Radiocommunications Spectrum Marketing Plan (700 MHz unallocated lots band) 2016

This instrument is concentrated on several interlocking concepts that determine how spectrum access and use will be governed for the specified unallocated portions of the 700 MHz band. The main concepts are: the lot structure, allocation mechanism, licence content and term, core technical constraints and exceptions by agreement, transmitter registration, and the region definition used for geographic scope.

Lot structure and spectrum pairing

• The instrument defines two lot sizes which are paired lower‑and‑upper frequency blocks (Schedule 1 Table 1). The 10 MHz lot comprises 738-748 MHz (lower) and 793-803 MHz (upper). The 5 MHz lot comprises 733-738 MHz (lower) and 788-793 MHz (upper). Each lot’s bandwidth refers to each half of the frequency pair and the duplex separation is 55 MHz (Schedule 1, Notes). These paired blocks are the units the auction and allocation determination will reference for bids and assignment.

Allocation mechanism and pre‑determined price option

• The primary allocation method specified is a simple clock auction (s 10(1)), meaning the detailed auction mechanics, bid rules, activity requirements, stopping criteria and payment calculation are governed by the allocation determination and related auction documents (s 13; note to s 10). The ACMA retains a power to allocate lots for a pre‑determined price without conducting an auction provided specific timing conditions are met (s 10(2)); Part 5 of the allocation determination governs the pre‑determined price option (s 10(2) note).

Licence issue, payment and guarantees

• Licences will be issued once required payments are received and any required bank guarantees for delayed payments are provided (s 15(1)-(3)). The instrument distinguishes between pre‑determined price payments and auction winning prices, and it recognises options to pay either upfront or by instalments; where instalments are used, a delayed payment bank guarantee must be provided before licence issue (s 15(2)-(3)). Once the first instalment or first auction instalment is paid, that payment and any subsequent instalments are non‑refundable (s 15(4)).

Term and timing

• Each licence issued under the instrument will commence on 1 April 2018 and expire on 31 December 2029, unless resumed or cancelled under the Act (s 16). This fixed term ties holders to a defined planning horizon for network roll‑out and asset amortisation.

Core conditions and technical limits

• The instrument mandates that each licence include the statutory core conditions from s 66 of the Act (s 17). The instrument then specifies how those conditions are to be determined: geographic area = the National Region (s 18(1)(b), Schedule 2); emission limits outside the geographic area = Schedule 3 (s 18(2)); emission limits outside parts of the spectrum = Schedule 4 (s 18(3)). Schedule 3’s base emission limit is 47 dBm EIRP per 30 kHz outside the geographic area (Schedule 3 Part 1(2)), with compliance to be determined at a confidence level of not less than 95% (Schedule 3 Part 1(3)). Schedule 4 sets multiple numeric ceilings for non‑spurious and spurious emissions across offsets and frequency ranges (Schedule 4 Tables 1-7) and contains special limits for “affected areas” to protect services such as television.

Registration, interference management and coordination

• Licences will prohibit operation of a transmitter unless registration requirements under Part 3.5 of the Act are met (s 20(1)). The ACMA explicitly notes that it may refuse registration if operation could cause an unacceptable level of interference and that the Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012 will be used for certification under subsection 145(3) of the Act (s 20 notes). The instrument points to the Radiocommunications Advisory Guidelines (Managing Interference to Receivers/Managing Interference from Transmitters - 700 MHz Band) 2012 (the advisory guidelines) as the coordination mechanism for services operating under these licences (s 22).

Trading, third‑party use and agreements

• Third‑party use and assignment of licences are permitted subject to the statutory divisions and to the ACMA’s trading rules (s 25-26). The instrument permits licence holders to enter written agreements with frequency‑adjacent and area‑adjacent licensees that can specify alternative maximum emission limits so long as those limits do not exceed the base limits in Schedule 3 or Schedule 4 caps (s 27; Schedule 3 Part 2(3)-(4); Schedule 4 Part 2(3)-(4)).

Region and mapping

• The geographic scope for licences is the National Region described by a large list of HCIS identifiers using the Australian Spectrum Map Grid (ASMG) HCIS scheme (Schedule 2). The instrument warns that the pictorial map is indicative only and participants should make their own inquiries (Schedule 2 note).

Interplay with other instruments

• The instrument is heavily cross‑referenced: it defers auction mechanics and applicant material to the allocation determination and applicant information package (ss 10, 13), emission certification to an earlier Unacceptable Levels of Interference Determination, and trading/registration mechanics to other determinations and the Act (s 24-26 notes). This means compliance requires reading a suite of instruments, not only this plan.

Confidence and measurement standards

• Several provisions require measurement and estimation to be performed in accordance with “good engineering practice” and require specified confidence levels (95% for certain emission limit determinations, see Schedule 3 Part 1(3) and Schedule 4 Part 2(2)). Definitions give technical meaning to terms such as horizontally radiated power, true mean power, occupied bandwidth and maximum true mean power (s 5 definitions).

These concepts together create a framework in which spectrum access is allocated via auction (or pre‑determined sale), licences are issued once payment/guarantees are secured, and use is constrained by detailed emission limits and registration requirements, with room for negotiated adjustments among affected licensees.

This instrument creates obligations and opportunities that materially affect several categories of actors. The primary affected parties are prospective spectrum applicants and winners, existing licence holders with adjacent spectrum or area adjacency, equipment manufacturers and integrators, broadcasters and other incumbent receiver operators, and ACMA as the decision maker and regulator.

