Petroleum Pipelines Regulations 1970

The Regulations revolve around a small set of recurring regulatory concepts: licence administration, survey and location certainty, signposting and public safety, inspector-led compliance at construction and modification stages, incident response and reporting, transfer and dealing documentation, and fees and prescribed monetary amounts.

Licence administration: The Regulations implement administrative expenses and transaction recording under the Act. Schedule 3 prescribes fees for key administrative transactions: applications for licences and variations under the Act (items 1 and 2), registration of transfers and changes (items 3-6), inspection and certified extracts from the register (items 7-9). Regulation 4 formally prescribes those fees. The Fourth Schedule supplies a standardised instrument form for transfer under section 44 of the Act (reg 4C; Fourth Schedule).

Survey and position certainty: Regulation 18 requires a licence-holder to "cause to be made a survey to a standard as directed by the Minister" for the purpose of precisely locating a pipeline, with a copy of such survey lodged with the Minister. This ties legal title and operational control to an official, Minister-directed geospatial standard.

Signposting and public safety: Regulation 20 requires signs "of such a kind as the Minister generally or in any special case directs" to be erected and maintained where a pipeline enters or leaves limits of highways, roads, railways, rivers and similar public corridors, and at other Minister-directed points. The obligation to remove signs when the marked situation changes is also explicit. These duties are framed as ongoing maintenance obligations.

Inspector function and rectification: Regulation 21 empowers inspectors to examine or inquire into any phase of pipeline construction, modification or reconstruction, and the installation of components, and to request rectification where elements are "not in accord with the Act". The statutory carve-out "for the purposes of the Act other than a listed OSH law" signals that occupational safety and health powers are to be coordinated with other statutory regimes. Regulation 22 provides a specific consequence: refusal to comply with an inspector’s request may lead the inspector to recommend to the Minister that permission to operate the pipeline be refused.

Incident response and reporting: Regulation 23 makes immediate response duties mandatory upon awareness of escape or ignition of petroleum. The licensee must act to minimise hydrocarbon loss and pollution (reg 23(1)(b)). Where repairs are carried out, the licence-holder must "forthwith submit a written report" to the Minister containing specified details: time and place, approximate quantity, resulting damage, known causal or contributing conditions, and methods of repair (reg 23(2)(a)-(e)). The penalty for breach is a fine of $5,000 for the subregulations specified in regs 18, 20 and 23.

Transfer particulars and related dealings: Regulation 4D prescribes particulars required under section 47(4)(b) of the Act, including the description and date of execution of the instrument, licence details, parties’ names and addresses, the effect of registration, and pre-existing related dealings, including options and rights that affect interests. Regulation 4D(2) defines "related dealing" for the purposes of the prescribed particulars. The Fourth Schedule gives a template instrument of transfer (reg 4C).

Fees and prescribed amounts: Regulation 4B fixes the prescribed amount for Act section 29(1) at $233.00, while Schedule 3 lists discrete administrative fees (for example, licence application $8,740.00). The Compilation Table records iterative updates to fees across many amendment instruments.

Transitional provision: Regulation 24 sets a transitional rule that, in respect of offences committed before a particular amendment (the Petroleum Legislation Amendment and Repeal Act 2005 section 29(1), which inserts section 66BA of the Act), the Criminal Procedure Act 2004 section 21(2) as in effect immediately before that commencement applies, effectively preserving an older limitation rule for pre‑amendment conduct.

Together these concepts show the Regulations as a mix of operational safety obligations, Ministerial-direction-based standards, documentary and registration formalities, and fee mechanics. Several duties are framed in absolute terms ("shall"), while standards and particular content are left to Ministerial direction or the Act’s substantive provisions.

The primary regulated parties under these Regulations are licence-holders for petroleum pipelines (referred to in the Regulations as "licensee"), transferees and transferrers of pipeline licences, applicants for licences and licence variations, inspectors empowered under the Act, and the Minister responsible for administering the Act and Regulations. The Regulations also affect third parties with an interest in dealings that affect licences, for example parties to "related dealings" (reg 4D(2)), and members of the public and infrastructure owners where pipelines cross highways, roads, railways, rivers and dry creek beds who are the practical recipients of the signposting measures (reg 20).

