Radiocommunications Spectrum Marketing Plan (1800 MHz unallocated lots band) 2017

This instrument centres on several interlocking concepts. First, a “lot” is a defined pair of uplink/downlink frequency blocks within the 1800 MHz band allocated to a geographic region; the lots being offered are listed in Schedule 1, Table 1 (cl 11). Each lot is described by region (Schedule 2 HCIS identifiers), lower and upper frequency ranges and bandwidth (Schedule 1). The “1800 MHz (unallocated lots) band” is explicitly defined as a subset of the wider 1800 MHz band (cl 5 definitions), and the five regions are Dubbo, Mackay, Maryborough, Regional Western Australia and Tasmania (Schedule 2, cl 1).

Second, the allocation mechanism is the simple clock auction specified in the allocation determination (cl 10(1)). Where a lot is only nominated by one applicant prior to the auction start date and time, ACMA may offer allocation at a pre-determined price as set out in Part 5 of the allocation determination (cl 10(2)). Lots not allocated in the auction or at pre-determined price may later be offered through the post-auction allocation process governed by Schedule 4 of the allocation determination (cl 10(3)).

Third, licence content and term are core concepts. Licences issued under this instrument are fixed-term and expire on 17 June 2028 (cl 16). Core licence conditions required by s 66 of the Act (cl 17(1)) will be included (spectrum parts, maximum permitted emissions outside licensed parts, geographic area, and emission limits outside the area). Additional conditions prescribed by the instrument include payment of charges (s 67 of Act, cl 19(1)(a)), third-party use (s 68, cl 19(1)(b)), transmitter registration (s 69, cl 19(1)(c)), and residency (s 69A, cl 19(1)(d)). The instrument also contains a specific protection/limitation clause for specified fixed services listed in Schedule 5; where a specified fixed service is provided under an apparatus licence, the spectrum licensee must not operate in a manner inconsistent with protections in Part 2 of the 2012 advisory guideline and cannot claim protection from interference caused by that fixed service (cl 19(2)).

Fourth, technical coordination and interference management are central. The instrument incorporates advisory guidelines (cl 5 definition) and sets default emission limits for out-of-area emissions (Schedule 3) and out-of-band emissions (Schedule 4). Those limits apply unless all affected frequency-adjacent and area-adjacent licensees agree in writing to alternate maximum levels (Schedule 3 cl 1(1), Schedule 4 cl 1(1)). Registration of transmitters is mandatory as a licence condition (cl 20(1)) with specific exemptions for low-power mobile and lower-power fixed transmitters (cl 20(2)). The instrument also references the Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 as the instrument to be used for certificates by accredited persons under subsection 145(3) of the Act (cl 20 Note 3).

Fifth, administrative interoperability: the instrument repeatedly cross-references the allocation determination, the re-allocation declaration, advisory guidelines and other legislative instruments and determinations (cl 6). References to instruments are to those instruments “as in force from time to time” unless the contrary intention appears (cl 6(1)), meaning future amendments of the cross-referenced instruments will bind this marketing plan unless specifically excluded.

Finally, documentation and sample materials: the ACMA will publish an applicant information package specifying application requirements and auction processes (cl 13(1)), and Schedule 6 contains a sample spectrum licence which may not reflect final licence conditions (cl 21). The instrument therefore creates a defined auction and licensing product but leaves implementation detail (auction timing, start of rounds, applicant package content, and some licence terms) to the allocation determination and the ACMA’s administrative processes.

The primary affected groups are: potential and successful auction applicants and their investors; incumbent and neighbouring spectrum licensees in adjacent frequency or adjacent geographic areas; owners/operators of specified fixed links listed in Schedule 5; manufacturers, vendors and integrators of radiocommunications equipment that will be operated under the licences; and end users of services delivered using the licensed spectrum. The ACMA is the administering regulator and exercises decision-making authority over issuance, registration, condition inclusion and, where necessary, refusal to register transmitters (cl 3, cl 15, cl 20, cl 24).

