Police Informants Royal Commission Implementation Monitor Act 2021

Implementation Monitor: The central construct is the Implementation Monitor, a statutory officer or officers appointed to perform monitoring, advisory and reporting functions in relation to implementation of the RCMPI recommendations. The Monitor is defined by appointment provisions (s 7) and given express independence: not subject to direction or control in respect of performance of functions or content of implementation reports (s 13(1)-(2)). The Monitor may be one or two persons (s 6(2)), and where two are appointed they must prepare reports jointly (s 26(3)).

Responsible agency: The Act specifies a defined list of responsible agencies required to carry out implementation work (s 3). The list includes the Secretary to the Department of Justice and Community Safety, Secretary to the Department of Premier and Cabinet, the Chief Commissioner of Police, the Director of Public Prosecutions, Public Interest Monitor, IBAC, the Victorian Government Solicitor, the Victorian Legal Services Commissioner (in their capacity as CEO of the VLSP Board), the Law Institute of Victoria and the Victorian Bar Inc (s 3). The Governor in Council may add other entities by order, but only after the entity consents and after consultation with each Implementation Monitor (s 5).

RCMPI recommendation and implementation report: The RCMPI recommendations are the deliverables of the Royal Commission into the Management of Police Informants, defined in s 3. An implementation report is the Monitor’s statutory instrument for assessing and communicating progress: it must cover designated reporting periods (initially 30 Nov 2020-30 Jun 2021, and annually thereafter until implementation is complete), specify progress, assess adequacy and advise on further measures (s 26(1)-(4)). Where the Monitor intends to include adverse information the subject must be given an opportunity to respond and the response fairly set out (s 26(5)-(6)). The Monitor must exclude from reports information that would reveal sensitive law enforcement methods, prejudice investigations, disclose unpublished Cabinet deliberations, or otherwise be contrary to the public interest (s 26(7)).

Compelled information and cooperation: The Monitor may issue written notices requiring information necessary for functions (s 18(1)). Specified timeframes apply , 21 days to comply unless an extension is agreed or the Monitor accepts that the agency cannot give the information (s 18(2)). A general duty to cooperate applies to responsible agencies and persons acting on their behalf as to any reasonable request for purposes of the Monitor’s functions (s 19). Responsible agencies may also volunteer information (s 20).

Secrecy and FOI adjustments: The Act removes statutory or common law secrecy constraints for the purpose of providing information to the Monitor , secrecy obligations do not apply to information given under ss 18(2), 19 or 20 (s 21(1)). Responsible agencies must nevertheless identify what they consider secret or privileged information when providing it (s 21(2)). The Monitor is then bound not to disclose such information except to persons assisting the Monitor or another Implementation Monitor (s 21(3)-(4)). Separately, the Monitor is not a prescribed authority under the Freedom of Information Act 1982 and the FOI Act does not apply to documents received or stored by the Department solely on behalf of the Monitor (s 23).

Independence and immunity: The Monitor’s statutory independence (s 13) is paired with immunity for acts or omissions done in good faith under the Act, with any resulting liability attaching to the State (s 14). The Act also protects the validity of acts and decisions despite defects in appointment (s 25).

Reporting and parliamentary interface: The Monitor gives implementation reports to the Attorney‑General by 30 September each year (s 26(8)). The Attorney‑General prepares progress reports for the same periods and must table them in Parliament (ss 27-28). The tabling provisions include notice and publication mechanisms and absolute privilege for the published progress reports (s 28(5)-(6)).

Temporal and review features: The Act commenced the day after Royal Assent (s 2; endnote), mandates specified reporting periods (s 26(1)-(2)), limits acting appointments (s 10), and requires a statutory review of the Act’s operation as soon as practicable after the fifth anniversary of commencement (s 29).

Primary affected parties are the Implementation Monitor(s), the responsible agencies named in s 3, the Attorney‑General, the Governor in Council, the Secretary to the Department of Justice and Community Safety, and ultimately Parliament and the public via tabling of progress reports.