Licence-holders: A broad set of obligations falls on the licence-holder. They must cause surveys to be made to a Minister-directed standard and lodge copies with the Minister (reg 18). They must erect and maintain signposting at specified crossing points and remove signs where the circumstances that necessitated them change (reg 20). They must comply with inspector requests for rectification of non‑conforming construction/modification works (reg 21-22). They must immediately act to minimise the loss of petroleum and pollution in the event of escape or ignition, and must submit a "forthwith" written report with specific content following repairs (reg 23). They must attach a plan of operational procedure to an application under s 36 of the Act (reg 26). They are also the parties who pay the fees set out in Schedule 3 and the prescribed amount in reg 4B.

Applicants and transferees: Applicants for licences and variations pay substantial application fees (Schedule 3 items 1 and 2). Parties effecting transfers or dealings must use or supply the prescribed form where required (reg 4C; Fourth Schedule) and must supply the detailed particulars prescribed in reg 4D(1) for dealing registration and Ministerial approval. Those particulars extend to pre-existing or related dealings and options that may affect the licence (reg 4D(1)(f) and reg 4D(2)).

Inspectors and the Minister: Inspectors are given investigative and remedial-request powers in relation to construction and installation phases (reg 21). They can recommend refusal to operate to the Minister when their requests are not complied with (reg 22). The Minister holds discretionary roles: directing survey standards (reg 18), directing signposting requirements (reg 20), registering and approving dealings and effects (reg 4D), and receiving the surveys, transfer instruments and incident reports that licence‑holders must lodge.

Infrastructure owners and the public: Owners and managers of public corridors such as highways, roads, railways, and rivers are indirectly affected because signposting must be placed at pipeline entry and exit points in those corridors (reg 20). The Regulations therefore impose duties that influence the interface between pipelines and public infrastructure, including the visibility of pipelines where they cross such corridors.

Legal and compliance advisors: Lawyers, surveyors, engineers and compliance officers advising licence-holders will need to design operational procedures, survey scopes and incident response reporting templates that satisfy the Minister-directed standards and the specific reporting content required by reg 23(2). They must also advise on the particulars required under reg 4D when structuring transfers and related dealings.

The Regulations also affect prosecutorial and criminal procedure considerations because of reg 24, which preserves an older Criminal Procedure Act limitation provision for offences committed before the commencement of an amendment. That transitional arrangement affects how time-limited proceedings for historic offences are treated.

This section sets out the principal duties imposed on licence-holders, the rights or procedural entitlements created by the Regulations, and the discrete administrative mechanics that flow from them. All references are to the Regulations as compiled.

Duties to survey and lodge: Regulation 18 states the licence-holder "shall cause to be made a survey to a standard as directed by the Minister" for the purpose of precisely locating a pipeline, and "a copy of such survey shall be lodged by the licensee with the Minister." The duty is expressed in mandatory terms. The Ministerial direction sets the standard, but the obligation to conduct and lodge the survey is on the licence-holder. Breach attracts a prescribed monetary penalty , a fine of $5,000.

Signposting duty: Regulation 20 requires the licence-holder to erect and maintain signs of the kind directed by the Minister at each point where a pipeline enters or leaves the limits of specified public corridors and at any other point the Minister directs. When the pipeline is removed from the situation that necessitated marking, the licence-holder must remove the signs. Penalty for breach of either subregulation is a fine of $5,000. The content and form of the signs are subject to Ministerial direction.

Construction and modification scrutiny: Regulation 21 grants inspectors the power to "examine or inquire into any phase of a construction, modification or reconstruction of a pipeline" and to request rectification of any part not in accord with the Act. That is an operational compliance duty, applying while pipelines are constructed, modified or reconstructed and during component installation. Regulation 22 makes clear that non‑compliance with an inspector’s rectification request may result in the inspector recommending to the Minister that permission to operate the pipeline be refused. This creates a two-step enforcement chain: rectification request by an inspector, then potential Ministerial refusal to authorise operation if the request is ignored. The Regulations do not in themselves state a specific time within which rectification must be completed; the remedy for non‑compliance is the inspector’s recommendation.

Incident response and reporting: Regulation 23 requires licence-holders, "immediately" upon awareness of the escape or ignition of petroleum being conveyed in a pipeline, to take action necessary to minimise loss and pollution (reg 23(1)(b)). After the pipeline is repaired, the licence-holder must "forthwith submit a written report to the Minister" containing specific particulars: time and place, approximate quantity escaped, damage resulting, known causal conditions, and methods adopted to carry out repairs (reg 23(2)(a)-(e)). The requirement to submit the report "forthwith" is immediate and continuing until discharge. A fine of $5,000 applies for breach of these subregulations.