Prospective applicants and bidders

• Entities that plan to participate in the simple clock auction (or accept pre‑determined offers) are directly affected. They will need to engage with the allocation determination and applicant information package (s 13), prepare financing for upfront payment or instalments, and secure delayed payment bank guarantees if opting for instalments (s 15). The instrument explicitly warns that neither ACMA nor the Commonwealth accept liability for losses from auction participation and suggests obtaining legal, technical and financial advice before applying (s 10 note). This affects the cost structure of market entry and the capital and credit readiness required to participate.

Winning bidders / licensees

• Licensees bear immediate obligations: payment of licence charges and any instalments (s 15, s 19(1)(a)), providing bank guarantees for delayed payments where chosen (s 15(2)-(3), s 19(2)-(3)), ensuring transmitter registration (s 20(1)-(3)), complying with mandatory emission limits in Schedules 3-4 (s 18(2)-(3)), and operating within the geographic region and frequency parts specified in the licence (s 18(1)). Licensees also face restrictions and administrative steps when they propose to change network topology (registration) or trade/assign licences (s 24-26).

Adjacent spectrum licensees and receiver operators

• Holders of frequency‑adjacent and area‑adjacent licences are affected by the emission limits and the instrument’s recognition of the potential for agreements among licence holders to specify alternative emission limits (s 27; Schedule 3 Part 2(3), Schedule 4 Part 2(3)). The instrument requires that where a written agreement exists with all affected adjacent licensees, the specified maximum emission level governs, provided it does not exceed base limits (Schedule 3 Part 2(3)-(4), Schedule 4 Part 2(3)-(4)). Incumbent receiver operators (for example, television broadcasters) are protected by particular constraints (e.g. Table 4 and Table 5 in Schedule 4) in affected areas; these provisions operate to limit out‑of‑band emissions impacting those receivers.

Equipment suppliers, integrators and network designers

• Equipment makers and integrators must ensure the products and their deployment meet the detailed definitions and measurement bases used in the instrument, such as horizontally radiated power, maximum true mean power and occupied bandwidth (s 5 definitions). They must also support licensees in demonstrating compliance at the 95% confidence level where required (Schedule 3 Part 1(3), Schedule 4 Part 2(2)), and in producing certification required for registration under the Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012 (s 20 note).

Retail and wholesale service providers

• Businesses intending to use the spectrum to provide mobile or fixed services will be affected by the size and pairing of the lots, the national geographic area, and the licence term (Schedule 1, Schedule 2, s 16). The lot bandwidths and duplex pairing affect capacity and technology choices and may influence network economics, wholesale pricing, and competition. The fact that licence trading and third‑party authorisation are permitted under the Act (s 25-26) also affects business models: spectrum‑leasing and MVNO‑type arrangements are administratively feasible but must comply with the trading rules.

ACMA and Commonwealth

• The ACMA administers the auction, determines whether to offer pre‑determined prices (s 10(2)), issues licences once payment/guarantees are provided (s 15), registers licences and transmitters (s 24, s 20 note), enforces emission and registration rules, and retains power to include additional licence conditions under s 71 of the Act (s 19(4)). The Commonwealth is the recipient of licence payments and is referenced in the payment mechanism (s 15(1) note).

Other regulators and spectrum users

• The instrument interacts with prior instruments such as the re‑allocation declaration 2011, the residual 700 MHz spectrum direction 2016, advisory guidelines 2012, and determinations on unacceptable interference and trading rules. Holders of licences that might be affected by resumption, cancellation or re‑issue of licences (s 16 note, s 29) are also affected.

Who pays

• The applicant or winning bidder pays the balance of any upfront or winning price, or pays by instalments secured by bank guarantees (s 15(1)-(3)). The licence fee receipts go to the Commonwealth (s 15(1) note). Compliance costs , measurement, equipment limits, certification, bank guarantee costs, legal and auction participation advice , are borne by applicants/licensees and adjacent licensees that must enter coordination agreements.

Who decides

• ACMA decides whether to auction or offer pre‑determined prices (s 10(1)-(2)), sets lot mapping and the National Region (Schedule 1-2), determines licence content and conditions within the boundaries of the Act (s 17-19), and registers licences and transmitters (s 24, s 20). Applicants decide whether to participate and which payment method to use; licensees can negotiate agreements with affected adjacent licensees for alternative emission limits (Schedule 3 Part 2, Schedule 4 Part 2).

Behavioural effects

• Bidders must be prepared for an auction or a pre‑determined sale and for the requirement to provide bank guarantees. Licensees will need to design networks that meet emission limits and registration requirements and either coordinate with adjacent licensees or accept the base emission limits. Equipment selection and deployment strategies will be affected by power thresholds (for registration) and by the detailed out‑of‑band emission constraints in Schedule 4.

Practical scale

• The National Region is extensive and specified via many HCIS identifiers (Schedule 2 Part 3); the instrument’s geographic ambit is therefore effectively nationwide (excluding the Mid West Radio Quiet Zone, per s 18 note). This makes the licences valuable for national mobile or fixed wireless deployments but also requires national planning and cross‑jurisdictional technical compliance.

In short, the instrument affects potential and actual spectrum licence holders most directly, but it also imposes technical and administrative obligations on adjacent licensees, equipment manufacturers and service providers, with ACMA responsible for allocation, issue and enforcement.

This instrument imposes duties on applicants and licensees, and recognises certain rights, many of which are framed by or delegated to other instruments and statutory provisions in the Radiocommunications Act 1992. Below are the principal duties and rights set out or incorporated by reference.

