Parks and Reserves Act 1895

The Act rests on a small set of interlocking legal concepts that determine structure, authority and enforcement on reserved Crown land.

Boards and Governor appointment: The Governor appoints Boards to control and manage land reserved under Part 4 of the Land Administration Act 1997 (s 3(1)). The Governor may also constitute a Board as a body corporate, in which case the Board gains perpetual succession, a common seal, property powers and the capacity to borrow with Governor approval (s 3(4)-(6)). An appointment terminates on dissolution (s 3(7)-(8)). The Act expressly excludes certain other regimes from its appointment power (s 2A).

Duties and funding: A Board’s statutory duty is to control and manage the land placed under its control, using funds provided by Parliament and funds arising from fees, pecuniary penalties or other receipts (s 4). This ties Boards to both public appropriation and internally generated revenue as sources of finance.

Specific management powers: Section 5 lists substantive activities that a Board may perform, including works such as fencing, levelling, drainage and construction of water retention structures; planting and forming walks and drives; establishing zoological gardens; and granting licences to depasture animals or remove sand, gravel or minerals from the land. Licence powers for depasturing and removal of materials are subject to prior Ministerial approval unless the land’s purpose specifically contemplates the proposed licence (s 5(1), s 5(1a)).

By‑laws and regulatory reach: Boards may make by‑laws with the Governor’s approval for a broad range of matters relevant to management and public use, including hours of opening, conduct of persons, regulation of sports, vehicle use, admission fees, prohibitions on damage to plantings, sale of goods, and mechanisms for fee collection (s 8). By‑laws can impose pecuniary penalties not exceeding $1,000 and prescribe fixed sums up to $200 for specified procedural breaches (s 8(2)). By‑laws must be gazetted and tabled in Parliament to take effect (s 9).

Authorised persons and enforcement powers: The Act defines authorised persons to include police members, Board members, and rangers appointed by a Board (s 2). Authorised persons who are not police officers may, without warrant but subject to the statute’s requirements, remove vehicles or animals, stop and search vehicles or conveyances, and enter non‑permanent dwellings where they find or reasonably suspect an offence against a by‑law (s 7A(1)). They must first make reasonable attempts to communicate their intention and grounds for believing they are authorised to exercise the power (s 7A(1)). Authorised persons may examine vehicles on reserved land and require information about vehicle licensing and ownership under the Road Traffic (Vehicles) Act 2012 (s 7A(2)-(3)). The Act also prescribes evidentiary rules for speed‑measuring equipment used by authorised persons (s 7C).

Certification and evidentiary rules: Boards must issue certificates of authority to their members and rangers (s 7B(1)). Production of the certificate is conclusive evidence of appointment and authority in proceedings under the Act (s 7B(3)). Speed equipment evidence is admissible as proof of speed in the absence of contrary evidence (s 7C(2)-(3)).

Infringement notice mechanism and owner liability: The Act implements a civil infringement notice facility for by‑law breaches, setting out minimum contents, serial numbering, notice periods and the option to elect for court determination (s 14(1)-(4)). For vehicle‑related by‑law breaches where the driver cannot be immediately identified, a notice may be addressed to the vehicle owner and served by attaching it to the vehicle; and by‑laws may deem the owner to have been the driver if the owner fails to respond within the prescribed time or to show the vehicle had been stolen (s 8(o), s 14(3)).

Personnel and dissolution mechanics: Boards may appoint secretaries, rangers, park‑keepers and other staff and may delegate powers to committees (s 6, s 7). Where a Board is to be dissolved, staff transition protections and consultation obligations apply: the Minister must nominate a public sector employer for staff or staff must be covered by Part 6 of the Public Sector Management Act 1994, and remuneration and accrued rights are protected unless otherwise agreed (s 15). The Governor, with Treasurer approval, may make regulations governing disposal of Board assets, transfer of rights and liabilities, continuation of proceedings, and other dissolution consequences (s 16). The Treasurer may certify that a thing occurred because of a Board’s dissolution for the purposes of State tax exemption (s 17).

Liability protections and evidentiary presumptions: Persons, other than Boards, enjoy statutory protection from tort actions for acts done in good faith in performance or purported performance of functions under the Act (s 13). The Act contains evidentiary presumptions about habitual ownership of animals and the burden of proving contrary facts in proceedings instituted by a Board (s 12B), and a statutory right for Boards to recover losses caused by children from parents or guardians unless the parent can show non‑negligence (s 12A).

Interplay with other written laws: The Act expressly cross‑references and defers to other NSW or State Acts in defined ways. For example, vehicle and speed provisions refer to the Road Traffic Acts (s 2, s 7C); senior executive service inconsistencies are to be resolved in favour of the Public Sector Management Act 1994 (s 7(3)); and financial and audit obligations fall under the Financial Management Act 2006 and the Auditor General Act 2006 where applicable (s 12). The Act also excludes certain specific regimes from its scope (s 2A).

