Public Sector Employment (Award Entitlements) Act 2006

The Act builds a small conceptual framework around four interlocking terms: preserved award, preserved entitlements, relevant award, and statutory industrial agreement. These concepts determine what terms employees in the Victorian public sector retain and what types of agreements employers may not lawfully offer.

Preserved award and preservation time. A “preserved award” is an award as it stood at the preservation time (s 5(1)). The Act defines preservation time as the moment immediately before Schedule 1 to the Workplace Relations Amendment (Work Choices) Act 2005 (Commonwealth) commenced (s 3). That anchors preservation to a specific pre‑WorkChoices legal state, not to later state award variations except for specified increases (s 5(2)).

Deemed increases to preserved awards. The Act expressly deems preserved awards to include increases in minimum pay rates after the preservation time that arise from particular Commonwealth bodies or instruments: decisions or determinations of the Australian Fair Pay Commission, orders of the Australian Industrial Relations Commission, and orders or determinations of Fair Work Australia or the Fair Work Commission under Commonwealth Fair Work legislation (s 5(2)(a)-(d)). The inclusion of those increases makes preserved awards dynamic with respect to specified federal minimum wage developments, but not otherwise open to ad hoc alteration.

Relevant award and preserved entitlements. A “relevant award” for an employee is a preserved award that was binding on the employer at the preservation time and was applicable to the employee at that time (s 6(1)). More than one preserved award may be relevant to an employee (s 6(2)). The Act defines “preserved entitlements” as the employee’s terms and conditions of employment under a relevant award, to the extent those terms are not excluded or modified by an industrial instrument in force under the Commonwealth Act or a transitional arrangement under the Fair Work Transition Act (s 9). That operationalises a layering rule: preserved entitlements are the preserved award terms that still stand after accounting for valid Commonwealth instruments and transitional arrangements.

Mandatory non‑diminution and exceptions. The Act creates a strict non‑diminution rule: public sector employers must not provide a term or condition less favourable than preserved entitlements (s 10(1)). The statute contains defined exceptions where other instruments or agreements may lawfully provide different terms: a workplace agreement that passes the fairness test or is subject to the federal no‑disadvantage test while in operation (s 10(2)(a)); workplace determinations or enterprise agreements under the Commonwealth Fair Work Act (s 10(2)(b), (c)); and coverage by a modern award under the Fair Work Act (s 10(2)(e)). Those exceptions are discrete gateways through which preserved entitlements can be displaced.

Restrictions on statutory industrial agreements. Part 3A introduces the concept of “statutory industrial agreement” for the Act and then prohibits a public sector employer from offering or accepting a statutory industrial agreement that provides terms materially different from what would apply under a collective agreement, a relevant award or a designated preserved award (ss 15A, 15B). The Act goes further and declares that a public sector employer has no legal capacity or power to offer or accept such agreements (s 15C(1)-(2)). That declaration is treated as a corporations‑law displacement provision (s 15C(3)), signalling legislative intent that state law should control corporate capacity when it would otherwise be affected by Commonwealth corporations law.

Limited ministerial power. The Minister may publish a single Family Provisions standard based on the Family Provisions Test Case (s 7). That standard is an option the Minister may exercise once, not a continuing delegated power to set terms repeatedly.

Auxiliary concepts. The Act treats certain persons as employees (including police, protective services officers and police reservists for certain purposes, s 3 and note at s 3(2)), binds the Crown (s 8), and makes the Act prevail over inconsistent state laws (s 16). Regulations may exempt Part 3A or particular employers (s 15E) and the Governor in Council may make regulations to give effect to the Act (s 18).

The Act therefore weaves statutory protection of historic award terms with defined escape hatches and an explicit limit on the state public employer’s capacity to enter alternative statutory agreements.

Primary parties affected are public sector employers in Victoria and their employees. The Act’s definitions establish precise contours.

Public sector employers. “Public sector employer” is defined to include entities responsible for employing persons in public sector bodies under the Public Administration Act 2004, Departments under the Parliamentary Administration Act 2005, the Chief Commissioner of Police for police officers, protective services officers and police reservists, and any entities or classes prescribed to be public sector employers (s 3). That broad definition places state agencies, departments and certain statutory office holders within the Act’s reach. The Act binds the Crown (s 8), which means the obligations are intended to apply to the State as employer as well as to statutory authorities that are public sector employers by definition.

