Pool Betting Act 1964

The Act revolves around a small set of tightly defined concepts that determine scope and regulatory reach. The statutory dictionary supplies working definitions that should be read as integral to the Act (s 2; dict). The core concepts are:

• Pool betting competition: a competition or transaction where members of a group bet with each other not at fixed odds and where winnings or prizes are determined by reference to the stake money or entry fees paid by the group (dict). This definition frames the activity regulated as pari‑mutuel or pool betting rather than fixed odds wagering. Any analysis of whether a particular betting product falls under the Act must test whether the product is "otherwise than fixed odds" and whether winnings are determined by reference to the stake pool rather than a bookmaker's offered odds (dict).

• Pool betting scheme: an arrangement for conducting one or more pool betting competitions and includes negotiation, receipt or payment of money connected to such competitions (dict). The scheme concept captures the organisational and transactional architecture of pooled betting: promoters, collection mechanisms, coupon systems, prize distribution and settlement processes fall within the scheme concept. A "promoter" is the person carrying on the scheme (dict).

• Approved pool betting scheme: a scheme for which the commission has granted an approval under section 6 (dict; s 6). The approval is the statutory gateway to lawful operation in the ACT, and it may be granted with conditions that the commission considers necessary to protect participant interests and ensure proper conduct (s 6(5)). Approval status affects advertising, printing and distribution freedoms (ss 7-9).

• Commission: the gambling and racing commission is the regulator named by the Act; it is the decision maker for approvals, the first instance enforcement authority for audits and supervision, and the party empowered to enter intergovernmental agreements under s 13C (dict; ss 6, 10, 13, 13C).

• Levy on interstate competitions: where a promoter lawfully conducts a competition under a State law and receives money paid in the ACT in connection with an entry submitted in the ACT, the promoter is liable to pay to the Territory either a specified amount or a prescribed percentage of the duty that would be payable under the State's law (s 13A(1)). The default prescribed percentage is 50 per cent unless the commission sets a different percentage by disallowable instrument (s 13A(2)). This is a territorially targeted levy seeking to capture a share of State duty receipts attributable to ACT-sourced entries.

Secondary but operationally significant concepts include "soccer football pool", which is carved out of s 6(3) (dict; s 6(4)), and "unlawful game", which the dictionary directs the reader to the Unlawful Gambling Act 2009 (dict). The Act also treats printed matter and coupon distribution as separately regulated activities, with discrete offences and penalties (ss 8-9). The audit concept is operationalised: the commission may require audited statements, retain books and printed matter, and authorise persons to obtain information and require answers during audits (s 10). The supervision concept gives authorised supervisors power to enter premises, direct persons concerned with the scheme and be shown authority on request; obstruction is an offence (s 13).

Key structural features flow from these concepts. Approval is a discretionary gate, subject to statutory limits (s 6(2)-(3)). Conditions may be imposed to protect participants; contravention is penalised (s 6(5); s 5(2)). The Act separates approval and levy regimes, treating schemes lawfully carried on under another State law as normally outside approval unless an agreement exists (s 6(3)), but simultaneously subjects interstate promoters to territorial levies for ACT‑sourced entries (s 13A). The commission can use both administrative measures (conditions, audits, supervisory powers) and criminal penalties (contraventions and specific offences) to regulate conduct (ss 5, 10, 12, 13). The dictionary and cross‑references to other statutes (Gambling and Racing Control Act 1999, Unlawful Gambling Act 2009, Legislation Act 2001 notes) signal that some operational detail, forms and related scope are handled outside this Act.

The Act’s primary legal targets are promoters of pool betting schemes, persons involved in conducting or facilitating such schemes (including printers, distributors and advertisers), the gambling and racing commission as regulator, and persons who submit entries in the ACT to schemes run under other jurisdictions’ laws. Secondary impact falls on intermediaries such as printers, advertisers, and venues where coupons or advertising might be displayed.

Promoters: A person who carries on a pool betting scheme must secure an approval under section 6 unless the scheme is lawfully conducted under another Territory law (s 5(1); s 4). Promoters are the named duty-bearers for a large part of the Act: they must not operate without approval (s 5(1)), must comply with approval conditions (s 5(2)), must provide receipts, disbursements and books if required for audit (s 10(1)), must not misappropriate stake money, entry fees, winnings or prizes (s 12), and, if they operate under State law and receive ACT-sourced money, they have a levy liability to the Territory (s 13A). Promoters who operate under State law and receive ACT entries will face additional compliance risk because the commission refuses approvals for schemes lawfully carried on under a State law unless an agreement exists (s 6(3)), and the promoter will remain subject to the levy without the approval pathway unless a s 13C agreement addresses collection (s 13A, s 13C).