Responsible agencies: The Act directly compels activity by a defined group of entities required to carry out the implementation of RCMPI recommendations (s 3). Those listed include central executive departments (Department of Justice and Community Safety; Department of Premier and Cabinet), law enforcement (Victoria Police; Chief Commissioner s 3), prosecutorial bodies (Office of Public Prosecutions; Director of Public Prosecutions s 3), oversight bodies (Public Interest Monitor; IBAC), legal profession regulators and representative bodies (Victorian Government Solicitor, Victorian Legal Services Commissioner, Law Institute of Victoria, Victorian Bar Inc). The Governor in Council may add further entities by order, but only after obtaining the entity’s consent and consulting each Monitor (s 5).

Senior officials and staff: Persons acting on behalf of responsible agencies are captured by the information powers and duties (s 18(1)). That phrase brings within scope both senior decision‑makers and staff or contracted service providers who hold information necessary for implementation. The Act shifts the legal landscape for those individuals when providing material to the Monitor by lifting secrecy constraints for that purpose (s 21(1)), while at the same time imposing statutory duties to identify secret or privileged material (s 21(2)).

The Attorney‑General and Parliament: The Attorney‑General receives implementation reports (s 26(8)), may request advice from Monitors (s 16) and must prepare and table progress reports in both Houses (ss 27-28). Parliament participates indirectly in the Monitor’s tenure: suspension and removal involve tabling of the grounds and a possible resolution by each House to remove an Implementation Monitor (s 12(2)-(4)). Clerks of each House and members also have practical duties under the tabling regime (s 28).

Public and affected persons: The public is affected via the publication and tabling of progress reports in Parliament (s 28). However, the Act simultaneously restricts access to certain Monitor documents under FOI (s 23) and mandates exclusions from implementation reports that would prejudice law enforcement or reveal sensitive methods (s 26(7)). Persons who may be adversely described in implementation reports have a statutory right to be given at least 14 days to respond and to have their response fairly set out if adverse material is included (s 26(5)-(6)).

The Crown and liability: The Act binds the Crown (s 4). It also states that an Implementation Monitor’s protected acts or omissions in good faith result in any liability attaching to the State rather than the Monitor personally (s 14(2)), changing who ultimately bears legal risk for Monitor actions.

Other legislation and administrative apparatus: The Department of Justice and Community Safety is implicated as host of the Implementation Taskforce to which the Monitor has access (s 15(1)(b)) and as a potential provider of staff and facilities to Monitors on request (s 24). Entities that hold documents now potentially accessible to the Monitor include those whose statutory secrecy previously would have prevented disclosure (s 21(1)). The FOI Act’s applicability is directly altered for Monitor records (s 23).

Implementation Monitor duties and rights

• Monitor, assess and advise: The Monitor must monitor and assess the adequacy and progress of implementation of each RCMPI recommendation by responsible agencies until implementation is complete (s 15(1)(a); s 15(1)(e) as amended). The Monitor may provide written or oral advice to responsible agencies on measures that would support adequate implementation (s 15(1)(c)) and must have regard to the recommendations, agency reports, impediments, attempts to meet timeframes, interdependencies and measures taken to manage those (s 15(3)(a)-(e)).
• Access and information powers: The Monitor can attend Implementation Taskforce meetings and request regular reports from Victoria Police on disclosure obligations (s 15(1)(b), (d)). The Monitor has all powers necessary to perform functions (s 17) and can require information by written notice from responsible agencies or persons acting for them (s 18(1)). Notices require compliance within 21 days unless an extension is agreed or the Monitor accepts that the agency cannot give the information (s 18(2)).
• Reporting obligations: The Monitor must prepare implementation reports for specified periods (s 26(1)) and provide copies to the Attorney‑General by 30 September each year (s 26(8)). Where there are two Monitors, reports must be joint (s 26(3)). If the Monitor intends to include adverse information, the subject must be given at least 14 days to respond and the response must be fairly set out (s 26(5)-(6)). The Monitor must not include information that would reveal sensitive law enforcement methods, prejudice ongoing investigations/prosecutions/IBAC matters, disclose unpublished Cabinet deliberations, or otherwise be contrary to the public interest (s 26(7)(a)-(f)).
• Independence and immunity: The Monitor is statutorily independent from direction or control over functions and report content (s 13). The Monitor has personal immunity for acts or omissions done in good faith in the performance of roles under the Act and any resulting liability attaches to the State (s 14(1)-(2)).