Employees. “Employee” is defined to mean an employee of a public sector employer and explicitly includes police officers, protective services officers and police reservists for operation of the Act (s 3 and note to s 3(2)). Part 3A extends the term “employee” to include a prospective employee for the purpose of that Part (s 15A). This inclusion is consequential: restrictions on offering statutory industrial agreements apply to offers to prospective employees as well as to existing employees (s 15B). The Act’s preservation objectives therefore cover recruitment and hiring processes.

Third parties and unions. The Act interacts with collective agreements and industrial instruments (s 3 definition of “collective agreement”, “industrial instrument”), so industrial organisations, representative unions and bargaining counterparts have interests in preserved entitlements and in the limited pathways for lawful variation (e.g., by enterprise agreement under the Commonwealth Fair Work Act, s 10(2)(c)). Commonwealth industrial bodies (Australian Fair Pay Commission, Australian Industrial Relations Commission, Fair Work Australia, Fair Work Commission) are also functionally implicated because their decisions can increase preserved awards under s 5(2), thereby changing preserved entitlements for Victorian public sector employees.

Private entities. Private employers generally lie outside the Act’s mandatory non‑diminution rule because the statute is specifically directed at public sector employers; however Part 3A’s declaration of lack of legal capacity (s 15C(3)) operates as a corporations‑law displacement provision, potentially affecting corporate capacity arguments for public sector employer entities established as corporations.

Regulators and the executive. The Minister has the power to publish a Family Provisions standard once (s 7). The Governor in Council may make regulations under s 18, and regulations may exclude the application of Part 3A to particular public sector employers or classes (s 15E). Those powers affect how the Act will be administered across the public sector and who may be exempted.

Who pays. The Act places financial and operational consequences on public sector employers as payors and decision‑makers. Because the Act deems preserved awards to include certain later increases set by federal bodies (s 5(2)), public employers bear the cost of those increases where they apply to preserved entitlements for their employees. The Act does not create express funding mechanisms; the obligation is statutory.

Who decides. The Act allocates decision roles: Commonwealth industrial bodies decide minimum pay increases that are folded into preserved awards (s 5(2)); the Minister can publish the Family Provisions standard (s 7); public sector employers and employees decide whether to enter workplace agreements that pass the relevant tests (s 10(2)(a)) or enterprise agreements under the Fair Work Act (s 10(2)(c)); and the Governor in Council can make regulations (s 18, s 15E) which may change how Part 3A applies.

Behavioural effect. Public sector employers must maintain preserved entitlements (s 10(1)), and they lack legal capacity to offer or accept statutory industrial agreements that are materially different from the relevant preserved terms (ss 15B-15C). Employers therefore face constraints on downgrading pay or conditions and on negotiating alternative statutory industrial agreements that substantially depart from preserved standards.

The Act establishes primary duties for public sector employers, conditional rights for employees, and specific administrative capacities for the Minister and the Governor in Council.

Duties on public sector employers

• Non‑diminution duty: A public sector employer must not provide a term or condition of employment to an employee that is less favourable than the employee’s preserved entitlements (s 10(1)). This is a strict statutory obligation expressed in imperative language.
• Capacity limitation on agreements: Under Part 3A a public sector employer must not offer an employee a statutory industrial agreement that provides terms materially different from those that would otherwise apply under a collective agreement, relevant award or designated preserved award; likewise it must not accept such offers from employees (s 15B(1)-(2)). Section 15C further declares that the employer has no legal capacity or power to offer or accept such agreements (s 15C(1)-(2)), which is a sharper constraint framed as an incapacity rather than only a proscribed act.
• Deference to preserved award content: Employers must treat preserved awards as including subsequent minimum pay increases set by specified Commonwealth mechanisms (s 5(2)). Practically, employers must implement those increases for preserved entitlements where they apply.

Exceptions and permitted conduct

• Lawful variation via qualifying agreements: Subsection 10(2) lists exceptions where the non‑diminution rule does not apply. A workplace agreement that passes the fairness test as it existed (or is subject to the federal no‑disadvantage test) may displace preserved entitlements while it operates (s 10(2)(a)). Enterprise agreements under the Commonwealth Fair Work Act, workplace determinations, and coverage by a modern award under that Act are separate exceptions (s 10(2)(b)-(e)). Those carve‑outs provide identifiable lawful pathways to vary employee terms.
• Common law top‑ups allowed: Part 3A expressly allows public sector employers to include in employment contracts terms more beneficial than what would be provided under a collective agreement or preserved award (s 15D). That preserves (or clarifies) employers’ discretion to grant greater benefits.

