Radiocommunications (Spectrum Re-allocation — 26GHz Band) Declaration 2019

The instrument rests on several core technical and legal concepts that determine scope and operation. Each is defined or invoked in the text and must be read together with the referenced provisions of the Radiocommunications Act 1992.

• Spectrum re-allocation. The instrument declares that particular parts of the spectrum are subject to re-allocation under Part 3.6 of the Act (s 5(1)-(2)). The phrase "subject to re-allocation under Part 3.6" triggers the Act’s re-allocation regime. The instrument itself does not recite the procedural steps under Part 3.6; it designates frequency ranges and the mechanism under Subdivision B of Division 1 of Part 3.2 for issuing spectrum licences (s 5(1)(a), s 5(2)(a)).

• Frequency intervals and inclusivity. The instrument contains a specific interpretative rule about a "part of the spectrum": it includes all frequencies greater than the lower frequency up to and including the higher frequency (s 4(2)). This produces an interval notation of (lower, higher], that is, exclusive at the lower end and inclusive at the upper end. Applied to the instrument’s ranges, 25.1-27.0 GHz means frequencies greater than 25.1 GHz up to and including 27.0 GHz, while 27.0-27.5 GHz means frequencies greater than 27.0 GHz up to and including 27.5 GHz (s 5(1)-(2) and s 4(2)). The practical implication is that the numeric frequency 25.1 GHz is excluded from the first declared range and 27.0 GHz is included in the first but excluded from the second.

• Allocation mechanism specified. The instrument expressly confines the re-allocation mechanism to issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 of the Act (s 5(1)(a), s 5(2)(a)) and cites s 153L of the Act. Those provisions in the Act will govern the form of the licences, the allocation method, any payment or bid mechanisms, and procedural rules. The instrument does not alter those Act provisions; it points the re-allocation to that statutory pathway.

• Spatial definition via HCIS. Geographic scope is specified by named areas that are to be "ascertained as the composite of the areas, described using identifiers from the Hierarchical Cell Identification Scheme" listed in the table (s 5(4)). The instrument defines "HCIS" as "the Hierarchical Cell Identification Scheme used as a part of the Australian Spectrum Map Grid 2012 document published by the ACMA on its website, as the document existed at the time this instrument was made" (s 4(1)). That fixes the mapping reference to a historical snapshot rather than to a moving, updated online resource.

• Timing terms: re-allocation period and re-allocation deadline. The instrument sets temporal boundaries: re-allocation period is a three-year period beginning at the start of the 21st day after commencement; the re-allocation deadline is the end of the day before the second anniversary of the re-allocation period’s start (s 5(3)). These defined times interact with the Act’s Part 3.6 processes; any steps under the Act that depend on those parameters will follow the instrument’s definitions.

• Commencement and legal effect. The instrument commences the day after it is registered (s 2). The table in s 2 indicates that the entire instrument takes effect from that date. The notes in s 2 make clear that the marked column in the commencement table is not part of the instrument; that is a drafting convention about published versions and metadata (s 2(2)).

• External ACMA resources referenced but not incorporated. The instrument’s notes point to ACMA’s website for the ASMG/HCIS descriptive document and a conversion tool "as the document existed at the time this instrument was made" (Notes to s 5). Those external references are for stakeholder convenience and to clarify how the named areas were constructed. The instrument, however, includes the HCIS identifiers directly in the table (s 5(4)).

Each of these concepts is textual and self-contained in the instrument. The instrument does not itself create licence terms, application procedures, fees, or penalties; those are matters of the Act and the subordinate instruments and policies made under the Act. The declaration ties specific frequencies and specific HCIS-coded geographic cells to the statutory re-allocation mechanism and fixes a defined timeframe in which that mechanism will operate.

The instrument designates who is within its scope by reference to frequency and geography; it does not list stakeholders by industry nomenclature. The direct legal effect falls on the spectrum segments and the HCIS-coded geographic cells named in the instrument, with consequential effects for persons and entities that hold, use, seek or plan to use radiofrequency resources in those segments and places.

