Rail Safety National Law (Victoria) (Drug and Alcohol Controls) Regulations 2019

The Regulations are built around a handful of stable legal and operational concepts, each tethered to named provisions in the Act. Understanding these concepts is necessary for compliance and for evaluating the Regulations’ effects on operations.

Prescribed devices and collection units. The Regulations identify, by name, specific breath analysers (reg 6) and oral fluid/drug screening devices (reg 15) that are authorised for use under the Act’s testing powers. The device lists are not open‑ended; they are literal lists in the text and are the catalogue operators must use unless the Regulations are amended. That creates a direct link between procurement choices and regulatory compliance.

Authorised person and operator duties. Multiple provisions impose duties on an “authorised person” or person authorised under particular Act sections to act in specific ways when conducting tests. For example, reg 7 requires the person authorised under section 48M(7) of the Act who operates a breath analysing instrument to observe a 15‑minute abstention verification, to provide a fresh mouthpiece and to use only mouthpieces kept in sealed containers. Regulation 16 imposes analogous duties for oral fluid tests, including that a test be performed on the device or oral fluid unit through which the sample was provided (reg 16(c)).

Chain of custody and sample structure. For blood and urine, the Regulations specify multiple containers and sealing methods. Blood samples must be divided into two dry containers, each vacuum sealed or sealed with a septum seal, labelled with the anticoagulant and preservative and the preparer’s name and signature (reg 10(1)(a)-(d)). Urine samples are to be split into two dry containers fitted with tamper‑proof locking seals and labelled with collector’s signature, date/time and identification (regs 22-23). For blood taken under a particular Act provision (48ZA), both sample containers must be placed and sealed in a plastic sample bag and placed in a locked receptacle at the place taken (reg 10(3)).

Prescribed particulars for certificates and reports. The Regulations supply fixed lists of particulars that must appear in certificates and reports required by the Act. These lists cover breath analysis records (reg 8), certificates from medical practitioners regarding compliance with blood‑taking procedures (reg 11), analyst certificates quantifying alcohol concentration (reg 12) or presence of a prescribed drug (reg 13), approved expert statements addressing effects on behaviour (reg 14 and reg 21), and an extensive set of particulars for police‑carried assessments of drug impairment (reg 24).

Interactions with the Act and other statutory materials. The Regulations repeatedly operate “for the purposes of” specific Act provisions (for example regs 6, 7, 8, 16, 17, 19). The endnotes make explicit that the Regulations are made under s 51 of the Rail Safety National Law Application Act 2013 (reg 2) and that they are subject to the Subordinate Legislation Act 1994 sunset rules (endnotes). The Interpretation of Legislation Act 1984 style rules are also noted in the endnotes.

Temporal and amendment dynamics. The Regulations themselves have been amended multiple times, with insertions, substitutions and revocations of device entries and small procedural amendments (see Table of Amendments in the endnotes). That indicates the device lists and some procedural details are expected to change over time and operators must track updates.

Collectively, these main concepts convert high‑level statutory powers in the Act into a precise set of operational actions, documentary requirements and device constraints that govern how breath, oral fluid, blood and urine samples are to be taken, handled and certified for use within the rail safety regulatory regime.

The Regulations allocate obligations across a set of actors and change behaviour and costs for several categories of parties.

Rail safety workers. The Regulations apply to “rail safety workers” who are the subjects of tests and samples. They prescribe what a worker may be required to provide (breath, oral fluid, blood, urine) and how those samples must be taken and labelled (regs 7, 16, 17, 22-23). Workers bear the immediate consequence of being required to submit to tests; they are the sources of the biological material subject to handling, storage and certification requirements.

Rail operators and employers. Employers who operate rail services must ensure that authorised persons and testing programs comply with the procedures and use the prescribed devices. That creates procurement and operational obligations: buying or maintaining approved breath and oral fluid devices (regs 6 and 15), stocking sealed mouthpieces and oral fluid units (regs 7, 16-17), providing access to locked receptacles for certain blood samples (reg 10(3)), and ensuring appropriate recordkeeping and labeling (regs 8, 10, 18, 23, 24). Employers therefore pay: device purchase and maintenance, consumables, training, storage, and administrative time.