Duties on applicants and winning bidders

• Payment and guarantees: A person allocated a spectrum licence is obliged to pay whichever of the relevant sums applies , the balance of an upfront pre‑determined price, the first instalment, the balance of an upfront winning price, or the first auction instalment , before the ACMA issues the licence (s 15(1)). If instalments are used, the applicant must supply the relevant delayed payment bank guarantee before licence issue (s 15(2)-(3)). The instrument specifies that once a first instalment or first auction instalment is paid, it and subsequent instalments are non‑refundable (s 15(4)). These are binding pre‑issue duties.
• Application procedures: Prospective applicants must follow the application processes in the allocation determination and the applicant information package (s 13(1)-(2); s 10 note). The ACMA will advertise and invite applications in accordance with the allocation determination (s 12).

Duties on licensees post‑issue

• Core licence conditions: Each spectrum licence must include the statutory core conditions listed in s 66 of the Act (s 17(1)-(2)). Those relate to the part(s) of spectrum authorised, emission limits outside the parts and area, and the geographic area of operation.
• Emission limits: Licensees must ensure their radiocommunications devices do not exceed the base emission limits outside the geographic area (Schedule 3 Part 1(2) imposes 47 dBm EIRP per 30 kHz) and must also meet the detailed non‑spurious and spurious emission limits specified in Schedule 4 where applicable (s 18(2)-(3), Schedule 4). Where alternate limits are agreed in writing with all affected adjacent licensees, those agreed limits apply provided they do not exceed the base limits (Schedule 3 Part 2(3)-(4), Schedule 4 Part 2(3)-(4)).
• Registration: Licensees must not operate a transmitter unless the registration requirements under Part 3.5 of the Act are met (s 20(1)). Registration may be refused by ACMA where operation could cause unacceptable interference (s 20 note referencing subsection 145(1) of the Act). The instrument specifies that transmitters may be registered individually or as grouped registrations (s 20(2)).
• Bank guarantees when deferred payment chosen: If the licensee accepted a pre‑determined price paid by instalment or elected to pay a delayed winning price, they must provide the relevant delayed bank guarantee (s 19(2)-(3), s 15(2)-(3)).
• Charges and administrative compliance: Licences will include conditions about payment of charges (s 19(1)(a)), use by third parties (s 19(1)(b)), registration of transmitters (s 19(1)(c)) and residency (s 19(1)(d)). ACMA may include any other conditions under s 71 of the Act (s 19(4)) and the sample spectrum licence shows further likely conditions (s 21).

Rights of applicants and licensees

• Right to be issued licence after compliance: Subject to the Act, allocation determination and other relevant law, the successful applicant has the right to be issued a spectrum licence once they pay the required sums and provide required guarantees (s 15(1)-(3)).
• Choice of payment arrangements: The instrument explicitly affords the applicant or winning bidder choice to pay upfront or utilise instalment options, for both pre‑determined sales and auction outcomes, subject to bank guarantees if deferred (s 15 notes).
• Trade and assignment rights: Licensees have the statutory right to assign or otherwise deal with whole or part of a licence in accordance with Division 5 of Part 3.2 of the Act and must follow the ACMA’s trading rules made under s 88 of the Act (s 26(1)-(2)). This preserves commercial flexibility in secondary markets.
• Third‑party use: Licensees may authorise other persons to operate radiocommunications devices under their licence in accordance with Division 1 of Part 3.2 of the Act (s 25). This allows commercial arrangements such as leasing or service reselling, subject to the Act’s limits.
• Agreement‑making: Licensees have the right to enter written agreements with frequency‑adjacent and area‑adjacent licensees to specify alternative emission limits (s 27; Schedule 3 Part 2(3)-(4); Schedule 4 Part 2(3)-(4)). These negotiated rights allow licensees to tailor coexistence arrangements.

Administrative and measurement duties

• Measurement standards: Emission limits are to be determined with a level of confidence not less than 95% in specified parts of Schedule 3 and Schedule 4 (Schedule 3 Part 1(3); Schedule 4 Part 2(2)). Definitions prescribe how horizontally radiated power, maximum true mean power and occupied bandwidth are to be measured and what adjustments are required to follow good engineering practice (s 5 definitions; Schedule 3 Part 1(5) and notes).
• Use of advisory guidelines: While the advisory guidelines are non‑statutory instruments, the instrument points licensees to them as a means to coordinate services operating under spectrum licences (s 22). This is framed as guidance but the existence of the advisory guidelines is explicitly stated and they are registered instruments.

Registration refusal and interference prevention

• ACMA has the power to refuse registration if a transmitter could cause an unacceptable level of interference to other operations; the instrument references the Act’s registration refusal power and the 2012 determination used for certificates (s 20 note). This imposes a practical duty on licensees to ensure their proposed transmitters meet the unacceptable interference standard set by the ACMA’s 2012 determination.

Licence re‑issue and uncertainty

• When licences are re‑issued under Division 4 of Part 3.2 of the Act, they may not take the same form as originally issued and may have different conditions or different lot configurations (s 29(2)). Licensees therefore face the duty to monitor re‑issue processes and cannot assume any automatic renewal rights.

Enforcement and compliance duties

• ACMA will register licences and enforce conditions under Part 3.5 and related provisions (s 24). Licensees must maintain compliance because s 16 notes licences can be resumed or cancelled in accordance with the Act.

In sum, the instrument creates a clear set of pre‑issue duties around payment and guarantees, on‑going operational duties around emission limits and registration, rights to trade/authorise third‑party use and to negotiate emission agreements, and administrative duties to measure and document compliance in accordance with specified technical definitions and measurement confidence levels.

