Police Superannuation Regulations 2017

Commutation. The central operational concept is commutation, the conversion of periodic pension entitlements into a single lump sum. Regulation 4 defines how a pensioner’s "annual pension" is to be calculated for Part 2 by converting the fortnightly pension to an annual figure using a multiplier of 313 divided by 12. Regulation 5 prescribes who may apply to commute, the eligible pension types (retirement, invalidity, retrenchment, and pensions payable to spouses of deceased contributors), the proportions that may be commuted in particular circumstances, and strict application windows measured in months from retirement, attaining age 55, or death. Regulation 7 contains the conversion tables: for retiring contributors, for invalidity and retrenchment, for spouse commutations, and for non-member spouse elections under section 38S of the Act. The tables give amounts of lump sum per dollar of annual pension commuted, expressed as ranges by age bands. Regulation 9 requires proportional adjustment of commutation factors to the applicant’s age measured in years and completed months, which means interpolation across the tables is the mandated method for precise conversion. Regulation 10 authorises the Board to round lump sums to the nearest dollar.

Non-member spouse interests and splitting. Regulations 6, 11, 12 and 13 operationalise the Act’s non-member spouse splitting provisions. Regulation 6 prescribes election windows for non-member spouses under section 38S of the Act and provides a six-month window for a legal representative to elect on behalf of a deceased non-member spouse. Regulation 11 sets the required content and form of the Board’s notice to a non-member spouse and prescribes what information the Board must provide if an interest is rolled to the Southern State Superannuation Fund because no election was made. Regulation 12 fixes time limits for the Board to split a pension (14 days after receipt of a splitting instrument) and lists the information a non-member spouse must provide before payments commence. Regulation 13 sets the method for calculating an associate pension where an election is made to take a share as an associate pension, relying on conversion factors in Schedule 1 and specifying which table to use depending on whether the member spouse’s pension commenced before the commencement of the Act.

Salary and contribution definitions. The regulations alter what counts as salary for contribution and benefit purposes. Regulation 14 lists allowances excluded from the second definition of "salary" in s 4(1) of the Act and sets rules for inclusion of higher duties allowances depending on duration of payment. Regulation 15 provides a formula to include the specific Flexibility Allowance from the South Australia Police Enterprise Agreement 2011 in benefit calculations, including parameters for months of receipt and contribution period. Regulation 16 fixes the proportion of a total remuneration package taken as salary under certain Police Act contracts at 86.6%. Regulation 16A prescribes how to determine salary for contributors who were seconded, specifying a 1 per cent compounded annual increment for each full year of secondment when certain conditions apply.

Administrative and protective rules. The regulations fix the fund’s share of administrative costs at 30 per cent for a particular Act cross-reference (reg 18), limit the number of under-55 retirements per year at 50 unless varied by the Minister (reg 19), prescribe the notice content for invalidity notices sent by the Commissioner (reg 21), prescribe minimum fortnightly pensions to eligible children (reg 22), provide payment options where a pensioner is not competent (reg 23), and allow the Board to employ a medical practitioner for health advice (reg 24). Regulation 8(1) requires the Board to be satisfied that no other spouse is entitled before paying a lump sum to a spouse, and reg 8(2) absolves the Board of liability for payments made under that requirement.

Contributors and pensioners. The regulations primarily affect contributors to the South Australian Police Superannuation Scheme and those receiving pensions. Regulation 5 sets out which contributors can apply to commute pensions, including retiring contributors, contributors in receipt of invalidity pensions who have reached age 55, and contributors receiving retrenchment pensions who have reached age 55. Contributors who leave employment with an invalidity pension have a specific limited right to commute up to 20 per cent within 3 months after termination of employment (reg 5(8)). Contributors who were seconded to other police forces are subject to regulation 16A when their salary is determined for benefits.

Spouses and non-member spouses. Spouses of deceased contributors who are entitled to a pension may apply to commute in whole or part, subject to timing rules in regulation 5(1)(c) and 5(5) to (7). Non-member spouses who are entitled to have their share converted to a lump sum under section 38S of the Act face a 3-month election window measured from the operative time under regulation 6(1). Legal representatives of deceased non-member spouses have a six-month election window in certain cases (reg 6(2)). Regulation 11 imposes notice content obligations on the Board when informing a non-member spouse of election rights, and requires the Board to provide rollover and fund membership information if the interest is rolled to the Southern State Superannuation Fund.