Authorised persons and operators. The Regulations create specific procedural duties for persons authorised under particular Act sections. For example, a person authorised under s 48M(7) must observe the 15‑minute abstention requirement and supply sealed mouthpieces (reg 7). Authorised persons conducting oral fluid analyses must test samples using the device through which the sample was provided (reg 16(c)). These duties affect the daily practice of safety officers, testing staff and contractor technicians.

Registered medical practitioners and approved health professionals. Medical practitioners or approved health professionals who take blood or collect urine must follow explicit handling and labelling requirements (regs 9-10, 22-23). They must ensure two containers are used for blood and urine, that the containers bear identification labels and that samples are vacuum/septum/sealed appropriately. They also have an obligation to hand samples to an authorised person (reg 10(2)) and, in some cases, to place sealed bags in locked receptacles (reg 10(3)). Those duties impose clinical procedural standards, chain‑of‑custody responsibilities and documentation tasks on medical staff.

Approved analysts and approved experts. The Regulations set out what approved analysts and experts must include in their certificates (regs 12-14, 20-21). Analysts are required to declare their approved status, the method used and the date of analysis; approved experts must specify the usual effects of specified substances on behaviour. Laboratories and individual analysts must therefore maintain accreditation and produce certificates with the prescribed particulars.

Police officers. The Regulations set out the form and content of a report of assessment of drug impairment when the assessment is carried out by a police officer (reg 24). That allocates reporting duties to police who perform impairment assessments, mandating detailed observations and administrative particulars (for example, identity particulars, time/place, description of speech, eyes, balance, statements by the worker, and whether the officer opines the worker may be impaired) and requires the officer’s name, rank, station and signature.

Device manufacturers and suppliers. Because the Regulations list specific devices by trade name, manufacturers and suppliers of those devices are affected commercially. Being on the prescribed list gives purchasers a clear compliance route, while removal or substitution from the list (as seen in the amendments) affects marketability and ongoing sales to Victorian rail operators.

Regulators and courts. The Regulations provide the technical, documentary and procedural content regulators and courts will inspect when evaluating compliance with the Act’s testing regime. The matters set out in the Regulations (for example, the exact content of certificates and preservation of samples) will be central to evidential evaluation under the Act’s enforcement architecture, although the Regulations themselves do not prescribe penalties.

In summary, these Regulations affect workers subject to testing, employers and their safety systems, medical and analytical practitioners who collect and process samples, police undertaking assessments, device suppliers, and the administrative functions of regulators and courts. The primary economic costs fall on employers and service providers through device procurement, consumables, training and administrative recordkeeping; the principal decision‑makers are authorised persons, medical practitioners, analysts, police officers and the regulator that enforces the Act.

The Regulations allocate specific duties to workplace testers, medical personnel, analysts, experts and police officers, and prescribe documentary particulars for certificates and reports. Those duties are expressed in mandatory language in the text; rights are mostly implicit (for example the worker’s procedural protections are inferred from the required processes), and the text principally focuses on duties.

Duties of authorised operators conducting breath analysis. Regulation 7 requires that a person authorised under section 48M(7) of the Act who operates a breath analysing instrument must not require a rail safety worker to provide a breath sample until the operator is satisfied the worker has not consumed any alcohol for at least 15 minutes before analysis (reg 7(a)). The operator must provide a fresh mouthpiece for each worker and must use only mouthpieces kept in a sealed container until used (reg 7(b)-(c)). These are direct operational duties imposed on the authorised operator which affect timing and consumables.

Label and record duties for breath analysis. Regulation 8 prescribes the particulars required for a certificate under s 48M(8) of the Act, including the serial number of the breath analysing instrument, the sample number, test location, worker identity details, operator surname, instrument self-test and zero test results, and date and time of analysis (reg 8(a)-(h)). The operator must therefore record and preserve these particulars for each breath analysis.

Duties when taking blood. Regulation 9 imposes a specific hygiene/contamination duty: the puncture site must be cleansed with a swab from a container that appears sealed and does not contain ethanol (reg 9(a)-(b)). Regulation 10 requires the practitioner to place blood into two dry containers, each containing approximately the same amount of blood, each vacuum sealed or sealed with a septum seal (reg 10(1)(a)-(b)), and that each container bears labels stating the specific anticoagulant and preservative and the preparer’s identity (reg 10(1)(c)-(d)). If the sample is taken under certain Act provisions, the practitioner must give sample containers to an authorised person (reg 10(2)), and where taken under section 48ZA the two containers must be placed and sealed in one plastic sample bag and put in a locked receptacle at the place where taken (reg 10(3)).