Responsible agency duties and rights

• Duty to cooperate: A responsible agency or a person acting for a responsible agency must comply with any reasonable request made by a Monitor or by a person assisting the Monitor for the purposes of performing Monitor functions (s 19). This creates an affirmative obligation on agencies to respond to reasonable requests.
• Duty to provide information on notice: When served with a written notice under s 18, the agency must give the requested information within 21 days unless the Monitor agrees to an extension or that the information cannot be provided (s 18(2)).
• Duty to respond to advice: A responsible agency must respond in writing to any written advice provided under s 15(1)(c) (s 15(4)), creating a follow‑up obligation after advisory interactions.
• Obligations when disclosing secret/privileged material: Although secrecy or privilege obligations do not apply to information given under ss 18(2), 19 or 20 (s 21(1)), the agency must identify any information that is subject to secrecy or privilege when giving it to the Monitor (s 21(2)). This preserves the agency’s position while enabling disclosure.
• Voluntary disclosure right: A responsible agency may give information to the Monitor without prior request (s 20), allowing proactive cooperation.

Attorney‑General rights and duties

• Request for advice: The Attorney‑General may request written or oral advice from a Monitor on any issue relating to implementation of a recommendation; the Monitor must comply (ss 16(1)-(2)).
• Preparation and tabling of progress reports: The Attorney‑General must prepare progress reports for the same reporting periods as Monitor reports and may include copies of Monitor implementation reports (s 27). The Attorney‑General must provide each progress report to the clerk of each House of Parliament by 30 November each year or within 60 days of receiving an implementation report, and the clerks are required to table the report on the next sitting day (s 28(1)-(2)).
• Privilege when tabling: Publication of progress reports under s 28 is absolutely privileged and treated as published by authority of the Parliament, with sections 73 and 74 of the Constitution Act 1975 and other publication rules applying (s 28(5)-(6)). This limits legal exposure from tabling.

Monitoring and operational rights

• Access to Implementation Taskforce: The Monitor may access written information from and attend meetings of the Implementation Taskforce within the Department (s 15(1)(b)). The Monitor can request staff and facilities from the Secretary by asking for assistance reasonably necessary to perform functions (s 24).
• FOI and documentation status: Monitors are not prescribed authorities for FOI purposes and FOI does not apply to documents the Department holds solely on behalf of a Monitor for the purposes of the Act (s 23). This affects rights of third parties to access Monitor‑held documents under FOI.

Enforcement, removal and checks

• Suspension and removal mechanics: The Governor in Council may suspend a Monitor on the Attorney‑General’s recommendation for misconduct, neglect, inability, or other unfitness (s 12(1)). The Attorney‑General must table a statement of grounds in each House within seven sitting days (s 12(2)). Removal requires each House to pass a resolution within 20 sitting days that the Monitor ought to be removed; absent such a resolution, suspension must be removed and the Monitor restored (s 12(3)-(4)). These provisions provide political and parliamentary checks but do not create criminal penalties for agencies that fail to comply with a Monitor’s requests.

Other rights and constraints

• Confidentiality constraints on Monitor use of information: The Monitor must not use or disclose confidential or personal information obtained in the course of functions except as permitted by the Act (s 22(1)). The Act permits disclosure of identity where consent exists or information is already public (s 22(2)(a)), and to persons assisting the Monitor or another Monitor (s 22(2)(b)). These rules limit the Monitor’s promotional or investigative use of sensitive material.
• Validity despite defects: Acts or decisions of a Monitor are not invalid merely because of defects in appointment (s 25), preserving continuity and legal effect of Monitor actions.

Overall, the Act creates a suite of rights for the Monitor to obtain information and for the Attorney‑General to use Monitor outputs, paired with duties on responsible agencies to cooperate and respond, and statutory confidentiality, immunity and parliamentary oversight mechanisms.

The Act establishes compulsory information powers and cooperation obligations but contains no express criminal penalties or administrative fines for responsible agencies or individuals who fail to comply with a Monitor’s information notice or reasonable request. The enforcement and accountability architecture is therefore largely administrative and political rather than penal.