Commission: The gambling and racing commission is the decision-maker for approvals (s 6), may impose conditions and enforce them, may require and retain financial records and printed matter for audit (s 10), may authorise individuals to conduct supervision and audits (s 10(2)-(3); s 13(1)), and may enter collection agreements with States (s 13C). The commission also determines the prescribed percentage for the levy by disallowable instrument (s 13A(2)). The commission therefore bears enforcement costs and administrative burdens in operating approvals, audits and intergovernmental arrangements.

Printers, advertisers and distributors: The Act criminalises printing of coupons, and distribution or circulation of coupon, entry form or printed card in connection with a non-approved competition (ss 8-9). Advertising, sign or notice in public places visible from public places that relates to pool betting competitions that are not under an approved scheme is prohibited (s 7). Entities that produce printing material, post public displays or circulate coupons will face these restrictions and potential penalties.

Bettors and members of the public: The Act aims to protect participants through the commission’s power to impose conditions and supervise competitions (s 6(5); s 13(1)-(2)). Participating persons are indirectly affected by the safeguards, by the levy regime insofar as a proportion of duty-like amounts may be payable to the Territory when they submit entries to interstate promoters (s 13A). The Act does not create individual licensing obligations for bettors but imposes protections and penalties targeting organisers.

Interstate promoters and State authorities: Promoters operating lawfully under a State law are expressly caught by s 13A where they receive money paid in the ACT in connection with ACT-submitted entries, making them liable to pay the Territory a share tied to the State duty. Section 13C empowers the commission to enter agreements with the appropriate State authority to collect these amounts in the State and remit them to the Territory. Thus the Act affects interstate enforcement and fiscal arrangements.

Service providers and venues: Any place in which advertising is displayed or where coupons might be distributed, including venues visible from a public place, can be implicated by the advertising and distribution offences (s 7). Printers who produce coupons on behalf of clients should check approval status; unauthorised printing is an offence (s 9).

Other regulators and laws: The Act cross‑references forms approved under the Gambling and Racing Control Act 1999 (s 6 note) and excludes operations already lawful under other Territory laws (s 4). It also relies on the Unlawful Gambling Act 2009 for the definition of "unlawful game" (dict). Entities operating under other laws must map their compliance across multiple instruments.

The Act assigns clear duties to promoters and persons concerned in schemes, and confers rights and administrative powers on the commission and authorised persons. Key duties include obtaining approval, complying with approval conditions, recordkeeping, cooperating with audits, respecting restrictions on advertising and printed materials, and avoiding misappropriation and obstruction.

Duty to obtain approval: A person must not conduct a pool betting competition except under, and in accordance with, an approved pool betting scheme approval granted under section 6 (s 5(1)). This is the central duty-creating provision. The duty is disjunctive for schemes lawfully carried on under other Territory laws because s 4 excludes those activities.

Duty to comply with approval conditions: Where approval is granted under s 6, it is subject to the conditions the commission considers necessary to ensure the scheme is properly conducted and participant interests are protected (s 6(5)). The person carrying on the scheme must not contravene an attached condition (s 5(2)). The commission must notify applicants in writing of grant or refusal as soon as practicable (s 6(6)), and a certificate from the commission is admissible evidence about whether an approval exists and its conditions (s 6(7)).

Recordkeeping and audit cooperation: The commission may by written notice require a person concerned in carrying on a pool betting scheme to provide a written statement showing the whole of receipts and disbursements and to deliver books, documents, coupons and printed matter relating to the competition (s 10(1)). The commission may keep those materials and have them audited by an authorised person (s 10(2)). An authorised auditor may require information and answers necessary for the audit (s 10(3)). Persons required to comply with these requirements face a maximum penalty of 50 penalty units or imprisonment for 6 months, or both (s 10(4)).

Duty to avoid misappropriation: A person concerned in carrying on a scheme must not convert stake money, entry fees, winnings or prizes to their own use (s 12). The maximum penalty is 50 penalty units or imprisonment for 6 months or both.

Restrictions on advertising, distribution and printing: Persons must not print, publish, display in a public place, distribute or circulate adverts, coupons, entry forms or printed cards in connection with a pool betting competition other than one under an approved scheme (ss 7-9). Penalties are set out for each offence (ss 7-9).

