What it does
Mechanically, the Act authorises the Treasurer of Victoria to issue guarantees in connection with the planning, erection and outfitting of a single, identified medical facility, the Queen Victoria Medical Centre at Clayton (the Centre), and creates the budgetary and disclosure framework for those guarantees. The key powers and mechanics are: (a) the Treasurer may give guarantees of repayment of advances or financial accommodation to a Development Authority that is arranging construction and financing of the Centre, s 3(1); (b) the Treasurer may give guarantees of due performance by the Development Authority under contracts for the construction of the Centre, s 3(2); (c) any guarantee may be made alone or jointly with other persons, s 3(1); (d) guarantees are to be in such form and on such terms as the Treasurer thinks fit, and may extend to interest, charges and enforcement expenses, s 3(3)(a) and (b); (e) a beneficiary cannot assign or encumber the benefit of a guarantee without the Treasurer’s written consent, s 3(4); (f) the Treasurer must not issue guarantees of principal that would cause the aggregate principal liabilities under guarantees "executed under this Part" to exceed $150,000,000, s 3(5); (g) there is a standing appropriation from the Consolidated Fund for payment of liabilities under these guarantees, s 4, and any recoveries are to be paid back into the Consolidated Fund, s 4; (h) the execution of a guarantee by the Treasurer is conclusive evidence that the Act’s requirements for that guarantee have been complied with, s 5; and (i) the Treasurer must publish notice in the Government Gazette of each guarantee and lay a copy of that notice before each House of Parliament within six sitting days, s 6(1)-(3). Definitions of the Centre, construction and Development Authority are in s 2. The Act commenced on royal assent, s 1(2).