Rights and administrative powers

• Employee rights: The Act creates a statutory baseline right for employees that their terms will not be reduced below preserved entitlements (s 10(1)). Employees may therefore insist on preserved terms unless a permitted exception applies.
• Ministerial standard: The Minister may publish a Family Provisions standard based on the Family Provisions Test Case once (s 7(1)-(2)). This provides a standard template which may be referenced by employers and employees when assessing family provision entitlements.
• Regulatory powers: The Governor in Council may make regulations necessary to give effect to the Act (s 18). Regulations may also exempt Part 3A wholly or in part for specified employers or classes (s 15E). Those regulatory powers create administrative liabilities and discretion for the executive to tailor application across the public sector.

Legal capacity and Corporations Act displacement

• The declaration that public sector employers have no legal capacity or power to enter materially different statutory industrial agreements is accompanied by an express statement that these provisions are Corporations legislation displacement provisions for the purpose of s 5G of the Corporations Act (s 15C(3)). That means to the extent state law conflicts with corporations law as to capacity, the state provision will displace the Commonwealth provision to avoid inconsistency. The vote to frame incapacity at the state level alters the legal mechanics by which corporate entities that are public employers can claim authority to enter such agreements.

Implementation obligations

• Mapping preserved entitlements: Employers must identify relevant awards and preserved entitlements for each employee because the non‑diminution duty is employee‑specific (s 6(1)-(2); s 9). The Act contemplates multiple relevant awards could apply to one employee (s 6(2)), which creates a duty of careful assessment.
• Public law constraint: Because the Act binds the Crown (s 8) and applies despite other Acts (s 16), public authorities cannot rely on other statutory provisions to justify providing less favourable terms.

The Act does not itself specify enforcement routes or penalties within its text. It provides mandatory commands and capacity limitations (s 10, Part 3A), and empowers regulation (s 18), but leaves penalties, dispute resolution or administrative enforcement mechanisms to be found elsewhere or in regulations if enacted.

The Act contains mandatory prohibitions and declarations of incapacity but does not, in its own text, prescribe specific civil or criminal penalties. Enforcement and compliance therefore arise from a combination of statutory obligations, the common law, regulatory instruments (if any), and other applicable legal remedies.

What the text provides

• Mandatory obligations and prohibitions: The statute uses imperative language , for example, “must not provide” in s 10(1) and “must not offer” or “must not accept” in ss 15B(1)-(2) , creating clear statutory duties. Section 15C declares a public sector employer has no legal capacity or power to offer or accept a statutory industrial agreement that is materially different (s 15C(1)-(2)). The Act therefore creates legal prohibitions and, in one place, an incapacity rather than a mere offence.
• Regulatory power to prescribe matters: Section 18 gives the Governor in Council broad power to make regulations “for or with respect to any matter or thing required or permitted by this Act to be prescribed or necessary to be prescribed to give effect to this Act.” Regulations could, in principle, create offences, compliance mechanisms, dispute resolution or administrative sanctions. The Act itself does not specify such regulations in the text as published (s 18).
• Corporations law displacement: Section 15C(3) declares the incapacity provisions to be Corporations legislation displacement provisions under s 5G of the Corporations Act. That reduces the risk that corporations law would be used to override the statutory incapacity in the context of corporate public sector employers.

Gaps and consequential enforcement mechanisms

• No express penalties within the Act: The Act does not contain express monetary fines, criminal sanctions or an administrative penalty regime. There is no provision for an inspectorate, civil penalty regime, or administrative compliance notices within the text supplied.
• Enforcement likely through civil process or other Acts: Because the Act creates statutory duties but does not specify sanctions, enforcement would commonly be through civil remedies, for example by seeking declarations, injunctions or damages in the courts, or by relying on statutory industrial law dispute mechanisms under related Commonwealth instruments referenced in the Act. The Act also preserves common law rights and does not exclude them (s 15D), so contract and tort remedies remain available. The regulatory power in s 18 could be used to create administrative enforcement mechanisms, but such regulations are not contained in the text.
• Potential for judicial review and contract invalidity: The statutory declaration of no legal capacity (s 15C) may render attempted agreements void or voidable if courts treat incapacity as affecting the validity of the instruments. That is a legal consequence embedded in the statutory wording; the Act itself does not specify the remedy or the process. The Act also binds the Crown (s 8), which makes judicial review an avenue for public servants or third parties to challenge executive action that contravenes the Act, subject to procedural and subject‑matter limitations of public law.