• Spectrum licence holders, incumbents and rights-holders. Any current holder of a spectrum licence that confers rights in the declared frequency ranges in the listed HCIS areas will be affected because the instrument places those frequencies under Part 3.6 re-allocation (s 5(1)-(3)). The instrument does not itself vary or cancel licences; rather it triggers the Act’s re-allocation regime, which may include processes under the Act that affect licence allocation and tenure. The exact statutory consequences for incumbents are determined by Part 3.6 of the Act and any processes ACMA follows under Subdivision B of Division 1 of Part 3.2 (s 5(1)(a), s 5(2)(a)).

• Prospective spectrum users and bidders. Parties interested in obtaining spectrum licences in the declared bands over the listed HCIS areas will find that their opportunities are regulated by this declaration because it sets the geographic and frequency scope, and it ties allocation to the Act’s Subdivision B process (s 5(1)-(4)). Those parties must act within the re-allocation period and be mindful of the re-allocation deadline defined in s 5(3).

• Equipment and network planners. Engineers and planners responsible for deploying radio equipment operating in the declared frequencies need to account for the declared ranges and the inclusive/exclusive endpoints set by the instrument (s 4(2); s 5(1)-(2)). A device configured to transmit exactly at a boundary frequency such as 25.1 GHz is technically outside the first declared range because the lower bound is exclusive; 27.0 GHz is within the first declared range but not the second (s 4(2), s 5(1)-(2)). That can affect device certification, interference assessments and deployment timing.

• Localised geographic operators. The instrument identifies 29 named areas across Australia, each constituted by a composite list of HCIS identifiers (s 5(4)). Entities operating wireless services that are defined by those HCIS areas, for example base stations, point-to-point links, or local coverage services, will be within scope where their operational footprint intersects the listed HCIS cells. The instrument fixes the HCIS snapshot at the time it was made (s 4(1)), so the exact mapping of these areas is determined by that snapshot.

• ACMA’s operational and regulatory apparatus. The Australian Communications and Media Authority is the actor that will implement allocations under the cross-referenced Act provisions. The instrument invokes ACMA’s statutory powers to carry out re-allocation under Part 3.6 and allocation under Subdivision B of Division 1 of Part 3.2 (s 3; s 5(1)(a), s 5(2)(a)). ACMA’s administrative actions and timelines will be shaped by the re-allocation period and deadline fixed in s 5(3).

• Contractual counterparties and supply chains. Where contracts (for example, tower leasing, equipment procurement, spectrum leasing, or services delivery) depend on the availability or exclusivity of radiofrequency resources in the specified bands and HCIS areas, those contractual interests may be indirectly affected by an ACMA re-allocation process that flows from this declaration. The instrument’s legal text itself does not change contracts, but it will be the legal trigger for processes under the Act that may affect spectrum availability.

The instrument does not itself name commercial sectors such as telecommunications carriers, enterprises providing fixed wireless access, or the broadcasting sector. Any such characterisation is an application of the instrument’s frequency and geography to real-world industry deployments. The safe legal takeaway from the instrument’s text is that those whose operations either use, occupy, interfere with or plan to use frequencies above 25.1 GHz and up to 27.5 GHz inside any of the HCIS cells listed in s 5(4) should consider themselves affected because the declaration brings those frequencies and places into the Act’s re-allocation regime.

The declaration establishes limited, but legally consequential, duties and rights by reference to the Act. The instrument itself sets boundaries and cross-references the statutory machinery that creates particular rights and duties. The following are the principal legal points in the instrument about duties and rights.

• ACMA’s enabling authority and duty to act under the Act. The instrument is made under subsection 153B(1) of the Radiocommunications Act 1992 (s 3). That means the declaration is an exercise of the statutory power to declare parts of spectrum subject to re-allocation. The exercise creates a statutory condition that Part 3.6 applies to the identified frequencies and areas. The duties imposed on ACMA in taking steps under Part 3.6 are located in the Act, not the instrument.

• Allocation mechanism and rights to spectrum licences. The instrument specifies that re-allocation is to be effected by issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 of the Act (s 5(1)(a), s 5(2)(a)). That cross-reference is important because Subdivision B and s 153L of the Act will define how licences are issued, what rights a spectrum licence confers, the conditions attached, and how applications are to be processed. The instrument does not create those licence terms; it channels future allocations into the statutory pathway.