Those core concepts determine decision‑makers, funding flows, regulatory instruments, enforcement tools and transition mechanisms under the statute.

The Act creates distinct categories of affected parties, each with different legal positions and obligations.

Boards and their members: Boards appointed by the Governor are the central decision‑makers. A Board’s duties are to control and manage land placed under its control and to apply parliamentary funds and proceeds from fees and penalties to that task (s 3(1), s 4). Boards may be corporate entities and thereby hold, lease and dispose of real and personal property and borrow money with Governor approval (s 3(4)-(6)). Board members are authorised persons under the Act (s 2) and must be issued with certificates of authority (s 7B(1)). The president may be the legal persona in which proceedings are taken (s 3(3)). Boards also have a direct financial stake through the receipt of pecuniary penalties from by‑law breaches, which by statute must be paid into the Board’s funds (s 8(3)).

Staff and rangers: Staff appointed under section 7, including secretaries, rangers and park‑keepers, hold office at the pleasure of the Board (s 7(1)). Rangers and Board members have enforcement roles as authorised persons (s 2, s 7A). Where a staff member is a senior executive under the Public Sector Management Act 1994, that Act prevails in case of inconsistency (s 7(3)). Staff are affected by dissolution provisions that require arrangements for re‑employment or Part 6 coverage under the Public Sector Management Act and protect remuneration and accrued rights unless the staff member agrees otherwise (s 15).

Visitors and users of reserved land: The public who use, visit or enter land under Board control are subject to Board by‑laws governing conduct, vehicle use, admission fees, hours of opening and more (s 8). Visitors may be required to comply with by‑laws and, if alleged to breach them, may be issued infringement notices or face prosecution. Owners and drivers of vehicles are specifically affected by vehicle regulation provisions. The Act permits by‑laws to regulate vehicle entry, parking, weight restrictions, and even to deem owners to be drivers in certain circumstances where identity is unknown and the owner fails to respond (s 8(h)(i)-(iii), s 8(o), s 14(3)).

Owners of animals and livestock: By‑laws may control the admission and depasturing of animals, and Boards may grant licences for depasturing subject to Ministerial approval except where the land’s purpose matches the licence’s purpose (s 5(1)(e), s 5(1a), s 8(i)). The Act contains evidentiary presumptions about habitual ownership of animals in Board proceedings, deeming a person who habitually appears to own an animal to be the owner unless they show cause to the contrary (s 12B).

Vehicle owners and operators: Vehicle owners are defined in reference to licences or permits under the Road Traffic (Vehicles) Act 2012 or, absent such person, the person who owns or is entitled to possession (s 2). Authorised persons can examine vehicles on reserved land and require information about licensing and ownership (s 7A(2)). Vehicle owners may be served infringement notices attached to vehicles and can be deemed to have been the driver if they fail to respond; by‑laws may also prohibit removal of such notices by anyone other than owner, driver or person in charge (s 8(o), s 8(p), s 14(3)).

Ministers, Governor and Treasurer: The Governor decides appointments of Boards and may constitute Boards as corporations and dissolve them subject to the Act’s dissolution mechanics (s 3). The Governor’s approval is required for Board by‑laws to take effect (s 8(1), s 9). A Minister’s approval is required before a Board may grant licences for depasturing or material removal unless the land’s specific purpose allows otherwise (s 5(1a)). The Treasurer’s role appears in definitions and in dissolution tax exemptions; the Treasurer or an authorised person may certify that a thing occurred because of a Board’s dissolution to trigger tax exemption under section 17 (s 2, s 17).

Parliament and the Auditor: By‑laws must be gazetted and tabled before both Houses and are effective upon publication unless later repealed or disallowed (s 9). If a Board is listed in Schedule 1 of the Financial Management Act 2006, the Financial Management Act and Auditor General Act apply to its financial administration and reporting (s 12).

Third parties dealing with Board property: When Boards are constituted corporate bodies and may own or lease land or grant licences, third parties dealing in leases, licences or contracts with a Board will be subject to the corporate capacity and any regulatory constraints such as Governor or Ministerial approval where the Act requires it (s 3(4)-(6), s 5(1a)).

Parents and guardians: The Act permits a Board to recover losses caused by a child’s intentional or negligent act or omission from the parent or guardian unless the parent proves exercise of due care and control (s 12A).

Collectively, the Act affects public administrators, Board staff, visitors, vehicle owners, animal owners, Ministers and the Treasurer, each with roles and exposures set out in specific sections.

Duties imposed by the Act are primarily on Boards, Board members and authorised persons, together with procedural obligations tied to by‑laws and enforcement mechanisms.