Certificates for blood analysis. Regulation 11 prescribes the particulars for a certificate under s 48ZB(5) confirming compliance with the blood‑taking requirements, including practitioner statement, name of worker, date/time and signature (reg 11(a)-(d)). Regulation 12 prescribes the particulars for an analyst’s certificate quantifying alcohol in blood, including concentration in g/100 mL, an approved analyst’s statement, method of analysis, name/signature and date and the identification label information from reg 10(1)(d) (reg 12(a)-(f)). Regulation 13 prescribes particulars where an analyst reports presence of a prescribed drug (reg 13(a)-(g)). Regulation 14 prescribes the approved expert particulars on effects of substances (reg 14(a)-(c)).

Duties for oral fluid testing. Regulation 16 requires authorised persons to provide a fresh oral fluid collection unit for each worker, to use only units that have been kept in sealed containers until issue, and to test or analyse any sample using the device or unit through which the sample was provided (reg 16(a)-(c)). Regulation 17 extends the sealed unit requirement to samples provided for analysis by a properly qualified analyst (reg 17(a)-(b)). Regulation 18 mandates labelling an oral fluid sample with the authorised person’s name and signature, date/time and worker identification (reg 18(a)-(c)). Regulations 19-21 prescribe the content of oral fluid certificates and expert statements (regs 19-21).

Duties for urine collection. Regulation 22 requires that urine be collected in a container which is clean, dry and not previously used. Regulation 23 requires two dry containers, each with tamper‑proof locking seals, and labels bearing collector signature, date/time and worker identification (regs 22-23).

Duties for police assessment report. Regulation 24 prescribes extensive particulars for the assessment of drug impairment under s 48X(7), including identity particulars, date/time/place, any preliminary breath test results, the record of interview, medical treatment particulars, worker statements about drugs, and a set of observational particulars covering injury/illness, liquor smell, speech, eyes, breathing, skin, movement, balance, clothing, actions, demeanour, physical signs of drug use, comprehension and divided attention, and whether the officer considers the worker may be impaired (reg 24(a)-(k)). The police officer must supply name, rank, station and signature.

Rights and implied protections. The Regulations do not set out procedural “rights” such as the rights of workers to legal representation or appeal. Instead, they embed process protections through documentary and handling requirements (for example sealed mouthpieces, prescribed labelling and split samples). Those protections serve to support reliable identification and chain of custody for samples and certificates that will be relied upon under the Act.

Accountability through specified certificates. The requirement that specific particulars appear in prescribed certificates (regs 8, 11-14, 19-21) creates traceable accountability: individuals who sign those certificates attest to compliance with specified procedures or to the method and result of analyses. That concretely allocates professional responsibility to the named medical practitioner, analyst or expert who must sign the document.

Absence of statutory rights or penalties in the Regulations. The Regulations do not create stand‑alone penalties; they are procedural and evidentiary. Where consequences attach (for example under the Act’s enforcement provisions), they are found in the Act itself, not in these Regulations. The Regulations therefore create duties that will be relevant to enforcement, evidentiary sufficiency and administrative oversight under the Act, but do not set out the sanctioning regime in this instrument.

In sum, the Regulations impose concrete documentary, sampling and device obligations on operators, medical personnel, analysts, experts and police officers, and place the production of prescribed certificates and reports at the core of compliance.

The Regulations themselves do not set out penalties, fines or criminal sanctions. Their content is procedural and evidentiary: specifying devices, sample‑handling, labelling and the particulars required in certificates and reports. Enforcement and penalties for contraventions of the Act’s substantive provisions or of the testing regime are matters for the Act and for the regulator(s) identified in the broader Rail Safety National Law framework, rather than for these Regulations. The Regulations therefore function as a set of mandated procedures and evidentiary requirements whose breach will be assessed under the Act and other relevant laws.