Duty to cooperate with supervision and avoid obstruction: If the commission authorises a person to supervise a competition, that authorised person may enter premises and give directions necessary to protect participants (s 13(1)-(2)). Persons must not hinder or obstruct the authorised supervisor or contravene directions; obstruction is penalised (s 13(3)).

Levy payment duty: Where an interstate promoter receives money paid in the ACT in connection with an entry, that promoter is liable to pay to the Territory either a specified amount (soccer football pools) or a prescribed percentage of the amount payable by way of duty under the relevant State law (s 13A(1)). The prescribed percentage is the commission’s determined percentage or 50 per cent by default (s 13A(2)). Amounts become due 21 days after the end of the calendar month when the amount became payable (s 13B).

Rights and administrative powers of the commission: The commission has the discretionary power to grant or refuse approvals (s 6(2)), to attach conditions to approvals (s 6(5)), to audit and retain records (s 10(2)), to authorise auditors and supervisors (ss 10(2), 13(1)), to require information and answers (s 10(3)), to determine prescribed percentages for levy by disallowable instrument (s 13A(2)), and to enter intergovernmental collection agreements (s 13C(1)). The commission also must notify applicants of grant or refusal (s 6(6)), and a certificate it issues is evidence of approval and conditions (s 6(7)). Those powers enable both regulatory surveillance and fiscal collection activities.

Interactional duties: The commission is barred from granting approval in relation to a scheme lawfully carried on under a State law unless there is an agreement under s 13C (s 6(3)). However, s 6(4) exempts soccer football pools from that limitation. Where an agreement is terminated, any associated approval ceases to be in force by operation of s 6(8).

Procedural safeguards: Approvals are to be issued in writing (s 6(6) implies written notice), and the commission’s determinations on levy percentage are disallowable instruments, meaning they are subject to parliamentary oversight (s 13A(3) and note).

Regulatory powers are complemented by criminal penalties for non‑compliance. The Act links administrative duties (apply, keep books, allow audits) to specific penalties to create enforcement leverage rather than leaving matters to civil regulatory sanctions alone.

The Act sets criminal penalties for a range of offences, and vests enforcement powers principally in the gambling and racing commission via audit and supervision instruments. Penalties are expressed principally as penalty units and, for more serious breaches, include the possibility of imprisonment. At the republication date the penalty unit value is noted as $110 for an individual and $550 for a corporation (endnote to front matter, referencing the Legislation Act 2001).

Key offences and maximum penalties

• Conducting pool betting without approval, or contrary to an approval condition: Maximum penalty 50 penalty units, imprisonment for 6 months or both (s 5(1)-(2)). This is the principal licensing offence.

• Failure to comply with audit requirements: A person served with a notice under s 10 to provide statements, books or printed matter, or to answer auditors, must comply. Non‑compliance attracts a maximum penalty of 50 penalty units, imprisonment for 6 months or both (s 10(4)).

• Misappropriation of stake money, entry fees, winnings or prizes: Maximum penalty 50 penalty units, imprisonment for 6 months or both (s 12). This creates personal criminal exposure for persons "concerned in the carrying on of a pool betting scheme."

• Obstruction of an authorised supervisor: Hindering or obstructing an authorised supervisor in the exercise of powers is punishable by up to 50 penalty units, imprisonment for 6 months or both (s 13(3)(a)). Contravening a direction given by the authorised supervisor attracts a maximum 50 penalty units (s 13(3)(b)).

• Advertising or public display of material relating to a non‑approved pool betting competition: Maximum penalty 10 penalty units (s 7).

• Distribution or circulation of coupons, entry forms or printed cards in connection with a non‑approved competition: Maximum penalty 10 penalty units (s 8).

• Printing of coupons, entry forms or printed cards for a non‑approved competition: Maximum penalty 5 penalty units (s 9).

Enforcement mechanisms

• Audit and information powers: Under s 10 the commission may require statements, books and printed matter and may retain them for audit. An authorised auditor can demand information and answers (s 10(1)-(3)). These powers enable document production and testimonial cooperation without a separate court order, though non‑compliance is criminalised (s 10(4)).

• Supervision: The commission may authorise a person to supervise a competition and that person may enter premises, give directions and be shown the notice of authority; obstruction is an offence (s 13(1)-(3)). Supervision is a regulatory incursion intended to protect participants by on‑site oversight.