Board duties: A Board’s core duty is to control and manage the land placed under its control and to employ funds provided by Parliament and funds arising from fees, penalties or other receipts for that purpose (s 4). This is a statutory duty to manage, conserve and adapt the land for public recreation, health and enjoyment, as manifested in the specific powers in section 5 such as fencing, forming walks and drives, planting, constructing dams, establishing zoological gardens and granting licences under specified constraints (s 5(1)(a)-(d), (e), (f)). Boards must keep accounts and, if listed under the Financial Management Act 2006, comply with that Act and the Auditor General Act in financial administration and reporting (s 8(b), s 12).

By‑law-making duty and constraint: Boards may make by‑laws to give effect to the Act in relation to land under their control, but by‑laws require the Governor’s approval before they can be made effective (s 8(1)). By‑laws must be gazetted and tabled before both Houses; they have the effect of law on publication unless repealed or disallowed (s 9). Section 8 specifies numerous permissible topics for by‑laws and imposes a statutory cap on pecuniary penalties of $1,000, with prescribed fixed sums for certain procedural matters not exceeding $200 (s 8(2)).

Authorised person duties and constraints: Authorised persons, including Board members and rangers, may exercise enforcement powers such as removing vehicles, stopping and searching vehicles, and entering non‑permanent residences where an offence is suspected; however, before exercising powers they must take all reasonable steps to communicate their intention and reasons to the owner or person in charge (s 7A(1)). Authorised persons who are not police officers are also prescribed as public officers for the purposes of the Criminal Investigation (Identifying People) Act 2002 and may exercise powers under that Act’s Part 3, where relevant (s 7A(1a)). Authorised persons who are not police must produce their certificate of authority when required by a person affected by their exercise of power (s 7B(2)).

Rights of individuals facing enforcement: Individuals alleged to have breached a by‑law have a statutory right to be given an infringement notice with specified content, serial number and minimum notice period of 10 days, and an express right to elect to have the matter dealt with in court rather than by payment of the prescribed penalty (s 14(2)(d)-(e)). Where a vehicle offence is alleged and the driver cannot be identified, the owner may be served a notice within 30 days and has the right to respond; if the owner fails to respond within the prescribed time, by‑laws may deem the owner to have been the driver (s 14(3), s 8(o)).

Financial rights and duties: Boards have the power to fix fees for admission and other services and to prescribe methods for their collection (s 8(t), s 8(u)). All pecuniary penalties recovered under by‑laws go to the use of the Board (s 8(3)). Boards must keep accounts of receipts and expenditure (s 8(b)) and, where applicable, must comply with the Financial Management Act 2006 and Auditor General Act 2006 (s 12).

Duty to issue certificates: Boards must issue certificates of authority to each member and each ranger under section 7B(1). The certificate is conclusive evidence of appointment and authority in proceedings under the Act (s 7B(3)), and authorised persons must produce the certificate when required by any person affected by their exercise of power (s 7B(2)).

Duties on Ministers and Treasurer: Ministers must approve licences for depasturing or removal of materials unless the land’s purpose matches the proposed licence’s purpose (s 5(1a)). The Treasurer can certify that a specified thing occurred because of a Board’s dissolution for purposes of State tax exemption and thereby affect tax outcomes under section 17(3).

Protections and limitations: The Act shields persons other than Boards from tort liability for acts done in good faith while performing functions under the Act, but preserves Board and Crown liability (s 13(2)-(4)). Parents and guardians are potentially liable to Boards for losses caused by a child’s intentional or negligent acts unless they can show they exercised due care and control (s 12A(1)).

Delegation and committees: Boards may delegate powers to committees, and the committee exercises those delegated powers as if it were the Board within the meaning of the Act (s 6). This creates an internal structure for operational delegation.

Dissolution‑related duties: Before dissolving a corporate Board under s 3(7), the Minister must consult the Public Sector Commissioner and arrange employment for staff or ensure staff are covered by relevant public sector provisions, and staff remuneration and accrued rights are preserved unless they agree otherwise (s 15).

Taken together, the Act allocates decision‑making rights to Boards, the Governor and Ministers, imposes specific operational duties and documentary obligations on Boards and their officers, and establishes procedural rights for persons subject to enforcement and financial interactions.

The Act creates a hybrid enforcement model combining by‑laws with capped pecuniary penalties, authorised person investigatory powers, evidentiary presumptions, an infringement notice regime and avenues for court determination.

By‑law penalties: Boards may, with Governor approval, make by‑laws and impose pecuniary penalties for breaches of those by‑laws up to a fine of $1,000 for an offence and prescribe sums up to $200 for procedural contraventions specified in the by‑laws (s 8(2)). The Act requires that all pecuniary penalties recovered under Board by‑laws be remitted to the use of the Board (s 8(3)). By‑laws have the force of law once gazetted and tabled before Parliament, subject to repeal or disallowance (s 9).