Compulsion with limited statutory sanction: The Monitor may require information by written notice and sets a 21‑day default compliance period (s 18(1)-(2)). Section 19 imposes a general duty to comply with reasonable requests. The Act does not set out express statutory sanctions, such as fines, imprisonment or specific enforcement proceedings,if a responsible agency or person fails to provide information or to comply with a reasonable request. Where the Act is silent about sanctions, agencies remain subject to other legal or administrative mechanisms outside this statute (for example, internal disciplinary processes, public law remedies, or other statutory offences) but such mechanisms are not identified or created by this Act. The absence of specified sanctions is material to implementation risk and the Monitor’s leverage.

Political and parliamentary checks as enforcement levers: The Attorney‑General and Parliament provide the principal enforcement channels within the Act. The Monitor’s implementation reports must be provided to the Attorney‑General (s 26(8)), who prepares progress reports that are tabled in Parliament (ss 27-28). Publication and parliamentary scrutiny create reputational and political pressure on responsible agencies to comply. Progress reports are absolutely privileged when published under s 28(5)-(6), limiting legal risk for the Attorney‑General and potentially facilitating candid reporting to Parliament.

Suspension and removal for the Monitor, not for agencies: The Act provides a mechanism to suspend and remove an Implementation Monitor for misconduct, neglect, inability or other unfitness (s 12(1)-(4)). That mechanism includes requirement of a recommendation by the Attorney‑General, tabling of grounds, and potential parliamentary resolution to remove. Those provisions are protections and controls on the Monitor rather than enforcement tools against agencies. They create a political and procedural cost to the removal of a Monitor, but do not create criminal or civil consequences for non‑cooperative agencies.

Information access overrides secrecy but does not create penalty for misuse: The Act specifically states that obligations to maintain secrecy or privilege do not apply to information given under ss 18(2), 19 or 20 (s 21(1)). This effectively eliminates statutory secrecy as a ground for refusing to provide information to the Monitor. However, the Monitor and persons performing duties under the Act are themselves subject to confidentiality constraints (s 21(3), s 22), and the Monitor has immunity for acts done in good faith (s 14). The Act shifts legal exposure by making the State, not the Monitor, the potential respondent to liability arising from Monitor activity (s 14(2)), but again does not specify penalties for breaches by agencies of information duties.

Immunity alters enforcement consequences: The Monitor is accorded immunity from personal liability for anything reasonably or necessarily done in good faith in performing functions under the Act (s 14(1)). Where liability would otherwise attach to the Monitor, it attaches to the State (s 14(2)). This structure insulates the Monitor from direct legal consequences and thereby shifts any enforcement or accountability claim to the State.

Administrative levers and indirect enforcement: In absence of explicit statutory sanctions, enforcement will manifest through:

• reputational pressure from reports tabled in Parliament (ss 26-28);
• internal administrative remedies available to agencies (not specified in the Act);
• potential judicial review of administrative decisions or conduct relevant to implementation where general public law grounds exist (the Act does not qualify ouster of judicial review); and
• political or ministerial action led by the Attorney‑General or Ministers in response to report findings.

Practical consequence: Responsible agencies must treat the Act as creating a statutory duty to respond and to cooperate; while failure to comply does not trigger an express statutory penalty, non‑compliance exposes agencies to parliamentary scrutiny and reputational costs, and may create administrative consequences outside this Act. The Act therefore primarily relies on informational compulsion, confidentiality constraints, and parliamentary publication as its enforcement architecture.

The Act operates by referencing, amending access to, and in some respects suspending the effect of other statutes and legal doctrines for the specific purpose of enabling an Implementation Monitor to obtain and assess information about implementation of the RCMPI recommendations.

Freedom of Information Act 1982: The Act expressly excludes the Monitor from being a prescribed authority under the Freedom of Information Act 1982 and removes the FOI Act’s application to the Department of Justice and Community Safety in relation to a document received or stored by the Department solely on behalf of the Monitor for purposes of this Act (s 23(1)-(2)). Those provisions mean that third parties cannot use FOI to compel access to Monitor records or to documents held only as a function of the Monitor. The Act elsewhere requires responsible agencies to identify where information is subject to secrecy or privilege but allows disclosure to the Monitor by overriding secrecy constraints (s 21). The combined effect is that the Monitor gains access to material otherwise protected, but its own records are insulated from FOI requests.

