### 49 Grounds for suspension or cancellation of registration
> > (1) The Registrar has grounds for determining to suspend or cancel a person’s registration if –
> >
> > > > (a) the person’s registration is subject to a condition; and
> > >
> > > > (b) the person contravenes the condition; and
> > >
> > > > (c) the Registrar reasonably believes that suspension or cancellation is appropriate.

> > (2) If the Registrar determines to conduct an additional risk assessment of a person, the Registrar has grounds for determining to suspend the person’s registration while the assessment is conducted.

> > > > (a) has conducted an additional risk assessment of the person; and
> > >
> > > > (b) [*\[Section 49 Subsection (3) amended by No. 17 of 2024, s. 37, Applied:01 Nov 2024\]*](/view/html/inforce/2024-11-01/act-2024-017#GS37@Hpa@EN) is satisfied that the person poses an unacceptable risk of harm to vulnerable persons generally or to a class of vulnerable persons to which the regulated activities allowed by the registration apply.

> >
> > > > (a) is to apply a lower threshold when making a determination to suspend a person’s registration than would be applied to a determination to cancel the person’s registration; and
> > >
> > > > (ab) [*\[Section 49 Subsection (4) amended by No. 24 of 2025, s. 8, Applied:27 Nov 2025\]*](/view/html/inforce/2025-11-27/act-2025-024#GS8@EN) must suspend a person’s registration if the Registrar is conducting an additional risk assessment of the person on the grounds that the person’s registration under a corresponding law has been suspended under that corresponding law; and

> > > > (b) must suspend a person’s registration if the Registrar is of the opinion that it is necessary for the safety, welfare or protection of vulnerable persons.