The Board. The Board is the decision-maker and administrator under the regulations. It has mandatory duties to act within specified timeframes, such as commuting a pension within one month after receiving an application and paying the lump sum within 14 days thereafter (reg 5(11)). The Board must provide specific written notices to non-member spouses (reg 11(1)), must split pensions within 14 days of a splitting instrument (reg 12(a)(i)), may round lump sums (reg 10), must be satisfied that no other spouse is entitled before paying a lump sum to a spouse (reg 8(1)), and may extend application timeframes where the applicant was not at fault (reg 5(10)). The Board also holds discretion to employ a medical practitioner for advice (reg 24) and to determine what other information may assist a non-member spouse in the event of a rollover (reg 11(2)(b)).

Commissioner and other agencies. The Commissioner has a procedural role in relation to invalidity notices to the Board, and regulation 21 specifies the evidence and inquiries that must accompany such a notice, including inquiries into other suitable employment and information about workers compensation entitlements. The Southern State Superannuation Fund is an alternative payee or rollover destination if a non-member spouse does not make an election (reg 11(2)). Designated external decision-makers under other statutes may also be involved; the Board’s payment options for an incompetent pensioner are subordinated to the rights of managers or administrators appointed under the Aged and Infirm Persons' Property Act 1940 or the Guardianship and Administration Act 1993 (reg 23(2)).

Employers and payroll. South Australia Police and employers negotiating enterprise agreements are affected because the regulations determine which allowances are part of "salary" for contributions and benefit calculations. Regulation 14 excludes certain allowances from salary calculations and defines treatment of higher duties allowances. Regulation 15 prescribes a formula for including the Flexibility Allowance from the 2011 enterprise agreement for members who received it. Regulation 16 fixes a percentage for the salary component of total remuneration packages for certain contracts.

Minister and governance. The Minister can approve a larger number of contributors retiring under 55 in a financial year than the default cap of 50, per regulation 19. The Board is granted non-liability protection when making spouse lump sum payments after satisfying itself there is no other spouse entitled (reg 8(2)).

Legal representatives, carers and banks. The regulations involve legal representatives of deceased non-member spouses (reg 6(2)), permit payments to persons caring for an incompetent pensioner subject to application for the pensioner’s maintenance and benefit (reg 23(1)(c)), and allow payment into an account in the pensioner’s name with an ADI (authorised deposit-taking institution) (reg 23(1)(b)).

Pensioner and contributor rights. Contributors have an expressly preserved right to apply to the Board for commutation of pensions under specified conditions (reg 5(1)). Retirement pension commutation applications generally must be lodged within 3 months after retirement, while invalidity and retrenchment commutation applications have their own 3-month windows commencing at age 55 (reg 5(2) to (3)). Contributors who are entitled to an invalidity pension may, within three months after termination of employment, apply to commute up to 20 per cent of the pension (reg 5(8)); this does not preclude further commutation on attaining 55 (reg 5(9)). Spouses of deceased contributors may apply for commutation of whole or part of the pension (reg 5(1)(c)), and non-member spouses have discrete election windows under regulation 6 tied to section 38S of the Act.

Board duties and timing. The Board must act within tight timelines: it must commute a pension within one month after receiving a commutation application and must pay the lump sum within 14 days after commutation (reg 5(11)). For non-member spouse interests that result in a pension, the Board must split the relevant pension within 14 days of receipt of a splitting instrument and must advise the non-member spouse of value and adjustments (reg 12(a)). The Board is required to give written notice to a non-member spouse of the right to elect and of consequences of failure to elect within 28 days, providing the value and basis of adjustments and notifying that the interest cannot be retained in the Scheme (reg 11(1)). If a non-member spouse interest is rolled over because no election was made, the Board must notify the spouse within 14 days and provide membership details and supporting information about the receiving fund (reg 11(2)).

Evidence and form requirements. The Board may require personal and bank account details and other verifying documents before commencing payments to a non-member spouse (reg 12(b)). Where the Commissioner sends an invalidity notice under s 31(8) of the Act, the notice must be accompanied by a medical certificate in a Board-approved form and must inform the Board of inquiries about alternative employment with at least 80 per cent of the contributor’s salary and the result of those inquiries, and of any entitlement to workers compensation periodic payments (reg 21).