Applicants and bidders face defined procedural and financial obligations. The instrument requires the ACMA to publish an applicant information package (cl 13(1)) and to advertise the auction (cl 12). Successful bidders pay either the balance of a pre-determined price or the balance of the winning price before issuance of the licence (cl 15(1)). The ACMA may, before the auction manager sets the start date and time for rounds, offer a lot for allocation at the pre-determined price if only one applicant has nominated that lot (cl 10(2)), affecting those who prefer negotiated certainty over contestable auction outcomes.

Current holders of frequency-adjacent or area-adjacent licences are affected in two ways. First, the instrument sets default emission limits (Schedule 3 and Schedule 4) that govern what emissions a new licensee can cause outside its area or band. Second, those adjacent licensees are parties whose written agreement can alter default emission limits; where all affected adjacent licensees and the licensee execute a written agreement specifying alternate maximum permitted levels, those agreement terms govern instead of the default (Schedule 3 cl 1(1); Schedule 4 cl 1(1)). Thus incumbents can potentially negotiate protection or trade-offs.

Operators of specified fixed services listed in Schedule 5 (identified by licence number and A/B end site IDs) have special standing. The instrument obliges spectrum licensees not to operate in a manner inconsistent with the protections afforded to those services by Part 2 of the Radiocommunications Advisory Guidelines (Managing Interference from Spectrum Licensed Transmitters - 1800 MHz Band) 2012, and further prohibits licensees from claiming protection from interference caused by such specified fixed services (cl 19(2)(d)-(e)). Those fixed link operators therefore have both protective measures and potential asymmetrical exposure: they benefit from protection but may cause interference that spectrum licensees cannot claim against.

Equipment manufacturers, integrators and certificating bodies are affected by the instrument’s technical definitions and measurement expectations. Definitions set out “true mean power”, “maximum true mean power”, occupied bandwidth and measurement interval expectations (cl 5 definitions), and the instrument notes that power measurement methodology and estimation should follow “good engineering practice” (cl 5 note on maximum true mean power). The Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 is specified as the instrument for use by accredited persons issuing certificates under subsection 145(3) of the Act (cl 20 Note 3), implicating technical compliance processes and accredited testing regimes.

Finally, secondary market participants and advisers are affected because the instrument explicitly allows assignment and dealing in licences subject to Division 5 of Part 3.2 of the Act and to trading rules made under section 88 of the Act (cl 26(1)-(2)). The ACMA has already made trading rules (Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012) and section 85 of the Act requires assignments to comply with those rules; this creates a regulated secondary market framework that legal and commercial advisers must navigate.

The instrument creates a set of duties for licensees and procedural rights for applicants. Key duties include:

• Payment obligation for issuance: a successful applicant must pay the balance of either the pre-determined price or the balance of the winning price before ACMA will issue the licence (cl 15(1)). That payment is a condition precedent to issuance.

• Operation within licensed frequencies and geographic areas: licences will authorise operation only for the frequencies and geographic areas assigned to the lots allocated (cl 18(1)(a)-(b)). Core licence conditions (required by s 66 of the Act and restated at cl 17) must be included, meaning the licensee must operate within the specified parts of spectrum and within the geographic area and respect specified emission limits both outside the area and outside parts of the spectrum.

• Transmitter registration: each licence includes a condition prohibiting operation of transmitters unless registration requirements under Part 3.5 of the Act are met (cl 20(1)). There are specified registration exemptions: mobile transmitters with radiated power ≤ 39 dBm EIRP per occupied bandwidth and fixed transmitters with radiated power always ≤ 33 dBm EIRP per occupied bandwidth are exempt from registration (cl 20(2)).

• Emission limits compliance: absent a written agreement, licensees must comply with the emission limits set out in Schedule 3 for emissions outside the area (maximum true mean power 54.5 dBm EIRP per 30 kHz, Schedule 3 cl 2(1)-(2)) and Schedule 4 for out-of-band emissions and spurious emission limits (Schedule 4 cl 2 and cl 3). The instrument specifies measurement bandwidths and offset ranges; licensees must ensure equipment meets those limits.