Documentation and transfer particulars: Regulation 4C prescribes that the form of an instrument of transfer under Act s 44(3)(a) is the form in the Fourth Schedule. Regulation 4D prescribes particulars that must be provided for the purposes of Act s 47(4)(b). Those particulars are detailed and include instrument description and execution date, licence details, parties’ names and business addresses, effects of registration under s 47(1) of the Act, the interests before and after registration, and particulars of related dealings that might affect the licence (reg 4D(1)(a)-(f)). Regulation 4D(2) defines "related dealing" to encompass prior transactions affecting the licence, including creation or assignment of options or rights, and transactions that are altered or terminated by the dealing.

Procedural attachments to applications: Regulation 26 requires that an applicant for consent to operate a pipeline under section 36 of the Act must attach "a plan of the operational procedure that the applicant proposes to follow in operating the pipeline." The content of that plan is not specified in the Regulations, but the obligation is mandatory.

Fees and prescribed amount: Regulation 4 prescribes that the fees set out in Schedule 3 are the fees for the purposes mentioned in that Schedule. Schedule 3 lists specific fees and ties them to relevant Act provisions. Regulation 4B prescribes the amount for Act s 29(1) as $233.00. These payments are mandatory to the extent the Act triggers fee obligations or the Regulations require payment as part of application or registration processes.

Rights and administrative entitlements: The Regulations create certain procedural entitlements. For example, inspection of the register and certified copies may be obtained for the fees in Schedule 3 (items 7 and 8). Parties have a prescribed form of instrument for transfer and defined fields to complete; that standardisation creates predictability but also mandates a certain approach to documentation. Inspectors and licence-holders both have defined operational roles , inspectors are empowered to request rectification, while licence-holders have the right to respond and, unless non‑compliant, to seek the Minister’s permission to operate.

Transitional protection for earlier offences and procedural clarity: Regulation 24 protects certain pre‑amendment offences by preserving an earlier version of the Criminal Procedure Act s 21(2) for offences committed before the commencement of the Amending Act’s section 29(1). This affects time bars and prosecutorial procedure for historical offences.

Collectively, the duties are prescriptive and rely heavily on Ministerial direction for standards and some content. Rights are mainly procedural, being the right to lodge prescribed forms and to obtain registry inspections and certified documents for prescribed fees.

The Regulations set a limited set of monetary penalties and an administrative enforcement mechanism that relies on inspector recommendations to the Minister. Enforcement is a mixture of fixed monetary fines for particular breaches and a discretionary refusal-to-operate pathway overseen by the Minister.

Monetary fines: The Regulations prescribe specific fines for breaches of particular regulatory duties. Regulation 18 (survey and lodging) carries a penalty of a fine of $5,000 for non-compliance. Regulation 20 (signposting duties) prescribes a fine of $5,000 for failure to erect and maintain signs where directed, and for failure to remove signs when the pipeline is moved from the marked situation. Regulation 23 (duty on escape or ignition and reporting) carries a fine of $5,000 for breaches of the immediate action duty (reg 23(1)(b)) and the "forthwith" reporting obligations required following repair (reg 23(2)(a)-(e)). The Regulations do not specify a graduated penalty scale or administrative infringement notice amounts; the stated penalty is a fine. The Regulations do not themselves elaborate the process for imposing the fine, which will be governed by the Act and general procedural law.

Inspector-driven administrative enforcement: Regulations 21 and 22 establish an enforcement pathway that relies on inspectors. Regulation 21 authorises inspectors to examine and inquire into any phase of pipeline construction, modification, reconstruction, or component installation, and to request rectification where work is not in accord with the Act. Regulation 22 provides that if a licence-holder does not comply with an inspector’s request under reg 21, the inspector may recommend that permission to operate the pipeline be refused by the Minister. That recommendation mechanism is administrative rather than criminal; the immediate remedy is the inspector’s recommendation and the Minister’s subsequent decision to refuse to grant permission to operate. The Regulations do not specify timelines for compliance with inspector requests, nor do they provide for intermediate administrative penalties short of recommending refusal to operate.

Interaction with criminal time-limitation rules: Regulation 24(2) is a transitional enforcement‑related provision. It directs that the Criminal Procedure Act 2004 section 21(2), as in effect immediately before the commencement of the Act’s amendment (section 29(1) of the Petroleum Legislation Amendment and Repeal Act 2005), applies to an offence against the Petroleum Pipelines Act 1969 committed before that commencement. In practice, this preserves an earlier criminal procedural rule or time bar for certain historic offences and thus affects the enforceability window for older breaches. This is procedural rather than an additional penalty, but it directly affects prosecution risk for earlier conduct.

