’s customer service channels rather than the Board when lodging applications and supplying identity information for verification. Schedule 1 item 3 also affects registered disability workers by specifying delivery of the certificate of registration, given by the Board under s 199(1) of the Disability Service Safeguards Act 2018, via a mobile application as a transferred customer service function. Registered workers therefore may receive their certificate through Service Victoria’s mobile application rather than direct Board delivery.

The Board is the service agency from which the listed functions are transferred. Each item in Schedules 1 and 2 expressly names "The Board" as the service agency from which the function is transferred (Sch 1 and Sch 2 columns). The Regulations do not purport to dissolve the Board or to remove the Board’s statutory responsibilities and powers under the Disability Service Safeguards Act 2018; they move only specified customer-service and identity verification tasks away from the Board’s administrative operations.

Service Victoria and the Service Victoria CEO are the public-sector actors who assume the transferred tasks. The Regulations declare the functions to be "transferred customer service function[s]" and "transferred identity verification function[s]" to be "performed by the Service Victoria CEO" from the relevant commencement (Notes to regs 5 and 6). That identifies who decides operationally how the specified activities are to be performed, within any constraints in the principal Acts and Service Victoria’s authorising statute.

Other parties indirectly affected include legal or compliance advisers who assist applicants and organisations with workforce onboarding. The shift of the receiving, processing and identity verification tasks to Service Victoria changes the point of contact and likely alters the practical compliance pathway for employers and intermediaries who assist workers with registration or renewal. The Regulations themselves are silent on how employers or third-party agents lodge applications or supply identity information on behalf of applicants; they only specify that the Service Victoria CEO performs the listed functions (Sch 1 and Sch 2).

The Regulations themselves are largely procedural and assign duties to the Service Victoria CEO rather than creating novel substantive rights or regulatory standards for applicants. The principal duties created or reallocated are the receiving and processing of registration and renewal applications, collecting and verifying identity information submitted with those applications, and delivering certificates of registration to registered disability workers via a mobile application (reg 5; reg 6; Sch 1 and Sch 2).

Under Schedule 1, items 1 and 2, the Service Victoria CEO has the duty to receive and process applications for registration as a disability worker under s 151(1) and applications to renew registration under s 186(1) of the Disability Service Safeguards Act 2018. The Regulations make no change to the statutory basis for those applications or to the decision-maker for registration; they transfer the customer-service function of receipt and processing to the Service Victoria CEO. The Schedule frames those duties as the processing of ministerial or administrative inputs rather than the adjudication of eligibility or regulatory sanctions, which remain situated in the Disability Service Safeguards Act 2018 (the Schedule cites the relevant substantive provisions).

Schedule 1 item 3 creates the duty for Service Victoria to deliver, through a mobile application, the certificate of registration that the Board gives under s 199(1) of the Disability Service Safeguards Act 2018. The Schedule preserves the Board’s role as the entity that gives the certificate while assigning the delivery channel to the Service Victoria CEO. The obligation to deliver via a "mobile application" engages the statutory definition provided in reg 4, which defines the term by reference to software used on portable devices.

Schedule 2 assigns the Service Victoria CEO the duty to collect identity information provided with applications under s 151(1) and s 186(1) and to verify the applicant’s identity (Sch 2 items 1-2). Those duties cover both collection and verification activities as a combined function. The Regulations do not specify technical standards, evidence thresholds, or verification processes; they simply move the tasks to the Service Victoria CEO.

The Regulations are silent about applicant rights such as timeframes for processing, review or appeal rights against processing decisions, privacy safeguards, or data retention obligations. They do not displace the Board’s statutory functions or powers under the Disability Service Safeguards Act 2018. Nor do the Regulations set fees, prescribe procedural rules for lodging via third parties, or state whether the original documentary or evidentiary obligations continue unchanged; consequently, the substantive rights and obligations governing registration, renewal and identity requirements remain those found in the Disability Service Safeguards Act 2018 and any associated regulations, forms or practice directions that are not replicated in this instrument.

The Regulations do not create new criminal offences, civil penalties, or an administrative enforcement regime. There are no penalty clauses, infringement notices, or enforcement provisions within the Regulations themselves. The Table of Provisions and the substantive text list the functions transferred, definitional material and commencement details but include no enforcement clauses, sanctions or prescribed penalties.