• Temporal rights and duties anchored to the re-allocation period and deadline. The re-allocation period and deadline are defined in s 5(3). Those temporal definitions will interact with any statutory time constraints or duties in the Act about notification, consultation, application windows or deadlines embedded in Part 3.6 and Subdivision B procedures. Practically, the existence of a re-allocation deadline within the re-allocation period is the instrument’s chosen time-limiting mechanism and will shape the timing of any duties on ACMA or applicants under the Act.

• Geographic ascertainment duty. A practical duty for stakeholders arises from the instrument’s method for ascertaining the named areas. The instrument requires the named area to be ascertained as the composite of the HCIS-identifiers listed in s 5(4). That means affected persons must identify whether particular premises or coordinates fall within those HCIS cells. The instrument points to ACMA’s ASMG/HCIS documents and a conversion tool in its notes (s 5 Note 1 and Note 2), and it fixes the HCIS snapshot (s 4(1)). The onus is therefore on operators to map their footprint to the listed HCIS identifiers to determine if they are inside the declared area.

• Interpretative duty on frequencies. Section 4(2) creates a strict interpretative rule for what a "part of the spectrum" means, i.e. (lower, higher] frequency ranges. That rule is binding for interpreting the instrument and imposes a duty on stakeholders to check whether their exact operating frequencies are within or outside the ranges. This is a precise technical duty because boundary frequencies are treated asymmetrically.

• No express new compliance obligations or penalties in the instrument. The declaration does not itself impose specific compliance obligations (such as notice requirements to ACMA) or penalties; those are matters for the Act and any spectrum licences subsequently issued. For enforcement measures and specific licence conditions, stakeholders must refer to the Act and any licence instrument ACMA issues under Subdivision B of Division 1 of Part 3.2 (s 5(1)(a), s 5(2)(a)).

In short, the instrument’s core legal effect is to place particular frequencies and geographic cells into the statutory re-allocation pathway defined by the Act. That confers potential future rights (to be allocated spectrum licences) and creates duties by reference (for ACMA to follow Part 3.6 processes and for stakeholders to map their operations to the listed HCIS cells and comply with any licence conditions subsequently imposed). The precise content of rights and duties that matter for day-to-day compliance and enforcement lies in the Act and in any licences issued under it; the instrument establishes the scope and timing for those statutory processes (s 5(1)-(4)).

The instrument itself does not prescribe penalties or enforcement mechanisms. It is a declaratory instrument that brings specified spectrum and places within the statutory re-allocation regime of the Radiocommunications Act 1992. The practical enforcement and penalties that may affect persons in practice will therefore arise from the Act and from any spectrum licence terms issued under Subdivision B of Division 1 of Part 3.2, which the instrument has specified as the allocation mechanism (s 5(1)(a), s 5(2)(a)).

Relevant points drawn from the instrument’s structure include:

• No penalties in the declaration. The text contains no offence provisions, monetary penalties or compliance notices. There are no licence conditions declared in the instrument itself. The instrument is not a licence and does not identify specific enforcement actions (see the whole instrument).

• Enforcement is by reference to the Act. Because the instrument triggers Part 3.6 re-allocation and references Subdivision B of Division 1 of Part 3.2 and s 153L of the Act, any statutory offences, infringements, civil remedies, or enforcement powers available to ACMA will be those provided by the Radiocommunications Act 1992 and any subordinate instruments made under it. Stakeholders must consult the Act for the catalogue of offences, pecuniary penalties, and compliance powers (the instrument’s s 3 and s 5 cross-references).

• Spectrum licence enforcement. Once ACMA issues spectrum licences under Subdivision B, the terms, conditions and enforcement provisions attached to those licences will govern authorised use. Breach of a licence condition, unauthorised use, causing interference contrary to licence conditions, or failure to comply with directions under the Act will be dealt with under the Act’s enforcement framework, not this declaration.

• Administrative process timelines. The instrument sets a re-allocation period and a re-allocation deadline (s 5(3)). Any enforcement or compliance consequences that turn on those timelines will derive from the Act’s procedures. For example, if the Act requires particular notices, application windows or deadlines to be met within the re-allocation period, failure to satisfy those requirements may have administrative consequences under the Act.