Who enforces? The Act does not appoint a specific enforcement agency or officer. The Governor in Council’s regulation power (s 18) could be used to establish compliance responsibilities or enforcement agencies, but that requires separate regulation-making. In practice the enforcement landscape will likely involve a mix of:

• private civil actions by employees or unions seeking relief;
• industrial processes under Commonwealth instruments where those instruments apply (noting s 10(2) exceptions);
• administrative remedies under regulations if the Executive chooses to create them.

Summary. The Act creates clear statutory duties and a statutory incapacity, but leaves the design of practical enforcement mechanisms to either existing legal processes (courts, industrial tribunals, common law) or to regulation under s 18. Practitioners should note the absence of express sanctions in the Act itself and the potential for regulation to add enforcement architecture later.

The Act is explicitly designed to operate in a landscape populated by Commonwealth industrial law and existing state and federal instruments. Its text both defers to and overrides other legal sources in precise ways.

Primacy and override. The Act states it applies despite anything to the contrary in any other Act, passed before or after its commencement, unless expressly excluded (s 16). The text declares the Act is intended to limit any provision concerning the legal capacity and powers of a public sector employer. That means where a state law conflicts with the obligations or incapacity in this Act the later expression of policy in this Act takes precedence within the state law framework.

Relationship to Commonwealth industrial instruments. The Act’s core preservation construct explicitly takes account of Commonwealth instruments and transitional arrangements:

• Preserved awards are defined with reference to awards as in force at the preservation time under the pre‑amendment Commonwealth Act (s 5(1); s 4(1)).
• The Act deems preserved awards to include certain post‑preservation minimum pay increases resulting from decisions of Commonwealth industrial bodies (s 5(2)(a)-(d)). Those federal determinations thereby affect the content of preserved entitlements under this state Act.
• Preserved entitlements are defined in s 9 as the terms under a relevant award to the extent they are not excluded or modified by an industrial instrument in force under the Commonwealth Act, or continued under a Fair Work Transition arrangement. That explicitly recognises Commonwealth industrial instruments as capable of excluding or modifying preserved terms.

Exceptions to non‑diminution tied to federal instruments. Section 10(2) lists exceptions where employers can lawfully provide terms different from preserved entitlements: workplace agreements passing the fairness or federal no‑disadvantage tests (s 10(2)(a)), workplace determinations or enterprise agreements under the Commonwealth Fair Work Act (s 10(2)(b)-(d)), and coverage by a modern award under the Fair Work Act (s 10(2)(e)). Those carve‑outs function as harmonisation mechanisms allowing Commonwealth instruments and outcomes under the Fair Work framework to displace preserved entitlements.

Corporations Act interaction. Section 15C(3) expressly declares the incapacity provisions to be Corporations legislation displacement provisions for the purposes of s 5G of the Corporations Act. Under s 5G, if a State law declares a provision to be a corporations legislation displacement provision, any inconsistent Corporations Act provision does not operate to the extent necessary to avoid inconsistency. Therefore, the Act preempts conflict with corporations law arrangements about corporate capacity insofar as public sector employers are concerned.

Common law and contractual freedom. Part 3A contains an express saving: nothing in Part 3A prevents a public sector employer from including in an employee’s contract a term more beneficial than what the collective agreement or preserved award would provide (s 15D). The Act otherwise preserves common law legal relations by not excluding common law remedies and recognising contract law can be used to provide better terms.

Regulatory instruments. The Act confers power to make regulations (s 18) and permits regulations to exempt Part 3A or elements of it for particular public sector employers or classes (s 15E). That means future state regulations could change the practical interplay between this Act and other state or federal instruments by granting exemptions or detailing implementation mechanisms.

