### 41 Timber growing near roads may be cut down: Consent of owner required in certain cases
> > (1) *\[Section 41 Subsection (1) amended by No. 75 of 1973, s. 2 and Sched. 1 \]*The road authority may cut down and remove any indigenous timber growing or standing within 23 metres of the centre of any road of which it has the care, control, or management, making good all damage or injury to the fences, hedges, ditches, walls, or any other thing upon the land on which such timber may be growing or standing.

> > (2) The road authority shall not, without the consent of the owner of such land, cut down any timber reserved or planted thereon for the purpose of ornament or shelter.
