45 Rent etc. associated with other land not recoverable A provision in a retail premises lease is void to the extent that it requires the tenant to pay an amount in respect of— (a) rent payable under any head lease under which the landlord holds the retail premises; or (b) rent or other costs associated with any other land including— (i) land on which the building or retail shopping centre of which the retail premises forms part is located; and (ii) land of the landlord used by, or for the benefit of, the tenants conducting business in that building or retail shopping centre or in connection with trading in that building or retail shopping centre.