• Mapping and ascertainment disputes. Since geographic scope is determined by HCIS identifiers listed in s 5(4) and the instrument fixes the HCIS snapshot (s 4(1)), disputes about whether particular premises fall inside a named area will turn on application of that HCIS snapshot and ACMA’s mapping files. The instrument’s Notes indicate that ACMA’s ASMG/HCIS documents and conversion tools were, at the time of making, published on ACMA’s website. The instrument does not itself provide dispute-resolution procedures for such ascertainment queries; questions of scope and enforcement again will be resolved under the Act’s mechanisms and ACMA’s administrative practice.

Practical consequence: any person concerned about enforcement exposure must look beyond this declaration to the Radiocommunications Act 1992 and to any licence instruments that ACMA issues under the statutory pathways called up by this declaration.

The instrument is an exercise of statutory power under the Radiocommunications Act 1992 and therefore operates within, and interacts directly with, that Act. Its interactions with other laws are principally those that flow from that relationship.

• Direct interaction with the Radiocommunications Act 1992. The instrument is expressly made under subsection 153B(1) of the Act (s 3). It brings parts of the spectrum into re-allocation under Part 3.6 of the Act (s 5(1)-(2)) and confines the method of re-allocation to issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 (s 5(1)(a)-(b), s 5(2)(a)-(b)), with a cross-reference to s 153L of the Act. In practical terms, the instrument is a declaratory act that hands to the Act the task of setting out the specific allocation, licence terms, fees, and enforcement.

• Relation to ACMA’s administrative rules and instruments. The instrument relies on ACMA’s ASMG/HCIS spatial framework (s 4(1) and notes to s 5). ACMA’s own instruments, technical publications, and spatial datasets are therefore functionally relevant to application of this declaration. The instrument fixes the HCIS snapshot to the version in force at the time the instrument was made, therefore interactions with later ACMA updates are constrained: changes to the HCIS after the instrument’s date do not alter the areas as specified in the table (s 4(1)).

• No direct interaction with other Acts or statutory regimes in this instrument. The declaration does not mention other Commonwealth or State laws, for example planning regimes, environmental laws, telecommunications consumer law, competition law or spectrum-related international agreements. That does not mean those regimes are irrelevant in practice; it means this instrument itself operates within the Act and that any interface with other legal regimes will occur through the activities that follow under the Act , for example, licence-granting, network deployment, planning approvals and contractual disputes. Those interfaces are outside the text of this instrument.

• Property and contract law. The instrument does not create or extinguish property rights in real estate or in other legal forms; it creates the statutory condition for re-allocation under the Act. The effect on contractual arrangements that depend on spectrum or on the availability of certain radio frequencies will be determined by the actions ACMA takes under the Act and by private contract law, but those consequences are not spelled out in this declaration.

• Administrative law and judicial review. Because the instrument is an exercise of statutory power, decisions taken by ACMA under the Act that flow from this declaration will be subject to the usual administrative law disciplines, including obligations of procedural fairness, statutory discretion and potential judicial review where applicable. The instrument itself creates the framework for ACMA action but does not displace judicial oversight of administrative action taken under the Act.

• Technical standards and electromagnetic compatibility. The instrument relies on HCIS mapping and frequency definitions. Compliance with technical standards, equipment certification or electromagnetic compatibility requirements may be required under other instruments or under ACMA’s regulatory framework, but this instrument does not itself specify technical standards. Persons should look to ACMA and the Act for the detailed technical regulatory rules that will interact with this declaration.

In summary, the instrument is tightly focused: its legal work is to designate frequencies and places for re-allocation under the Radiocommunications Act 1992 and to fix the temporal parameters for that re-allocation. The substantive interactions with other laws and administrative regimes will be mediated by ACMA’s actions and the Act’s provisions. Stakeholders should therefore read this declaration in conjunction with the Radiocommunications Act 1992, ACMA instruments and technical guidance documents.

The instrument as presented includes its own commencement table and a drafting note about the table’s status. The text indicates that the commencement information in the instrument relates only to the provisions as originally made (s 2 preamble). Relevant points in the instrument itself about amendment history and persistence are as follows.

• Original instrument and commencement. The instrument’s commencement table in s 2 states that the whole instrument commences "the day after this instrument is registered." The table is explicitly the instrument’s original commencement information (s 2(1) and the commencement table). The instrument contains an explicit note that the table relates only to provisions as originally made and "will not be amended to deal with any later amendments of this instrument" (s 2).