Transitional and historic instruments. Several defined terms reference pre‑WorkChoices and transitional arrangements: “preservation time” is tied to the date immediately before the commencement of Schedule 1 to the Workplace Relations Amendment (Work Choices) Act 2005 (s 3). “Designated preserved award” relates to preserved awards in respect of which the Workplace Rights Advocate (WRA) made a determination under s 12 before its repeal (s 3). The Table of Amendments shows WRA was subsequently repealed and definitions were updated (endnotes, Table of Amendments). Practitioners must therefore map historic determinations and transitional arrangements when assessing preserved entitlements.

Net effect. The Act is not isolationist. It both preserves a historic state baseline and incorporates specified Commonwealth developments while also providing legal mechanisms to defer to federal enterprise agreements and modern awards. It both overrides inconsistent state law (s 16) and displaces aspects of corporations law for public sector employer capacity (s 15C(3)). The regulatory power (s 18) and exemption power for Part 3A (s 15E) create further interaction points where later state instruments can alter the statutory landscape.

The endnotes include a Table of Amendments that records successive legislative changes to the Act between enactment and the version dated 30 March 2022. The text shows several consequential amendments and insertions; this section summarises the changes recorded in the Act’s endnotes and links them to the relevant provisions.

Original enactment and commencement. The Public Sector Employment (Award Entitlements) Act 2006 was assented to on 11 April 2006 and, according to the endnotes, came into operation on 3 July 2006 (endnotes, Minister’s second reading and commencement note). The long title indicates it was intended to protect public sector employment entitlements and to amend other Acts (endnotes).

Public Sector Acts (Further Workplace Protection and Other Matters) Act 2006 (No. 80/2006). Sections 21-22 of that amending Act commenced on 11 October 2006 and inserted Part 3A (ss 15A-15E) into the principal Act (table of provisions and endnotes indicate Pt 3A inserted by No. 80/2006 s. 22). This introduced the definitions for collective agreement and statutory industrial agreement and created the restriction on offering statutory industrial agreements (ss 15A-15E).

Public Sector Employment (Award Entitlements) Amendment Act 2008 (No. 27/2008). This amending Act commenced on 4 June 2008 and repealed Part 3 (which had previously contained ss 11-15), among other changes (endnotes). The 2008 amendments also replaced certain definitions and removed the fairness test in one place (s 3(1) def. of fairness test repealed by No. 27/2008 s. 5(c)). The text contains several editorial notations that mark where s 10(2)(a) was amended by No. 27/2008 s. 6 and other substantive changes were made.

Workplace Rights Advocate (Repeal) Act 2009 (No. 21/2009). This Act, assented 10 June 2009 and with s 7 commencing on 1 October 2010, repealed the WRA and made consequential changes to definitions in the principal Act (endnotes). The definition of WRA in s 3 was amended to reflect repeal and residual references to determinations by the WRA are preserved through the “designated preserved award” concept (s 3 definition).

Fair Work (Commonwealth Powers) Act 2009 (No. 24/2009). Assented 17 June 2009 and commenced 1 July 2009 for sections 14-18, this amending Act updated multiple definitions and inserted references to the Commonwealth Fair Work Act regime. It added definitions such as “Commonwealth Fair Work Act” (s 3) and adjusted the list of instruments and exceptions in s 10(2) to recognise enterprise agreements and modern awards under the Fair Work Act (noted in the Act text and endnotes). Substantial modifications under this package harmonised the principal Act with the new federal Fair Work framework.

Statute Law Revision Act 2011 (No. 29/2011). This made editorial or technical changes and came into operation on 22 June 2011 for the item cited (endnotes), revising definitions and making style amendments without changing substantive policy in the principal Act.

Victoria Police Amendment (Consequential and Other Matters) Act 2014 (No. 37/2014). Assented 3 June 2014 and with a commencement date of 1 July 2014 for certain items, this amending Act inserted definitions for “police officer”, “police reservist” and “protective services officer” into s 3 so they have the same meanings as in the Victoria Police Act 2013 and also adjusted the definition of public sector employer to mention the Chief Commissioner responsibilities (endnotes).

Regulatory Legislation Amendment (Reform) Act 2022 (No. 13/2022). Assented 29 March 2022 and commenced s 76 on 30 March 2022, this Act made further formal amendments, including updates to references to Fair Work bodies (endnotes show s 76 amendments amending s 5(2)(c) and inserting references to the Fair Work Commission). The principal Act reflects those changes in s 5(2).