Calculation duties. The Board must apply the commutation tables in regulation 7 and adjust factors proportionately to the precise age (years and completed months) of the applicant under regulation 9. For associate pensions elected by non-member spouses, the Board must apply the method in regulation 13(2), using Schedule 1 conversion factors according to whether the member spouse’s pension commenced before the commencement of the Act (reg 13(2) last two paragraphs).

Discretionary powers and protections. The Board has discretionary power to extend application timeframes if it considers the applicant was not at fault (reg 5(10)), to round lump sums to the nearest dollar (reg 10), and to employ a medical practitioner to advise it on contributors’ health (reg 24). The Board must not pay a lump sum to a spouse unless it is satisfied that no other spouse is entitled to part of the pension commuted (reg 8(1)); it has statutory protection from liability for payments made in accordance with that requirement (reg 8(2)).

Employer and fund responsibilities. Employers and the fund must apply the salary rules: exclude specified allowances per regulation 14(1), treat higher duties allowance as excluded for contribution calculations but conditionally included for benefit calculation depending on duration of payment (reg 14(2) to (4)), and apply the Flexibility Allowance inclusion formula in regulation 15 where relevant. Regulation 16 establishes 86.6 per cent as the salary proportion for certain Police Act contracts, which employers must apply when reporting salary for scheme purposes.

Administrative financial duty. For the fund’s allocation of administrative costs under section 10(7)(b) of the Act, regulation 18 prescribes the fund’s proportion at 30 per cent, creating a binding figure for internal cost apportionment.

Regulatory enforcement is largely administrative and procedural. The instrument contains no express criminal sanctions, pecuniary fines, or civil penalty provisions within its text. Instead, the regulations prescribe administrative timeframes, documentation and calculation methods that condition entitlement and payment mechanics, with the Board given explicit duties and procedural protections.

Time-limited claims. Several rights are exercisable only within specific time windows, and failure to act in those windows displaces the right unless the Board exercises its discretion to extend time. For example, regulation 5 sets three-month windows for most commutation applications, with a six-month window in some spouse and legal representative contexts (reg 5(2), 5(5), 6(2)). The Board may extend time "if, in the Board's opinion, the person was not at fault in failing to apply" (reg 5(10)). The practical enforcement mechanism is therefore administrative discretion rather than criminal sanction.

Board non-liability. Regulation 8(2) removes personal or institutional liability from the Board for payments made where the Board has complied with its duty to be satisfied that no other spouse is entitled (reg 8(1)). This is an enforcement-limiting provision: it preserves the Board’s position where, following its enquiries, the Board pays a lump sum to one spouse. That shifts legal risk away from the Board and places responsibility on claimants to ensure competing spouse entitlements are identified.

Administrative compliance as sanction. The primary compliance levers are timing and condition precedents to payment. For example, the Board must not commence payment of a split pension until the non-member spouse provides identity and banking details and any other requested information (reg 12(b)). Likewise, the Commissioner’s invalidity notice must be accompanied by a medical certificate and information about inquiries into alternative employment and workers compensation entitlements (reg 21). Failure to supply required documentation will delay or prevent payment; that is the primary practical enforcement consequence.

Dispute resolution and external law. The regulations reference other statutes that include their own enforcement and remedy structures. For example, disputes about guardianship and administrators’ rights to payment are routed through the Aged and Infirm Persons' Property Act 1940 and the Guardianship and Administration Act 1993 (reg 23(2)). The scheme’s Act will contain its own dispute and appeal mechanisms which are not repeated in these regulations; enforcement of statutory rights and obligations may therefore be pursued under the Act rather than the regulations.

Operational safeguards and audit risk. The Board’s power to employ a medical practitioner (reg 24) and its requirement to consider alternative employment inquiries (reg 21(b)) create documentary points that can be audited. The fund’s share of administrative costs is set (reg 18), which creates an accounting obligation to allocate costs per the Act cross-reference. These provisions function as internal enforcement through record-keeping, not as penal provisions.

Ministerial approval and caps. The regulation limiting under-55 retirements establishes administrative approval as the controlling mechanism: the cap is 50 unless increased with Ministerial approval (reg 19). Non-compliance with such a cap would be a procedural matter subject to internal governance and the Act’s mechanisms.