• Certificates as evidence: A certificate issued by the commission specifying approval status and conditions is admissible evidence in proceedings (s 6(7)). This procedural device streamlines proof of regulatory status in enforcement actions.

• Levy enforcement and intergovernmental mechanisms: Section 13A creates a monetary liability for interstate promoters receiving ACT‑sourced money. Section 13C allows the commission to enter agreements with State authorities for collection in the State and payment to the Territory. The Act thus contemplates administrative collection through State mechanisms rather than direct enforcement in all cases (s 13C(1)-(2)).

Regulatory discretion and parliamentary oversight

• The commission’s discretion to grant or refuse approvals (s 6(2)) and to set levy percentage by determination (s 13A(2)) is significant. The levy determination is a disallowable instrument, subject to parliamentary disallowance (s 13A(3) and note), so there is an accountability mechanism.

• The Act vests the commission with both administrative and criminal enforcement levers. Administrative action includes withholding or terminating approvals (s 6(8) on termination of State agreement), requiring records (s 10), and authorising supervisors (s 13). Criminal sanctions back these powers where compliance is necessary to ensure integrity and participant protection.

Practical enforcement implications

• The penalty differentials between printing (5 penalty units), distribution (10 units), and operating without approval or misappropriation (50 units, possible imprisonment) indicate a calibrated enforcement regime: the most serious conduct, which directly threatens financial integrity and unapproved operation, attracts the harshest penalties (ss 5, 12, 9, 8, 7).

• The commission’s ability to retain and audit documents and compel answers without a separate warrant or court process (s 10) accelerates investigations but places strict compliance obligations on promoters and associated persons, backed by criminal sanctions.

• The levy regime relies on co‑operation with State authorities or the promoter’s voluntary compliance; s 13C contemplates formal collection agreements, and absence of such agreement could complicate recovery of amounts due under s 13A.

The Act explicitly cross‑references and defers to other domestic instruments, creating a regulatory perimeter rather than a full stand‑alone scheme. The principal interactions evident in the text are with other Territory laws, State laws, and specific Acts named in notes and the dictionary.

Territory law exclusion: Section 4 provides that the Pool Betting Act does not apply to betting that may lawfully be conducted under any other Territory law. That exclusion means if another ACT enactment already regulates a particular betting activity, the Pool Betting Act will not duplicate regulation. Practically, entities operating under another Territory regime need to determine which statutory regime governs their activity and whether the Pool Betting Act’s approval requirement is engaged.

Gambling and Racing Control Act 1999: Section 6 contains a note that, if a form is approved under the Gambling and Racing Control Act 1999, s 53D for an application, that form must be used. This indicates that procedural elements, such as approved application forms and possibly other administrative apparatus, are housed in the Gambling and Racing Control Act and its subordinate instruments. Operational compliance will therefore involve navigating both statutes.

Unlawful Gambling Act 2009: The dictionary defines "unlawful game" by reference to the Unlawful Gambling Act 2009. This cross‑reference narrows the scope of schemes that must apply for approval, as s 6(1) allows application other than for schemes involving betting on or by reference to the playing of an unlawful game. Similarly, the Act elsewhere refers to the Unlawful Gambling Act for definitions, which creates an integrated compliance landscape where activities illegal under the Unlawful Gambling Act are excluded from the approval pathway because they are otherwise illegal.

State law and levy interface: Sections 6(3), 13A and 13C create a two‑way interaction with State regimes. Section 6(3) bars the commission from granting approval for schemes lawfully carried on under a State law unless there is a s 13C agreement with the appropriate State authority in relation to the promoter. This places constraints on approvals where the primary regulatory authority is a State. At the same time, s 13A imposes a territory‑level levy on promoters who are lawfully conducting pool betting under State law but receive money paid in the ACT in connection with ACT entries. Section 13C enables the commission to enter collection agreements with States so that amounts payable under s 13A can be collected in the State and remitted to the Territory. The interaction is therefore fiscal and administrative: the Act will not displace State regulatory jurisdiction for schemes lawfully run under State law, but it can extract a levy and requires interjurisdictional collection agreements for approvals.

Disallowable instruments and the Legislation Act 2001: The commission’s determination of a prescribed percentage for levy purposes is a disallowable instrument (s 13A(3) and note). This means the Legislative Assembly may disallow such determinations under the Legislation Act 2001. The Act also references the Legislation Act for definitions, the status of notes (s 3), and penalty unit calculations (front matter endnote). Users must treat administrative determinations and some procedural matters as statutory instruments subject to parliamentary oversight.

