changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any examples, diagrams or notes inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, form part of that Act. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of an Act. \nSee section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the **Public Sector Employment (Award Entitlements) Act 2006** by Acts and subordinate instruments.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––\n\n**Public Sector Acts (Further Workplace Protection and Other Matters) Act 2006, No. 80/2006**\n\n| Assent Date: | 10.10.06 |\n| --- | --- |\n| Commencement Date: | Ss 21, 22 on 11.10.06: s. 2(1) |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n**Public Sector Employment (Award Entitlements) Amendment Act 2008, No. 27/2008**\n\n| Assent Date: | 3.6.08 |\n| --- | --- |\n| Commencement Date: | 4.6.08: s. 2 |\n| Current State: | All of Act in operation |\n\n\n**Workplace Rights Advocate (Repeal) Act 2009, No. 21/2009**\n\n| Assent Date: | 10.6.09 |\n| --- | --- |\n| Commencement Date: | S. 7 on 1.10.10: Government Gazette 30.9.10 p. 2286 |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n**Fair Work (Commonwealth Powers) Act 2009, No. 24/2009**\n\n| Assent Date: | 17.6.09 |\n| --- | --- |\n| Commencement Date: | Ss 14–18 on 1.7.09: Special Gazette (No. 227) 1.7.09 p. 1 |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n**Statute Law Revision Act 2011, No. 29/2011**\n\n| Assent Date: | 21.6.11 |\n| --- | --- |\n| Commencement Date: | S. 3(Sch. 1 item 76) on 22.6.11: s. 2(1) |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n**Victoria Police Amendment (Consequential and Other Matters) Act 2014, No. 37/2014**\n\n| Assent Date: | 3.6.14 |\n| --- | --- |\n| Commencement Date: | S. 10(Sch. item 138) on 1.7.14: Special Gazette (No. 200) 24.6.14 p. 2 |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n**Regulatory Legislation Amendment (Reform) Act 2022, No. 13/2022**\n\n| *Assent Date:* | 29.3.22 |\n| --- | --- |\n| *Commencement Date:* | S. 76 on 30.3.22: s. 2(3) |\n| Current State: | This information relates only to the provision/s amending the **Public Sector Employment (Award Entitlements) Act 2006** |\n\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––\n\n3 Explanatory details\n\nNo entries at date of publication.","sortOrder":0}],"analysis":{"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"Since enactment the Act's scope has been adjusted by amendments that broadened what counts as preserved entitlements (deeming certain post‑preservation pay increases to be included; s.5(2)), incorporated Fair Work transitional instruments and modern awards into exclusions (s.3; s.10(2)(c)–(e)), and added Part 3A which restricts public sector employers from entering statutory industrial agreements that 'materially differ' from collective agreements or preserved awards (ss.15A–15C). However, amendments in 2006 (Part 3A), 2008, 2009, and 2022 have expanded it to: (1) block individual statutory agreements that undercut collective bargaining, (2) accommodate the Fair Work Act 2009 transition including modern awards and enterprise agreements, (3) incorporate ongoing federal wage-setting mechanisms (Fair Work Commission), and (4) extend coverage to new employee categories like protective services officers. The Act has evolved from a transitional preservation mechanism into a permanent structural constraint on Victorian public sector industrial relations, effectively operating as ongoing 'no-disadvantage' protection regardless of which federal industrial relations system is in force."},"complexity_factors":["Multiple overlapping definitions referencing both current and repealed Commonwealth legislation (Workplace Relations Act 1996, Fair Work Act 2009, Fair Work Transition Act)","Complex temporal references ('preservation time', 'pre-amendment Commonwealth Act', 'WR Act repeal day') requiring historical knowledge of federal industrial relations changes","Nested conditional exceptions in section 10(2) with five separate pathways for exemption from the main preservation obligation","Cross-referencing between Victorian and Commonwealth jurisdictions, including references to Corporations Act displacement provisions (section 15C(3))","Amendment history visible in text creates fragmentation (e.g., repealed sections 11-15, repealed Part 5, multiple amendment notes throughout)","Extended and modified definitions for specific contexts (e.g., 'employee' has extended meaning in Part 3A, specific inclusion of police reservists and protective services officers)","Interaction between 'preserved awards', 'relevant awards', and 'designated preserved awards' creates a three-tier classification system"],"plain_english_summary":"This Victorian law protects the pay and conditions of public sector workers (like government employees, police officers, and protective services officers) by preventing their employers from offering them worse deals than what they were entitled to under old industrial awards (legal documents setting minimum wages and conditions).\n\n**What it does:**\n- **Locks in old protections**: It \"preserves\" the terms and conditions from awards that existed before the federal Work Choices laws started in 2006. This means Victorian public sector employers can't pay less or offer worse conditions than those old awards guaranteed.\n- **Blocks dodgy individual contracts**: It stops public sector employers from using statutory industrial agreements (individual contracts made under law) to undercut collective agreements or awards. Employers legally cannot offer, and employees cannot accept, individual contracts that are materially different from (worse than) the collective deal.\n- **Keeps pace with wage increases**: Even though the old awards are \"frozen\" in time, the law automatically updates preserved entitlements to include pay rises decided by federal bodies like the Fair Work Commission.\n\n**Who it affects:**\n- Victorian public sector employers (government departments, agencies, and the Chief Commissioner of Police)\n- Public sector employees, including police officers, protective services officers, and police reservists\n\n**Why it matters:**\nThis law acts as a safety net. When the federal government changed industrial relations laws in 2006 (Work Choices) and later in 2009 (Fair Work), this Victorian legislation ensured that public sector workers in Victoria couldn't be forced onto worse individual contracts that stripped away their award conditions. It essentially forces public sector bosses to maintain fair minimum standards and prevents them from using individual agreements to bypass collective bargaining."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