Cross-references to the Police Superannuation Act 1990. These regulations are subordinate to and operationalise multiple provisions of the Police Superannuation Act 1990. Regulation 6 explicitly invokes section 38S(2)(b) and 38S(7) of the Act when prescribing election windows for non-member spouses and legal representatives. Regulation 11 implements section 38T(3) regarding notice to non-member spouses, and regulation 12 implements section 38T(4) concerning pension payments following a splitting instrument. Regulation 4 ties to Part 2 of the regulations by defining "annual pension" for the purpose of commutation calculations that the Act authorises. Regulation 5 implements entitlements that arise under Act provisions concerning commutation. The regulations therefore function primarily as procedural and numerical detail for the Act’s substantive rights.

Interaction with Police Act 1998. Regulation 16 applies to contracts under sections 13 or 16 of the Police Act 1998, specifying that 86.6 per cent of a total remuneration package is to be treated as salary for the first definition of salary in s 4(1) of the Police Superannuation Act. Regulation 16A also interacts with s 4(6b)(d) of the Act, prescribing how salary is to be determined for contributors on secondment to other forces. These provisions therefore create an interface between employment contract drafting under the Police Act and the superannuation benefit calculations under the Police Superannuation Act.

Interaction with other social security and compensation regimes. Regulation 21 requires that the notice sent by the Commissioner under s 31(8) to the Board must inform the Board of the contributor's existing or future entitlement, if any, to weekly payments of workers compensation. That embeds workers compensation entitlements into the Board’s assessment of invalidity-related claims, making the workers compensation regime relevant in benefit calculation or offset contexts. The requirement to inform the Board of inquiries into alternative public sector employment that would offer at least 80 per cent of salary also brings public sector employment frameworks into play in assessing invalidity retirements (reg 21(b)).

Rollover to other funds. Regulation 11(2) prescribes that a non-member spouse interest may be rolled over to the Southern State Superannuation Fund where no election is made, and requires the Board to provide membership and fund information. That creates a statutory interface between the Scheme and the Southern State Superannuation Fund and imposes an administrative duty on the Board to supply fund-level disclosure post-rollover.

Guardianship and administration law. Regulation 23(2) explicitly preserves the rights of managers or administrators appointed under the Aged and Infirm Persons' Property Act 1940 and administrators appointed under the Guardianship and Administration Act 1993 to receive pension payments, so superannuation payments must be coordinated with these appointment regimes where relevant.

Cost allocation and financial reporting statutes. Regulation 18 fixes the fund's share of administrative costs at 30 per cent for the purposes of section 10(7)(b) of the Act, which may affect reporting and financial statements required under the Act and associated finance rules.

Potentially obsolete references. The legislative history warns that cross-references to other legislation, instruments, or titles may be obsolete as they are not automatically updated in the government’s revision program. Practitioners should confirm that titles, cross-references to other Acts, and references to named enterprise agreements remain current in the relevant administrative context.

The regulations were made in 2017 as the Police Superannuation Regulations 2017. The legislative history provided in the instrument documents the principal dates and subsequent variations. The regulations were published as No 243 in the Gazette on 8 August 2017 (Gazette 8.8.2017 p3489) and commenced on 8 August 2017, with commencement indicated at reg 2. Entry in 2018 shows variation No 29 (Gazette 13.2.2018 p739) that commenced on 13 February 2018; the confirmed variation in the table states that regulation 16A was inserted by 29/2018 r 4, with commencement dated 13.2.2018. The table also records that regulation 2 was omitted under the Legislation Revision and Publication Act 2002 on 13.2.2018. A further variation, No 121 (Gazette 13.11.2025 p4462), is recorded as having varied regulation 7 by item r 3 and commenced on 13 November 2025; that same instrument is listed in the principal regulations and variations table (2025, 121, with commencement 13.11.2025: r 2). The legislative history notes that the Police Superannuation Regulations 2017 revoked the Police Superannuation Regulations 2002. The instrument also records that historical versions are available and that earlier versions are listed at the end of the legislative history, with a historical version dated 13.2.2018 available. The history includes a cautionary note that references in the legislation to other legislation, instruments, or office titles are not automatically updated, which may render some cross-references obsolete unless independently verified. The schedule of provisions varied identifies specific provisions amended or inserted: regulation 7 was amended by the 2025 instrument and regulation 16A was inserted in 2018. No other amendments are listed in the provided history. Practitioners should rely on the specific commencement dates listed for each variation and verify whether any further amendments or consolidations have occurred since the latest recorded variation.