• Compatibility with specified fixed services: where a specified fixed service (Schedule 5) operates under an apparatus licence in the 1800 MHz band, the spectrum licensee must not operate in a manner inconsistent with the protections in Part 2 of the 2012 advisory guideline and cannot claim protection from interference caused by that service (cl 19(2)).

• Third-party use and trading: licensees may authorise others to operate devices under their licences in accordance with Division 1 of Part 3.2 of the Act (cl 25), and may assign or otherwise deal with whole or part of a licence subject to Division 5 of Part 3.2 and ACMA trading rules (cl 26).

Key rights deriving from the instrument and the Act include:

• Right to have a licence issued on payment of the relevant balance subject to compliance with the Act and allocation determination (cl 15(1) and cl 15(2) for post-auction allocations).

• Ability to negotiate alternate emission limits by written agreement with affected adjacent licensees, thereby altering default technical constraints (Schedule 3 cl 1(1) and Schedule 4 cl 1(1)).

• Ability to trade, assign and otherwise deal with licence interests subject to the statutory trading regime (cl 26(1)-(2)); the instrument provides an avenue to monetise spectrum rights within the framework of the trading rules (Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 referenced in cl 26 Note).

• Right to participate in the simple clock auction process by following the application processes set out in the allocation determination and applicant information package (cl 10(1), cl 12, cl 13(1)).

• Licence term certainty: licences expire on a fixed date (17 June 2028, cl 16). That provides a known remainder term for secondary market valuation and planning, subject to resumption or cancellation under the Act as noted (cl 16 Notes).

Administrative duties and discretions held by the ACMA include the duty to advertise and publish the applicant information package (cl 12 and cl 13), to register licences and transmitters in accordance with Part 3.5 of the Act (cl 24 and cl 20), to include core conditions and additional conditions as required by the Act (cl 17 and cl 19), and the discretion to refuse to register a transmitter if it could cause an unacceptable level of interference (cl 20 Note 1 referencing s 145 of the Act). The ACMA also has the discretionary power to offer allocation at a pre-determined price where only one applicant has nominated a lot prior to auction start (cl 10(2)).

Procedural rights and limitations are therefore a mix: applicants have auction participation rights and a right to be allocated and issued a licence on payment, while licensees have rights to trade and negotiate emission regimes but also duties to register transmitters, comply with emission limits and the various licence conditions mandated by the Act and this instrument.

This instrument itself does not list monetary penalties or criminal offences. Enforcement and sanctioning mechanisms are effected through the Radiocommunications Act 1992 and related determinations which are repeatedly invoked throughout the instrument. The instrument makes the following enforcement-related arrangements explicit.

Registration and refusal: cl 20 requires a licence condition that prohibits operation unless the transmitter is registered under Part 3.5 of the Act. The instrument’s note to cl 20(1) refers to subsection 145(1) of the Act, under which the ACMA may refuse to include transmitter details in the Register if it is satisfied operation could cause an unacceptable level of interference. The instrument further notes that subsection 145(4) allows the ACMA, by written instrument, to determine what are acceptable levels of interference, and identifies the Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 as the operative determination to be used for certificates by accredited persons under subsection 145(3) of the Act (cl 20 Notes 1-3). Those references mean technical non-compliance can be addressed at registration stage and that ACMA has the administrative power to refuse registration on interference grounds.

Licence variation, resumption and cancellation: cl 16 notes that, “in accordance with the Act, a licence may be resumed or cancelled before the expiry date.” That cross-reference points practitioners to the Act’s powers governing resumption and cancellation. Similarly, cl 17(2) notes that core conditions may be varied by ACMA with the licensee’s agreement under section 72 of the Act, and cl 19(3) refers to section 71 of the Act for the ACMA’s power to include conditions it thinks fit. These statutory powers are the enforcement levers that ACMA can use administratively: varying conditions, refusing registration or, where statutory thresholds are met, resuming or cancelling licences.

Trading and assignment compliance: cl 26(2) directs that assignments must comply with rules the ACMA has made under section 88 of the Act, and cl 26 Note points to the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012. Section 85 of the Act requires assignments to comply with those trading rules, thus regulatory enforcement of trading compliance occurs via the Act and its trading rules.