Criminal law cross‑linkage: The Act’s offences (misappropriation, obstruction, non‑compliance) interact with general criminal law. The amendment history indicates the Criminal Code (Theft, Fraud, Bribery and Related Offences) Amendment Act 2004 affected the Act via schedule entries (endnotes). The Act does not elaborate its interaction with the general criminal code beyond prescribed maximum penalties and prison terms, but prosecutorial decisions and sentencing will be administered under general criminal procedures.

Regulations: Section 15 empowers the Executive to make regulations for the Act, which will be subordinate legislation and may include matters of procedure, further definitions, or enforcement mechanisms. Any regulatory instrument will be subject to the notification and presentation requirements under the Legislation Act 2001.

Forms and administrative practice: Given references to an approved application form under the Gambling and Racing Control Act 1999 (s 6 note), administrative practice and forms are likely governed across instruments. Practitioners must look beyond the Pool Betting Act to secondary instruments and other Acts for the full administrative procedure.

Overall, the Act is not a closed system. It delegates and defers to other Territory statutes for forms and definitions, it is conditioned by State regulatory regimes via the levy and approval constraints, and it embeds parliamentary oversight via disallowable instruments. Compliance and enforcement therefore require reading this Act together with the Gambling and Racing Control Act 1999, the Unlawful Gambling Act 2009, the Legislation Act 2001, and relevant State laws governing pool betting in the States where promoters are based.

The Act has a multistage legislative history starting as a Commonwealth ordinance and subsequently subject to multiple amendments. The endnotes attached to the republication provide the authoritative timeline of enactments and amendments through to the republication date, 22 March 2010.

Origins and conversion to Territory law: The Pool Betting Act 1964 began as the Pool Betting Ordinance 1964 (Ord1964‑15) of the Commonwealth (endnote 3). The Self‑Government (Citation of Laws) Act 1989 and related provisions converted many ordinances into Territory enactments on self‑government day, 11 May 1989 (endnote 3). The Act’s name was changed from Ordinance to Act as part of these processes (endnote 3).

Major amendments and chronological markers recorded in the endnotes include:

• Ordinance amendments in the 1960s through 1980s: The Ordinances Revision (Decimal Currency) Ordinance 1966 (Ord1966‑19) amended the Act (endnote 3). Subsequent Pool Betting Amendment Ordinances in 1981, 1982 (Ord1981‑1; Ord1982‑18; Ord1982‑101), and 1984 (Ord1984‑26) introduced further changes (endnote 3). These early amendments reworked operational provisions.

• Conversion and consequential amendments around self-government: The Self‑Government (Consequential Amendments) Ordinance 1989 (Ord1989‑38 sch 1) and other related conversion instruments adjusted the Act on conversion to ACT enactment (endnote 3).

• Post‑self‑government legislative amendments: After becoming a Territory enactment, the Act was amended by the Pool Betting (Amendment) Act 1990 (A1990‑48) which commenced some provisions on 1 January 1991 (endnote 3). The Financial Management and Audit (Consequential and Transitional Provisions) Act 1996 (A1996‑26), the Statute Law Revision (Penalties) Act 1998 (A1998‑54), and the Gambling and Racing Control (Consequential Provisions) Act 1999 (A1999‑47) amended various provisions (endnote 3).

• Structural and definitional amendments in 2001 and later: The Legislation (Consequential Amendments) Act 2001 (A2001‑44) and subsequent amendments relocated definitions into the dictionary and changed section numbering for clarity (endnote 3; amendment history). The Criminal Code (Theft, Fraud, Bribery and Related Offences) Amendment Act 2004 (A2004‑15) affected provisions relating to falsification and related offences (endnote 4). The Statute Law Amendment Act 2007 (No 2) A2007‑16 made further changes including relocation of definitions to the dictionary and other textual amendments (endnote 4).

• Interaction with Unlawful Gambling Act 2009: The Unlawful Gambling Act 2009 (A2009‑39) amended or influenced definitions in the Pool Betting Act; the amendment history records A2009‑39 sch 2 pt 2.5 as taking effect with some parts commencing 22 March 2010 (endnote 4).