Enforcement and penalties relevant to registration and identity matters must therefore be sought in the primary legislation that deals with registration as a disability worker, namely the Disability Service Safeguards Act 2018, or in other statutes. The Regulations repeatedly reference that Act for the substantive registration provisions that give rise to the transferred functions. For example, Schedule 1 refers to applications under s 151(1) and renewals under s 186(1), and item 3 refers to a certificate "given by the Board under section 199(1) of the Disability Service Safeguards Act 2018" (Sch 1). Any statutory sanctions, prohibitions on unregistered practice, or enforcement powers remain those located in the Disability Service Safeguards Act 2018 and any regulations made under it. The Regulations do not alter who may enforce those statutory provisions or change the sanctioning apparatus.

The instrument was made under section 58 of the Service Victoria Act 2018 (reg 2), which is the authorising provision. The Regulations should therefore be read in the context of the enforcement architecture in the Service Victoria Act and the Disability Service Safeguards Act, but no enforcement mechanisms or penalty provisions are inserted or modified by this instrument itself.

Because the Regulations assign operational duties to the Service Victoria CEO, failure by Service Victoria to perform the transferred functions could give rise to administrative complaint or review rights under general public law principles, or contractual remedies if Service Victoria contracts delivery, but the Regulations do not specify any remedy, timeframe, or pathway for redress. The Endnotes list no explanatory details regarding enforcement and the explanatory details section is empty at date of publication (Endnote 3). The absence of express enforcement or penalty measures in the Regulations means that enforcement questions will turn on the primary Acts and on general administrative law rather than on this instrument.

The Regulations are expressly derivative instruments that interact primarily with three statutory instruments referenced in the text: the Service Victoria Act 2018, the Disability Service Safeguards Act 2018, and the Subordinate Legislation Act 1994. The instrument is made under section 58 of the Service Victoria Act 2018 (reg 2), and the Notes to regs 5 and 6 make explicit the linkage to that Act by citing s 5(5) and s 10(5) respectively. The Schedules repeatedly reference particular sections of the Disability Service Safeguards Act 2018 (Sch 1 items refer to ss 151(1), 186(1), 199(1); Sch 2 items refer to ss 151(1), 186(1)), thereby anchoring the transferred functions to existing substantive registration and certification provisions in that Act.

By design, the Regulations do not change the statutory content of the Disability Service Safeguards Act 2018. Instead they reallocate certain service delivery and identity-verification tasks to the Service Victoria CEO. For example, Schedule 1 item 3 preserves the Board as the entity that "gives" the certificate under s 199(1) of the Disability Service Safeguards Act 2018 while transferring the function of delivery via a mobile application to Service Victoria. That creates an interaction in which the Board remains the decision-maker or certifier while Service Victoria performs a technology-mediated delivery function.

The Endnotes show the Regulations are subject to the Subordinate Legislation Act 1994 sunset mechanism and will sunset 10 years from the making date (Endnote 1). This legal interaction imposes a time limit that requires either legislative renewal or expiry of the transfer mechanism unless further legislative action occurs.

The Regulations also rely on the Interpretation of Legislation Act 1984 (ILA) for interpretive and structural conventions, as shown in the Endnotes. The Endnotes include a section titled "INTERPRETATION OF LEGISLATION ACT 1984 (ILA)" outlining how headings, notes, punctuation and provision numbers are treated in statutory rules made after 1 January 2001. Those Endnotes confirm that the instrument’s headings and notes form part of the statutory rule and should be used in statutory interpretation where relevant.

The instrument contains no express interaction with privacy legislation, identity verification frameworks, or electronic transactions laws. The Regulations transfer the collection and verification of identity information to Service Victoria (Sch 2 items 1-2) and define "mobile application" (reg 4), but they do not state how privacy privacy safeguards, data-sharing, or digital identity standards are to be applied. Therefore compliance with privacy, data protection, or electronic transaction laws will rely on the Service Victoria Act, the Disability Service Safeguards Act, and other external statutes or policies, none of which are modified by this instrument.