• Column 3 metadata not part of the instrument. Section 2(2) clarifies that any information in column 3 of the commencement table is not part of the instrument and that information may be edited in published versions. That is a drafting detail about the public presentation of metadata and does not alter substantive effect.

• HCIS snapshot fixed in time. Section 4(1) defines HCIS as the HCIS used in the Australian Spectrum Map Grid 2012 document "as the document existed at the time this instrument was made." That is an explicit fixing of the spatial definition to a historical snapshot. It prevents later updates to the ASMG/HCIS document by ACMA from altering the meaning of the named areas in this instrument unless the instrument itself is amended.

• The instrument includes no recorded amendments within its text. There are no amendment clauses in the instrument text provided, nor is there a schedule indicating prior variations. The instrument’s own notes and the final words of s 2 indicate how published metadata may be edited, but they do not show an amendment history to the operative content. As drafted, the instrument’s operative content is the original made text.

• Expect amendment only by fresh instrument. Any substantive change to the declared frequencies, the named areas, timing or allocation mechanism would require a further exercise of statutory power under the Act and publication of a new or amended declaration. The instrument itself contains no mechanism for unilateral future amendment; it is a static declaration until replaced or amended under the Act.

Practitioners should, when advising clients, confirm the instrument’s currency on the Federal Register of Legislation or ACMA publications, because the instrument text prescribes its own commencement but does not list subsequent amendments. The instrument’s internal notes caution that some published metadata columns are not part of the instrument; do not rely on column 3 items as authoritative law (s 2(2)). For definitive amendment history, consult the official legislative register where any formal amendment instruments would be recorded.

The instrument contains no references to, and the text records no, litigation history. It is a declaratory instrument that establishes a scope for re-allocation. The document itself does not list legal challenges, judicial determinations, or administrative review outcomes.

Practical implications for litigators and advisers:

• No cases named or identified in the instrument. The instrument does not name any judicial decisions, nor does it include examples of case law. It is silent on disputes that may arise from its operation.

• Potential for future dispute. Because the instrument defines frequency boundaries with inclusive/exclusive endpoints (s 4(2)) and assembles geographic scope via HCIS identifiers fixed to a snapshot (s 4(1) and s 5(4)), foreseeable categories of future disputes that could lead to litigation or review include boundary questions, the mapping of particular premises to HCIS cells, and challenges to ACMA processes in implementing the re-allocation under the Act. None of those potential disputes are recorded as having occurred in the instrument.

• Administrative review and judicial oversight. Actions taken by ACMA under the Radiocommunications Act 1992 in consequence of this declaration (for example decisions to issue, vary, or refuse licences, or directions made under the Act) will sit within the ordinary administrative law landscape, with potential for merits review where available under the Act and judicial review in respect of legal errors. The instrument itself makes no pronouncements on the availability of review; those questions are governed by the Act and general administrative law.

• What to check. For any report on litigation history you should check the public law registries, ACMA determinations, tribunal decisions, and court records after the date of the instrument to discover whether decisions made under this declaration have been challenged. The instrument itself gives no hint of prior litigation.

In short, the instrument is silent on litigation. Practitioners should not assume absence of disputes from silence; rather, they should expect that litigation or administrative review could arise from subsequent ACMA action under the Act and should check official records for developments post-dating the instrument.

The instrument contains precise technical drafting choices that can produce traps for the unwary. The following are concrete, source-grounded "gotchas" to watch for, each referenced to the relevant provision.

• Frequency interval inclusions and exclusions (s 4(2) and s 5(1)-(2)). The interpretative rule in s 4(2) means that declared frequency parts are (lower, higher] intervals. Practically, 25.1 GHz is not included in the declared 25.1-27.0 GHz part because the lower bound is exclusive. A device tuned to exactly 25.1 GHz sits outside the first declared range. Conversely, 27.0 GHz is included in the 25.1-27.0 GHz declaration but excluded from the 27.0-27.5 GHz declaration because the latter only includes frequencies greater than 27.0 GHz up to 27.5 GHz. This asymmetric inclusion at numeric boundaries is a common source of operational confusion; the instrument’s s 4(2) makes this explicit.