What the Regulations do provide for enforcement‑relevant processes:

• Evidencing standards. The Regulations prescribe the precise content of certificates and reports to be used with particular Act sections. For example, reg 12 sets the particulars to be supplied by an approved analyst under s 48ZB(6) of the Act (including alcohol concentration, method of analysis, and analyst’s signature). That creates an evidentiary checklist regulators, prosecutors and decision‑makers will use when assessing whether the Act’s testing and analysis requirements were followed.

• Chain of custody and sample integrity measures. Requirements such as splitting blood and urine into two dry containers of approximately equal amount, vacuum/septum sealing for blood (reg 10(1)(a)-(b)) and tamper‑proof locking seals for urine containers (reg 23(b)) are measures commonly regarded as relevant to the integrity of samples used in enforcement. The Regulations require these specific steps and therefore make non‑compliance an observable fact that enforcement agencies will likely note.

• Delegated enforcement actions by police. Regulation 24 prescribes the form and content of police‑carried assessments of drug impairment under s 48X(7) of the Act, listing the observations and particulars that must be recorded by the police officer. That reflects the role of police in operational enforcement when impairment assessments occur.

• Obligations to provide samples and to hand samples to authorised persons. Regulation 10(2) requires a registered medical practitioner or approved health professional who takes a blood sample under enumerated Act provisions to give the sample containers to an authorised person. The obligation to transfer custody to an authorised person creates a discrete moment where lawful possession and transfer are recorded.

Gaps and enforcement implications in the Regulations. Because no penalties are prescribed within the Regulations, consequences for non‑compliance are not stated here. The practical implication is that compliance is enforced via the Act and associated regulatory powers and penalties. The Regulations therefore function as a deterministic set of procedural criteria that enforcement agencies, courts or tribunals will rely on to judge compliance with the testing regime authorised by the Act.

Regulatory oversight and administrative enforcement remain matters of the Act and of the rail safety regulator responsible under the Rail Safety National Law Application Act 2013. The endnotes also note that the Regulations are made under section 51 of that Act (reg 2), which is the authorising provision. Practitioners should therefore map these procedural obligations back to the enforcement and penalty framework in the Act and other applicable legislation to determine the exact consequences of non‑compliance.

The Regulations operate as subordinate instruments made under the Rail Safety National Law Application Act 2013 and are explicitly framed “for the purposes of” particular Act sections. There are multiple cross‑references and interaction points that practitioners must track.

Authorising statute. Regulation 2 states that the Regulations are made under section 51 of the Rail Safety National Law Application Act 2013. Thus their legal force derives from that authorising power and they must be interpreted and applied in the context of the Act’s provisions to which they refer.

Direct cross‑references to the Act. The Regulations repeatedly operate “for the purposes of” specified sections of the Act. Notable references include section 48L(2) in reg 6 (prescribing breath testing devices), section 48M(7) and 48M(8) in regs 7 and 8 (breath‑analysis operator duties and certificate particulars), sections 48ZB(5)‑(8) in regs 11-14 (blood sample certificates and expert statements), sections 48R and 127 of the Rail Safety National Law (Victoria) in regs 16-17 (oral fluid tests and analyses), and section 48ZC(5)‑(7) in regs 19-21 (oral fluid certificates and expert statements). Further, reg 24 explicitly supplies particulars for a report of assessment of drug impairment for the purposes of section 48X(7) of the Act.

Interaction with the Rail Safety National Law (Victoria). The Regulations refer to the Rail Safety National Law (Victoria) in the text (for example regs 9, 16 and 23 refer to the Rail Safety National Law (Victoria) sections such as 127 and section 124). Where the Regulations mention both the Act and the Rail Safety National Law (Victoria), they are operationalising testing and sample provisions that may be located in the applied Rail Safety National Law instrument. Practitioners should read the Act, the Rail Safety National Law (Victoria) and these Regulations together to appreciate the full legal scheme.

Subordinate legislation framework. The endnotes state that these Regulations are subject to the Subordinate Legislation Act 1994 sunset regime, and that the Rules will sunset 10 years after making on 26 November 2029 (endnotes). That interacts with the lifecycle rules under Victoria’s subordinate legislation regime and implies a future review or replacement process.

Interpretation Act consequences. The endnotes reference the Interpretation of Legislation Act 1984 and note various style and numbering effects. Those references affect interpretation, for example making clear that headings and notes form part of the statutory rule and that provision numbers are integral to the instrument. Practitioners should therefore apply the ILA’s interpretive rules when construing the Regulations alongside the Act.