Certificates and registrar services: Schedule 3 specifies fees for inspection of the register (item 7), copies or extracts or certified instruments (item 8), and certificates by the Minister (item 9). These fees are payable for obtaining administrative documentation, and failure to pay is likely to affect the ability to obtain certified documents rather than being a criminal or civil penalty under these Regulations themselves.

No other administrative sanctions or licence suspension rules are in the Regulations: the principal non‑monetary enforcement tool they provide is the inspector’s ability to recommend refusal to operate and the Minister’s consequent power to withhold permission to operate. The Regulations leave broader enforcement powers, prosecution mechanisms and licence conditions to the Act itself and to relevant criminal and administrative procedure laws.

Implementation and discretion risks: The regulatory enforcement design relies on (a) Ministerial direction to define standards (reg 18 and reg 20), (b) inspectors to detect non‑compliance and issue rectification requests (reg 21), and (c) the Minister to act on recommendations to refuse permission to operate (reg 22). Where standards are not specified in the Regulations but left to Ministerial direction, enforcement decisions will frequently involve discretionary judgment calls and operational coordination between inspectors and the Minister’s office. That has implications for predictability and for the timing of enforcement outcomes.

The Regulations explicitly reference and interact with the Act, certain amendment statutes, the Criminal Procedure Act 2004, and occupational safety and health laws. They provide procedural complements to the substantive provisions of the Petroleum Pipelines Act 1969 and direct certain material and process to the Minister required under the Act.

Primary statutory link , the Petroleum Pipelines Act 1969: The Regulations are subordinate legislation made under the Act and implement Act-based triggers. Several Regulations cross‑reference specific Act provisions: reg 4C refers to Act s 44(3)(a) (instrument of transfer), reg 4D prescribes particulars for purposes of Act s 47(4)(b) (dealings), reg 26 requires attachment of the operational plan with applications under Act s 36 (consent to operate), and Schedule 3 ties fees to various Act provisions (for example s 8, s 15(2)(d), s 44(9), s 47(12), s 52(1), s 53(2)-(3)). This means that the Regulations must be read alongside the parent Act to understand substantive duties, time limits and effects that the Regulations trigger procedurally.

Interaction with occupational safety and health (OSH) laws: Regulation 21 is framed to apply "for the purposes of the Act other than a listed OSH law", signalling an express legislative boundary between the inspector’s power under these Regulations and statutory OSH regimes. The wording acknowledges parallel or overlapping regulatory regimes. It implies that matters covered by a "listed OSH law" are excluded from the inspection power under reg 21, and suggests that compliance and enforcement in the safety domain will involve coordination with the statutory OSH framework. The Regulations do not define the listed OSH laws or set out mechanisms for conflict resolution where jurisdictional boundaries might be unclear; those rules will be in the Act or the other legislation.

Criminal Procedure Act 2004 and transitional provisions: Regulation 24(2) directs that the Criminal Procedure Act 2004 section 21(2), as it stood immediately before the commencement of the Petroleum Legislation Amendment and Repeal Act 2005 section 29(1), applies to offences against the Petroleum Pipelines Act 1969 committed before that commencement. In practice, this preserves pre-amendment criminal procedure rules for historic offences and is a clear linkage between these Regulations and criminal procedure rules applicable to prosecutions under the Act.

Reference to amending Acts and historical instruments: The Regulations incorporate a record of amendments and machinery by reference to various amending instruments, including the Acts Amendment (Petroleum) Act 1990 (see compilation note and reg 4D(2)), the Petroleum Legislation Amendment and Repeal Act 2005 (reg 24(1) definition), and multiple Mines and Petroleum Regulations Amendment instruments that have adjusted fees. The Compilation Table records successive amending regulations from 1983 through 2025, meaning regulatory content is the product of iterative statutory adjustments and must be read with that amendment history in mind.

Administrative law and Ministerial discretion: Many duties in the Regulations implement Ministerial directions (for example reg 18 and reg 20), which means administrative law principles such as reasonableness, procedural fairness and proper exercise of statutory power will govern Ministerial decision-making where a licence-holder seeks clarity on standards or approval. Inspectors’ recommendations to refuse to operate (reg 22) likewise lead to administrative decisions by the Minister that will be subject to judicial review principles if challenged.