Interference and technical enforcement: default emission limits are set in Schedules 3 and 4 (Schedule 3 cl 2 and Schedule 4 cl 2-3). Those limits create objective technical standards against which operation can be measured. The instrument also creates an avenue for affected licensees to enter written agreements specifying alternate maximum permitted levels (Schedule 3 cl 1(1), Schedule 4 cl 1(1)); absence of agreement leaves the default limits enforceable. The precise enforcement pathway, administrative action (refusal to register, condition enforcement) versus statutory penalties for breach, sits in the Act and its enforcement provisions referenced in the instrument.

Practical enforcement implications for practitioners: enforcement will typically follow from registration decisions, conditions included in licences, and the ACMA’s statutory powers in the Act. The instrument’s repeated cross-references (cl 17-20, cl 24-26) make clear that regulatory compliance and enforcement will be exercised under the Act and the various determinations and guidelines named. Because this instrument does not itself set fines or criminal offences, practitioners must turn to the Act for specific enforcement mechanisms and penalties.

Finally, note the ACMA’s disclaimers of liability in cl 10(1) advising that the ACMA and the Commonwealth accept no liability for losses arising from auction participation and urging participants to obtain independent advice. That is an administrative risk-allocation statement rather than an enforcement mechanism, but it signals the ACMA’s intent that auction participation is a private commercial risk subject to statutory allocation and issuance procedures.

This instrument is intentionally interlaced with the Radiocommunications Act 1992 and several existing legislative instruments and determinations. The instrument is made under s 39A of the Act (cl 3), and it expressly adopts terms and processes from the Radiocommunications (Spectrum Licence Allocation - Multi-band Auction) Determination 2017 (the allocation determination) (cl 5 definition and throughout, e.g. cl 10, cl 11, cl 13, cl 15). It also relies on the Radiocommunications (Spectrum Re-allocation - Regional 1800 MHz Band) Declaration 2015 (re-allocation declaration, cl 5 definition) for the broader 1800 MHz band description.

Statutory core conditions, registration, resumption and trading are governed by specific Act provisions the instrument references: s 66 core conditions (cl 17), s 67 payment of charges, s 68 third-party use, s 69 registration of transmitters, s 69A residency, s 71 power to include other conditions (cl 19(3)), s 72 variation of core conditions with licensee’s agreement (cl 17 Note), Part 3.5 registration rules (cl 20 and cl 24), Division 1 and Division 5 of Part 3.2 concerning third-party use and assignment (cl 25-26), s 85 requiring assignments to comply with trading rules and s 88 empowering ACMA to make those rules (cl 26). The instrument points readers back to those Act provisions for the operative statutory mechanics.

It references several other legislative instruments and determinations that operate in conjunction with it: the Radiocommunications Advisory Guidelines (three guidelines from 2012, cl 5), the Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 (cl 20 Note 3), the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (cl 24 Note), and the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 (cl 26 Note). Clause 6 states that references to these legislative instruments are to them “as in force from time to time”, so future amendments to these instruments will generally affect the operation of this marketing plan unless a contrary intention appears.

The instrument also depends on the Australian Spectrum Map Grid (ASMG) 2012 and its Hierarchical Cell Identifier Scheme (HCIS) for geographic delineation (cl 5 definitions, Schedule 2). That renders geographic coverage and boundary determinations dependent on a separate non-legislative technical instrument maintained by ACMA, and introduces cross-instrument reliance where the legal allocation references a separately maintained technical map.

Administrative and procedural interaction: the allocation determination sets detailed auction processes (cl 10(1) and cl 13(2) referencing Part 4 of the allocation determination), and Schedule 4 of the allocation determination governs post-auction allocation processes referenced in cl 10(3) and cl 18(1)(b). The instrument therefore functions as the marketing plan overlaying the allocation determination’s auction mechanics.