Authorised persons’ powers: Section 7A grants authorised persons who are not police officers powers to remove vehicles, animals or other things from land; to stop, detain and search vehicles, vessels or conveyances; and to enter and search non‑permanent dwellings such as huts, tents or caravans where they find a person committing or reasonably suspect a person is committing an offence against a by‑law. Those powers are exercisable without warrant, but an authorised person must first take all reasonable steps to communicate intention and grounds for believing they are authorised to the owner or person in charge (s 7A(1)). The Act also preserves additional powers for police members, stating that the Act’s provisions are in addition to other Acts that empower police officers (s 7A(4)).

Procedural safeguards: The Act requires authorised persons who are not police to produce certificates of authority issued under section 7B when required by any person in respect of whom they have exercised or are about to exercise power (s 7B(2)). The certificate is conclusive evidence of appointment and authority in proceedings under the Act (s 7B(3)). The requirement to communicate intention before exercising search and removal powers is a statutory procedural condition; failure to do so may be relied upon in proceedings though the Act does not prescribe exclusionary remedies.

Infringement notices and civil resolution: Section 14 enables authorised persons to issue infringement notices where they find or reasonably suspect a by‑law offence and consider that infringement proceedings are adequate given the offence and circumstances. The notice must be serialised, identify the recipient, describe the alleged offence, inform the person of the option to pay a prescribed penalty within at least 10 days, and inform the person of the right to elect court determination instead of paying the penalty (s 14(2)). If the recipient pays within the time specified, criminal prosecution on the same matter is not competent; if the recipient elects court determination, court process will issue in due course (s 14(4)).

Vehicle owner presumptions and notice service: For vehicle‑related alleged offences where the driver is not identified, a notice may be addressed to the vehicle owner within 30 days after the alleged offence, and, for parking or standing matters, may be served by attaching it to or leaving it in or on the vehicle without naming the owner (s 14(3)). Complementing this, by‑laws may provide that where the owner fails within the prescribed time to satisfy the Board that the vehicle was stolen or unlawfully taken or to inform the Board of the identity of the driver, the owner shall be deemed to have been the driver at the time of the offence (s 8(o)). By‑laws may also prohibit anyone other than owner, driver or person in charge from removing notices attached to vehicles under s 14 (s 8(p)).

Evidentiary rules: Section 7C permits evidence of speed measured by speed measuring equipment used by an authorised person in proceedings for by‑law offences, and deems the equipment to be speed measuring equipment if an authorised person so swears, absent contrary evidence (s 7C(2)-(3)). Section 12B contains presumptions about habitual ownership of animals in proceedings instituted by a Board, shifting evidentiary burdens to the person alleged to be owner (s 12B(1)-(3)).

Recovery of losses and other civil liability measures: Section 12A allows a Board to recover losses resulting from intentional or negligent acts of a child from the parent or guardian by court action, subject to a parental defence of non‑negligence. Section 13 provides protection from tort actions against individuals, other than Boards, for acts done in good faith while performing functions under the Act, although the Board and the Crown remain liable (s 12A, s 13).

Enforcement limits and parliamentary oversight: By‑laws require Governor approval to be made effective and must be gazetted and tabled in Parliament, which imposes an external oversight mechanism; by‑laws disallowed by both Houses will cease to have effect (s 8(1), s 9). The Act limits maximum pecuniary penalties that Boards may prescribe for by‑law breaches and sets a separate cap for certain prescribed sums (s 8(2)).

Sanctions allocation and use: The statute explicitly directs pecuniary penalties to fund the Board’s operations, aligning enforcement revenues with the entity enforcing the by‑laws (s 8(3)).

Taken together, the Act creates a framework where Boards, through authorised persons, may enforce conduct rules on reserved land using statutory powers and a civil infringement route, with evidentiary presumptions and statutory caps on monetary penalties. Parliamentary and executive approvals constrain the exercise of regulatory power, and certain procedural safeguards are imposed on authorised persons.

The Act contains multiple express cross‑references and carve‑outs that determine its interaction with other State legislation. These cross‑references allocate competence, preserve existing specialised regimes, and harmonise overlapping regulatory fields.

Exclusions for specific regimes: Section 2A expressly excludes the Act’s appointment power from operating where the land is governed by the Rottnest Island Authority Act 1987 (Rottnest Island Reserve under that Act’s section 4) and where the land is designated under the Botanic Gardens and Parks Authority Act 1998 (s 2A(1)-(2)). This removes the possibility of a Board under the Parks and Reserves Act being appointed to manage those specific lands.

Land administration reference: The Governor’s power to appoint Boards is expressly linked to land reserved under Part 4 of the Land Administration Act 1997 (s 3(1)). The compilation further notes that references to the Land Act 1933 in written laws may be construed as references to the Land Administration Act 1997 where appropriate, pursuant to a compilation note (other notes 1). When Boards as corporate entities have land vested or placed under their control, leasing and other powers are to be exercised under the Land Administration Act or Land Act framework as indicated by s 3(6).