Registry and property law interface: Regulation 4D’s requirements for particulars and registration of dealings under the Act (and the prescribed form in the Fourth Schedule) interact with property transfer mechanics, evidentiary requirements and public registration systems. The particulars prescribed are intended to provide certainty as to pre-existing interests and to allow the Minister and the public register to reflect the true distribution of rights post-dealing. The Regulations therefore interact with property-transfer administrative processes and disclosure obligations.

In sum, the Regulations are primarily procedural and administrative. Their effective operation requires cross‑instrument reading with the parent Act, coordination with criminal procedure rules for prosecutions, engagement with OSH regimes for safety-related matters, and compliance with general administrative law when Ministerial directions and inspector recommendations affect licence-holders’ rights to operate.

The Regulations have a multi-decade amendment history recorded in the Compilation Table and in individual regulation notes. Major insertion points and consequential amendments relevant to current practice are as follows.

Early enactment and 1983 amendment: The Petroleum Pipelines Regulations 1970 were originally published 30 July 1970. A notable early amendment was the Petroleum Pipelines Amendment Regulations 1983, published 11 November 1983, which inserted regulation 4 prescribing fees (reg 4 inserted: Gazette 11 Nov 1983 p. 4543).

1990 amendments and transfer/form materials: The Petroleum Pipelines Amendment Regulations 1990 (Gazette 28 September 1990) introduced several provisions that persist: regulation 4B (prescribed amount for Act s 29(1)) was later inserted (reg 4B inserted: Gazette 28 Sep 1990 p. 5103) and regulation 4C (form of instrument of transfer) was inserted on 28 Sep 1990. The Fourth Schedule (the form of instrument of transfer) was also inserted at that time (Fourth Schedule inserted: Gazette 28 Sep 1990 p. 5105). Regulation 4D, prescribing particulars for Act s 47(4)(b), was also inserted on 28 Sep 1990 (reg 4D inserted: Gazette 28 Sep 1990 p. 5103-4). These 1990 changes established the standardised documentation for transfers and dealings that the regulator requires.

1993-2003 incremental updates: Amendments occurred in 1993 (24 Dec 1993), 1994 (22 Jul 1994) and in a cluster between 2000 and 2003. Several regulations were deleted in the 1994 and 2010 consolidations (notably regs 2, 3, 4A and multiple items). Regulation 4B saw multiple amendments over the 2000-2003 period and subsequent years, reflecting regular indexing or fee adjustments (see reg 4B amendment list).

2009-2010 amendments and insertion of transitional and operational provisions: The Compilation Table records an amendment instrument in June 2009 (No. 2, 2009). Significant drafting updates appear in 2010: reg 18 was amended (Gazette 14 May 2010 p. 2019) and reg 21 and reg 23 were amended at that time (Gazette 14 May 2010 p. 2020). Regulation 24 (the transitional provision concerning criminal procedure and s 29(1)) was inserted on 14 May 2010 (reg 24 inserted: Gazette 14 May 2010 p. 2020-1). The 2010 amendments also involved deletions of multiple earlier regulations and schedules, indicating a consolidation and streamlining effort.

Ongoing fee and administrative updates 2011-2025: The Compilation Table records a steady series of annual or multi-yearly amendments affecting fees and charges under Mines and Petroleum Regulations Amendment instruments and related updates from 2011 through to 2025. Fee and levy adjustments were made under various instruments titled Mines and Petroleum Regulations Amendment (Fees and Levies) or (Fees and Charges) in 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023, 2024 and 2025. The Schedule 3 present in the current compilation was inserted via SL 2025/90 r. 24 (Schedule 3 inserted: SL 2025/90 r. 24), indicating the most recent consolidation of fees and aligning amounts to current administrative policy.

Notable insertions and deletions: The record in the text shows many provisions deleted across amendments (for example regs 2, 3, 4A, 4BA, 5-8, 9-17, 19, 25, 27, First Schedule, Second Schedule). The current text therefore represents a streamlined instrument focusing on the core ongoing duties (surveys, signposting, inspectors, incident reporting, transfer particulars, fees and operational plan requirement). The repeated amending instruments updating reg 4B and Schedule 3 indicate a regular administrative practice of re‑setting prescribed monetary amounts and fee schedules by regulation.

