68 Meaning of impaired decision-making ability
(1) For this Act, a person has impaired decision-making ability if the
person—
(a) cannot make decisions in relation to a proceeding under this Act;
or
(b) does not understand the nature and effect of the decisions the
person makes in relation to the proceeding.
(2) For subsection (1), a person does not have impaired decision-making
ability only because—
(a) the person makes an unwise decision; or
(b) a disability guardian is appointed for the person; or

(c) subject to section 69, the person is a child; or
(d) the person has, or is taken to have, impaired decision-making
ability under another territory law or in relation to another
matter.