Road traffic and vehicle laws: The Act’s definitions and vehicle‑related provisions cross‑reference road traffic legislation. The defined term "owner of a vehicle" refers to licences or permits under the Road Traffic (Vehicles) Act 2012, and section 7A(2) authorises authorised persons to require information about whether a vehicle is the subject of such a licence or permit. Section 7C adopts the Road Traffic (Administration) Act 2008 definition of speed measuring equipment, and permits speed measurements by authorised persons to be given in evidence in proceedings under this Act (s 7C(1)-(3)). Amendments listed in the compilation table also show later cross‑linkages through Road Traffic legislation amendments (compilation table).

Public sector management and senior executives: Where a person appointed under section 7 is a member of the Senior Executive Service under the Public Sector Management Act 1994, the Act explicitly states that the Public Sector Management Act prevails in the event of inconsistency (s 7(3)). Section 15 also interacts with the Public Sector Management Act by providing staff protections and references to Part 6 of that Act as an alternative coverage mechanism for staff whose re‑employment is not arranged upon dissolution.

Financial and audit legislation: Section 12 makes the Financial Management Act 2006 and the Auditor General Act 2006 applicable to a Board and its operations if the Board is listed in Schedule 1 to the Financial Management Act. This imports rigorous financial administration, audit and reporting obligations where the Board is so listed. The compilation table records the acts that introduced or amended this cross‑reference.

Criminal identification and police powers: Section 7A(1a) prescribes that Board members and rangers are public officers for the purposes of the Criminal Investigation (Identifying People) Act 2002 and may exercise the powers in that Act’s Part 3, which augments authorised persons’ identification powers. Section 7A(4) clarifies that the Act’s provisions relating to authorised persons are in addition to, and not in derogation of, other Acts that confer powers on police members.

Tax and duties legislation on dissolution: Sections 16 and 17 establish regulatory and certification mechanisms for dissolution of corporate Boards and provide an exemption from State tax for anything that occurs because of the dissolution or under regulations made under section 16. The Treasurer or an authorised person can certify that a specified thing occurred because of the dissolution, and such a certificate is conclusive evidence for the tax exemption unless shown otherwise (s 17).

Children and community services interface: Section 12A defines "parent" with reference to the Children and Community Services Act 2004 and creates potential parental liability for damage by a child. The compilation notes amendments reflecting that Act’s insertion.

Interpretative and operational notes: The Act contains interpretation provisions and compilation notes that instruct how older references should be read in light of new statutes (for example, Land Act references to be read as Land Administration Act 1997, and Public Service Act references as Public Sector Management Act 1994) as explained in the "Other notes" and compilation table.

Parliamentary oversight and statutory limits: The requirement that by‑laws be gazetted and tabled before both Houses (s 9) places the Act’s subordinate legislation within the parliamentary oversight framework, and the Governor’s approval requirement for by‑laws (s 8(1)) places an executive check on Boards’ regulatory reach.

In summary, the Act operates as an interstitial statute that manages reserved Crown land while explicitly deferring or interfacing with specialist regimes for land management, road traffic, public sector employment, financial oversight and taxation. Users must check whether a given Board is subject to the Financial Management Act listing, whether land falls under an excluded regime, and how vehicle and identification powers operate jointly with road traffic and criminal identification legislation.

The Act’s compilation table records numerous amendments and reprints spanning from its original enactment in 1895 through to modern statutory updates. The compilation table in the source provides the authoritative list of amendment Acts, assent dates and commencement information as compiled by the State.

Key chronological amendments and reprints recorded in the compilation table include:

• Parks and Reserves Act original enactment, 1895; assent 12 October 1895.
• Amendment Acts in 1947 (No. 60 of 1947) and 1954 (No. 59 of 1954); reprint in 1960 incorporating early amendments.
• Further amendments in 1955 (No. 17 of 1955) and 1963 (No. 40 of 1963), and a reprint approved 31 January 1979.
• Substantive 1972 amendments (No. 4 of 1972) and a major set in 1978 (No. 50 of 1978) which inserted, inter alia, the authorised person definitions, by‑laws and certificate of authority provisions dated to that regime (see sections as presently numbered).
• The Acts Amendment (Reserves) Act 1982 (Pt III) and the Parks and Reserves Amendment Act 1983 (No. 22 of 1983) made further updates; the 1983 Act inserted the 7C speed measuring equipment provision (as recorded in the amendments).
• The Criminal Investigation (Identifying People) Act 2002 amendment (Sch. 2 cl. 4) prescribed Board members and rangers as public officers for identification powers (s 7A(1a)) and commenced 29 June 2002.
• The Acts Amendment (Reserves and Reserve Boards) Act 2003 (No. 76 of 2003) introduced several modernising amendments including financial and administrative adjustments; this Act’s amendments are visible throughout the current text (for example, s 4, s 5 amendments and insertion of s 15, s 16, s 17 and s 13 protection).
• The Children and Community Services Act 2004 introduced the parental liability provision now s 12A, with a commencement recorded for 1 March 2006.
• The Financial Legislation Amendment and Repeal Act 2006 and other later amendments adjusted references to the Financial Management Act and Auditor General Act, and provided for compliance where Boards are listed in the Financial Management Act schedule (s 12).
• Road traffic legislation amendments in 2012 and 2024 updated cross‑references and the evidentiary status of speed measuring equipment in s 7C; the compilation table records Road Traffic Legislation Amendment Act 2012 (Pt 4 Div 38) and Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024 (Pt 4 Div 2) with associated dates and commencement notes.

