97 Consideration of application where member ceases to hold office Where a member of the Tribunal, other than the Chairperson or Deputy Chairperson, ceases to hold office by reason of his or her death, resignation, termination of appointment or, by virtue of section 93(6), ceasing to be qualified to hold office as a member, the vacancy shall be filled in the same manner as the appointment of the vacating member unless the Chairperson has advised the Minister, in writing, that, in the opinion of the Chairperson, an injustice to a party is likely to arise by reason of the consideration of an application or reference being continued by the Tribunal constituted with a new member.