The text of these regulations, as provided, contains no reported cases, judicial decisions, or tribunal determinations. There is no litigation history set out in the instrument. The regulations make multiple references to provisions of the Police Superannuation Act 1990 and other statutes, but they do not record contests or decisions arising from application of the regulations themselves.

Where disputes could arise, the regulations suggest likely factual and legal flashpoints, which can be relevant for litigation risk planning even though no cases are cited in the instrument. Examples of potential dispute areas grounded in the regulations include:

• Timeliness disputes. The regulations impose short application windows for commutation and non-member spouse elections (reg 5, reg 6). Litigation could arise if the Board declines an out-of-time application and the applicant contests whether they were "not at fault" under reg 5(10).

• Calculation and interpolation disputes. Regulation 9 requires proportional adjustment of commutation factors to the applicant’s years and completed months. Litigation could occur where parties disagree about the correct interpolation method, the exact age in completed months used for calculation, or the selection of the appropriate table under reg 7 and reg 13.

• Spousal entitlement and competing claim disputes. Regulation 8(1) requires the Board to be satisfied that no other spouse is entitled before paying a lump sum, and reg 8(2) removes Board liability for payments made in accordance with that requirement. Disputes might centre on whether the Board satisfied itself reasonably and on the factual basis for selecting a payee where competing spouse claims exist.

• Non-member spouse election and rollover disputes. Regulation 11 prescribes notice content and the Board’s responsibilities if an interest is rolled to the Southern State Superannuation Fund. Litigation could arise if a non-member spouse asserts insufficient notice or improper valuation prior to rollover.

• Salary inclusion disputes. Regulation 15 contains a formula to include the Flexibility Allowance in salary for benefit calculations for members who received it in accordance with the 2011 enterprise agreement. Disputes could arise about whether the formula was applied correctly, whether the allowance was "received during the contributor’s membership of the Scheme", and the treatment of subsequent enterprise agreements.

The absence of recorded litigation in the instrument does not preclude future judicial or tribunal review under the Act’s dispute mechanisms. Any litigation would be determined against the statutory text of the Act and these regulations and would involve interpretation of the precise timelines, calculation methods and evidentiary requirements set out in the instrument.

Short and strict timeframes. Multiple provisions impose short, non-intuitive time limits. An application for commutation of a retirement pension must be within three months after retirement, and invalidity or retrenchment commutation applications must be made within three months after the pensioner reaches age 55, with special three-month windows for other events (reg 5(2) to (5)). Non-member spouse elections under s 38S must be made within three months of the operative time (reg 6(1)). For persons unable to apply because the pension is suspended, limited alternative windows (three months after suspension ceases) apply (reg 5(3), reg 5(6)). These short windows can extinguish entitlements if not observed and the Board’s power to extend time only applies where the Board considers the person was not at fault (reg 5(10)). Practitioners should not assume generous grace periods.

Interpolation and ranges in the tables. The commutation tables in regulation 7 provide ranges in age bands rather than single factor values. Regulation 9 instructs proportional adjustment "in accordance with the appropriate table" to the applicant’s age expressed in years and completed months. Users must interpolate between the band endpoints to produce the correct factor. Failure to interpolate accurately will produce incorrect lump sums.

Multiple factor tables and cross-dependencies. The instrument uses different tables depending on the pension type and circumstances, including a separate set for non-member spouse commutations and for non-member spouse elections referencing the member spouse’s age (reg 7(d)). For associate pensions, regulation 13(2) requires conversion factors from Schedule 1, with different tables depending on whether the member spouse’s pension commenced before the commencement of the Act. Practitioners must track which table applies to which situation and to which person’s age.

Salary composition traps. Regulation 14 excludes specific allowances from the second definition of salary and treats higher duties allowances differently for contribution and benefit calculation purposes. Regulation 15’s formula for including the Flexibility Allowance applies only to the Flexibility Allowance under the South Australia Police Enterprise Agreement 2011 and explicitly does not apply to any later enterprise agreement (reg 15(3)). Employers and payroll staff must trace which exact allowance instruments apply to a contributor and whether the allowance was paid for the threshold period to trigger inclusion.