Interpretation notes and defined terms: The Regulations also authoritatively list defined terms for "dealing", "related dealing" and "section 29(1)" where those terms are defined within the Regulations (see reg 4D(1), reg 4D(2), and reg 24(1)). Some amendment instruments reformed the context in which those definitions applied, most notably the Acts Amendment (Petroleum) Act 1990 (the day fixed for that Act’s commencement is recorded in the compilation notes).

Practical effect: For practitioners and licence‑holders this amendment history means that the content of the Regulations is the product of many incremental changes , particularly in fee regimes , and the current operative Schedule 3 and the prescribed amount in reg 4B reflect the policy and indexation decisions made up to 2025. Licence-holders must therefore consult the current compilation and the parent Act to determine their exact obligations and the current fees payable.

The Regulations’ compilation and the text provided do not record any judicial decisions or reported cases that interpret these Regulations. They do not cite any cases, nor do the notes identify litigation outcomes. Given that the Regulations principally implement administrative, documentary and operational duties, litigation that would engage them would typically arise in one of the following contexts: prosecution for the offences the Regulations reference (for example, breaches attracting the $5,000 fine in regs 18, 20 and 23), administrative review of Ministerial decisions following inspector recommendations (for example, refusal to grant permission to operate under reg 22), or judicial review challenges to Ministerial directions (for example, a challenge to the validity or exercise of the power to direct survey standards under reg 18, or the power to direct signposting under reg 20).

Transitional prosecution procedure: The Regulations contain a transitional provision dealing with prosecutions for offences committed before a specified amendment (reg 24). Regulation 24(2) instructs that the Criminal Procedure Act 2004 section 21(2), as it was immediately before the commencement of the amending provision, applies to offences committed before that commencement. This provision alters the prosecutorial procedural context for historic offences and may have been inserted in light of case law or procedural guidance at the time the amendment was made; the Regulation itself does not record decisions.

Absence of named cases: Because the Regulations do not list authorities, a search of judicial databases and the registries would be required to identify any case law relying on these specific regulations. Practitioners should therefore not assume a settled body of jurisprudence derived directly from these Regulations; instead, judicial treatment will likely be situated within broader litigation under the parent Act, administrative law challenges, and OSH or environmental cases where pipeline incidents occur and interlocking legislative schemes apply.

Practical implication: In the absence of cited litigation in the instrument, compliance risk centres on administrative enforcement and the potential for criminal prosecution for non‑compliance with the explicit offence provisions. For those reasons, operators and lawyers commonly focus on documentary evidence (surveys, operational plans, incident reports), demonstrating cooperation with inspectors, and maintaining records of compliance to mitigate exposure to administrative or criminal proceedings.

For an authoritative picture of litigation affecting these Regulations, practitioners should consult up-to-date legal databases and the decisions of Western Australian courts and tribunals for any cases invoking the Regulations, the Act, or the interplay with OSH and environmental laws.

The Regulations are concise but contain several features that create practical compliance and legal‑risk pitfalls. These are not judgments about policy but flagged implementation and legal risk areas grounded in the text.

1. Ministerial direction sets key standards and is unspecified: Several mandatory duties require compliance "to a standard as directed by the Minister" (reg 18) or erecting "signs of such a kind as the Minister generally or in any special case directs" (reg 20). The substantive standard-setting occurs outside the Regulations and is therefore not publicly specified in the text. Practitioners must therefore obtain the Minister’s direction, or documentary evidence thereof, to demonstrate compliance. Absent that, it will be difficult to show that a survey or sign met the required standard.

2. No fixed timeframes for inspector rectification requests: Regulation 21 empowers an inspector to request rectification, but the Regulations do not specify a timeframe to comply or a process for contesting a request. The only stated consequence for non‑compliance is that the inspector "may recommend" refusal to operate (reg 22). That creates operational uncertainty: a licence-holder may be uncertain how long they have to rectify before the Minister is asked to refuse permission to operate, and whether interim relief (for example, a conditional operating permission) is available.

3. "Forthwith" reporting obligation is immediate and uncompromising: Regulation 23(2) requires a licence-holder, after repair of the pipeline, to "forthwith submit a written report to the Minister" with detailed particulars (time, place, quantity, damage, causes, repair methods). The "forthwith" obligation creates exposure if reports are delayed, and the content requirements are granular. There is no regulatory safe harbour for initial notifications followed by later detailed reports; the text suggests an immediate and detailed written report upon repair.