The Regulations were originally made on 15 December 2020 and commenced on 1 July 2021 (Endnote 1). The Table of Amendments in the Endnotes records a later statutory rule, the Service Victoria (Miscellaneous) Amendment Regulations 2024, S.R. No. 38/2024. That 2024 instrument amended this Regulation package in a few specific ways. The Table of Amendments records:

• Date of Making for the amendment: 28 May 2024.
• Date of Commencement for certain amendment items: Regulations 11-13 commenced on 29 May 2024 (Endnote 2).

The body text shows the specific amendment effects marked in-line in the Regulations:

• Regulation 1(b) was amended by S.R. No. 38/2024 reg 11(1). Regulation 1(b) is the objective that prescribes identity verification functions transferred to the Service Victoria CEO. The text in reg 1(b) now reads that objective as amended.
• Regulation 1(c) was revoked by S.R. No. 38/2024 reg 11(2). The original instrument appears to have had a subparagraph (c) in reg 1 which has since been revoked; the current text shows no reg 1(c).
• Regulation 7 was revoked by S.R. No. 38/2024 reg 12. The Regulations do not display a regulation 7 in the current consolidated text; the in-line note indicates reg 7 was removed.
• Schedule 3 was revoked by S.R. No. 38/2024 reg 13. The present consolidated text contains only Schedules 1 and 2; any prior Schedule 3 has been removed.

The Endnotes’ Table of Amendments states the S.R. No. 38/2024 changes were made on 28 May 2024 and reg 11-13 came into operation on 29 May 2024. The consolidated version provided here is stated to incorporate amendments up to 29 May 2024, Version No. 002, which indicates that the published consolidation reflects that amending instrument (header information and Version No. 002 metadata).

No other amendment instruments are recorded in the Table of Amendments section of the Endnotes. The Endnotes also say that explanatory details contain "No entries at date of publication" (Endnote 3), meaning there are no further explanatory notes about amendment history in the publication. The Regulations remain subject to the Subordinate Legislation Act 1994 sunset rule, set to expire on 15 December 2030 unless renewed, amended again, or replaced (Endnote 1).

Users should note that the Amendment Regulations made targeted deletions and subtle changes to the objectives and to some regulation numbering. The consolidated text reflects those changes and shows the current Schedules and operative provisions. The Endnotes provide the authoritative record of amendment dates and commencement of amendment provisions.

There is no litigation history recorded in the instrument or its Endnotes. The Explanatory details section is blank at the date of publication (Endnote 3 states "No entries at date of publication"). The Regulations themselves contain no notes, schedules or commentary that cite cases or judicial interpretations. The Endnotes and the Table of Amendments list statutory changes but do not record any appellate or judicial decisions interpreting or applying these Regulations.

Because the Regulations are a relatively narrow operational instrument that transfers specific administrative tasks from the Board to the Service Victoria CEO, any litigation that might concern these arrangements would likely arise in one of three contexts: challenges to the validity of the transfer under the Service Victoria Act 2018, disputes about the Board’s statutory powers under the Disability Service Safeguards Act 2018, or administrative-law challenges arising from Service Victoria’s performance of the transferred functions. None of those potential litigation strands are present in the published material for this instrument.

The absence of recorded litigation in the Endnotes does not preclude future challenges. The instrument is subject to statutory interpretation rules under the Interpretation of Legislation Act 1984, which the Endnotes summarise for interpretive practice. The Endnotes’ interpretive guidance confirms that headings and notes form part of the statutory rule and that punctuation and provision numbers are part of the Statutory Rule; those technical points could be relevant to litigation about the scope or timing of transferred functions. But as of the consolidation date shown (29 May 2024), the publisher records no cases or judicial commentary concerning these Regulations.

Practitioners seeking litigation history should therefore consult court databases and legal reporting services for decisions that post-date the consolidation or that are not captured in the instrument’s Endnotes. For the purposes of this publication, however, the litigation history section contains no entries and no case law to cite.

This instrument is short but contains several practical pitfalls that arise from what it says and what it leaves unsaid.

