What it does
This instrument is a boundary‑setting schedule that delineates the spatial extent and internal zoning of the Murray Marine Park in the Southern Ocean. It does not contain operative prohibitions, permit schemes, enforcement provisions or penalties. Mechanically it accomplishes three tasks.
First, it declares the outer boundary of the Murray Marine Park as a polygon of latitude/longitude coordinates and navigational descriptors (geodesic, meridian, parallel), and it explicitly excludes "coastal waters" in relation to the State of South Australia (Part 1). The Part 1 description comprises fifteen sequential points and connecting legs (for example, commencing at 36°31′57″S, 136°48′06″E and proceeding by geodesic and meridian/parallels through specified points to the point of commencement).
Second, it subdivides the marine park into three internal zones, each captioned with an International Union for Conservation of Nature (IUCN) category:
- a Sanctuary Area Zone labelled IUCN Category Ia , Strict Nature Reserve (Part 2), with its own set of bounding coordinates;
- a Special Purpose Area Zone labelled IUCN Category VI , Managed Resource Protected Area (Part 3), with its own bounding coordinates;
- a Multiple Use Area Zone also labelled IUCN Category VI , Managed Resource Protected Area (Part 4), which is presented in two sub‑polygons (a) and (b), each with coordinates and an express exclusion of South Australian coastal waters.
Third, the instrument furnishes three definitional or interpretive references as part of the schedule rather than embedding definitions in the body of the schedule: it identifies the legal source that defines coastal waters in relation to the States and the Northern Territory (Coastal Waters (State Powers) Act 1980 and Coastal Waters (Northern Territory Powers) Act 1980), it specifies the geodetic datum for coordinates (Geocentric Datum of Australia 1994 (GDA94) as described in Gazette GN35 of 6 September 1995), and it anchors the outer limit reference to the exclusive economic zone to a proclamation under the Seas and Submerged Lands Act 1973 (Proclamation dated 26 July 1994, Gazette S290 of 29 July 1994). These references are enacted as connective material to establish what is meant by "coastal waters", what coordinate system to use, and what legal limit counts as the "outer limit of the exclusive economic zone".