The marketing plan itself does not list novel criminal penalties; instead it situates enforcement and sanction pathways within the existing regulatory framework of the Radiocommunications Act 1992 and ACMA’s administrative machinery. The instrument specifies ACMA’s administrative powers, technical compliance checkpoints and the documents governing registration and unacceptable interference. Practical enforcement levers relevant to licensees and transmitters include refusal of registration, inclusion of licence conditions, potential cancellation or resumption of licences, and compliance actions under the Act.

Enforcement mechanisms referenced or implied in the instrument

• Registration refusal and certificates: The instrument refers explicitly to subsection 145(1) of the Act as permitting the ACMA to refuse registration where operation of a transmitter could cause an “unacceptable level of interference” to other devices (s 20 note). That is a direct operational gate: without registration under Part 3.5, a licensee must not operate the transmitter (s 20(1)).
• Licence cancellation or resumption: The instrument notes that licences, while fixed‑term, may be resumed or cancelled before the expiry date in accordance with provisions of the Act (s 16 Note 1). Licence cancellation/resumption powers are statutory enforcement levers with significant practical consequences for licensees but are exercised under the Act (not spelled out further in this instrument).
• Conditions and variation: The ACMA can include a range of conditions under s 71 of the Act (s 19(4)). Conditions are binding contractual‑statutory obligations; failure to comply provides a basis for regulatory action under the Act.
• Emission limits and technical compliance: Schedules 3 and 4 set specific numeric emission ceilings and spurious emission limits. Non‑compliance may lead to ACMA action through the Act’s enforcement provisions, including direction, suspension or cancellation, or other compliance measures available to ACMA (the instrument does not list the penalties but embeds this within the Act’s enforcement architecture).
• Trading and registration rules: Trading/assignment must comply with s 85 and s 88 rules; non‑compliance with trading rules may result in regulatory sanctions per the Act and the trading rules determination (s 26 notes).

Nature of penalties (as contextualised by the instrument)

• The instrument itself does not prescribe monetary penalties, criminal offences or administrative fines. Instead, enforcement is through administrative condition setting (including the mandatory core conditions), registration control (refusal, cancellation), and licence resumption/cancellation under the Act. This means the practical “penalties” are operational or commercial: inability to operate, forced modification of network parameters, loss of licence, or limits on sale/assignment of rights.

Measurement and evidentiary standards for enforcement

• The instrument mandates certain measurement and confidence standards; for example, base emission limits are to be determined with a level of confidence not less than 95% (Schedule 3 Part 1(3)), and other emission determinations use the same 95% confidence threshold (Schedule 4 Part 2(2)). These technical demands affect how ACMA and licensees will measure compliance and what evidence the ACMA will require to establish compliance or breach. The definitions in s 5 specify how to measure maximum true mean power, occupied bandwidth, and horizontally radiated power, and require adherence to “good engineering practice”, which establishes an evidentiary baseline for enforcement.

Court and administrative review

• The instrument does not specify administrative review or merits review procedures for decisions under this instrument. Those rights and processes, where available, derive from the Act and general administrative law. For example, decisions such as refusal to register a transmitter or cancellation of a licence may be subject to statutory review rights or judicial review under administrative law, but those processes are governed by the Act and general law, not restated here.

Practical enforcement risk and compliance friction

• Enforcement actions will likely require technical measurements, certificate evaluation, and coordination between ACMA and affected licensees. The 95% confidence requirement and the need to use good engineering practice increase technical compliance costs and raise the standard of proof for ACMA in any enforcement action. For licensees, the cost of defending enforcement actions will include technical measurement programs and possibly coordination agreements to reduce interference risk.

Interaction with other instrument‑based enforcement

• The instrument cross‑references the Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012 for certificate issuance and refusal criteria (s 20 note). That determination contains the technical definitions and procedure for accredited persons to issue certificates under subsection 145(3) of the Act, which in practice will be used to evidence compliance and inform registration decisions.

Summary

• The instrument relies on the Act’s pre‑existing enforcement regime rather than creating new penalties. Practical consequences for non‑compliance are administrative and commercial (registration refusal, licence cancellation, modification of operation), and the instrument tightens enforcement by specifying numerical emission limits and high confidence measurement standards. Licensees should anticipate that ACMA enforcement actions will hinge on technical measurement evidence prepared in accordance with the instrument’s definitions and the referenced determinations.

This marketing plan is an instrument made under s 39A of the Radiocommunications Act 1992 and is explicitly designed to interact with, and operate alongside, a set of other legislative instruments, determinations and statutory provisions. The document contains many cross‑references; compliance requires consulting the Act and several other instruments the plan explicitly identifies.

Primary statutory framework

• Radiocommunications Act 1992: The instrument is made under s 39A (s 3) and embeds multiple statutory obligations drawn from the Act. Key Act references included are s 66 (core licence conditions), s 67 (payment of charges), s 68 (use by third parties), s 69 (registration of transmitters), s 69A (residency), s 71 (ACMA’s discretion to include other licence conditions), s 72 (variation of core conditions by agreement), Part 3.5 (registering transmitters), and Division 4 of Part 3.2 (re‑issue of licences) (see ss 17-21, 24, 29). These references mean the plan does not displace or override statutory regimes contained in the Act but sets out how the ACMA will apply those provisions for the unallocated lots.