Other editorial amendments. Throughout the text there are parenthetical notes marking where definitions were amended (for example s 3(1) def. of Commonwealth Act, Fair Work Commission, WRA). The endnotes track each amending Act with assent and commencement dates and the affected provisions.

Practical implication of amendments. The amendment history shows a pattern: the principal Act was drafted to preserve pre‑WorkChoices awards, then adjusted to fit the post‑2009 Fair Work federal architecture and to reflect the repeal of the Workplace Rights Advocate office. Part 3A was an early insertion to control statutory industrial agreements offered by public employers. Subsequent amendments primarily import Fair Work era vocabulary and administrative changes (e.g., renaming Fair Work Australia to Fair Work Commission in later amendments).

This note draws only on the Table of Amendments recorded in the Act’s endnotes and the text as incorporated to 30 March 2022. Practitioners should cross‑check the chronology in the state legislative database for any amendments after the version date.

The Act’s text and endnotes reference one named industrial decision, but the statute, its endnotes and the Table of Amendments do not list any judicial or tribunal litigation about the Act itself. The one referenced decision is the Family Provisions Test Case of the Full Bench of the Australian Industrial Relations Commission on 8 August 2005 (s 3 definition “Family Provisions Test Case”). That decision is the basis for the Family Provisions standard the Minister may publish under s 7(1)-(2). The Act does not attach any other named case law to its provisions nor does the endnotes include a litigation record.

What the Act records

• Family Provisions Test Case: The Act expressly refers to the Family Provisions Test Case as the judicial/tribunal decision underlying the Family Provisions standard that the Minister may publish (s 3 definition; s 7(1)). The Act therefore imports the Test Case as a source of template terms in one limited context.
• WRA determinations: The definition of “designated preserved award” refers to preserved awards in respect of which the WRA made a determination under s 12 before its repeal (s 3), which evidences an administrative history. The Work‑Place Rights Advocate office was later repealed (endnotes), leaving the results of some prior WRA determinations preserved in the statutory structure. The Act does not list litigation involving WRA determinations in the endnotes.

Absence of statutory litigation record. The Act’s endnotes include a section “3 Explanatory details” in which at the date of publication it states “No entries at date of publication.” There is no statutory registry of litigation in the text. The Act therefore does not provide a consolidated litigation history.

Implications for practitioners. Because the statute does not set out enforcement mechanisms or an internal dispute resolution scheme, disputes about whether an employer has provided terms less favourable than preserved entitlements, whether a preserved award applies to a particular employee, or whether a purported statutory industrial agreement is “materially different” will likely be litigated in courts or tribunals under general judicial processes, existing industrial law regimes, or via contract law causes of action. The Act’s lack of prescribed litigation procedures means case law interpreting the Act (if any) would be developed in the general courts and industrial tribunals. The Act as provided does not contain a list of cases to consult beyond the Family Provisions Test Case reference.

Practical research note. The absence of litigation history in the Act does not mean there has been no litigation. It means the statutory text and endnotes here do not report cases. Practitioners seeking authoritative precedents should search court and tribunal databases for post‑2006 decisions addressing the Act’s provisions, particularly disputes about the meaning of “preserved entitlements”, the scope of “materially different” in Part 3A, and judicial treatment of the s 15C incapacity clause.

The Act contains several drafting features and structural choices that create practical traps for employers, employees and advisers. The following points are high‑risk areas where the statute’s wording can produce uncertainty, administrative burden or unintended legal consequences.

1. “Materially different” is undefined. Part 3A prohibits offering or accepting statutory industrial agreements that are “materially different” from terms under a collective agreement, a relevant award or a designated preserved award (ss 15B(1)-(2); 15C(1)-(2)). The statute does not define “materially different” or set an objective threshold. That opens immediate interpretive risk: small drafting changes might or might not be judged material by a court or tribunal, and employers seeking to innovate in contract design will face legal uncertainty about what departures are permitted. The Act does provide a safe route: top‑ups are allowed if more beneficial (s 15D), but materially different down‑wards changes are proscribed.

2. Preservation includes some post‑preservation federal increases. Preserved awards are deemed to include subsequent minimum pay increases ordered by specified Commonwealth bodies (s 5(2)(a)-(d)). That means preserved entitlements may rise over time with federal minimum wage adjustments even though the preserved award otherwise refers to a snapshot in time (s 5(1)). Employers may under‑budget if they treat preserved awards as frozen at the preservation time without checking for applicable federal increases.

