However, amendments in 1981 (Ord1981-1) introduced sections 13A-13D, creating a levy system for interstate pool betting competitions. This significantly expanded the Act's scope from purely regulating ACT-based betting to capturing revenue from betting activity conducted outside the Territory but involving ACT participants. The 1999 and 2001 amendments further integrated the Act with the broader gambling regulatory framework, and the 2009 amendment linked it to the Unlawful Gambling Act 2009. The Act has evolved from a simple local licensing regime into a hybrid local/interstate revenue and regulatory mechanism."},"complexity_factors":["Short statute with only 15 sections (plus dictionary)","Minimal cross-referencing—primarily internal references to the Gambling and Racing Control Act 1999 and Unlawful Gambling Act 2009","Straightforward conditional logic: approval required → conditions may attach → breach is an offence","Simple penalty structure with clear maximum penalties expressed in penalty units","Only 7 defined terms in the dictionary, with most definitions being descriptive rather than technical","No nested exceptions or deeply conditional provisions—section 13A(3) contains the only significant exception (soccer football pools exempt from interstate agreement requirement)","Legislative history shows incremental amendments over 46 years but core structure remains intact"],"plain_english_summary":"This law tightly regulates pool betting in the ACT: unapproved operators are prohibited and face fines or prison, and anyone running pool competitions must gain approval and comply with conditions to protect players. The Gambling and Racing Commission can audit, supervise and enforce anti‑fraud rules. It also restricts advertising and imposes levies on interstate promoters taking ACT entries so the Territory shares in betting revenue."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":true,"description":"The Act's scope has expanded since its origin as a 1964 Ordinance. Originally focused on prohibiting unapproved pool betting and licensing operators, later amendments added interstate levy and collection provisions (sections 13A–13C were inserted by Ord1981-1 and subsequently amended—see endnotes Amendment history) and adjusted definitions in the Dictionary. The Commission's discretionary powers and cross‑State collection mechanisms increase regulatory and compliance reach beyond the original licensing/prohibition model."},"complexity_factors":["Licensing and conditional approvals: operator must apply to and obtain approval from the Gambling and Racing Commission; approvals can be conditional and are subject to the Commission's discretion (s 6).","Criminal and monetary penalties: multiple offences carry fines and imprisonment, including conducting unapproved schemes and misappropriation of stakes (ss 5, 12, 13(3)).","Operational restrictions: blanket prohibitions on advertising, distributing or printing coupons for unapproved schemes create compliance rules for marketing and printers (ss 7–9).","Audit and supervision powers: Commission may require statements, seize or keep records and authorise auditors, and authorised supervisors may enter premises and give binding directions (ss 10, 13).","Interstate levy and collection mechanics: levy on amounts paid from the ACT to out‑of‑State promoters, with a prescribed percentage or Commission determination and a 21‑day payment timetable (ss 13A–13B).","Delegated rulemaking and review: Commission may determine the prescribed percentage (a disallowable instrument) and may enter agreements with State authorities for collection (s 13A(2)–(3), s 13C).","Cross‑jurisdictional linkage and exceptions: Commission must not approve schemes lawfully run under a State law unless there is a section 13C agreement; a specific exception for soccer football pools (s 6(3)–(4)).","Historical amendments and definitions: definitions and scope have been adjusted over time (see Dictionary and endnotes), requiring attention to amendment history for current operation."],"plain_english_summary":"This Act makes unapproved pool betting in the ACT illegal and requires operators to hold an approval from the Gambling and Racing Commission. It restricts advertising, printing and distribution of betting coupons, empowers audits and supervision, and creates criminal and civil penalties for misuse of stakes or non‑compliance. \n\nIt also imposes a levy on interstate pool bets paid from the ACT and lets the Commission set the levy percentage or enter agreements with States to collect it (ss 13A–13C).