Compatibility with advisory guidelines: cl 22 explicitly states the advisory guidelines provide a means of coordinating licence services with other services. For specified fixed services listed in Schedule 5, cl 19(2) binds licensees to protections in Part 2 of one of those advisory guidelines (Managing Interference from Spectrum Licensed Transmitters - 1800 MHz Band) 2012, and prevents licensees from claiming protection from interference caused by those services.

In sum, the instrument is not a stand-alone regime: it is an implementation document that operates through, and in close reference to, the Act, multiple determinations, trading rules, advisory guidelines and the ASMG. Practitioners must therefore treat the instrument as part of a web of interdependent laws and technical instruments; compliance, enforcement and operative procedures will derive from the Act and the associated determinations the instrument references.

The instrument itself incorporates and references several earlier and co‑existing instruments and determinations, and its commencement is tied to a related variation instrument. The instrument begins by stating its name and that it commences immediately after the commencement of the Radiocommunications Spectrum Marketing Plan (1800 MHz Band) Variation 2017 (No.1) (cl 2). It is made under section 39A of the Radiocommunications Act 1992 (cl 3). The instrument defines and cross-references the Radiocommunications (Spectrum Licence Allocation - Multi-band Auction) Determination 2017 (the allocation determination) (cl 5 definition), and cites the Radiocommunications (Spectrum Re-allocation - Regional 1800 MHz Band) Declaration 2015 (cl 5 definition).

The instrument also references, and depends upon, advisory guidelines made in 2012: Radiocommunications Advisory Guidelines (Additional Device Boundary Criteria - 1800 MHz Lower Band) 2012; Radiocommunications Advisory Guidelines (Managing Interference to Spectrum Licensed Receivers - 1800 MHz Band) 2012; and Radiocommunications Advisory Guidelines (Managing Interference from Spectrum Licensed Transmitters - 1800 MHz Band) 2012 (cl 5). Schedule 4 and cl 20 further reference the Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 and the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (cl 24 Note).

The instrument’s clause 6 adopts the common drafting approach that references to other legislative instruments are to those instruments as in force from time to time. Thus, the marketing plan automatically tracks amendments to the allocation determination, the advisory guidelines (if amended), the unacceptable-levels determination, the register determination, and other instruments referenced, unless a contrary intention in this instrument exists (cl 6(1)-(2)). That drafting choice means the instrument’s operative effect can change as cross-referenced instruments are amended.

Two explicit temporal markers appear in the instrument: commencement “immediately after the commencement” of the related 1800 MHz Band Variation 2017 (No.1) (cl 2), and a fixed licence expiry date of 17 June 2028 for licences issued under this marketing plan (cl 16). For licences allocated through a post-auction process, the licence commencement date is the later of three dates, one of which is 1 February 2018 (cl 16(2)(c)), indicating a transitional temporal structure for post-auction allocations.

Schedule-based changes: the instrument introduces new schedules (Schedules 1-6) that concretely define lots, HCIS identifiers for regions, emission limits, specified fixed links, and a sample spectrum licence. Those schedules are part of the instrument and therefore part of its amendment history: any future amendment to this marketing plan would likely alter the lot definitions in Schedule 1 or the HCIS lists in Schedule 2.

In practice, the amendment history that affects this instrument includes the prior re-allocation declaration of 2015, the allocation determination of 2017, and the 2017 variation instrument that this plan follows on from; the instrument’s automatic incorporation of “as in force from time to time” references means other, later amendments to the linked determinations and guidelines will also shape how this marketing plan operates. Practitioners should therefore track amendments to the allocation determination, the trading rules, the unacceptable-levels determination and the advisory guidelines, as those amendments will alter obligations and entitlements that this marketing plan relies upon (see cl 6).

The instrument itself does not record any judicial decisions, case law or litigation history. It contains no references to court decisions, and the text does not identify any judicial interpretations of its provisions. Where the instrument refers to statutory powers (for example the ACMA’s powers under sections of the Act: s 66, s 71, s 72, s 85, s 88, s 145 and others, cl 17-20, cl 26), it does not cite any judicial authority or administrative appeal outcomes.