Statutory secrecy and privilege: Section 21(1) states that obligations to maintain secrecy or privilege, or any other restriction on disclosure imposed by or under an Act or rule of law, do not apply to information given under s 18(2), s 19 or s 20. That is a narrow, statutory override that facilitates transfer of protected material to the Monitor. At the same time, s 21(2) requires agencies to identify material subject to secrecy or privilege when disclosing, and s 21(3) imposes non‑disclosure duties on the Monitor and those performing functions under the Act. The Monitor is thus permitted access to otherwise restricted material but remains constrained in further disclosure, and the Act preserves specific report exclusions (s 26(7)) including unpublished Cabinet deliberations.

Cabinet confidentiality and executive processes: The definition of "cabinet document" is imported from s 28(1)(a)-(d) of the Freedom of Information Act 1982 (s 3). Section 21(1) would permit an agency to provide cabinet documents to a Monitor, but s 26(7)(e) prevents inclusion in an implementation report of a deliberation or decision of Cabinet that has not been officially published. This creates a mechanism for executive material to be reviewed by the Monitor while limiting public disclosure of Cabinet deliberations in Monitor reports.

Victoria Police Act 2013 and prosecutorial law: The Act interacts functionally with Victoria Police and the Office of Public Prosecutions by authorising the Monitor to request regular reports from Victoria Police on its ongoing disclosure obligations to potentially affected persons identified by the Royal Commission (s 15(1)(d)). The Monitor may require other information relating to agencies’ implementation of recommendations (s 18(1)). The Act does not amend or displace substantive provisions of the Victoria Police Act 2013 or criminal law, but it creates a statutory channel for internal police information to be made available for oversight.

Constitution Act 1975 privilege: Section 28(6) treats the publication of progress reports under s 28 as absolutely privileged and as if published by authority of the Parliament, invoking ss 73 and 74 of the Constitution Act 1975 and other publication rules. This extends legal privilege protections for parliamentary publication to the progress reports.

Other oversight statutes: The Act lists bodies created by other statutes (Public Interest Monitor Act 2011; Independent Broad‑based Anti‑corruption Commission Act 2011; Legal Profession Uniform Law Application Act 2014) as responsible agencies (s 3). The Act compels those bodies to cooperate with the Monitor but does not alter their statutory powers or mandates. The insertion and repeal history in the endnotes shows amendments were made in relation to a Special Investigator Act and its repeal, reflecting interactions with other statutory architectures, but the Act itself remains the mechanism for monitoring RCMPI implementation.

Interpretation and administrative law: The Act contains a validity provision that an act or decision of a Monitor is not invalid merely because of a defect or irregularity in appointment (s 25), reducing risks of legal challenge on appointment technicalities. The Act does not explicitly oust judicial review; general administrative law remedies may still be available to challenge administrative acts where appropriate, but that is not expressly addressed in the text.

Liability and State responsibility: By providing immunity to the Monitor and transferring any liability to the State for acts done in good faith (s 14(1)-(2)), the Act adjusts who bears risk for Monitor activity, interacting with civil liability law and government indemnity arrangements.

In short, the Act creates statutory carve‑outs from secrecy and FOI rules to permit oversight access, while preserving confidentiality and report exclusions. It relies on cooperation with existing agencies rather than modifying their core statutory powers. The statutory structure therefore creates overlaying monitoring powers that interact with but do not supplant the substantive legal regimes governing police, prosecutorial, executive and professional regulatory functions.

The Act as published incorporates a small number of amendments recorded in the Endnotes. The source documents referenced in the Act’s endnotes identify two amending instruments relevant to this Act: the Special Investigator Act 2021 (No. 50/2021) and the Special Investigator Repeal Act 2023 (No. 31/2023).

Key points from the amendment table in the source:

• Special Investigator Act 2021 (No. 50/2021) assented 30 November 2021. The endnote states that sections 134 and 135 of that Act commenced on 1 December 2021. The endnote indicates that some definitions were inserted into s 3 by No. 50/2021 s 134(1) (for example, the defn of Chief Commissioner and Office of the Special Investigator), and s 15(1)(e)(iii) and other subsections were amended by Nos 50/2021 s 135(a) and s 135(b) respectively. The endnote flags that certain insertions were later repealed.
• Special Investigator Repeal Act 2023 (No. 31/2023) assented 8 November 2023. Sections 64 and 65 commenced on 2 February 2024 (Special Gazette 19.12.23 p.1). The endnote records that the addition of the defn of Office of the Special Investigator in s 3 was repealed by No. 31/2023 s 64 and that amendments to s 15 were repealed by No. 31/2023 s 65.

