71 Abandonment of perpetual pastoral lease (1) The abandonment of a perpetual pastoral lease shall be deemed to be a breach of a condition of the lease and section 40 applies to and in relation to the lease, and the lease may be forfeited under that section, notwithstanding the exceptions expressed in section 40(3)(e) and (4). (2) For the purposes of subsection (1), a perpetual pastoral lease is abandoned when the rent for the lease has not been paid for 2 years and during that period there is, in the opinion of the Minister, no discernible effective day to day management or occupation for pastoral purposes of the leased land by the lessee.