Evidential and procedural relationship to enforcement. The Regulations set out procedural requirements and the required particulars for certificates that will be relied on under the Act. Evidence admissibility, weight and the consequences of non‑compliance (for example whether an analysis certificate that fails to include the prescribed particulars will be treated as defective) are matters governed by the Act, relevant evidence rules and any applicable criminal or administrative law. The Regulations therefore influence evidentiary outcomes through their specific requirements but do not themselves determine penalty or adjudicative consequences.

Revocation of prior subordinate instruments. Regulation 5 revokes the Rail Safety National Law (Limited Accreditation Exemptions) Regulations 2014. That change must be interpreted alongside the Act to determine what transitional or substantive effects follow from that revocation.

In practice, the Regulations should be read as a procedural and device‑list annex to the Act and to the applied Rail Safety National Law (Victoria). Compliance requires reconciling the procedural prescriptions here with the enforcement powers, rights and sanctions located in the Act and other relevant statutes and with the interpretive rules of the Interpretation of Legislation Act 1984.

The Regulations include an explicit Table of Amendments and internal notes showing how specific provisions were inserted, substituted or revoked by later statutory rules. The published version in the material provided is a version incorporating amendments as at 1 July 2025. The amendment record identifies at least three instruments that altered these Regulations after the initial making in 2019.

Original making and commencement. The Regulations were made on 26 November 2019 and commenced on 2 December 2019 (reg 3 and endnotes). Regulation 1 sets the objective and reg 2 states the authorising provision.

Statutory Rules altering the Regulations. The endnotes table records three amending instruments to the Regulations:

• Rail Safety National Law (Victoria) (Drug and Alcohol Controls) Amendment Regulations 2024, S.R. No. 11/2024, made 13 February 2024 and commencing 13 February 2024. The internal text flags Reg 15(f) was substituted by S.R. No. 11/2024 reg 3 and that regs 15(g)-(i) were revoked by the same instrument. That indicates the oral fluid/analysis device entries were adjusted in that amendment.

• Rail Safety National Law (Victoria) (Drug and Alcohol Controls) Further Amendment Regulations 2024, S.R. No. 73/2024, made 6 August 2024 and commencing 6 August 2024. In the regulations, reg 15(ea) was inserted by S.R. No. 73/2024 reg 3 to add the Quantisal Oral Fluid Collection Device.

• Rail Safety National Law (Victoria) (Drug and Alcohol Controls) Amendment Regulations 2025, S.R. No. 66/2025, made 1 July 2025 and commencing 1 July 2025. The text shows reg 6(b) was substituted by S.R. No. 66/2025 reg 3, and regs 15(eb) and 15(ec) were inserted by S.R. No. 66/2025 reg 4 to add Clonal Technologies Oral Fluid Drug Test 7 and Oranoxis ToxWipe 7+ entries respectively.

Internal amendment markers. The body of the Regulations includes parenthetical notes showing which paragraphs were substituted or inserted by which amending rules, for example:

• Reg 6(b) substituted by S.R. No. 66/2025 reg 3 (affecting the breath analyser list).

• Reg 15(ea) inserted by S.R. No. 73/2024 reg 3; reg 15(eb) and 15(ec) inserted by S.R. No. 66/2025 reg 4; reg 15(f) substituted by S.R. No. 11/2024 reg 3; and regs 15(g)-(i) revoked by S.R. No. 11/2024 reg 3. These show an active process of updating the device list, which is a central compliance feature.

Versioning and currency. The document is presented as Version No. 004 incorporating amendments as at 1 July 2025. The endnotes alert users to the official legislation website for the current versions. The Regulations are subject to a sunset date under the Subordinate Legislation Act 1994, with a 10‑year life expiring 26 November 2029 unless remade or otherwise addressed (endnotes).

Practical implications of the amendment pattern. The amendment history shows that the device lists and some procedural items are subject to discrete, serial changes through statutory rules. For practitioners this means compliance requires active monitoring of subordinate instrument updates; a device that is prescribed today may be removed or replaced by a later SR. Employers and medical providers must therefore plan procurement and maintenance not only against the current text but against an expectation of periodic updates.