1. Narrow transfer, broad reliance on other Acts. The Regulations transfer specific customer-service and identity-verification tasks to the Service Victoria CEO, but the substantive legal definitions and thresholds for registration and certification remain in the Disability Service Safeguards Act 2018. The Regulations explicitly make "Board" and "disability worker" terms have "the same meaning as in the Disability Service Safeguards Act 2018" (reg 4). Practitioners must therefore consult the Disability Service Safeguards Act 2018 for the substantive content of these terms. The Regulations do not reproduce eligibility criteria, disqualifications, fitness-to-practise rules, or nuanced evidentiary standards.

2. Certificate is still "given by the Board". Schedule 1 item 3 transfers delivery of the certificate via a mobile application but states the certificate is "given by the Board under section 199(1) of the Disability Service Safeguards Act 2018." That wording preserves the Board’s role as the originator of the certificate while outsourcing delivery to Service Victoria. That split can create operational questions about responsibility for issuing corrected or replacement certificates and who retains legal custody of the authoritative record.

3. Mobile application is specified but alternatives are not. Schedule 1 item 3 mandates delivery "through a mobile application" and reg 4 defines mobile application. The Regulations do not specify alternative delivery channels, accessibility arrangements, or remediation for registrants without access to suitable devices. The narrow specification may create practical access issues unless Service Victoria or the Board supplements the Regulations with policy, additional channels, or exceptions.

4. Identity verification standards are unspecified. Schedule 2 transfers "collecting identity information" and "verifying the applicant’s identity" to Service Victoria (Sch 2 items 1-2). The Regulations do not explain what identity information is required, what evidentiary proofs suffice, what verification technologies or standards apply, or how to handle refused verification. That silence means that the operational detail is delegated to Service Victoria procedures or the primary legislation. Users must check the underlying Act and any Service Victoria practice instruments for the required identity standards.

5. Silence on fees, timeframes and redress. The Regulations are silent about fees for processing, statutory or administrative timeframes, review rights for processing delays or errors, and privacy/data-sharing arrangements. Therefore practitioners should not assume that Service Victoria will apply the same processes or timelines as the Board previously used. The lack of procedural safeguards in the Regulations themselves raises the need to locate complementary instruments, guidance notes, or internal Service Victoria policies.

Compliance under these Regulations divides into duties for the Service Victoria CEO/agency and practical steps for applicants and their advisers.

For the Service Victoria CEO and Service Victoria as an agency:

• Ensure operational responsibility for the listed functions is established and staffed. The Regulations require Service Victoria to receive and process initial registration applications under s 151(1) and renewal applications under s 186(1) of the Disability Service Safeguards Act 2018 (Sch 1 items 1-2). Document workflows that receive, log, triage and process those applications, and coordinate with the Board for any matters that remain the Board’s responsibility.
• Implement identity-collection and verification capabilities. Schedule 2 requires Service Victoria to collect identity information provided with applications and to verify the applicant’s identity (Sch 2 items 1-2). Service Victoria needs procedures and technical systems to capture identity documents, perform verification checks, record verification outcomes, and escalate unresolved verification issues to the Board or other authority if required.
• Provide a secure mobile application delivery channel for certificates. Schedule 1 item 3 transfers the delivery of the certificate of registration to Service Victoria through a mobile application (Sch 1 item 3). Service Victoria must adopt a mobile application that meets security, authenticity and accessibility requirements, and must coordinate with the Board so that certificates "given by the Board" can be transmitted to and presented through the app.
• Draft and publish clear instructions, privacy notices and evidence lists. Because the Regulations do not prescribe identity standards, Service Victoria should publish the evidence required for identity verification, including acceptable documents, formats and verification steps. Privacy notices and data-retention policies should describe how identity data will be used, stored and shared with the Board in compliance with applicable privacy law.
• Establish interfaces with the Board. The Board still "gives" certificates under s 199(1) and remains the named service agency in the Schedules for the transferred functions. Service Victoria must have written arrangements with the Board,e.g. memoranda of understanding, service-level agreements or data-sharing protocols,to define responsibilities, timelines, record-keeping, error correction, and liability allocation.
• Plan for registrant access contingencies. The Regulations specify delivery through a mobile application. Service Victoria should provide alternative delivery mechanisms and assistance for registrants who lack compatible devices or have accessibility needs, unless other policy instruments provide those arrangements.
