What it does
These regulations prescribe fixed monetary amounts to be used for specified subsections of section 4 of the Petroleum and Geothermal Energy Resources (Registration Fees) Act 1967 (the Act). They do not restate or reproduce section 4 of the Act; they simply set "prescribed amounts" for the statutory references in s 4(2), s 4(3), s 4(4), s 4(6) and s 4(7). The operative text is concise: regulation 3 contains five subparagraphs, each declaring a dollar amount to be used "for the purposes of" the cited subsection of the Act (reg 3(1)-(5)). The amounts currently listed in the instrument are $6,010.00 for s 4(2), $6,010.00 for s 4(3), $9,550.00 for s 4(4), $6,010.00 for s 4(6) and $9,597.00 for s 4(7) (reg 3(1)-(5)).
The regulations also deal with timing and citation. Regulation 1 provides the short title: Petroleum and Geothermal Energy Resources (Registration Fees) Regulations 1990 (r 1). Regulation 2 fixes commencement to the commencement of the Petroleum (Registration Fees) Amendment Act 1990 rather than specifying an independent calendar date (r 2). The compilation table and amendment notes included in the instrument record a sequence of subordinate instruments that have varied the prescribed amounts and the instrument's status over time, showing repeated amendments and reprints up to 2023 (compilation table and reg 3 amendment note).
Mechanically, therefore, the regulations operate as a subordinate instrument that converts the Act's delegated fee-making power into tangible, payable sums. They do not create separate licensing, registration, procedural or enforcement provisions; they simply attach dollar figures to statutory references. The effect for any person required by s 4 of the Act to pay a "prescribed amount" is that the payable quantum is the dollar amount set in the relevant paragraph of regulation 3, subject to any later amendment recorded in the compilation table.