Transitional and revocation effects. Regulation 5 revoked an earlier subordinate instrument (Rail Safety National Law (Limited Accreditation Exemptions) Regulations 2014). The revocation suggests a consolidation of subordinate rules, but the Regulations themselves do not elaborate transitional arrangements; such arrangements, if any, will be in the amending instruments or in the parent Act.

In sum, the amendment history is concentrated on the device lists and some procedural clarifications. The observable pattern is iterative updating by statutory rule, and the Regulations’ versioning metadata identifies the date to which the text has been brought up to date (1 July 2025).

The text of the Regulations and the endnotes supplied do not contain any mention of litigation, court decisions, or judicial consideration of these Regulations. There are no cases named, no judicial interpretations recorded in the instrument, and no references to litigation outcomes in the endnotes or explanatory details provided.

Because these Regulations are procedural and evidentiary, litigation arising from their application would most likely appear in decisions construing the parent Act (for example evidentiary admissibility of certificates or whether procedural non‑compliance affected the legal consequences under the Act). However, the Regulations as supplied contain no recorded litigation history, and no case law is cited.

Practical consequence for practitioners. The absence of a litigation history in the instrument means there is no statutory precedent supplied within this material interpreting the particular phrasing, device lists or specified particulars. Practitioners should therefore:

• Consult the relevant court or tribunal databases and the regulator’s published decisions for any post‑regulatory litigation or administrative determinations that interpret how the prescribed particulars and procedures operate in contested cases.

• Monitor whether courts have considered the rigour of the chain‑of‑custody requirements in these Regulations when evaluating the admissibility of analysis certificates or expert statements in enforcement proceedings under the Act.

• Note that the Regulations’ detailed documentary lists (for certificates and reports) will be prominent in any challenge to the sufficiency of analysis evidence; absence of litigation here simply means any such litigation must be sourced from case law external to this instrument.

In short, there is no litigation material embedded in the provided Regulations. Any discussion of litigation outcomes must therefore be based on external research into decisions applying the Rail Safety National Law Application Act 2013 and these Regulations, which is beyond the text supplied.

The Regulations include a number of precise, technical requirements that can cause compliance failures if operational practices or procurement choices are insufficiently attentive to the text and to subsequent amendments. Below are practical “gotchas” distilled from the Regulations, each grounded in the specific provisions.

Device list is literal and changes. The Regulations list named devices for breath analysis (reg 6) and oral fluid/drug screening (reg 15). That list is amended by statutory rules (see Table of Amendments). If an operator purchases a device that is not on the list or continues using a device removed by amendment, a test performed using that device will not comply with the Regulations’ device prescription. The remedy is ongoing monitoring of SR amendments and procurement aligned to the current published list.

Timing requirement before breath analysis. Regulation 7(a) requires the authorised operator to be satisfied that the worker has not consumed alcohol for at least 15 minutes before analysis. The obligation is subjective in its formulation (“satisfied that”), which can create evidential disputes about how satisfaction was formed. Practically, operators should document steps taken to satisfy themselves (for example a checklist) to avoid later contest about whether the 15‑minute delay was observed.

Mouthpiece and oral fluid collection sealing. Regs 7(b)-(c) and 16(a)-(b) require fresh mouthpieces and oral fluid collection units kept in sealed containers until provided. Failure to store or issue sealed consumables can undermine the formal requirements and call into question sample integrity. Operators should maintain inventory control and log sealed‑pack consumable issues.

Blood sample labelling and preservative details. Regulation 10(1)(c) demands that each blood container bears a label stating the specific anticoagulant and the specific preservative and the name of the laboratory or organisation that prepared the container. Generic labels that do not identify the specific anticoagulant/preservative may not satisfy the prescribed particulars (reg 10(1)(c)(i)-(ii)). Laboratories and medical practitioners must ensure container labels include the full particulars.

Two containers and vacuum/septum sealing for blood. Reg 10(1)(a)-(b) requires two dry containers, each vacuum sealed or sealed with a septum seal. Using a single container or using containers with incompatible sealing methods will not meet the rule. Where samples are taken under s 48ZA, reg 10(3) further requires both containers to be placed and sealed in one plastic sample bag and stored in a locked receptacle. Failure to follow that chain can be fatal to evidentiary admissibility.