4. Penalties are limited and unevenly specified: The Regulations prescribe a fine of $5,000 for specified regulatory breaches (regs 18, 20, 23), but do not provide a graduated penalty framework. There is also no express provision for infringement notices, civil penalties or administrative fees for non‑compliance in these specific regulations. Enforcement therefore may be limited to criminal fines or administrative action under the Act, creating enforcement unpredictability.

5. Transfer documentation requires disclosure of related dealings: Regulation 4D(1)(f) requires details of related dealings in which an entry has been made in the register or an application for approval lodged, including prior instruments and dates of approval. The definition of "related dealing" in reg 4D(2) is broad, capturing options, rights, alterations or terminations. This can create complex disclosure obligations during corporate restructures, mergers or when dealing chains involve options or contingent arrangements, and a failure to disclose can affect registration or raise compliance issues.

6. Fees are significant for transactional activity: Schedule 3 itemises fees; the application fee for a licence and for variation are both $8,740 (items 1 and 2). For smaller operators or for repeated applications, these fees are material. Also note the prescribed amount in reg 4B ($233) for Act s 29(1), which may be an administrative levy that recurs in transactional contexts.

7. Deleted provisions may create historical uncertainty: Multiple regulations and schedules are marked "deleted" in the current text. Practitioners dealing with historic conduct, transfers or disputes must ensure they consult the appropriate reprints and amendment history to understand what provisions applied at the time of relevant conduct. The Compilation Table helps, but careful temporal analysis is required.

8. Interface with OSH laws: Regulation 21 excludes "a listed OSH law" from the inspector’s powers here, implying that safety matters may be subject to parallel regulatory oversight. Licence-holders must therefore coordinate compliance and reporting between pipeline-specific obligations and the relevant occupational safety and health regulators; failure to do so can result in inconsistent compliance approaches or duplicated investigations.

9. Administrative decisions left to Minister: Several operational outcomes hinge on Ministerial discretion: survey standards, signposting directions, registration approvals and permission to operate following inspector recommendations. This concentrates decision-making power and creates the practical need for licence-holders to engage early and proactively with the Minister’s office.

10. "Forthwith" and "immediately" are ambiguous in enforcement practice: The Regulations use words such as "immediately" and "forthwith" (reg 23), which are strong but legally imprecise. In enforcement disputes, those terms will be interpreted by reference to the facts and may be the subject of litigation if prosecution is pursued.

Mitigation of these "gotchas" requires documentation of Ministerial directions, prompt engagement with inspectors, careful drafting and timely lodgement of required reports and surveys, and early disclosure of related dealings in transfers. Practitioners should also account for the fee schedule and prepare for administrative discretion by establishing lines of communication with the Minister’s office and inspectors.

This section sets out concrete steps to implement the obligations the Regulations place on licence-holders, applicants and parties to dealings. Each step cites the relevant regulation and explains the documentary or operational practice it requires.

1. Surveys and lodgement (reg 18)

• Obtain the Minister’s direction as to the survey standard before commissioning the survey. Record that direction in writing; if the Minister has published a standard or technical specification, retain the version date and any Ministerial instrument or correspondence.
• Engage a qualified surveyor to prepare the survey "to a standard as directed by the Minister". Ensure the survey expresses coordinates, datum, scale and accuracy, and includes any metadata the Minister’s direction requires.
• Lodge a copy of the survey with the Minister promptly after completion, and retain contemporaneous evidence of lodging (receipt, email confirmation). Given the $5,000 penalty for failure to lodge, make lodgement part of the commissioning checklist for any new pipeline or significant reroute.

2. Signposting (reg 20)

• Identify every point where the pipeline enters or leaves the limits of highways, roads, railways, rivers, streams and dry creek beds, and any other points the Minister directs.
• Request from the Minister any specific signage requirements; where the Minister has issued general directions, ensure signage conforms to the specified design, size, wording and placement.
• Implement a maintenance programme for signs with inspection schedules and records of repair or replacement. When a pipeline is removed or rerouted so that the original reason for signage no longer applies, remove signage promptly and record the removal event. Non‑compliance risks a $5,000 fine.

3. Construction/modification oversight and inspector engagement (regs 21-22)

• During construction, modification or reconstruction, provide inspectors reasonable access for examination and inquiry as required by reg 21. Maintain an audit trail of inspector interactions and any rectification requests issued.
• If the inspector issues a rectification request, document receipt, the scope of the rectification required, the remedial plan, and timelines for completion. Even though the Regulations do not prescribe a timeframe, communicate with the inspector and the Minister’s office to avoid an inspector making a recommendation to refuse operation (reg 22).
• Keep a record of all remedial works, third-party contractors, inspection reports and completion certificates to demonstrate compliance in any later enforcement or administrative review.