Secondment calculation detail. Regulation 16A prescribes a 1 per cent compounded annual increase in determining salary for seconded contributors, but the base used depends on whether the contributor returned to South Australia Police after secondment or not. The rules differ depending on whether the contributor returned to the employer and whether the higher post-return salary exceeds the secondment-adjusted pre-secondment salary (reg 16A(1)(a) and (b)). Practitioners must document secondment start and end dates and identify the highest pre-secondment and post-return permanent grade and salary to apply the correct formula.

Board’s non-liability protection and competing spouse claims. Regulation 8(2) removes the Board’s liability for payments made once it has satisfied itself as to spouse entitlement. Where competing spouse claims exist, the Board’s decision-making process to "be satisfied" is critical. The Board’s procedural checks must be documented because the non-liability protection will be meaningful only if the Board can show proper inquiry.

Rounding discretion. Regulation 10 permits the Board to round lump sum amounts to the nearest dollar. That discretion is broadly expressed and could produce small variances against precisely calculated figures; accounting systems and benefit statements should reflect this rounding policy.

Minimum children’s pension amounts. Regulation 22 prescribes very small fortnightly minimums ($8 or $12) for eligible children depending on spouse benefits. These amounts may be inconsistent with practitioner expectations of minimum support levels and require explicit attention in family planning and estate advice.

Evidence burdens on invalidity notices. Regulation 21 requires that a Commissioner’s notice accompany a medical certificate in a Board-approved form and include evidence of inquiries into alternative employment and workers compensation entitlements. Missing details may delay invalidity pension processing and create gaps in rights and entitlements for contributors.

Rollover fund and information requirements. If a non-member spouse does not elect, their interest is rolled to the Southern State Superannuation Fund and the Board must provide membership identification and recent annual report and other information it determines useful (reg 11(2)). Practitioners should confirm the identity of that fund in practice and ensure the Board fulfils this 14-day disclosure duty to avoid complaints.

Administrative cost allocation. Regulation 18 fixes the fund’s share of administrative costs at 30 per cent. That figure interacts with s 10(7)(b) of the Act and impacts fund cashflow modelling and reporting. Operational budgeting should factor this allocation in.

Prescribed body and enterprise agreement specificity. Regulation 17 prescribes the Police Association of South Australia for a specific Act cross-reference. Regulation 15 applies only to a prescribed 2011 enterprise agreement. Both the named body and the named enterprise agreement should be verified for contemporaneous relevance when advising clients.

Checklist for contributors and pension applicants

• Track and calendar windows. For commutation and election rights, calendar the triggering dates and corresponding windows precisely. For retirement pensions, lodge commutation applications within three months after retirement; for invalidity or retrenchment pensions, lodge within three months after reaching age 55 where relevant (reg 5(2) to (4)). Non-member spouse elections under s 38S must be made within three months of the operative time (reg 6(1)). If a pension is suspended, identify the suspension end date because alternate 3-month windows apply (reg 5(3), reg 5(6)).
• Provide documentary evidence. For invalidity-related applications, be ready to supply medical evidence and any required forms. Where termination of employment triggers a 3-month window for limited commutation, preserve termination and medical records (reg 5(8) to (9), reg 21).
• Where commuting, request a clear statement of how the annual pension has been calculated (reg 4), and obtain a written benefit statement showing the factor applied, interpolation method, and rounding applied.