• HCIS snapshot is fixed to the version at the instrument date (s 4(1)). The instrument defines "Hierarchical Cell Identification Scheme" to mean the HCIS used in the ASMG 2012 document "as the document existed at the time this instrument was made." That is not a live reference to the current ACMA website HCIS. If ACMA subsequently updates the ASMG/HCIS, the instrument’s named areas remain tied to the historical snapshot. Parties who rely on current ACMA spatial data must confirm whether later ACMA maps match the snapshot. This is important for mapping premises or coordinates to the listed HCIS identifiers in s 5(4).

• The named areas are defined as composites of HCIS identifiers (s 5(4)). The instrument does not provide coordinate polygons or street-level descriptions; it lists HCIS identifiers. Practitioners must convert those identifiers to spatial data using the HCIS/ASMG materials to determine whether particular property or coverage footprints fall within a named area. The instrument’s own notes point to a conversion tool on ACMA’s website that, "at the time this instrument was made", was available; reliance on an online tool requires verification because the instrument fixes the HCIS snapshot and the public tool may change.

• Timing quirks: start of the 21st day after commencement; deadline falls inside the re-allocation period (s 5(3), s 2). The re-allocation period begins at the "start of the 21st day after this instrument commences" and lasts three years (s 5(3)(a)). The re-allocation deadline is the "end of the day before the second anniversary of the start of the re-allocation period" (s 5(3)(b)). That structure means the re-allocation deadline falls roughly two years after the re-allocation period start, i.e. inside the three-year period. Practitioners must calculate three separate dates relative to registration and commencement: (i) registration date; (ii) instrument commencement (the day after registration) per s 2; and (iii) the start of the 21st day after commencement per s 5(3). Miscalculating those offsets can produce missed application windows or incorrect assumptions about when obligations or rights begin.

• Column 3 metadata is not part of the instrument (s 2(2)). The instrument’s commencement table has three columns. Section 2(2) expressly states that any information in column 3 is not part of the instrument and may be edited on published versions. Commercial and legal teams should not treat column 3 metadata on an online display as law; always rely on the operative columns as shown and on the register.

• The instrument does not itself specify allocation method details (s 5(1)(a), s 5(2)(a)). The declaration directs that allocation is by issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 of the Act, and it references s 153L of the Act. The instrument does not itself state whether allocations will be by auction, merit-based allocation, or administrative processes. That means that to understand fees, bidding processes, eligibility criteria or conditions of licence, interested parties must consult the Act, ACMA’s allocation rules and any public notices ACMA issues. Assuming a particular allocation mechanism from the declaration alone is a mistake.

• Large and fractured list of HCIS identifiers (s 5(4)). The table in s 5(4) lists dozens or hundreds of HCIS identifiers across 29 named areas. Mapping and operationalising this table requires careful use of spatial conversion tools and validation against ACMA’s HCIS snapshot. Failure to map correctly can lead to incorrect risk assessments, misdirected infrastructure rollouts, or incorrect licence applications.

• No licence protection or grandfathering language in the declaration. The instrument does not speak to whether existing licences are to be varied, surrendered, compensated or otherwise treated. Any protections or transitional arrangements would derive from the Act’s Part 3.6 processes or ACMA determinations, not from this instrument itself. Stakeholders should not assume the existence of transitional protections in the absence of express Act provisions or ACMA decisions.

These are concrete drafting features and operational points contained in the instrument. Each requires deliberate attention from spectrum-using entities, as small misreadings of the numeric interval endpoints or incorrect mapping of HCIS identifiers could produce materially different legal and commercial positions.

Compliance with this declaration is functionally compliance with the re-allocation process under the Radiocommunications Act 1992 as it applies to the declared frequencies and HCIS areas. The instrument itself imposes no licence-level obligations, but it creates discrete steps stakeholders should take to protect operational and legal positions. The following checklist is founded on the instrument’s provisions (see s 2, s 3, s 4, s 5) and is directed at operators, counsel, compliance officers and technical advisers.