3. Multiple preserved awards may apply. Section 6(2) permits more than one preserved award to be a relevant award for an employee, and s 6(1) requires the preserved award to have been binding on the employer at the preservation time and applicable to the employee at the preservation time. That requires employers to undertake careful historical mapping of employment relationships and past award coverage, which can be administratively onerous, particularly for employees who have transferred between employers or roles since the preservation time.

4. Exceptions create switching pathways , and traps. Subsection 10(2) provides exceptions enabling workplace agreements that pass pre‑repeal fairness tests or federal no‑disadvantage tests, enterprise agreements under the Fair Work Act, workplace determinations, or coverage by modern awards to displace preserved entitlements. These gateways are discretionary and subject to federal law tests; employers that attempt to rely on them without satisfying the required federal tests may find themselves in breach of the state non‑diminution duty.

5. Incapacity declaration has legal consequences beyond mere prohibition. Section 15C declares a public sector employer has no legal capacity or power to offer or accept a statutory industrial agreement that is materially different. That is drafted as an incapacity rather than just an offence. An incapacity can render purported contracts void ab initio and may bar ratification, which raises substantial legal risk if an employer mistakenly executes such an agreement.

6. Corporations Act displacement is limited but important. Section 15C(3) declares these provisions to be Corporations legislation displacement provisions. That affects conflicts between state limitations and Commonwealth corporations law. But the displacement operates only to the extent necessary to avoid inconsistency and does not create positive power where none existed. Public sector employers that are corporate entities should still exercise caution.

7. Part 3A may be waived by regulation. The Act allows regulations to provide that Part 3A or parts of it do not apply to a public sector employer or class of employer (s 15E). That creates contingent operational risk: employers may be compliant today but subject to future regulatory exclusions that change the permissible agreement landscape, or a currently exempt employer may later be brought into Part 3A coverage.

8. No express penalties in the Act. The Act contains mandatory prohibitions but no express penalty regime within the text. Enforcement pathway uncertainty means remedies will depend on the courts, tribunals or later regulations (s 18). Practitioners should not assume a fixed fine or administrative penalty exists because none is contained in the Act.

9. Family Provisions standard is a one‑time instrument. The Minister can specify a Family Provisions standard based on the Family Provisions Test Case only once (s 7(1)-(2)). This single‑use discretion means timing matters: whether the Minister elects to publish the standard and the content chosen have permanent significance, subject only to potential repeal or amendment by later statute or regulation.

10. Definitions tied to historical Commonwealth Acts. Many definitions reference the pre‑amendment Commonwealth Workplace Relations Act and the preservation time tied to the WorkChoices schedule (s 3). Correctly applying the Act therefore requires historical knowledge of employer binding instruments as at the preservation time. Employers may misidentify relevant awards if they do not account for historical award coverage and WRA determinations that were made before repeal.

11. Treatment of police and protective services. Police officers, protective services officers and police reservists are explicitly treated as employees of the Chief Commissioner of Police for the purposes of the Act (s 3(2)). That allocation affects who is the employer and which preserved awards apply; advising on police employment entitlements therefore needs to account for that special rule.

Bottom line: advisers should treat the Act as a preservation statute with asymmetric risk (prohibition on diminished terms, unclear thresholds for permitted departures), and should build historical award mapping, procedures for checking federal increases that feed into preserved awards, and conservative contract drafting practices to avoid creating agreements that could be judged “materially different” or void for incapacity.

Compliance requires a practical programme of legal review, data mapping, contract design and decision rules. Below are concrete steps for public sector employers and advisers, derived from the Act’s text.

1. Map the universe of employees to relevant preserved awards (s 6, s 9)

• For each employee, identify preserved awards that were binding on the employer at the preservation time and that were applicable to the employee at that time (s 6(1)). Record multiple preserved awards if relevant (s 6(2)).
• Determine preserved entitlements as the terms and conditions under those preserved awards, subject to exclusion or modification by industrial instruments in force under the Commonwealth Act or continued under Fair Work Transition arrangements (s 9).