Checklist for the Board and administrators

• Time-critical operations. Implement workflows so that a commutation application is actioned within one month and lump sums are paid within 14 days after commutation (reg 5(11)). For splitting instruments, ensure splitting and notice actions are completed within 14 days (reg 12(a)(i)).
• Notices to non-member spouses. Draft a template notice that satisfies regulation 11(1): it must be in writing, explain the option to make an election and consequences of failing to do so within 28 days, state the value of the interest, disclose the basis for any adjustments, and notify that the interest cannot be retained in the Scheme. Maintain records of service and dates to support any future disputes.
• Rollover procedure. If an interest is rolled to the Southern State Superannuation Fund due to failure to elect, send required information within 14 days: membership identification number, the most recent annual report for that fund, and any other information determined to assist (reg 11(2)). Record the rollover transaction and retain the fund contact details.
• Calculation protocols. Adopt a documented interpolation method to adjust commutation factors proportionately to the applicant’s age in years and completed months, as required by regulation 9. Maintain versioned spreadsheets or calculation software that reflect the current commutation tables in regulation 7 and any amendments (including those recorded in the legislative history). Apply rounding to the nearest dollar consistently per regulation 10.
• Associate pension calculations. For associate pensions elected by non-member spouses, implement the method in regulation 13(2). Ensure Schedule 1 conversion factors are referenced and the correct table is used depending on whether the member spouse’s pension commenced before the Act’s commencement.
• Identity and verification checks. Before commencing payment of a split pension, verify the non-member spouse’s name, address, date of birth, and bank account details and request any additional documentation necessary under regulation 12(b).
• Spouse entitlement checks and documentation. Before paying a lump sum to a spouse, document the enquiries made and the basis for being satisfied that no other spouse is entitled, following regulation 8(1). Keep records to support the Board’s reliance on reg 8(2) non-liability protection.
• Invalidity notices. Require the Commissioner to provide a medical certificate in a Board-approved form and provide evidence of inquiries about other suitable employment and workers compensation entitlements per regulation 21. Document the outcome of those inquiries and incorporate the details into the decision file.
• Competency processes. If the Board is satisfied that a pensioner is not competent to direct payment, implement payment options listed in regulation 23(1) and confirm whether a manager or administrator has been appointed under the Aged and Infirm Persons' Property Act 1940 or the Guardianship and Administration Act 1993 (reg 23(2)).
• Employ medical expertise. Consider engaging a medical practitioner for advice on contributors’ health matters where needed, using the authority in regulation 24.

Employer/ payroll compliance steps

• Salary composition. Apply regulation 14 to exclude specified allowances from the second definition of salary and to determine whether higher duties allowances are excluded or included for benefits based on duration. For contribution calculations, treat higher duties allowances as excluded (reg 14(2)). If a higher duties allowance has been paid for 12 months or more, include it at the lowest level paid in the preceding 12 months for benefit calculation (reg 14(3) to (4)).
• Flexibility Allowance. If a contributor received the Flexibility Allowance under the 2011 enterprise agreement, apply the formula in regulation 15 to include that allowance in salary for benefit calculations. Maintain records of months of receipt, contribution months, and salary levels S1 and S2 to enable formula application.
• Contract salary percentage. For contracts under sections 13 or 16 of the Police Act 1998, report 86.6 per cent of total remuneration package as salary for first-definition salary purposes as mandated by regulation 16.
• Secondment records. For contributors seconded to other police forces, preserve dates and salary grades to apply the 1 per cent compounded annual adjustment under regulation 16A and to compare pre-secondment and post-return highest permanent salaries.

Governance and reporting

• Administrative cost allocation. Implement accounting entries to allocate 30 per cent of the fund’s administrative costs per regulation 18 for the purpose of section 10(7)(b) of the Act. Ensure internal financial controls capture this allocation.
• Retirement cap monitoring. Track the number of contributors retiring under 55 in each financial year and seek Ministerial approval before exceeding 50 in any year per regulation 19.
• Document retention and audit trail. Maintain full documentary files for commutation applications, spouse election notices, splitting instruments, rollover actions, invalidity notices, and calculations showing age, interpolation steps, and rounding. These records will be the primary defence in any administrative review or litigation where the Board’s satisfaction and procedural compliance are contested.

Testing and validation

• Calculation validation. Build test cases covering edge ages (for example, applicants with ages at the boundary of age bands and applicants in completed months) and confirm interpolation, rounding and table selection outcomes against manual calculations.
• Notice compliance checklists. Periodically audit written notices sent to non-member spouses for the specific elements mandated by regulation 11(1), and sample rollovers to confirm 14-day post-rollover disclosure obligations were met.
• Policy updates. Review all references to enterprise agreements, other funds, and titles of bodies for currency, given the legislative history note that references to other instruments may become obsolete.

Following these steps will address the main compliance risks created by the regulations: timing errors, misapplied calculation methods, inadequate notice to affected spouses, and incomplete documentary support for the Board’s satisfaction and payment decisions.