Detailed amendment annotations in the endnotes identify specific provisions that were inserted, amended, relocated or removed over time. For example, the dictionary additions and relocations are annotated: the definitions for "approved pool betting scheme", "commission", "pool betting competition", "pool betting scheme", "promoter", "soccer football pool", and "unlawful game" were relocated to the dictionary under A2007‑16 (amdt 3.132-3.136) (endnote 4). Schedule amendments related to penalties, falsification offences and delegation provisions are recorded (endnote 4).

Regulatory instruments and forms: The Act’s note in s 6 signals that forms approved under the Gambling and Racing Control Act 1999, s 53D, must be used where relevant. Over time, the administrative interface between the Pool Betting Act and the Gambling and Racing Control Act has been formalised through these consequential amendments (endnote 4).

Republishing and editorial changes: The front matter explains that the republication incorporates editorial amendments authorised by the Legislation Act 2001, part 11.3 and that the Parliamentary Counsel’s Office may make formal editorial changes when preparing republications (front matter). Endnotes provide the legislative history and amendment history up to the republication date.

Implications for compliance: The amendment history shows the Act has been iteratively modernised (relocation of definitions, refinement of offences, alignment with other gambling laws). Practitioners should consult the consolidated instrument and confirm any post‑2010 amendments or subordinate instruments, including commission determinations under s 13A, and any regulations made under s 15, because the Act’s operational detail depends on forms, determinations and potential State agreements not contained within the Act text.

The republication and the Act as provided do not record any judicial decisions or litigation history. The statute’s endnotes and contents list show amendments, schedules and cross‑references, but do not include case law or references to specific judgments. The Act itself contains procedural devices such as admissibility of the commission’s certificate in proceedings (s 6(7)), and criminal penalties that would be enforced through ordinary criminal process, but the text does not cite litigation or set out any precedent.

Practical consequences of the absence of in-text litigation history

• No statutory case law within the Act: The Act should be read on its face for obligations and offences; there are no interpretive pointers from decided cases embedded in the republished text. This means legal interpretation will rely on the ordinary rules of statutory construction, the dictionary definitions, and any relevant case law outside the Act (which is not provided here).

• Potential for interpretive issues: Key terms such as "pool betting competition", "otherwise than fixed odds", "concerned in the carrying on of a pool betting scheme", and the scope of the commission’s discretion under s 6 may give rise to litigation in practice. For example, disputes might arise over whether a particular product is fixed odds or a pool bet, whether a person is a "promoter" or merely an agent, or whether an approval condition is valid. None of those questions have been settled in the document provided.

• Evidentiary devices and administrative decisions: The Act’s provision that a certificate from the commission specifying whether an approval has been granted is evidence in proceedings (s 6(7)) promotes an administrative evidentiary mechanism that may be the subject of litigation over secondary issues such as the certificate’s accuracy or procedural fairness in issuing approvals or conditions. Again, no cases are cited.

• Levy enforcement may generate interstate litigation: Section 13A creates a novel territorial levy on interstate promoters receiving ACT-paid entries for State-law competitions. Disputes could arise as to calculation, characterisation (is the amount captured a duty?), or collection, especially where s 13C agreements are absent or ambiguous. The Act’s text does not show whether such disputes have been litigated.

Advice for practitioners: Because the Act does not record litigated interpretations, practitioners should not rely on statutory commentary for settled law. Legal advisers should search case law databases and tribunal decisions for any subsequent interpretations or enforcement actions under the Pool Betting Act, and for any matters relating to s 13A levies, commission determinations under s 13A(2), approvals under s 6, and the interaction with State law under s 6(3) and s 13C. The absence of litigation history in the republished statute highlights the importance of external legal research for authoritative interpretive material.

The Act contains several operational pitfalls for promoters, intermediaries and regulators that may not be obvious on a first reading. These are concrete statutory mechanisms that create compliance traps, fiscal obligations and administrative uncertainties.

Approval dependence and the State law gap: The commission may not grant approval for a scheme lawfully carried on under State law unless there is an agreement under s 13C with the appropriate State authority (s 6(3)). That means a promoter lawfully operating in a State who seeks ACT approval may be blocked in the absence of intergovernmental agreement. At the same time, s 13A makes such interstate promoters liable for a levy in relation to ACT-sourced entries. The practical issue is that approval and levy regimes interact asymmetrically: a promoter could be prevented from getting an ACT approval while still being liable for a levy, and recovery of the levy may depend on a s 13C agreement. Promoters who operate across borders must therefore map approval availability and levy exposure separately.