The compilation table in the source lists many discrete amendment Acts and reprints with precise dates and sometimes staggered commencements. It also records the Standardisation of Formatting Act 2010 which altered certain headings and formatting and the Public Sector Reform Act 2010 which affected public sector cross‑references.

Statutory insertions and deletions are noted in the Act text with bracketed editorial notes indicating the amending instrument and section. For practitioners, the compilation table is the statutory source of record for tracing changes, and the "Other notes" section explains how references to newer Acts should be read for interpretation purposes (for example, Land Act references to the Land Administration Act 1997; Public Service Act references read as Public Sector Management Act 1994).

This Act has therefore been incrementally modernised over more than a century, with amendments touching governance, enforcement, evidentiary rules and staff transition on dissolution. The current text is the product of that amendment history as compiled in the provided source.

The Act text and compilation table provided do not include judicial decisions or an annotated list of cases decided under the Parks and Reserves Act 1895. The statutory text itself does not name any cases. Accordingly, there is no litigation history set out in the source document to cite.

That absence in the source does not mean particular provisions have not been judicially considered in Western Australian courts historically, but any such case law is not recorded in the Act text or compilation table supplied. For practitioners seeking litigation authority on points of statutory construction, enforcement, the scope of authorised person powers, the operation of the owner‑deemed‑driver provisions or the tort immunity in section 13, it will be necessary to consult case law databases and court reports external to the statute.

The Act, however, articulates several statutory provisions that are likely focal points for litigation when disputes arise, including but not limited to:

• The scope and limits of authorised persons’ powers under section 7A, including the requirement to take reasonable steps to communicate intention before exercising powers to stop, detain, search or remove property. Litigation could engage statutory reasonableness, procedural compliance and admissibility of evidence obtained during searches.

• The evidentiary weight given to speed measuring equipment under section 7C, which makes a certified speed measurement proof of speed in the absence of contrary evidence. Courts may be asked to determine the sufficiency of "contrary evidence" or the proper foundation for equipment use.

• The owner‑deemed‑driver mechanism in section 8(o) together with enforcement procedure in section 14(3), which imposes a statutory presumption against the owner where an owner fails to satisfy the Board. Litigation may focus on procedural fairness, the sufficiency of notice, ability to show the vehicle was stolen or to identify the driver, and the standard of proof required.

• The scope of the tort immunity in section 13, which bars actions against persons other than Boards for acts done in good faith in performance or purported performance of a function under the Act, while preserving Board and Crown liability. Courts could be required to determine what constitutes "good faith" and whether an act fell "in the performance or purported performance" of a function under the Act.

• Parental liability under section 12A, where a Board sues a parent or guardian for damage caused by a child, and the defence of having exercised "due care and control." Litigation may address evidentiary standards and the scope of the caretaker defence.

• Staff transition and employment protections under section 15 where a Board is dissolved may give rise to disputes about continuity, accrued rights and the operation of the Public Sector Management Act 1994.

Given the absence of cases in the source, practitioners must not rely on the statute alone for predictive litigation outcomes. The Act sets out clear statutory text and procedures that will form the basis of arguments, but interpretation and application over time will be found in case law that is external to the Act as compiled.

Several specific statutory features create operational or legal risks that may catch practitioners and administrators unprepared if overlooked. These are concrete, source‑grounded pitfalls and procedural traps.

By‑laws require Governor approval and parliamentary tabling: Boards cannot unilaterally promulgate enforceable by‑laws. By‑laws need the Governor’s approval to be made, must be published in the Government Gazette and tabled before both Houses within prescribed timeframes, and they operate as law upon publication subject to repeal or disallowance (s 8(1), s 9). Failure to obtain the Governor’s approval or to gazette and table the by‑laws correctly could invalidate enforcement actions relying on those by‑laws.

Pecuniary penalty caps: By‑laws may impose pecuniary penalties but are capped at a fine not exceeding $1,000 for breaches and prescribed sums not exceeding $200 for certain procedural contraventions (s 8(2)). Boards must ensure penalty levels in any by‑laws respect these statutory ceilings; otherwise penalties may be unenforceable or subject to legal challenge.

Owner deemed to be driver: By‑laws may deem vehicle owners to be drivers where the identity of the driver is unknown and the owner fails within the prescribed time to inform the Board or show the vehicle had been stolen (s 8(o)). The Act permits serving a notice by attaching it to the vehicle without naming the owner for parking or standing offences (s 14(3)(b)). Operationally, this creates risks around proper service, recordkeeping, and the possibility of disputes where ownership, theft or unauthorised use is plausible. Boards and authorised persons must follow the notice requirements carefully.