4. Incident response and reporting (reg 23)

• Prepare and maintain an incident response plan consistent with the operational plan required by reg 26. The response plan should include immediate steps to minimise petroleum loss and pollution.
• On awareness of escape or ignition, act "immediately" to minimise loss and pollution as reg 23(1)(b) requires. Document the incident contemporaneously, including time, location, initial actions, communications with emergency services and containment measures.
• After repair, "forthwith" submit a written report to the Minister containing: the time and place of the incident; approximate quantity escaped; resulting damage; conditions that caused or contributed to the escape, if known; and the repair methods adopted (reg 23(2)(a)-(e)). Keep copies of the report and any supporting materials such as photos, repair invoices and laboratory analyses.

5. Attach operational plan with s 36 application (reg 26)

• When applying for consent to operate under Act s 36, include a plan of the operational procedure proposed for operating the pipeline as reg 26 requires. While the Regulations do not prescribe the plan’s content, it should address safety management, environmental controls, monitoring, maintenance schedules, incident response and regulatory liaison to demonstrate comprehension of operating obligations.
• Retain contemporaneous evidence of submission of the plan and any correspondence with the Minister about required amendments or clarifications.

6. Transfers and dealings , form and particulars (regs 4C and 4D; Fourth Schedule)

• For a transfer under Act s 44(3)(a), use the prescribed form in the Fourth Schedule. Ensure the instrument includes the elements required by the form (transferor name(s), licence number, consideration, transferee name(s), seals or signatures).
• For dealings subject to Act s 47, prepare the particulars prescribed in reg 4D(1)(a)-(f): instrument description/date, licence details/number, full names and business addresses, details of effects on registration under s 47(1), interests before and after registration, and particulars of related dealings including prior instruments and dates of approval/registration.
• Assess whether any dealing is a "related dealing" as defined in reg 4D(2). That definition captures any prior transaction by parties to the instrument that affects the licence and creates or assigns options or rights, or is altered or terminated by the dealing. Full disclosure reduces the risk of Ministerial refusal or registration complications.

7. Fees and payments (reg 4 and Schedule 3; reg 4B)

• Identify required payments early in project budgeting: application for licence and variations are $8,740.00 each (Schedule 3 items 1-2). Registration of transfers, change of name, entry on memorial, inspections, copies and certificates are listed with their respective fees.
• For payments linked to Act s 29(1), pay the prescribed amount set in the Regulations: $233.00 (reg 4B). Confirm whether the Act requires the prescribed amount at a particular stage, and ensure invoices and receipts are retained.
• Use the most recent fee schedule as inserted in SL 2025/90 r. 24 (Schedule 3 inserted: SL 2025/90 r. 24) to avoid relying on out-of-date figures.

8. Records and documentary evidence

• Document Ministerial directions, survey standards, sign designs, inspector communications, rectification plans, incident reports, repair receipts and transfer particulars, and store them in an auditable compliance file.
• Given the regulator’s reliance on documentation and forms for enforcement, an auditable contemporaneous record is the primary protection in any administrative or criminal challenge.

9. Coordinate with OSH and other regulators (reg 21)

• Identify the relevant "listed OSH law" that governs occupational safety for pipeline work (the Regulations reference the carve‑out in reg 21), and coordinate inspections and reporting across agencies. Clarify which regulator leads in an incident and ensure joint reporting where required.
• Ensure safety management systems satisfy both pipeline-specific operational plans and the listed OSH law to avoid inconsistent compliance obligations.

10. Engage legal and technical advisers early

• Use counsel and experienced pipeline surveyors and engineers to draft the operational plan required by reg 26, the survey to Ministerial standards under reg 18, and to prepare the particulars for dealings under reg 4D.
• Seek written confirmation or published guidance from the Minister where standards are unspecified in the Regulations to reduce discretionary risk.

These compliance steps map directly to the text: survey duty and lodging (reg 18); signage (reg 20); inspector examinations and rectification requests (regs 21-22); incident response/reports (reg 23); operational plan with s 36 application (reg 26); form and particulars for transfers and dealings (regs 4C, 4D and Fourth Schedule); and fees (reg 4 and Schedule 3; reg 4B). Practitioners should retain contemporaneous evidence of Ministerial directions and all lodgements to demonstrate compliance and to reduce enforcement or litigation risk.