1. Determine whether you are in scope by mapping frequencies and geography

   • Confirm whether any current operations or planned deployments use frequencies strictly greater than 25.1 GHz and up to 27.5 GHz (bearing in mind s 4(2)’s (lower, higher] rule). For example, confirm whether equipment operating at exactly 25.1 GHz is inside the declared band (it is not).
   • Map your operational footprint against the HCIS identifiers listed in s 5(4). Use the HCIS snapshot defined in s 4(1) , that is the HCIS as it existed at the date the instrument was made. Do not assume that current ACMA online HCIS maps after the instrument date are identical; verify the snapshot that corresponds to the instrument.

2. Check commencement and timing windows

   • Consult the Federal Register of Legislation or the registered instrument to determine the registration date. The instrument commences the day after registration (s 2).
   • Calculate the start of the re-allocation period as the start of the 21st day after commencement (s 5(3)(a)). Note that the re-allocation deadline is the end of the day before the second anniversary of that start (s 5(3)(b)). Record these dates in your project timeline to ensure you meet any application or participation windows that ACMA establishes in consequence.

3. Monitor ACMA for allocation procedures and notices

   • The instrument points re-allocation to allocation under Subdivision B of Division 1 of Part 3.2 of the Act and cross-references s 153L (s 5(1)(a), s 5(2)(a)). ACMA will publish the procedural steps, application forms, eligibility criteria, and any fees or bidding rules. Register for ACMA announcements and subscribe to relevant ACMA publications to avoid missing notices tied to the re-allocation period and the deadline.

4. Prepare documentation and technical evidence

   • If you intend to apply for a spectrum licence, prepare technical submissions demonstrating how your proposed use conforms to spectrum planning, interference mitigation, and any technical constraints ACMA requires. Make sure frequency endpoints are precise and reflect the inclusive/exclusive endpoints in s 4(2).

5. Engage legal and technical advisers early

   • Because the declaration fixes HCIS by historical snapshot (s 4(1)) and uses HCIS identifiers rather than coordinates (s 5(4)), technical mapping is not trivial. Engage RF engineers and GIS specialists who can convert HCIS identifiers to shapefiles and overlay them on property or coverage maps.
   • Legal advisers should prepare to advise on the allocation methods ACMA adopts under Subdivision B and on the Act’s provisions that determine licence conditions, enforcement and remedies.

6. Review contractual commitments

   • Examine leases, supplier contracts, procurement orders and service agreements that depend on spectrum availability in the declared bands and HCIS areas. If re-allocation might affect your ability to perform contracts, consider risk mitigation steps such as renegotiation, notice to counterparties, or insurance.

7. Check transitional or incumbent treatment under the Act

   • The instrument does not state whether incumbents will be protected or compensated. Consult the Radiocommunications Act 1992 to see what rights, if any, existing licence-holders have under Part 3.6, and monitor ACMA’s public materials for any transitional measures or compensation frameworks it may adopt in implementing the re-allocation.

8. Prepare for potential disputes and administrative review

   • Keep records of any technical assessments, mapping outputs and communications with ACMA. If disagreements arise about whether a premise falls inside a listed HCIS cell, or if ACMA makes a decision adverse to your interests under the Act, those records will support any administrative review or judicial review proceedings. The instrument itself does not displace ordinary administrative law remedies.

9. Use the instrument’s notes to locate ACMA resources but verify snapshots

   • The instrument notes the existence of ACMA ASMG/HCIS materials and a conversion tool as they existed at the time of the instrument (s 5 notes). Use these resources to convert HCIS identifiers to spatial files, but verify you are using the correct archived snapshot consistent with s 4(1).

10. Plan deployment to account for licence allocation uncertainty

    • Because the instrument directs allocation under statutory mechanisms but does not define the allocation format, do not assume a particular commercial outcome. If your business case depends on a firm allocation of spectrum in the declared bands and areas, consider staged investment, conditional procurement, or contractual clauses that allow flexibility until ACMA’s allocation result is known.

Taken together, compliance requires attention to mapping, timing, monitoring of ACMA processes, and legal-technical preparedness. The instrument is a trigger that changes the regulatory context for specified spectrum and places rather than a self-contained licensing instrument, so the key compliance actions involve tracing the declaration to ACMA’s subsequent steps under the Radiocommunications Act 1992 and ensuring your technical and contractual positions are aligned with those steps.