The published Act text includes annotations showing where particular subsections were inserted or repealed (for example, S. 3 defn of Chief Commissioner inserted by No. 50/2021 s 134(1); S. 3 defn of Office of the Special Investigator inserted by No. 50/2021 s 134(1), repealed by No. 31/2023 s 64). The text also notes the dates of assent and commencement for the principal Act: assented to 14 September 2021 and came into operation on 15 September 2021 (Endnote 1).

The endnotes state that the publication incorporates amendments made by Acts and subordinate instruments, but the table shows only the two instruments above as affecting provisions of this Act. The explanatory details section in the source shows "No entries at date of publication" for explanatory details, indicating that readers should rely on the endnotes for amendment history.

Mechanically, the amendments that were made and then repealed indicate the Act’s interaction with the Special Investigator legislative process and subsequent repeal, which affected certain definitional and functional provisions. The Act as printed includes editorial annotations identifying where those changes occurred (insertions and repeals by the cited Acts and sections). Any practitioner relying on historical versions should consult the Victoria legislation site for consolidated and historical versions, and check the endnotes for the precise amending provisions and commencement dates referenced in the table.

The source provides no recorded litigation history for the Police Informants Royal Commission Implementation Monitor Act 2021. The Endnotes' "Explanatory details" section contains "No entries at date of publication," and there are no case citations or references to judicial decisions within the Act text. The Act itself contains provisions designed to reduce risks of invalidation of Monitor acts or decisions because of defects in appointment (s 25), but the source does not record any litigation that applies those provisions.

For practice:

• The absence of recorded litigation in the Act text means there are no reported judicial interpretations or litigated disputes arising under this Act included in the source.
• If disputes arise, for example, over whether a notice under s 18 is lawful, whether an agency has complied with s 19, whether the Monitor exceeded powers in a report, or in relation to confidentiality obligations, remedies would likely be sought through general administrative law channels (judicial review) or through rights and obligations established in other statutes. The Act does not oust judicial review and does not provide an exclusive statutory route for enforcement or appeals.
• The Act’s provision preserving validity despite defects in appointment (s 25), and the immunity of the Monitor with liability attaching to the State (s 14), may be relevant arguments in any future litigation concerning the legal effect of Monitor acts. Absent recorded cases in the source, these remain untested in reported decisions as per the text provided.

Users needing up‑to‑date litigation records should consult court databases and the Victorian legislation site for any subsequent cases or judgments engaging the Act after the date of the published version.

The Act contains several features that can catch practitioners and responsible agencies unaware if they assume ordinary access, secrecy, and FOI rules apply.

FOI exclusion and confidentiality scope: The Monitor is not a prescribed authority under the Freedom of Information Act 1982 and the FOI Act does not apply to documents held solely on behalf of the Monitor by the Department (s 23(1)-(2)). This means stakeholders cannot obtain Monitor documents by FOI. Simultaneously, the Act overrides secrecy and privilege for the purpose of disclosure to the Monitor (s 21(1)), yet it places non‑disclosure obligations on the Monitor (s 21(3)) and sets report exclusions for sensitive material (s 26(7)). The net effect is a one‑way, closed channel: agencies can provide material to the Monitor that they could not otherwise disclose, but third parties cannot access the Monitor’s holdings by FOI and the Monitor is constrained in public dissemination. Practitioners should not assume FOI will surface Monitor materials.

No express sanctions for non‑compliance: While s 18 allows the Monitor to require information and s 19 creates a duty to cooperate, the Act does not prescribe penalties or enforcement mechanisms for failure to comply. There is no statutory fine or criminal offence set out for a responsible agency or person who refuses or ignores a Monitor’s notice. Enforcement therefore relies on the Monitor’s capacity to report non‑compliance to the Attorney‑General and to publicise issues in implementation reports and the Attorney‑General’s tabling in Parliament (s 26-28). Agencies should not expect direct statutory penalties; instead, accountability is primarily reputational and political.