Allocation determination and auction rules

• Radiocommunications (Spectrum Licence Allocation - 700 MHz Band) Determination 2016: The marketing plan delegates substantive auction mechanisms and payment rules to the allocation determination. The plan repeatedly refers to definitions provided in subsection 4(1) of the allocation determination (for example, “lot”, “applicant”, “auction”, price definitions, instalment definitions) (s 5 and elsewhere), and states that the simple clock auction is to be conducted in accordance with the allocation determination (s 10(1)), that the applicant information package must comply with Part 4 and subsection 27(1) of the allocation determination (s 13(1)), and that the ACMA may offer pre‑determined prices as set out in Part 5 of the allocation determination (s 10(2) note). Therefore the allocation determination overlays critical procedural and commercial rules.

Residual 700 MHz spectrum direction and re‑allocation declaration

• The instrument refers to the Radiocommunications (Spectrum Licence Allocation-Residual 700 MHz Spectrum) Direction 2016 (residual 700 MHz spectrum direction) and the Radiocommunications (Spectrum Re‑allocation) Declaration No. 1 of 2011 (re‑allocation declaration). These instruments define how residual spectrum is treated and the geographic areas to which the 700 MHz band applies, including exclusion of the Mid West Radio Quiet Zone from the National Area (s 18 note; Schedule 2 note). The plan’s region and certain lot definitions are framed with reference to those instruments, so their provisions modify the geographic and technical baselines.

Advisory guidelines and interference determinations

• Radiocommunications Advisory Guidelines (Managing Interference to Receivers - 700 MHz Band) 2012 and Radiocommunications Advisory Guidelines (Managing Interference from Transmitters - 700 MHz Band) 2012 are flagged as tools for coordinating services and the plan refers to them as the advisory guidelines (s 5 definition, s 22). The Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012 is referenced as setting unacceptable interference levels for the purposes of registering devices (s 20 note). These documents inform practical coordination and registration decisions.

Trading rules and register determinations

• The instrument points to the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 for rules governing assignment and other dealings (s 26 note), and to the Radiocommunications (Register of Radiocommunications Licences) Determination 1997 for registration details (s 24 note). Trading, assignment, and registration therefore follow frameworks external to this plan.

Acts Interpretation and Legislation Act implications

• Section 6(1) establishes that references to other legislative instruments are references to them as in force from time to time, invoking ordinary statutory interpretation principles (s 6(1); notes reference Acts Interpretation Act 1901 and Legislation Act 2003). This means updates to the referenced determinations or changes in the Act may alter the practical operation of this plan.

Measurement and technical standards

• The plan’s technical definitions (s 5) and measurement expectations (Schedule 3 Part 1(5): use good engineering practice) interact with standards and certification regimes that are not fully set out in the plan. For example, the plan’s measurement rules will be applied alongside accredited person certificates under subsection 145(3) of the Act referenced in s 20 note and the ACMA’s determination on unacceptable interference.

Administrative law and rights of review

• The plan does not set out appeals or merits review rights, but decisions taken under the Act and the referenced determinations remain subject to administrative law remedies and statutory review avenues in the Act and general law. For instance, decisions to refuse registration or to cancel a licence would be grounded in the Act’s processes and subject to statutory review channels where applicable.

Cross‑instrument coordination and possible conflicts

• Because the plan prescribes (i) emission limits and (ii) empowers ACMA to include conditions under s 71, those actions must be applied consistently with the Act and the other instruments. Where multiple instruments apply (for example, the residual 700 MHz spectrum direction, the allocation determination and the advisory guidelines), the plan signals that these instruments collectively define the regulatory environment, and that the relative precedence and interpretation will follow ordinary legislative instrument rules (s 6(1) and notes). The plan does not resolve potential conflicts among instruments, so administrators and practitioners must cross‑check relevant instruments when implementing or challenging decisions.

In short, the marketing plan functions within a web of primary legislation and subordinate instruments: it sets the marketing and technical envelope for allocation and use, but the Act and several other determinations supply the detailed auction rules, trading rules, registration procedures, interference certification, and administrative processes that together govern behaviour and legal recourse.

The instrument contains limited direct amendment history information but refers to its contemporaneous position and related instruments. The text itself records the following temporal and instrument relationships that are material for tracing amendment and effective time relationships:

