What it does
This legislative instrument, the Private Health Insurance (Risk Equalisaton Administration) Rules 2025 (the Rules), revokes and replaces the 2015 equivalent (the Private Health Insurance (Risk Equalisation Administration) Rules 2015). It prescribes the administrative record-keeping requirements that a private health insurer must satisfy to participate in the risk equalisation mechanism under the Private Health Insurance Act 2007 (the Act). The Rules are made by a delegate of the Australian Prudential Regulation Authority (APRA) under subsection 333-25(1) of the Act, for the purposes of section 318-15. They commence on 30 September 2025.
Mechanically, the Rules achieve three things. First, they revoke the previous 2015 instrument. Second, they define categories of complying health insurance policies for risk equalisation data purposes: single, couple, 2 or more persons with no adults, single parent, and family. Third, they oblige an insurer to keep detailed records for each policy in each health benefits fund it conducts. The records must include personal identifiers (name, date of birth, age, principal place of residence) for each insured person; the type of cover (hospital treatment, hospital‑substitute treatment, chronic disease management programs, ambulance service, other general treatment); whether excesses or co‑payments apply; the policy category; and, for each benefit paid, the insured person's name, the medical or health specialty, the type of treatment, the disease type if a chronic disease management program, the gross benefits paid, and the dates of treatment and payment.
A separate rule (rule 5) applies if the insurer includes a gross benefit for the high cost claimants pool in a quarterly return. In that case, additional records must be kept for the relevant insured person: name, age, treatment dates, gross benefits paid, payment dates, the amount allocated to the age based pool, the amount allocated to the high cost claimants pool, and the amount of gross benefits paid for any of the preceding three quarters (after 1 April 2007). The Rules cross-reference the Private Health Insurance (Health Insurance Business) Rules 2018 for the definition of chronic disease management program and the Private Health Insurance (Risk Equalisation Policy) Rules 2025 for the high cost claimants pool and age based pool definitions. The instrument does not itself set contribution rates, payment obligations, or the formula for distributing risk equalisation amounts; it is purely an administrative data‑keeping rule that enables APRA to collect and verify the information needed to operate the pools.