Authorised persons’ search and removal powers require prior communication: Authorised persons may remove property, stop and search vehicles and enter non‑permanent dwellings under s 7A(1), but they must first take "all reasonable steps" to communicate intention and grounds for exercising the power to the owner or person in charge. Failure to do so may expose evidence to challenge or expose the conducting authority to procedural complaints, even if the Act does not specify an exclusionary remedy. The requirement to communicate is not merely discretionary; it is statutorily mandated.

Certificate of authority is conclusive evidence: The Board must issue certificates to members and rangers (s 7B(1)) and production of that certificate is conclusive evidence of appointment and authority in court proceedings under the Act (s 7B(3)). This has two consequences: authorised persons must carry and produce certificates when exercising powers (s 7B(2)); and opponents of a Board’s enforcement action facing an individual authorised person will face a statutory conclusive presumption of appointment once a certificate is produced.

Infringement notice formality: The infringement notice scheme under s 14 has strict content and timing requirements, including serial numbering, minimum notice periods (not less than 10 days), and clear explanation of the two resolution options. Mistakes in the notice form or timing could render the notice ineffective and subject the Board to subsequent prosecution rules.

Evidentiary presumptions for animals and speed equipment: Section 12B presumes habitual apparent ownership of an animal, shifting the burden to the person to show otherwise; and s 7C makes speed measured by prescribed equipment prima facie evidence of speed absent contrary evidence. These statutory presumptions are powerful, but they also create litigation flashpoints if the presumption is applied without adequate factual foundation or if “contrary evidence” exists.

Interplay with other Acts may override Board actions: Where staff are senior executives under the Public Sector Management Act 1994, that Act prevails over inconsistent provisions in this Act (s 7(3)). Boards must identify public sector status of staff and ensure compliance with the Public Sector Management Act and not assume this Act controls employment terms unilaterally. Similarly, if a Board is listed under the Financial Management Act 2006, that Act’s financial management and audit requirements apply (s 12), bringing more stringent obligations.

Dissolution processes and staff protection requirements: A Board cannot be dissolved until staff employment arrangements are set out as required by s 15. Practically, this requires Ministerial consultation with the Public Sector Commissioner and either re‑employment arrangements or coverage under Part 6 of the Public Sector Management Act 1994. Failure to comply with s 15 conditions before attempting dissolution could produce legal and employment disputes.

Pecuniary penalties fund the Board: All pecuniary penalties imposed under Board by‑laws are to be used by the Board (s 8(3)). This statutory flow of enforcement revenues to the enforcing Board creates a direct financial interest in enforcement levels that should be managed with governance safeguards and transparency given parliamentary and Auditor General oversight when applicable (s 12).

Tax exemption mechanics on dissolution require Treasurer certification: Section 17 exempts State tax for things occurring because of a Board’s dissolution or under regulations made under s 16, but the exemption may require a Treasurer’s certificate, which is conclusive absent contrary evidence (s 17(2)-(3)). Practically, parties must obtain and retain appropriate certification to rely on tax exemptions.

Small civil penalty caps: The maximum penalty of $1,000 and $200 prescribed sums are modest. This creates a compliance design consideration: for serious harms, the Act does not provide for large fines under by‑laws; Boards may need to rely on criminal prosecution in court for more substantial penalties or seek legislative reform where higher penalties are intended.

Taken together, these "gotchas" highlight procedural formalities and statutory constraints that Boards, authorised persons, visitors and third parties must navigate. Careful adherence to notice, approval and documentation requirements in the Act is essential to avoid invalid enforcement, unsuccessful prosecutions, employment disputes or tax surprises.

Compliance requires attention to multiple procedural and substantive obligations in the Act and to its cross‑references to other legislation. The steps below map source provisions to practical actions for Boards, authorised persons and administrators.

1. Establish lawful Board appointment and corporate status

• Confirm the Governor’s appointment instrument for the Board and whether the Board has been constituted as a body corporate under s 3(4). If corporate status is conferred, ensure corporate governance arrangements (common seal, corporate name, register of members) are in place and statutory powers to hold, lease and dispose of property are properly recorded (s 3(4)-(6)). Keep a record of any order in council that places land under the Board’s control.

2. Ensure by‑law-making follows the statutory process

• Draft by‑laws within the topics enumerated in s 8. Obtain the Governor’s approval before finalising a by‑law and arrange for publication in the Government Gazette so that the by‑law takes effect. Ensure by‑laws are tabled before both Houses of Parliament within 14 days after publication when Parliament is sitting or within 14 days of its next meeting if not (s 8(1), s 9). Ensure by‑law penalty amounts do not exceed the statutory caps of $1,000 and $200 for prescribed sums (s 8(2)). Record administrative processes for fee collection that comply with s 8(u).

