The Act expressly links to a number of other statutory regimes, importing procedural mechanisms, substantive definitions and cross-references. Those interactions are laid out in the text and should be accounted for in practical legal advice and operational design.
Interplay with the Greater Sydney Parklands Trust Act 2022. The Act uses the Greater Sydney Parklands Trust Act 2022 as a reference point for consultation and approvals. “Approved consultation and engagement framework” is defined by reference to the Greater Sydney Parklands Trust Act 2022 (s 3 definition). The Trust must give proposed plans of management to the Greater Sydney Parklands Trust for that Trust to submit to the Minister for approval (s 15(4)). Consequently, plan approval and consultation processes are channelled through statutory instruments and frameworks established under the Greater Sydney Parklands Trust Act 2022. Implementation of plans of management is therefore not an internal Trust-only process; a separate statutory body and the Minister are involved (s 15(4), s 17).
Land acquisition and compensation regimes. Where the Governor amends Schedule 1 Part 2 to add trusts, estates or interests, subsection 8(7) brings in Part 3 of the Land Acquisition (Just Terms Compensation) Act 1991 as if the proclamation adding an interest were an acquisition notice published by the Trust. That mechanism imports the NSW just terms compensation regime for divested interests (s 8(7)). Separately, s 9AA permits acquisition of substratum or part of principal trust lands for a public purpose with the term “public purpose” having the same meaning as in the Land Acquisition Act 1991, connecting to the federal/NSW acquisition vocabulary and practice.
Conveyancing Act positive covenants and restrictions. Section 12(2) authorises the Trust, with Ministerial approval, to impose restrictions on use or positive covenants in accordance with sections 88D or 88E of the Conveyancing Act 1919. This links Trust powers to the Conveyancing Act’s mechanisms for creating enforceable burdens on freehold land, which matters for long-term land management and commercial arrangements.
Fines Act and Road Transport Act. The penalty notice regime in s 30 is governed by the Fines Act 1996: penalty notices issued under s 30 are subject to the mechanics of the Fines Act (s 30(4)). The Act also imports definitions from the Road Transport Act 2013 for “owner of a vehicle” and recognises “responsible person” concepts (s 28(4), s 29(6)), which shapes nomination mechanics and evidentiary presumptions in vehicle-related offences.
Crown lands and Crown Land Management Act 2016. When Schedule 1 is amended to add land, that addition may include Crown land “within the meaning of the Crown Land Management Act 2016” (s 8(3)(a)). The Act thus operates alongside the Crown’s land management framework and may require coordination when Crown land is transferred into the Trust.
Parramatta Rail Link and Old Government House Acts. The Act expressly preserves the operation of the Transport Administration Act 1988 and the Public Works Act 1912 in relation to the Parramatta Rail Link, indicating that statutory rights and powers concerning the rail link are unaffected by the Trust’s vesting provisions (s 25(1)). Likewise, the Act does not affect operation of the Parramatta Park (Old Government House) Act 1967, in particular section 7 of that Act (s 26).
Native title and federal/State interface. Schedule 4 cl 7 preserves native title rights and interests existing at the time of vesting to the extent they exist in relation to the land described in Schedule 1, while recognising that extinguishment may have already occurred under the Native Title Act 1993 (Cth) or the Native Title (New South Wales) Act 1994 (Schedule 4 cl 7(1)-(2)). The clause imports the meanings used in the Native Title Act 1993 (Schedule 4 cl 7(3)) and therefore aligns the Trust’s property rights with the established native title framework.
Duties Act and taxation. The Trust is exempt from duty under the Duties Act 1997 in respect of gifts, devises or bequests made to the Trust (s 10(4)). That affects transaction cost calculations where property is donated to the Trust.
Government employment provisions. Schedule 2 cl 8(1) provides that Government Sector Employment Act 2013 provisions relating to employment of Public Service employees do not apply to a trustee, meaning trustees are not to be treated as Public Service employees for those purposes. Relatedly, statutory provisions that would otherwise disqualify a person from holding multiple offices do not operate to disqualify the person from being a trustee (Schedule 2 cl 8(2)).
Transitional and consequential amendments. The Act repeals the National Parks and Wildlife (Parramatta Regional Park) Act 1998 and contains savings and transitional provisions transferring assets, liabilities and proceedings from the former Trust to the new Trust (s 37(1), Schedule 4 cl 5). The Act also contains a saving that a plan of management that was in force under the National Parks Act is taken to have been adopted under this Act until superseded (Schedule 4 cl 8).
Regulations and subordinate instruments. Section 36 gives the Governor power to make regulations “not inconsistent with this Act” for many matters, including use and enjoyment, parking, fees for organised activities, filming and photography, meetings, and committees. The breadth of regulation-making means operational detail and many quasi-criminal rules will in practice be established via regulation rather than primary legislation (s 36(1)(a)-(f), (2)).
In short, the Act is deliberately connective. It imports governance, acquisition, convenants, fine-collection, vehicle ownership, native title and Crown land management law, producing a layered legal environment. Practitioners must therefore read the Act alongside the Conveyancing Act, Land Acquisition (Just Terms Compensation) Act 1991, Fines Act 1996, Road Transport Act, Crown Land Management Act 2016, Native Title Act 1993 (and NSW equivalent), and the Greater Sydney Parklands Trust Act 2022 to understand rights, obligations and processes.
