#### 80 Delegation of functions of agency head 80 Delegation of functions of agency head > > (1) The head of an agency may— > > > > > (a) delegate the exercise of a function of the head of the agency under this Act, other than this power of delegation, to a person employed in or by the agency, and > > > > > (b) by agreement, delegate the exercise of a function of the head of the agency under this Act to the head of another agency. > > > (2) Despite subsection (1), the following functions of the head of an agency may not be delegated— > > > > > (a) the head of the agency’s functions as a disclosure officer for the agency, > > > > > (b) the head of the agency’s responsibility for ensuring the agency complies with sections 34 and 61.