Giving samples to an authorised person. Reg 10(2) requires a practitioner who takes blood under enumerated Act provisions to give the sample containers to an authorised person. If such a transfer does not occur (for example because the practitioner gives the container to a non‑authorised third party), the transfer does not comply with the stated requirement and creates chain‑of‑custody risk.

Tamper‑proof locks for urine. Regulation 23(b) requires tamper‑proof locking seals for urine containers. Ordinary screw caps or non‑tamper‑proof lids will not suffice. Practical compliance requires procurement of appropriately certified tamper seals and a documented sealing procedure.

Certificates must include prescribed particulars. The Regulations prescribe the exact content required in certificates (for example reg 12(a)-(f), reg 13(a)-(g), reg 19(a)-(d)). Certificates that omit any of the prescribed particulars are non‑compliant with the Regulations’ stated form. Given that these certificates are the evidentiary instruments used under the Act, any omission is a material risk.

Testing only through the device used to collect the sample. Regulation 16(c) requires that any oral fluid sample be tested using the device or the oral fluid testing unit through which the sample was provided. Testing the sample on a different unit or transferring a swab to a different proprietary module may breach the provision.

Regulatory changes may remove previously acceptable devices. The amendment history shows revocations and substitutions in reg 15 (for example revocation of reg 15(g)-(i) by S.R. No. 11/2024). Operators who rely on a device that is removed will need to switch devices or obtain guidance from the regulator.

No penalties in the Regulations themselves. Because the Regulations do not state the consequences of non‑compliance, some parties may misjudge the legal risk. The enforcement consequences flow from the Act and other applicable laws. Practitioners should not assume the absence of penalties in these Regulations means non‑compliance is inconsequential.

Detailed police assessment form. Regulation 24 sets out an extensive list of observations a police officer must record when assessing drug impairment. Failure by police to record required particulars could affect later proceedings, but the Regulations do not set out remedial steps if the particulars are missing. Operators should preserve all contemporaneous records and seek copies of any police assessments promptly.

Sunset and future remaking. The endnotes indicate these Regulations will sunset 10 years after making on 26 November 2029 (endnotes). Organisations that design long‑term compliance programmes should note this sunset timetable as it may trigger regulatory change or re‑consultation before expiry.

In short, the “gotchas” are largely technical and procedural: device mismatch, labeling insufficiency, container sealing errors, failure to split samples, absence of prescribed certificate particulars, and lapses in chain of custody. Because the Regulations are precise on these points, compliance requires close operational discipline and active monitoring of amendment activity.

Compliance requires an operational checklist translating the Regulations’ prescriptions into day‑to‑day procedures, procurement practices and recordkeeping. The steps below map to the specific regulatory provisions and give practical pointers for rail operators, health providers, analysts and police agencies.

Governance and monitoring

• Nominate a compliance lead responsible for monitoring statutory rule amendments. The device lists in regs 6 and 15 have been amended multiple times (see Table of Amendments). Assign responsibility to keep procurement and testing devices current with the published list on the legislation site (reg 6; reg 15; endnotes).
• Maintain written policies that reference the exact regulatory text (for example reg 7 for breath testing timing and mouthpiece handling, regs 10 and 23 for blood/urine collection and sealing).

Procurement and inventory

• Procure only breath analysers and oral fluid/drug screening devices that are expressly listed in regs 6 and 15, and maintain evidence of device make/model/serial number (reg 8(a)). If substitutions occur by SR, phase out non‑prescribed devices promptly.
• Stock sealed, single‑use mouthpieces and oral fluid collection units and maintain sealed packaging until issued (reg 7(b)-(c); reg 16(a)-(b)). Keep inventory records showing original sealed‑pack receipt and date/time of issue.

Operational test procedures

• Breath testing: do not require a breath sample until the authorised operator is satisfied the worker has not consumed alcohol for at least 15 minutes (reg 7(a)). Implement a documented waiting policy and a checklist that records the start and end of the waiting period and how “satisfaction” was reached.
• Use a fresh mouthpiece for each worker and issue only mouthpieces kept in sealed containers until use (reg 7(b)-(c)). Record mouthpiece serial or batch numbers where feasible.
• Oral fluid testing: provide a fresh oral fluid collection unit per worker and use only units kept in sealed containers until issue (regs 16(a)-(b); 17(a)-(b)). Test or analyse the sample on the same device/unit through which it was provided (reg 16(c)).