Default 50 per cent prescribed percentage: The prescribed percentage for the levy is 50 per cent unless the commission determines otherwise (s 13A(2)). Unless the commission has made a lower determination, an interstate promoter could face a levy equal to half of the duty that would otherwise be payable under the State law, calculated in the specified way. The Act requires that the determination be a disallowable instrument (s 13A(3)), but until a different percentage is set, the default applies.

Termination of State agreement has automatic approval consequence: If a s 13C agreement is terminated, any approval granted in relation to the scheme that relied on that agreement ceases to be in force by force of s 6(8). Promoters relying on approvals linked to intergovernmental agreements must track agreement status because approvals will automatically collapse on termination.

Advertising and public visibility: The advertising prohibition extends to display in any place that is visible from a public place (s 7(b)). That is a broad visibility standard that can trip up promoters who use online or window displays viewable from public thoroughfares. The provision is not limited to paid public advertising; the visible-from-public-place test is the statutory trigger.

Separate offences for printing, distribution and advertising: Printing coupons is an offence separate from distribution (ss 9 and 8). Printers, print shops and in-house print units face risk even if they are not promoters, because printing a coupon in connection with a non‑approved competition is penalised (s 9). The maximum penalty differs (printing 5 penalty units, distribution 10 units), so both activities must be considered.

Audit powers and testimonial obligations: An authorised auditor can require a person to provide information in their possession or accessible to them and to answer questions considered necessary for the audit (s 10(3)). Such an obligation potentially raises privilege and self‑incrimination issues in practice; the Act enforces compliance by criminal penalty (s 10(4)). Persons should assess documentary and testimonial exposure when responding to audit notices.

Misappropriation offence extends to "persons concerned": Section 12 criminalises conversion of stake money, entry fees or winnings by any person "concerned in the carrying on of a pool betting scheme". The phrase is broad. Even peripheral actors involved in administration could risk liability if their conduct is characterised as conversion, whether intentional or through commingling funds. The Act does not define the precise threshold for being "concerned in" the scheme.

Certificate evidence: The commission’s certificate that an approval has been granted and the conditions attached is evidence in proceedings (s 6(7)). This shifts some evidentiary burden to the regulator in prosecutions and civil disputes, but also reduces discovery friction for prosecutors. Defendants must be prepared to challenge such certificates if inaccurate.

Interplay with other Territory laws and forms: Section 4 excludes betting lawfully conducted under any other Territory law. Practitioners should not assume Pool Betting Act coverage without cross‑checking other Territory licensing regimes, and must use forms required under the Gambling and Racing Control Act where applicable (s 6 note). Failure to use prescribed forms can create procedural non‑compliance.

Timing for levy payments: Amounts payable under s 13A become due 21 days after the end of the calendar month when the amount became payable (s 13B). Promoters operating across jurisdictions must have accounting systems that allocate ACT-sourced receipts and calculate due dates accordingly; failure to remit on time may invite collection actions.

Regulatory discretion and lack of explicit standards: The commission’s discretion to grant approvals and impose conditions (s 6(2) and s 6(5)) is broad and not burdened with a detailed statutory standard. Applicants face uncertainty about the approval criteria other than the general protective purpose in s 6(5). This discretion increases the administrative compliance risk for promoters.

No litigation record in the statute: As noted, the Act does not include litigation history. Where statutory language is novel or ambiguous (for example, calculation of the amount in s 13A or the meaning of "otherwise than fixed odds"), absence of precedent increases interpretive risk.

Regulatory instruments and determinations: The prescribed percentage is set by disallowable instrument (s 13A(2)-(3)). Until such determinations are issued, the default 50 per cent applies. Promoters should monitor commission determinations and regulations under s 15 for operative changes.

To comply with the Pool Betting Act 1964, entities should follow a structured compliance programme addressing licensing, recordkeeping, advertising and printed matter, audit readiness, supervision handling, levy exposure and intergovernmental issues. Below are concrete steps mapped to the statutory provisions.

1. Determine whether the activity is a pool betting competition under the Act

   • Test whether the product is "otherwise than fixed odds" and whether winnings are determined by reference to the stake pool (dict). If the product is fixed odds, the Pool Betting Act’s approval requirement will not be triggered. If the activity involves an "unlawful game", the scheme cannot be approved (s 6(1) and dict).