For practitioners seeking litigation-relevant materials, this means two points:

• There is no litigated body of law recorded in the instrument itself that interprets the marketing plan’s clauses. Any legal arguments about the meaning, application or validity of the plan’s provisions would need to be drawn from the Radiocommunications Act 1992 and judicial or tribunal decisions that interpret the Act or the referenced determinations, rather than from the marketing plan’s text.

• Because the instrument cross-references the allocation determination, the Act and other determinations and guidelines, litigation involving the practical operation of licences (for example, disputes over registration, interference, resumption/cancellation, trading or auction conduct) will likely be grounded in those sources. Any precedent that affects how the instrument operates in practice will therefore arise from case law or tribunal decisions addressing the Act’s provisions or the allocation determination rather than the marketing plan itself.

Practitioners should therefore search legal databases and administrative tribunal decisions for cases concerning auction procedures under the allocation determination, registration and interference disputes under Part 3.5 of the Act, trading and assignment disputes under Division 5 of Part 3.2, and any judicial review or contractual disputes involving ACMA’s discretionary powers referred to in the instrument. The instrument’s silence on litigation history means that users must not rely on the marketing plan document to reveal precedent; instead, they must research case law and tribunal decisions that give effect to the Act and the other referenced instruments.

Note also that administrative decisions of the ACMA (such as refusals to register transmitters) may be subject to merits review or judicial review under relevant statutes and judicial review principles, and those pathways will create the litigation history that may be applied to matters under this instrument. The instrument’s cross-references to the Act and regulatory determinations mean that litigation outcomes in those areas will shape how the marketing plan operates in practice.

The instrument contains specific drafting choices and technical particulars that can create practical pitfalls for applicants, licensees, equipment providers and advisers. These are concrete, source‑grounded “gotchas” drawn from the text.

1. Sample licence not definitive (cl 21). Schedule 6 is a sample spectrum licence and the instrument expressly cautions that the sample “may not reflect all the conditions included in a spectrum licence issued in accordance with the instrument.” Do not assume the sample text is the final licence language; ACMA may include other conditions under s 71 of the Act (cl 19(3)). Tender and contractual planning must therefore allow for licence-specific conditions.

2. Map is indicative only (Schedule 2 cl 2 Note and Schedule 2 2). The instrument states the pictorial map is indicative and ACMA does not accept responsibility for its accuracy. Geographic extent is defined through HCIS identifiers (Schedule 2 Table 1) not by the embedded map graphic, so bidders must verify the HCIS aggregation and not rely on the image.

3. HCIS complexity (Schedule 2). Regions are defined by HCIS identifiers at four hierarchical levels. Translating HCIS identifiers to precise geographic blocks requires consulting the ASMG and ACMA’s HCIS naming convention. Failure to map HCIS properly can lead to material misunderstanding of licensed geographic coverage.

4. Auction procedural leverage: pre-determined-price offer if single nominator (cl 10(2)). If only one applicant nominates a lot before auction rounds start, ACMA may offer allocation at a pre-determined price. Applicants seeking competition may be strategically affected by timing and nomination behaviour.

5. Licence term fixed and relatively short (cl 16). Licences commence on issue and expire on 17 June 2028, regardless of when issued. For post-auction allocations, commencement may be delayed to as late as 1 February 2018 depending on the post-auction application (cl 16(2)). Financial planning and secondary market valuation must account for the fixed expiry date.

6. Emission limit tables contain blank or non‑numerical cells (Schedule 4 Table 1 and Table 3). For example, Table 1 (Schedule 4 cl 2(3)) shows a blank radiated maximum true mean power value for the 200 kHz ≤ foffset < 900 kHz row. The instrument’s own structure (cl 2(2) of Schedule 4) does not explain the blank. Practitioners should not assume interpolation or apply external values; instead, obtain clarification from ACMA or the applicant information package.

7. Multiple technical measurement definitions and “good engineering practice” qualifier (cl 5 definitions). Terms such as “maximum true mean power”, “mean power” and “occupied bandwidth” are technically defined and the instrument notes measurement estimation should follow “good engineering practice.” Those qualifiers leave room for technical debate and measurement method disputes unless parties agree or the ACMA prescribes measurement methodology via the register determination or accredited-person certificates.