• Commencement: The Radiocommunications Spectrum Marketing Plan (700 MHz unallocated lots band) 2016 commences immediately after the commencement of the Radiocommunications Spectrum Marketing Plan (700 MHz Band) Variation 2016 (No. 1) (s 2). That places this instrument as a follow‑on instrument in the sequence of 2016 marketing plan instruments.
• Authority for making the instrument: The instrument is made under section 39A of the Radiocommunications Act 1992 (s 3). Any amendments to the Act or to section 39A would therefore materially affect the instrument’s authorising power.
• Cross‑referenced instruments and earlier declarations: The instrument repeatedly references other instruments whose own amendment histories matter for the plan’s operation. Notable referenced instruments include:
  • Radiocommunications (Spectrum Licence Allocation - 700 MHz Band) Determination 2016 (the allocation determination), which contains core allocation and auction mechanisms and definitions that the marketing plan relies on (s 5, s 10, s 13).
  • Radiocommunications (Spectrum Re‑allocation) Declaration No. 1 of 2011 (re‑allocation declaration), which defines the geographic areas to which the 700 MHz band applies and which the plan references when defining the 700 MHz band and National Region (s 5 definitions; s 18 note).
  • Radiocommunications (Spectrum Licence Allocation-Residual 700 MHz Spectrum) Direction 2016 (residual 700 MHz spectrum direction), which the instrument sometimes cross‑refers to in relation to how residual spectrum is handled and in certain definitions (s 5, s 11 note).
  • Radiocommunications Advisory Guidelines (Managing Interference to Receivers - 700 MHz Band) 2012 and Radiocommunications Advisory Guidelines (Managing Interference from Transmitters - 700 MHz Band) 2012, which are registered and referenced as advisory tools (s 5; s 22).
  • Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012, Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012, and Radiocommunications (Register of Radiocommunications Licences) Determination 1997, which the instrument references as operative determinants for registration, trading and interference certification (s 20 note; s 24-26 notes).
• Sample spectrum licence and subsequent change: The plan includes a sample spectrum licence at Schedule 5 and an express caveat that the sample may not reflect all conditions included in any issued licence (s 21 note) and that ACMA may include conditions not listed in the sample (s 19 note). It also warns that licences re‑issued under Division 4 of Part 3.2 of the Act may be in a different form (s 29(2)). These notes effectively acknowledge the instrument may be followed by administrative changes in the conditions of licences without formal amendment of this marketing plan.
• No explicit amendment entries in the text: The plan itself does not list prior versions or recorded amendments to this specific 2016 instrument beyond the immediate commencement relationship and the authority under s 39A. There is no schedule in the instrument providing a history of textual changes, nor are amending instruments for this specific marketing plan set out in the text supplied.
• References to “as in force from time to time”: The instrument expressly provides that references to other legislative instruments and to non‑legislative instruments are to be read as references to those instruments as in force or existing from time to time (s 6(1)-(2)). This standard construction clause means that updates to referenced instruments will automatically alter the operational context and that amendment history of those instruments is relevant.

Practical implications for users tracking amendment history

• To establish a full amendment history and current operative text, practitioners must check:
  • whether this marketing plan itself has been subject to later amendment instruments on the Federal Register of Legislation;
  • the allocation determination and whether it has been varied (it supplies many definitions and procedural rules);
  • any later versions of the advisory guidelines or unacceptable interference determination;
  • whether the residual 700 MHz spectrum direction or the re‑allocation declaration have been varied.
• The instrument’s references to other documents and the “as in force from time to time” clause imply that the complete legal picture depends on checking the current versions of all cross‑referenced instruments.

In short, the instrument was made and commenced in 2016 under s 39A of the Act, sits alongside a set of contemporaneous and earlier instruments, and contains internal notes that licence terms and conditions may change under re‑issue or administrative action. A definitive amendment history for operational practice therefore requires consultation of the Federal Register of Legislation for this instrument and all the cross‑referenced instruments to capture subsequent changes.

The instrument as provided contains no references to judicial or tribunal decisions, appeals, or any litigation history. It does not cite case law or administrative decisions, nor does it include any summary of disputes or precedent bearing on interpretation or enforcement. The text is purely administrative and technical in its content and references.

What this means for practitioners:

• There is no litigation record embedded in the instrument itself to guide interpretation or predict enforcement outcomes. Any legal challenges to allocations, auction conduct, licence conditions, registration refusals, or emission limit disputes would arise under the Radiocommunications Act and related instruments and be recorded externally.
• If a practitioner requires precedent, they must search administrative law and telecommunications‑related case law databases for decisions involving the ACMA, spectrum auctions, licence cancellations, registration refusals (subsection 145(1) refusals), or enforcement of emission limits. The instrument does not identify past tribunal or court rulings that might affect its operation.
• Because this plan cross‑references the allocation determination and other instruments, litigation involving those instruments (for example disputes over auction conduct governed by the allocation determination or certification under the Unacceptable Levels of Interference Determination) could be relevant. The plan itself does not supply such dispute history.

Practical next steps for practitioners seeking litigation context

• Check Federal Court and Administrative Appeals Tribunal (AAT) records for challenges related to ACMA spectrum allocations, trading rule disputes, registration refusals or enforcement actions involving the 700 MHz band or comparable auctions.
• Review any public statements, determinations or adjudications the ACMA has published concerning auction conduct or licence conditions under the allocation determination.
• Examine whether submissions or complaints were made during the consultative process that preceded the allocation determination and marketing plan (the instrument notes applicant information packages and consultation steps in the allocation determination).

In summary, the instrument does not itself contain litigation history; practitioners wishing to map the legal risk landscape must search case law and administrative decisions external to this marketing plan, focusing on ACMA decisions and disputes under the Radiocommunications Act and the associated determinative instruments referenced in this plan.

This instrument contains a number of practical pitfalls and traps for the unwary. The following are concrete “gotchas” drawn directly from the instrument’s text and its interaction with referenced instruments, focusing on operational, financial, legal and technical points that commonly cause risk or compliance problems.

Non‑refundable instalments and bank guarantees (s 15(4), s 15(2)-(3))

• Once the first instalment or first auction instalment is paid, that instalment and subsequent instalments are expressly non‑refundable. Practically, a bidder who elects instalments must accept irreversibility of paid instalments even if later circumstances make the licence commercially unattractive (s 15(4)).
• If deferred payment is chosen, the relevant delayed payment bank guarantee must be provided prior to licence issue (s 15(2)-(3)). Timing and form of those guarantees will be specified in the allocation determination and applicant information package; failure to provide a compliant guarantee can block licence issue.

Pre‑determined price option before auction start (s 10(2))

• The ACMA may offer a pre‑determined price for lots without holding an auction if it considers it can allocate licences without identifying highest bidders, but only before the auction manager sets the start date and time for the first and second rounds (s 10(2)). Bidders who rely on a public expectation of an auction can be disadvantaged if ACMA instead sells by pre‑determined price before the auction manager’s start times are set. That creates timing risk: potential participants must monitor ACMA announcements and the allocation determination’s Part 5 rules.

