4Application of Act

##### 4 Application of Act (1) Subject to subsection (2), this Act applies in relation to the supply of goods or services: (a) by a Commonwealth authority; (b) by a foreign corporation; (c) by a trading corporation in the course of, or for the purposes of, its trading operations; (d) by a financial corporation in the course of, or for the purposes of, its business operations; (e) by a body corporate incorporated in a Territory (other than the Northern Territory or Norfolk Island); (f) in an internal Territory (other than the Northern Territory), the Territory of Christmas Island or the Territory of Cocos (Keeling) Islands; or (g) in the course of, or in connection with, trade or commerce: (i) among the States; (ii) between a State and an internal Territory; (iia) between a State and the Territory of Christmas Island or the Territory of Cocos (Keeling) Islands; (iib) between an internal Territory and the Territory of Christmas Island or the Territory of Cocos (Keeling) Islands; (iic) between the Territory of Christmas Island and the Territory of Cocos (Keeling) Islands; or (iii) between 2 internal Territories; and not otherwise. (2) This Act does not apply in relation to the supply of goods or services by: (a) an authority, institution or other body (except a society, association or incorporated company) established for a public purpose by or under a law of Norfolk Island; or (b) a society, association or incorporated company in which a controlling interest is held by Norfolk Island, or an authority, institution or other body covered by paragraph (a).