8. Registration thresholds and ACMA discretion (cl 20). Low-power mobile transmitters (≤ 39 dBm EIRP per occupied bandwidth) and fixed transmitters (≤ 33 dBm EIRP per occupied bandwidth) are exempt from registration. But the ACMA may still be able to refuse registration of transmitters under subsection 145(1) of the Act if they could cause unacceptable interference (cl 20 Note 1). The interplay between exemption thresholds and the ACMA’s interference test can produce edge cases.

9. Default emission limits versus negotiated agreements (Schedules 3 and 4 cl 1). The instrument allows affected licensees to set alternate maximum permitted levels by written agreement; but this requires unanimity among all affected frequency‑adjacent and area‑adjacent licensees. Securing unanimity may be difficult in practice, creating a bargaining problem where default limits will apply unless a full set of adjacent parties agree.

10. Trading and third-party rules rely on separate instruments (cl 25-26). Assignment and third-party use are permitted but must comply with the Act’s Divisions and the ACMA’s trading rules (Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012). Relying on secondary market strategies without studying those rules and their practical effect can lead to unexpected restrictions or procedural steps.

11. Specified fixed links asymmetry (cl 19(2) and Schedule 5). Where a specified fixed service operates under an apparatus licence, the spectrum licensee both must afford protections to that service and cannot claim protection from interference caused by it. Practitioners must map the interaction between apparatus licences and spectrum licences carefully; spectrum operators may face operational constraints near listed fixed links.

12. Cross-references to instruments “as in force from time to time” (cl 6). This instrument will be affected by amendments to the allocation determination, advisory guidelines and other referenced instruments. Legal advice should therefore be contextualised to current versions of those instruments.

Each of these items is a source‑grounded operational hazard. Addressing them requires cross-disciplinary input: legal review of allocation and trading rules, technical verification of HCIS mapping and measurement approaches, and commercial strategy around auction tendering and timing.

This section sets out practical, source‑grounded steps and checklists to comply with the instrument’s requirements. Each step cites the relevant clause or schedule so practitioners can map duties to the instrument text.

1. Pre-bid due diligence and application

   • Obtain and study the applicant information package published by ACMA (cl 13(1)). The package contains application requirements and auction process details as required by subsection 28(1) of the allocation determination (cl 13(1) note).
   • Verify lot definitions in Schedule 1 Table 1 and the HCIS identifiers for the region(s) in Schedule 2 Table 1. Convert HCIS identifiers into geographic coordinates or block areas using the ASMG so you understand the precise geographic area associated with each lot (cl 11(1), Schedule 2 cl 2).
   • Identify any specified fixed licences listed in Schedule 5 that intersect your intended service area and plan operational parameters accordingly (cl 19(2), Schedule 5).

2. Auction participation and payment

   • Follow the allocation determination’s Part 4 processes for application to take part in the simple clock auction (cl 10(1), cl 13(2)).
   • Account for the ACMA’s power to make a pre-determined-price offer where only one applicant nominates a lot before auction rounds start (cl 10(2)). Consider nomination timing and strategic implications.
   • Budget for the financial obligations: licences will be issued only after payment of the balance of the pre-determined price or the balance of the winning price (cl 15(1)). Ensure funds and payment mechanisms are in place.

3. Licence commencement, term and administrative steps

   • Know the licence commencement and expiry mechanics: licences commence on issue and expire on 17 June 2028 (cl 16(1)). For post-auction allocations the licence will commence on the later of the date stated in the post-auction application, the date issued, or 1 February 2018 (cl 16(2)). Plan deployment timelines accordingly.
   • After allocation, ensure ACMA registers the licence in accordance with Part 3.5 of the Act (cl 24). Follow procedures in Radiocommunications (Register of Radiocommunications Licences) Determination 2017 as applicable (cl 24 Note).

