95 Occupation of residential area under a retail premises lease If— (a) a retail premises lease confers a right on the tenant to occupy a residential area in the building in which the retail premises are located; and (b) the **Residential Tenancies Act 1997** does not apply to the lease to the extent that it provides for the occupation of the residential area— the retail premises lease is taken to provide that the landlord must ensure that the residential area is maintained in good repair.
