99 Absence of submission of party (1) Subject to subsection (2), the Tribunal may proceed to consider an application referred to it notwithstanding that it has not received written submissions from a party. (2) The Tribunal shall not consider an application in circumstances described in subsection (1) unless it has given reasonable notice to the party of its intention to do so.