Confidentiality identification duty: When providing information it considers secret or privileged, a responsible agency must identify that material for the Monitor (s 21(2)). Failure to identify such material may complicate later claims of confidentiality; an agency should follow s 21(2) closely and establish records when disclosing sensitive items.

Report content restrictions: Implementation reports cannot contain information that would reveal sensitive law enforcement methods, prejudice ongoing investigations/prosecutions/IBAC matters, prejudice safety, disclose unpublished Cabinet deliberations or be otherwise contrary to the public interest (s 26(7)). This creates a tension between the Monitor’s access to sensitive material and the public availability of information about implementation. Agencies must plan redactions and protective handling consistent with s 26(7) when preparing material for the Monitor.

Timing traps for adverse material: The Monitor must give at least 14 days to respond before including adverse information in a report, and must fairly set out any response (ss 26(5)-(6)). This imposes tight deadlines for agencies and persons who may be the subject of adverse findings. If agencies do not build procedures to identify and respond quickly to such notices, they risk having adverse material included. Conversely, monitoring bodies have to manage procedural fairness.

Acting appointment limits: An acting Monitor can be appointed by the Attorney‑General for up to three months (s 10(1)), but the Attorney‑General may only make one acting appointment before a substantive appointment under s 7 must be made (s 10(2)). This limits temporary coverage and creates a risk window if appointments are delayed.

Immunity and State liability: The Monitor has personal immunity for acts done in good faith (s 14(1)) and any liability attaches to the State (s 14(2)). This shifts the legal costs and risk envelope. Agencies and external parties should anticipate claims against the State rather than individual Monitors if disputes arise from Monitor acts done in good faith.

Parliamentary involvement in removal: The suspension/removal process places a requirement for parliamentary resolutions to remove a Monitor after suspension (s 12(2)-(4)). Practically, this gives Parliament a role in Monitor tenure but also means that removal is a politically salient and procedural process. The Attorney‑General must table grounds within seven sitting days, and removal requires affirmative resolutions in each House within 20 sitting days. These timings can affect continuity and responses to allegations against Monitors.

Interdependencies and external process considerations: The Monitor must have regard to interdependencies and external processes that might affect timely implementation (s 15(3)(d)-(e)). Responsible agencies should not assume that implementation failures are the sole measure; the Monitor will evaluate cross‑agency and external constraints. Conversely, agencies relying on external processes should document those dependencies carefully.

Publication privilege: Progress reports tabled under s 28 are absolutely privileged and treated as parliamentary publications (s 28(5)-(6)). This protects the Attorney‑General and Parliament from legal action in respect of those publications but may make it more difficult for persons to obtain redress for reputational harms arising from parliamentary reports.

In practice, agencies should not treat this Act as a routine information request regime; it creates an exceptional oversight channel with special rules on secrecy, FOI exemption and report content that require careful procedural handling.

Responsible agencies (and persons acting on their behalf) should implement practical, documented procedures to meet the Act’s informational, procedural fairness and confidentiality obligations. Below are concrete steps mapped to the statutory provisions.

1. Identify status under the Act

• Confirm whether the entity is a responsible agency per s 3(a)-(k), or whether it has been added by Governor in Council order under s 5. If an entity is proposed to be added, the Attorney‑General must obtain the entity’s consent and consult each Monitor before recommending the order (s 5(1)-(2)). Record any such correspondence and legal status determination.

2. Designate points of contact and records owners

• Nominate a senior official as the agency’s Monitor liaison to receive notices under s 18 and requests under s 19, and to coordinate responses to written advice under s 15(4). Ensure contact details are maintained and circulated to relevant internal units (legal, crime/prosecution, FOI/records, corporate governance).

3. Procedure for notices and timeframes

• Put in place a documented workflow to respond to s 18 notices within 21 calendar days (s 18(2)). Build in a rapid assessment step: within two workdays, determine which parts of the request require legal clearance (privilege, secrecy, law enforcement sensitivity). If unable to comply within 21 days, immediately engage with the Monitor to negotiate an extension and obtain written agreement to the extension (s 18(2)(a)), or to document that the information cannot be provided (s 18(2)(b).