Sample collection, sealing and labelling

• Blood: if taking blood, ensure two dry containers are used, each containing approximately equal amounts (reg 10(1)(a)). Each container must be vacuum sealed or sealed with a septum seal (reg 10(1)(b)). Each container must bear labels stating the specific anticoagulant and preservative and the name of the chemist/lab/pharmaceutical organisation that prepared the container (reg 10(1)(c)(i)-(ii)). Attach a label with practitioner signature, date/time and worker identification (reg 10(1)(d)(i)-(iii)). If the sample is taken under section 48ZA, place both containers in one plastic sample bag and deposit in a locked receptacle at the place taken (reg 10(3)).
• Urine: collect urine in clean, dry, previously unused containers (reg 22). Split into two dry containers containing approximately the same amount and fit each container with a tamper‑proof locking seal (reg 23(a)-(b)). Label containers with collector signature, date/time and worker identification details (reg 23(c)(i)-(iii)).
• Oral fluid: label each sample with the name and signature of the authorised person receiving it, date/time and worker identification (reg 18(a)-(c)).

Chain of custody and transfers

• Where required by the Act or the Regulations (for example reg 10(2)), ensure the practitioner transfers blood sample containers directly to an authorised person and document the transfer with signatures and time stamps. Keep a log of transfers and custodial steps, including locked receptacle storage details.
• Preserve tamper seals and their removal records. Maintain CCTV or contemporaneous witness entries for sample handovers where practicable.

Certificates, analyst and expert particulars

• Use templates that replicate the prescribed particulars exactly. For example, for breath analysis certificate particulars see reg 8(a)-(h); for blood analysis certificates see regs 11-14; for oral fluid certificates see regs 19-21. Certificates must state the analyst’s approval status and the method of analysis and include signatures and dates (regs 12-13, 20).
• Ensure approved analysts and experts maintain qualifications and that certificates include the statement that the analyst/expert is an approved analyst/expert within the meaning of the relevant Act section (for example reg 12(b), reg 13(a), reg 14(a) and reg 21(a)).

Recordkeeping and retention

• Keep complete records of each test and sample, including the instrument serial number, sample number, test location, operator surname, instrument self‑test and zero test results, and date/time (reg 8(a)-(h)).
• For police impairment assessments, ensure copies of the assessment (reg 24) are obtained and retained, since the regulation prescribes an extensive list of particulars police must record that will be relevant for employer investigations or administrative processes.

Training and accreditation

• Train authorised persons on the 15‑minute abstention requirement, proper mouthpiece and oral fluid unit handling, sample splitting and sealing procedures, labelling particulars and transfer to authorised persons (regs 7, 16, 10, 18, 23).
• Confirm that medical practitioners and approved health professionals who collect blood or urine are aware of labelling, sealing and transfer duties (regs 9, 10, 22-23).
• Verify that approved analysts and experts are properly accredited and maintain current approval status required by the Act, and that their certificates meet reg 12-14 and reg 20-21 requirements.

Audit and quality assurance

• Implement periodic audits of testing operations, chain of custody, seal integrity, and certificate completeness against the precise lists in the Regulations.
• Where a device model is added or removed in an amendment, run a compliance audit to ensure systems reflect the amended device list.

Legal and regulatory liaison

• Keep a regular reporting line to the rail safety regulator and consult in advance if new device models are to be trialled. Because the Regulations name devices precisely, earlier consultation reduces risk of non‑compliance if testing technology changes.
• Retain legal counsel for advice on evidentiary sufficiency where historic tests are challenged on procedural grounds.

Miscellaneous practicalities

• Prepare contingency plans for device failure, including fallback devices that are on the prescribed list.
• Maintain locked receptacle(s) and access controls where the Regulations require storage of samples at the place taken (reg 10(3)).
• Keep originals of signed certificates and maintain secure electronic backups.

Following the Regulations closely and documenting every step is the most practical compliance strategy. The Regulations prescribe precise particulars and procedures; deviation is observable and creates legal and evidentiary risk. Regular training, device inventory control and document template compliance are the core operational responses.