Licence term and re‑issue uncertainty (s 16, s 29(2))

• Licences commence 1 April 2018 and expire 31 December 2029 (s 16). There is no guarantee of renewal in the same form; re‑issued licences under Division 4 of Part 3.2 of the Act may be divided differently and contain different conditions (s 29(2)). Bidders should factor potential re‑issue changes into long‑term business and amortisation models.

Emission limits with high confidence measurement (Schedule 3 Part 1(3), Schedule 4 Part 2(2))

• Emission limits are to be determined with a level of confidence not less than 95%. That creates practical measurement and statistical burdens; licensees must adopt sampling, monitoring and modelling protocols that meet this confidence threshold. Enforcement proofs and defence will hinge on such technical evidence. The plan’s definitions require “good engineering practice” for measurement and adjustments (s 5 note, Schedule 3 Part 1(5)).

Complex and sometimes non‑intuitive emission tables (Schedule 4)

• Schedule 4 contains multiple tables with different numeric limits that apply depending on transmitter band, offset from band edges, whether the transmitter operates in the affected area, and whether the limit is for non‑spurious or spurious emissions. For example, Table 1 contains negative dBm EIRP limits for certain offsets, while Table 2 contains positive dBm EIRP limits that apply in other specific situations. Misapplication of the wrong table is an operational risk that can lead to non‑compliance.

Registration refusal and ACMA discretion (s 20 note)

• ACMA may refuse to register a transmitter if it is satisfied the transmitter could cause an unacceptable level of interference (s 20 note referencing subsection 145(1) of the Act). The instrument signals that the ACMA “does not propose to register” low‑power transmitters below 23 dBm in the lower band and 30 dBm in the upper band (s 20(3)). Practically, this means that small cells or indoor base stations at those power levels may be precluded from registration and therefore from legal operation unless ACMA’s position changes; applicants cannot assume registration rights for low‑power deployments.

Agreements with adjacent licensees cannot exceed base limits (Schedule 3 Part 2(4), Schedule 4 Part 2(4))

• While the instrument allows written agreements to specify alternative emission limits between licensees and adjacent licence holders, the agreed limits cannot exceed the base emission limits (Schedule 3 Part 2(4); Schedule 4 Part 2(4)). Thus parties cannot agree to relax protections below the floor the instrument sets; downside risk exists where negotiation fails.

Sample licence is not definitive (s 21 note)

• The sample spectrum licence in Schedule 5 “may not reflect all the conditions” that will appear in an issued licence (s 21). ACMA may include additional conditions under s 71 (s 19(4)). Practitioners should not rely on the sample licence as comprehensive; they must examine their actual issued licence for binding conditions.

National Region scope and mapping precision (Schedule 2)

• The National Region is defined by a long list of HCIS identifiers and an indicative pictorial map that ACMA disclaims responsibility for (Schedule 2 notes). Participants must perform their own mapping exercises , the instrument warns explicitly to obtain independent advice and not to rely on the map. Reliance on the pictorial map risks misunderstanding geographic scope and potential area adjacency obligations.

Interaction with other instruments , cross‑document dependency (s 6)

• The instrument expressly references and depends upon other legislative instruments “as in force from time to time” (s 6). This means that material rules , notably allocation procedures, trading rules, unacceptable interference determinations, and the residual spectrum direction , may change and alter the rights and obligations initially anticipated. Practitioners must monitor changes across this instrument set.

Financial exposure to Commonwealth (s 15)

• Payments are made to ACMA on behalf of the Commonwealth (s 15(1) note). Winning bidders provide funds to the Commonwealth, and instalment and bank guarantee structures may impose substantial credit and cash requirements up front. Bidders who miscalculate can suffer liquidity problems with non‑refundable instalments and binding guarantees.

Ambiguities that require consult of allocation determination

• The instrument delegates many definitional and procedural matters to subsection 4(1) of the allocation determination (see s 5). Key commercial elements such as precise auction mechanics, bid increments, activity rules and reserve prices (if any) are not set out here and must be sourced from the allocation determination. Failure to consult that document can lead to surprises in auction conduct.

In summary, the most material “gotchas” are: non‑refundability of instalments and bank guarantee obligations; ACMA’s power to sell by pre‑determined price before auction rounds start; detailed technical limits with high measurement confidence burdens; ACMA’s explicit proposal not to register low‑power transmitters under certain thresholds; the sample licence not being exhaustive; and the need to consult multiple cross‑referenced instruments to understand the full regulatory position. Practitioners should budget for technical compliance costs, bank guarantee costs, and legal/auction advisory expenses.

The instrument prescribes a number of specific compliance steps and refers to other instruments for procedural and technical detail. Below are concrete, sequential steps an applicant or licensee should take to secure compliance and to reduce legal, technical and commercial risk.

1. Read the allocation determination and applicant information package before applying (s 13)

• The marketing plan repeatedly delegates auction rules, definitions and application procedures to the Radiocommunications (Spectrum Licence Allocation - 700 MHz Band) Determination 2016 and to the applicant information package (s 13(1)-(2); s 10(1) note). Obtain and study the allocation determination and the applicant information package to understand auction timing, bid rules, activity requirements, payment timing, the form of bank guarantees required, and any eligibility or residency requirements. The marketing plan alone is insufficient to prepare a compliant bid.

