What it does
This Act establishes a statutory framework for the regulation, inspection and enforcement of on-site plumbing and drainage work in New South Wales. It defines what constitutes plumbing and drainage work (s 4), who is the responsible person for such work (s 5), and prescribes mandatory regulatory processes for that work: who may carry it out (s 6), the standards to be met (s 7), the fittings that may be used (s 8, s 20), requirements to pre-notify work to the plumbing regulator (s 9), inspection procedures (ss 12-14), obligations to supply certificates and plans on completion (ss 15-16), and duties to notify defective installations discovered during work (s 11). The plumbing regulator is given monitoring and public‑health functions (s 19), powers to authorise fittings and to delegate functions (ss 20-21), and inspection and enforcement powers are set out across Parts 3 and 4, distinguishing inspectors and enforcement officers (ss 22-23) and defining their entry, inspection and warrant powers (ss 26-36). The Act provides for civil and criminal responses, including directions, appeals to the Land and Environment Court (s 39), injunctions (s 40), penalty notices (s 41) and summary proceedings (s 42). It also contains transitional and savings provisions and enables regulations for fees, exemptions and staged commencements (Schedule 1, cl 2; s 52).
Mechanically, the Act creates a regulatory cycle of pre-notification, inspection and certification for on-site plumbing and drainage work. Responsible persons must ensure code compliance (s 7) and use authorised fittings (s 8), pre-notify works to the plumbing regulator (s 9) except in specified emergency cases (s 10), make the work available for inspection (s 13) and give certificates of compliance and plans on completion (ss 15-16). Failure to observe these duties can attract directions from the plumbing regulator requiring remedial action, disconnection or uncovering of work (s 14), monetary penalties (usually up to 100 penalty units for individuals and higher for corporations in some sections), and enforcement by authorised officers exercising entry, inspection, sample-taking and evidentiary powers (Parts 4 and 5).