3. Licensing powers and Ministerial approvals

• When proposing to grant licences for depasturing animals or removal of sand, gravel or minerals, secure the Minister’s prior approval unless the land’s purpose explicitly contemplates the licence (s 5(1), s 5(1a)). Maintain documentary approval trails linking the licence to Ministerial consent or to the land’s authorised purpose.

4. Appoint and document authorised persons

• Appoint rangers, secretary and other staff under s 7(1). Issue certificates of authority in the form of the Schedule to each Board member and ranger and require authorised persons who are not police to carry and produce the certificate when exercising powers or upon request (s 7B(1)-(2)). Maintain a register of certificates issued to produce in proceedings as conclusive evidence under s 7B(3).

5. Train authorised persons on powers and procedural safeguards

• Train authorised persons on the limits of section 7A powers including the duty to take all reasonable steps to communicate intention and reasons prior to exercising removal, stop, detain, search or entry powers (s 7A(1)). Document standard operating procedures and checklists for communication and evidence collection to reduce the risk of procedural challenge. Ensure rangers are aware of the criminal identification powers under the Criminal Investigation (Identifying People) Act 2002 if using Part 3 powers, per s 7A(1a).

6. Follow infringement notice formalities

• Prepare infringement notice templates that meet the content requirements in s 14(2), including serial numbering, identification of the recipient, general terms of the alleged offence and clear information on payment timelines and the right to elect court determination. Observe the minimum 10‑day payment period. For vehicle matters where the driver cannot be identified, implement service by attachment to the vehicle in compliance with s 14(3) and record the date and details of attachment.

7. Manage vehicle‑related evidentiary steps

• For vehicle examinations on reserved land, authorised persons may request licence and ownership details (s 7A(2)). Where speed enforcement is to be undertaken, ensure equipment qualifies as "speed measuring equipment" under the Road Traffic (Administration) Act 2008 and document its use; maintain calibration and operator records to defend admissibility under s 7C. Retain a chain of custody and operator statements to rebut challenges under s 7C(4).

8. Account‑keeping and financial compliance

• Keep proper accounts of all receipts and expenditure as required by s 8(b). If the Board is listed in Schedule 1 to the Financial Management Act 2006, comply with that Act and the Auditor General Act 2006 for financial administration, audit and reporting (s 12). Implement procurement, debt and audit controls in line with those statutes where applicable.

9. Fee setting and collection mechanisms

• Where by‑laws prescribe fees for admission or services, ensure the by‑laws explicitly set fees and collection methods and identify prescribed classes responsible for fee collection if appointed (s 8(t), s 8(u)). Reconcile fee income with Board accounts and apply pecuniary penalties received under by‑laws to Board funds as required by s 8(3).

10. Manage staff and transitions on potential dissolution

• Before any dissolution under s 3(7), follow s 15: consult the Public Sector Commissioner and arrange nomination of a public sector employer for staff or ensure staff are covered by Part 6 of the Public Sector Management Act 1994. Document re‑employment agreements and ensure that remuneration, accrued rights, superannuation and continuity of service are preserved unless a staff member agrees otherwise (s 15(2)-(3)). Prepare for regulations under s 16 that may address property disposition, transfer of rights and liabilities, continuation of proceedings and final reporting obligations.

11. Use Treasurer certification when relying on tax exemptions

• If dissolution or related regulations trigger transactions that are intended to be exempt from State tax under s 17, obtain a Treasurer’s certificate confirming that the specified thing occurred because of the dissolution or under regulations made pursuant to s 16, and retain the certificate as conclusive evidence for tax authorities (s 17(2)-(3)).

12. Respect cross‑law interactions and exclusions

• Confirm that the land concerned is not within excluded regimes (Rottnest Island Authority Act 1987 or the Botanic Gardens and Parks Authority Act 1998) per s 2A. Check whether rangers are senior executives under the Public Sector Management Act 1994 and apply the prevailing statutory provisions accordingly (s 7(3)). Coordinate with Road Traffic authorities for vehicle licensing and speed enforcement cooperation and data sharing as necessary (s 7A(2), s 7C).

13. Maintain records to defend presumptions and enforce rights

• For animal ownership disputes, keep records of habitual care and ownership to rebut or to rely on presumptions under s 12B. For parental liability claims under s 12A, document damage, causation and the child’s identity, and preserve evidence as to the parent’s exercise of due care and control if a defence is likely.

14. Monitor parliamentary oversight and legislative compliance

• Track the tabling and any disallowance of by‑laws after gazettal under s 9. Ensure governance minutes and by‑law approvals are accessible for parliamentary or Auditor General scrutiny.

Execution of these steps, with careful recordkeeping and training, will align Board activity with statutory requirements. Legal counsel should review by‑law text, enforcement templates, and staff transition arrangements to ensure statutory compliance and to prepare for any contests in courts or before administrative tribunals.