2. Apply for approval (if required)

   • If the activity is a pool betting competition and not lawfully conducted under another Territory law, apply in writing to the gambling and racing commission for approval under s 6(1). Use any prescribed or required form noted under the Gambling and Racing Control Act 1999 where applicable (s 6 note). Expect discretionary assessment (s 6(2)).

3. Anticipate and satisfy approval conditions

   • Prepare to accept conditions intended to ensure the scheme is properly carried on and participant interests are protected (s 6(5)). Draft operational procedures, security measures, segregation of funds, dispute resolution and internal audit processes so they can be represented in the application and respond to likely conditions.

4. Ensure advertising and printed matter compliance

   • Do not print, publish, display in public, distribute or circulate any advertisement, coupon, entry form or printed card relating to a pool betting competition unless operating under an approved pool betting scheme (ss 7-9). Train marketing, venue, and printing staff to verify approval status before publishing or printing betting material. Avoid displaying any betting-related material that is visible from a public place unless the scheme is approved (s 7(b)).

5. Implement strict financial controls

   • Maintain records showing all receipts and disbursements, keep books and documents, and segregate stake money and entry fees from operating funds to avoid conversion risks (s 10(1); s 12). Establish internal controls to prevent commingling, and document prize allocations and disbursements.

6. Prepare for audits and supervisory access

   • Keep books, documents and printed matter readily accessible; develop procedures to respond to written notices under s 10 with required statements within specified periods. Train staff to cooperate with authorised auditors and supervisors, to provide information, answer questions and to show authorisation notices (ss 10(1)-(3); s 13(1)-(2)). Create audit teams and legal protocols for handling testimonial requests and assessing privilege and self‑incrimination issues.

7. Manage interjurisdictional levy exposure

   • If operating under a State law or accepting entries from persons in the ACT, identify whether the promoter will receive money paid in the ACT that is connected to submissions of entries from the ACT; if so, calculate amounts payable under s 13A. Understand the prescribed percentage; if no commission determination exists, plan for a default 50 per cent share (s 13A(2)). Implement accounting segregation by source jurisdiction to enable accurate levy calculations and timely payment under s 13B (due 21 days after the calendar month end when amounts became payable).

8. Engage with the commission and State authorities where needed

   • Where schemes operate across State/Territory boundaries, proactively engage with the commission about entering into s 13C agreements with the appropriate State authority to manage collection arrangements and to avoid approvals being blocked under s 6(3). If a s 13C agreement affects approvals, monitor any termination risk because approvals will cease if the agreement terminates (s 6(8)).

9. Record licence status and evidence

   • Maintain documentation of any approval and the conditions, and ensure that staff can produce such documentation and certificates in administrative or legal proceedings. The commission’s certificate is admissible evidence of approval and conditions (s 6(7)).

10. Train staff and suppliers on prohibited activities

    • Inform printers, marketing agencies, venue operators and others that printing or distributing coupons, or advertising non‑approved schemes, is an offence (ss 7-9). Require contracts with third-party printers to include warranties that no material for non‑approved schemes will be printed or distributed.

11. Monitor regulations, determinations and instruments

    • Track any determinations under s 13A(2) (disallowable instrument), regulations under s 15, and forms prescribed under the Gambling and Racing Control Act 1999. Ensure the compliance programme adapts to any regulatory changes and commission policies.

12. Legal review and risk management

    • Obtain legal advice on the characterisation of betting products, particularly where products sit close to the fixed-odds/pool boundary, and on the treatment of persons "concerned in the carrying on" of schemes. Establish compliance audit cycles and incident response plans for notices under s 10, supervisory directions under s 13, and levies under s 13A.

13. Financial planning for penalties and remediation

    • Prepare contingency funds for potential enforcement outcomes, and maintain insurance where appropriate. If an inadvertent breach occurs, engage with the commission promptly and document remedial steps to reduce risk of prosecution, noting that many violations are criminal offences with significant maximum penalties (s 5(1)-(2); s 10(4); s 12).

14. Keep records of jurisdictional participation

    • Track the provenance of entries, distinguishing ACT-sourced receipts from others, to support levy calculations and to facilitate audits (s 13A).

By implementing these steps, a promoter or service provider will align operations with the principal duties in the Act (ss 5-13C), be prepared for audits and supervision (ss 10, 13), and limit exposure under the levy regime and the advertising/printing prohibitions (ss 7-9, 13A-13B). Regular legal review is advisable because the Act contemplates regulatory discretion and relies on allied statutory instruments and intergovernmental agreements that may alter operational requirements.
