51 Persons acting as travel agents—the Act, s 4
> > (1) A person who carries on business as a travel agent is exempt from the Act in relation to the person’s acts or omissions when carrying on business as a travel agent.
>
> > (2) A person carries on business as a travel agent if the person carries on a business involving the following, whether or not in the course of, or as incidental to, or in connection with, another business—
> >
> > > (a) selling tickets entitling another person to travel on, or otherwise arranging a right of passage for another person on, a conveyance,
> >
> > > (b) selling, or arranging or making available, rights of passage to, and hotel or other accommodation at, one or more places—
> > >
> > > > (i) which are within or outside New South Wales, or
> > >
> > > > (ii) some of which are within, and others of which are outside, New South Wales,
> >
> > > (c) purchasing for resale the right of passage on a conveyance,
> >
> > > (d) the making, by a person who carries on an activity referred to in paragraph (a), (b) or (c), of a travel related arrangement, either separately from or in conjunction with the activity.

> > (3) A person also carries on business as a travel agent if the person holds out or advertises that the person is willing to carry on an activity referred to in subsection (2).

> > (4) In this section—

> > travel related arrangement means an arrangement commonly made in connection with an activity referred to in subsection (2)(a), (b) or (c).