4. Identification of secret/privileged material

• When providing information, explicitly identify material considered subject to an obligation of secrecy or privilege (s 21(2)). Create a standard form or cover letter that enumerates each item provided, the source of secrecy or privilege (statute, common law, legal professional privilege), and whether redaction is requested. This helps preserve claims of privilege while enabling disclosure to the Monitor.

5. Redaction, security and handling

• Because the Monitor may receive sensitive law enforcement material, prepare redaction and secure handling protocols consistent with s 26(7) (which disallows revealing sensitive law enforcement methods or prejudicing active matters). Provide materials on a need‑to‑know basis and use secure transmission channels. Maintain audit trails of what was disclosed and when.

6. Responding to written advice and adverse information

• If a Monitor issues written advice under s 15(1)(c), respond in writing as required by s 15(4). If the agency is the subject of intended adverse inclusion in an implementation report, use the 14‑day response window under s 26(5)-(6). Prepare templates for rapid, fair responses and ensure legal and operational input is included. Keep contemporaneous records of the agency’s response and any remedial actions taken.

7. Records to be kept separately for FOI and legal preservation

• Note that documents received or stored by the Department solely on behalf of the Monitor are not FOI‑accessible (s 23(2)). However, agencies should still keep internal records of what was provided to the Monitor, including copies and metadata, and record how the material was handled. If records are shared between an agency and the Department for other purposes, record the basis for sharing and whether FOI access may apply.

8. Coordinate with the Department and Implementation Taskforce

• The Monitor may attend Implementation Taskforce meetings and request information (s 15(1)(b)). Agencies should ensure the Taskforce has current, accurate summaries of implementation progress and interdependencies, and be prepared to supply those to the Taskforce and Monitor. If assistance from the Secretary is needed, the Monitor can request staff and facilities (s 24); agencies should liaise with the Department to ensure availability.

9. Legal review before providing particularly sensitive material

• When material raises complex privilege, public interest immunity or executive confidentiality questions (e.g. Cabinet material), obtain legal advice before disclosure. Although s 21(1) allows disclosure to the Monitor despite secrecy obligations, s 26(7)(e) prevents publication of unpublished Cabinet deliberations. Document legal advice and the basis on which disclosure to the Monitor is made.

10. Training and internal awareness

• Train staff who handle requests from the Monitor on the Act’s requirements: identification of secret/privileged material (s 21(2)); duty to cooperate (s 19); privacy and confidentiality limits (s 22); and response timelines. Ensure records, FOI officers, and legal teams are aware of the FOI carve‑outs in s 23 and the obligations in s 26(5)-(7).

11. Interagency communications on interdependencies

• Because the Monitor must consider interdependencies (s 15(3)(d)-(e)), agencies should document dependencies on other bodies or external processes, including timelines and risk mitigations, and supply those to the Monitor on request to avoid being judged non‑compliant when delays arise from external factors.

12. Prepare for parliamentary scrutiny

• Be ready for findings to be surfaced through the Attorney‑General’s progress reports and tabled in Parliament (ss 26-28). Senior agency executives should ensure that remediations and implementation plans are documented and that internal briefings are prepared in case questions arise in Parliament.

13. Compliance with confidentiality and personal information rules

• Treat Monitor material as confidential and ensure personal information handling complies with privacy law, consistent with s 22. When consent exists or when identity is already public, disclosure may be permissible (s 22(2)(a)). Ensure privacy officers review proposed disclosures to the Monitor and any internal sharing with persons assisting the Monitor (s 22(2)(b)).

14. Escalation and dispute processes

• If an agency believes it cannot provide requested material or that a request is unreasonable, document the basis for that position and engage the Monitor promptly. The Monitor may accept that the agency cannot provide the information (s 18(2)(b)). If intractable disputes arise, record them and consider seeking guidance from the Attorney‑General’s office or seeking judicial clarification where appropriate, keeping in mind the Act does not set out internal dispute resolution procedures.

By operationalising these steps, responsible agencies can meet the Act’s procedural obligations, preserve legitimate claims of confidentiality and privilege, and mitigate the risk that adverse findings arise from technical non‑compliance rather than substantive implementation failings.