4. Transmitter registration and equipment certification

   • Comply with the licence condition prohibiting operation unless transmitter registration requirements under Part 3.5 of the Act are met (cl 20(1)).
   • If transmitter radiated power exceeds the specified exemptions, arrange registration and, where required, obtain certificates from accredited persons in accordance with the Radiocommunications (Unacceptable Levels of Interference - 1800 MHz Band) Determination 2012 (cl 20 Notes 2-3).
   • For equipment below exemption thresholds, document EIRP figures rigorously (mobile transmitters ≤ 39 dBm EIRP per occupied bandwidth; fixed transmitters always ≤ 33 dBm EIRP per occupied bandwidth) to support non-registration status claims (cl 20(2)).

5. Technical compliance: emission limits

   • Where no written agreement with all affected adjacent licensees exists, ensure operations comply with Schedule 3 limits for emissions outside the geographic area (maximum radiated true mean power of 54.5 dBm EIRP per 30 kHz, Schedule 3 cl 2(1)-(2)).
   • Ensure equipment meets the non-spurious and spurious emission limits in Schedule 4 (cl 2 and cl 3). Pay close attention to specified bandwidths and offset ranges (e.g. 30 kHz specified bandwidth cells and particular offset ranges in Tables 1-3). Where table entries appear blank, seek clarification from ACMA and the applicant information package rather than assuming values.
   • Use measurement techniques consistent with the definitions in cl 5 regarding mean power, true mean power and occupied bandwidth, and the instrument’s note that measurements and adjustments should follow “good engineering practice” for accuracy estimations (cl 5 definitions).

6. Agreements with adjacent licensees

   • If seeking emission limits different from the default, negotiate and execute a written agreement with all affected frequency-adjacent and area-adjacent licensees, since such an agreement replaces default limits (Schedule 3 cl 1(1) and Schedule 4 cl 1(1)). Ensure agreements are comprehensive because unanimity among affected parties is required for the alternate limits to apply.

7. Third-party use and trading

   • For authorising third parties to operate under your licence, comply with Division 1 of Part 3.2 of the Act (cl 25).
   • For assignment or dealing with the whole or part of a licence, follow Division 5 of Part 3.2 and the trading rules made under s 88 of the Act. Review the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 for procedural requirements and constraints (cl 26).

8. Operational coordination with specified fixed services

   • Where specified fixed services (Schedule 5) operate in overlapping or adjacent frequencies, ensure operation conforms with Part 2 of the Radiocommunications Advisory Guidelines (Managing Interference from Spectrum Licensed Transmitters - 1800 MHz Band) 2012 and acknowledge that you cannot claim protection from interference caused by those specified fixed services (cl 19(2)(d)-(e)).

9. Administrative liaison and record-keeping

   • Maintain clear records of HCIS mapping, emission measurements, registration certificates and any written agreements with adjacent licensees. These will be necessary for registration, for responding to ACMA inquiries or enforcement actions, and for supporting assignment or third-party authorisations.

10. Monitor instrument cross-references and updates

    • Track amendments to the allocation determination, the advisory guidelines and other referenced determinations because clause 6 treats references as to instruments “as in force from time to time.” Regularly check the Federal Register of Legislation and ACMA publications for updates to the allocation determination, trading rules, unacceptable-levels determination and the ASMG.

11. Seek interdisciplinary advice

    • The instrument itself recommends independent legal, technical and financial advice for auction participants (cl 10(1) note). Given technical measurement complexity, registration thresholds and trading constraints, involve legal counsel familiar with the Act and ACMA practice, RF engineers familiar with measurement protocols and accredited-person processes, and financial advisors for auction and payment modelling.

By following this concrete checklist and cross-referencing the specific clauses cited above (cl 11 for lot definitions; cl 13 for applicant package; cl 15 for payment; cl 16 for commencement and expiry; cl 17-20 and Schedules 3-4 for licence and technical obligations; cl 24-26 for registration, third-party use and trading), applicants and licensees can align operational practice with the instrument’s legal requirements. Where the instrument is silent or ambiguous (for example blank table entries in Schedule 4), seek written clarification from ACMA and document any clarifying correspondence.