2. Prepare financing and bank guarantees (s 15)

• Decide whether to pay upfront or via instalments. If electing deferred payments, secure the required delayed pre‑determined price bank guarantee or delayed winning price bank guarantee and ensure it meets the form and timing requirements set out in the allocation determination and applicant information package. Remember the first instalment or first auction instalment is non‑refundable (s 15(4)) and the bank guarantee must be provided before issue (s 15(2)-(3)).

3. Ensure statutory and administrative eligibility

• Confirm your corporate eligibility and residency conditions as required by s 69A and any allocation determination conditions. The allocation determination may include applicant eligibility constraints; check those provisions carefully.

4. Plan technical deployment to meet emission limits (s 18; Schedules 3-4)

• Design networks and select equipment so radiated emissions comply with Schedule 3 (base limit 47 dBm EIRP per 30 kHz outside the geographic area) and the relevant entries in Schedule 4 for non‑spurious and spurious emissions (Tables 1-7).
• Account for the 95% confidence requirement where specified (Schedule 3 Part 1(3); Schedule 4 Part 2(2)). Set up measurement, monitoring and modelling protocols to produce compliance evidence at that confidence level, applying “good engineering practice” as required by the instrument (s 5 note; Schedule 3 Part 1(5)).
• Pay attention to affected areas with stricter limits (Schedule 4 Tables 4-5) if deploying transmitters in proximity to services such as broadcast television.

5. Register transmitters in compliance with Part 3.5 and ACMA expectations (s 20)

• Do not operate transmitters until registered under Part 3.5 of the Act. Use the Radiocommunications (Unacceptable Levels of Interference - 700 MHz Band) Determination 2012 and ACMA guidance to prepare certification for registration under subsection 145(3) of the Act (s 20 note).
• Be aware ACMA “does not propose to register” transmitters with maximum radiated true mean powers ≤ 23 dBm in the lower band or ≤ 30 dBm in the upper band (s 20(3)). Clarify the ACMA’s current position and obtain pre‑registration advice if you plan low‑power deployments near these thresholds.

6. Coordinate with adjacent licensees where necessary (Schedule 3 Part 2; Schedule 4 Part 2)

• If you need alternative emission arrangements, enter a written agreement with all affected frequency‑adjacent and area‑adjacent licensees specifying maximum emission limits. Ensure any agreed limits do not exceed the base emission limits set out in Schedule 3 or Schedule 4 (Schedule 3 Part 2(4); Schedule 4 Part 2(4)). Document and maintain evidence of such agreements.

7. Prepare compliance evidence and measurement protocols

• Adopt measurement methods consistent with the definitions in s 5: maximum true mean power, horizontally radiated power, occupied bandwidth, and spurious emission measurement bandwidths in Schedule 4 Tables 6-7. Use appropriate measurement equipment (spectrum analysers, adjacent channel power meters) and document adjustments and uncertainty estimates in line with “good engineering practice” (s 5 notes; Schedule 3 Part 1(5)). Maintain logs, calibration records and modelling assumptions to support a 95% confidence claim.

8. Understand and plan for trading and third‑party use (s 25-26)

• If planning to trade or assign the licence or to authorise third‑party use, ensure arrangements comply with Division 5 of Part 3.2 of the Act and the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 (s 26(1)-(2)). Put documentation in place for authorisations under s 25 and verify any assignment approvals required by ACMA or the trading rules.

9. Review sample licence and be prepared for additional conditions (s 21, s 19(4))

• Use the sample spectrum licence in Schedule 5 as a starting point but do not rely on it as exhaustive. ACMA may include additional conditions under s 71 of the Act. Review the final issued licence carefully to identify any bespoke conditions and adapt network and commercial plans accordingly.

10. Monitor ACMA announcements and timing

• The ACMA may offer pre‑determined prices before the auction manager sets the start dates for rounds (s 10(2)). Watch ACMA communications, the applicant information package and allocation determination for precise timing, and be ready to respond quickly if ACMA elects the pre‑determined sale route.

11. Factor licence term and re‑issue risk into commercial models (s 16, s 29)

• The licence term is fixed to 1 April 2018-31 December 2029. Account for this specific time horizon in capital planning, and recognise that re‑issued licences may differ in form (s 29(2)). Avoid assuming automatic renewal in the same terms.

12. Obtain legal and technical advice

• The instrument explicitly advises prospective participants to obtain independent legal, technical and financial advice (s 10 note). Given cross‑referenced instruments and technical requirements, specialist advice reduces risk of misinterpretation of auction rules, bank guarantee forms, emission measurement techniques, and registration semantics.

13. Maintain records and prepare for enforcement procedures

• Keep detailed records of measurements, certificates from accredited persons (for registration), agreements with adjacent licensees, bank guarantee documents, and payment receipts. These will be necessary to respond to any ACMA compliance checks or enforcement actions.

14. Check for updates to referenced instruments (s 6)

• Because referential clauses adopt “as in force from time to time” formulations (s 6), continually verify the current versions of the allocation determination, residual 700 MHz spectrum direction, advisory guidelines, unacceptable interference determination, trading rules, and register determination.

15. Map the National Region and verify area adjacency

• Use the ASMG and the HCIS identifiers in Schedule 2 to map the National Region and to identify any adjacent or affected areas for interference planning. Do not rely solely on the pictorial representation provided in the instrument (Schedule 2 note); conduct your own spatial analysis.

Following these steps will align an applicant or licensee with the instrument’s expressed requirements as framed in this marketing plan and the referenced instruments. In practice, consult the allocation determination and the applicant information package for exact procedural forms and timings, and secure expert technical and legal support for measurement, registration and bank guarantee tasks.