2. Track federal minimum wage and determination changes that feed into preserved awards (s 5(2))

• Maintain a schedule of pay rate changes by the Australian Fair Pay Commission, orders of the Australian Industrial Relations Commission, and orders/determinations of Fair Work Australia or the Fair Work Commission (s 5(2)(a)-(d)). Treat these increases as part of preserved awards when they apply.

3. Audit existing employment terms and compare to preserved entitlements (s 10(1))

• For each contract or employment arrangement, assess whether any term is less favourable than the employee’s preserved entitlements. If yes, the arrangement is prohibited under s 10(1), unless a listed exception applies.
• Where current terms may be less favourable due to past changes, rectify terms proactively to align with preserved entitlements or rely on a lawful exception where appropriate.

4. Use lawful gateways when you need to vary preserved entitlements (s 10(2))

• If variation is necessary, do so only through permitted mechanisms:
  • Workplace agreements that pass the fairness test as in force before repeal or that are subject to the federal no‑disadvantage test, for as long as those agreements operate (s 10(2)(a)).
  • Workplace determinations or enterprise agreements under the Commonwealth Fair Work Act if applicable (s 10(2)(b)-(d)).
  • Coverage by a modern award under the Fair Work Act (s10(2)(e)).
• Ensure federal tests and certification processes are properly satisfied before relying on one of these routes.

5. Avoid proposing or accepting statutory industrial agreements that are “materially different” (ss 15A-15C)

• Do not offer or accept a statutory industrial agreement that is materially different from the terms under a collective agreement, relevant award or a designated preserved award (s 15B(1)-(2)).
• Recognise the statutory incapacity: the employer has no legal capacity or power to enter such an agreement (s 15C(1)-(2)). Treat any such attempt as legally unreliable and potentially void.
• If you wish to vary terms, prefer contract top‑ups or arrangements that are more beneficial (permitted by s 15D) rather than downward variations.

6. Use contract terms to provide benefits but not to undermine preserved entitlements (s 15D)

• The Act allows employers to include more beneficial terms in contracts of employment than those in preserved awards or collective agreements (s 15D). Use this to offer enhancements rather than reductions.

7. Document decision processes and obtain legal sign‑off

• Keep contemporaneous records that demonstrate how preserved entitlements were identified and how any proposed change complies with s 10 exceptions or is otherwise lawful under the Act (s 10(2); s 15E in respect of exemptions).
• Before executing any workplace agreement or purported statutory industrial agreement, obtain legal sign‑off that the agreement does not create a materially different arrangement from preserved entitlements.

8. Monitor regulation and ministerial action (ss 7, 15E, 18)

• Track any regulations made under s 18 and any use of s 15E to exempt the application of Part 3A to particular employers or classes.
• If the Minister publishes a Family Provisions standard under s 7, review employment family provisions against that standard, noting the Minister may exercise the power only once (s 7(2)).

9. Special handling for police, protective services officers and reservists (s 3(2))

• Treat these personnel as employees of the Chief Commissioner of Police for the purposes of preserved entitlements and mapping (s 3(2)). Coordinate with the appropriate police employer unit to ensure consistent application.

10. Prepare remedies and dispute‑handling pathways

• Because the Act lacks express internal penalty provisions, plan for dispute resolution through negotiated processes, the courts, or applicable industrial tribunal procedures where Commonwealth instruments apply. Ensure HR and legal teams are ready to respond to claims for breach of preserved entitlements.

11. Training and change control

• Train HR and industrial relations staff on the meaning of “preserved entitlements”, the prohibited conduct in s 10(1), and the incapacity provisions in Part 3A to avoid inadvertent breaches.
• Set up an internal change control process that requires legal review before implementing any employment term changes that could be less favourable than preserved entitlements or that could be materially different under Part 3A.

12. Financial planning

• Budget for potential pay increases that are deemed part of preserved awards due to federal determinations (s 5(2)). Because these increases are statutory additions to preserved awards, they create ongoing cost obligations for public sector employers.

13. Consult unions and bargaining representatives early

• Where variation is contemplated, consult industrial representative bodies early to determine whether a lawful pathway exists (enterprise agreement under Fair Work, etc.) and to manage risk of disputes or industrial action.

Following these concrete steps, grounded in the relevant statutory provisions (notably ss 3, 5, 6, 7, 9, 10, 15A-15E and 18), will reduce the risk of contravening the Act and will provide a defensible administrative record in the event of a dispute.
