Outback Communities (Administration and Management) Regulations 2025

Outback is the central organising concept. Under the parent Act, the outback means the area of South Australia that is not within the area of a council. The regulations then declare specific areas not to be part of the outback. The declared exclusions are precise: defined sections in named Hundreds, a block “Out of Hundreds”, and a long list of islands, each identified by name and Hundred or “Out of Hundreds” location. The effect is that the outback boundary is not a continuous line but a patchwork: all land not within a council area is outback unless it falls into one of the listed parcels or islands. For example, Yalata Reserve land is excluded, meaning the Yalata community is not governed under the outback regime; the Gerard community area near Renmark is similarly excluded; the Nepabunna area in the Flinders Ranges is excluded. The islands listed are numerous and include both small uninhabited islets and larger islands such as Flinders Island, Boston Island, and Torrens Island. These islands are expressly not outback, so their governance falls to whichever council has jurisdiction, or possibly to no local government at all if they are not within a council area (the parent Act’s definition of outback is area not within a council area; if an island is not within any council and also not excluded, it would be outback, but these islands are excluded and so are not outback). The practical effect is that the Authority’s jurisdiction is confined to the mainland outback and any islands not listed.

Asset sustainability levy and community contribution are the two types of rates the Authority can levy under the modifications. Regulation 5 deletes most of the Local Government Act’s rate-setting machinery and replaces it with a stripped-down version. The heading to Chapter 10 loses “and charges”. Section 152 is rewritten so that a rate declared under that section must be “comprising an asset sustainability levy”. The Authority cannot impose service rates or service charges. The levy can be based on any factor other than land valuation, as approved by the Minister, rather than using a current valuation. The valuation basis for calculating rates is changed from “current valuation of land” to “capital value of the land” (modification (zza) to section 185(1)). This is a significant shift: capital values are generally higher and less volatile than current values, which could increase the rate burden on landholders.

Authority is the Outback Communities Authority established under the parent Act. Throughout the modifications, any reference to a council in the Local Government Act provisions is replaced with a reference to the Authority. For example, the heading of Division 9 is changed from “Recovery of unpaid rates and charges” by deleting “and charges”. Section 175(1) replaces “the council for the area within which the land is situated” with “the Authority”. The Authority is treated as if it were a council for certain purposes, such as appeals under section 257(5)(b) and service of documents under regulation 9.

Appeals replace internal reviews. The anti-nuisance provisions in regulation 7 change the Language: section 257(1) originally provided for an “application for review” to the ERD Court, but the regulations substitute “appeal” for “review” in three places. This may change the nature of the proceeding: an appeal is typically on a question of law or by way of rehearing, whereas a review might be de novo. The modification removes any ambiguity about the scope of the court’s consideration. Additionally, the deletion of sections 153(3) and (4) and 155 (which dealt with objections to rates) removes the internal review process for ratepayers, leaving only the appeal mechanism under section 257 as modified.

Landholders in the outback are the primary group affected. Any person who owns or occupies land that falls within the outback as defined is subject to the Authority’s rating powers under regulation 5. This includes pastoral lessees, mining tenement holders, owners of freehold land in outback townships (such as Marree, Oodnadatta, Innamincka), and holders of various Crown leases. They will pay asset sustainability levies and community contributions instead of council rates. The removal of service charges means the Authority cannot levy separate charges for water supply, waste collection, or other services, so the cost of those services may need to be recovered through the levy or through other means, potentially spreading costs across all ratepayers rather than direct users. The change to capital value may increase rates for land with high capital value relative to its current value (e.g., land with improvements that have increased capital value but where current use value is lower). Landholders must also comply with anti-pollution and anti-nuisance orders issued by the Authority under regulations 6 and 7. Those served with such orders have appeal rights to the ERD Court.

The Outback Communities Authority is the body that must administer this new regime. Its officers must be familiar with the heavily modified Local Government Act provisions. The Authority cannot rely on by-laws for enforcement; its authorised persons’ powers are limited to those under Chapter 12 Part 3 as modified, which deletes subsections 260(6) and (7) and removes by-law references. The Authority must issue rates notices using the capital value basis, not current valuation, which may require it to obtain capital value data from the Valuer-General or use alternative valuation methods approved by the Minister. The Authority also loses the ability to impose service charges, which may constrain its revenue flexibility.

The Minister responsible for the Outback Communities Act gains a specific role under the applied Local Government Act provisions. New section 145A inserted by regulation 5(c) defines “Minister” for that Part as the Minister responsible for the Outback Communities Act, not the Local Government Minister. The Minister must approve the factors used for rating under section 156(1)(d) as amended (the substitute paragraph (c) requires approval). This gives the Minister direct control over the rating methodology, reducing the Authority’s autonomy.

Persons on excluded land are not within the outback regime. The Yalata community, the Gerard community, the Nepabunna/Iga Warta/Nantawarrina areas, and all the listed islands are outside the outback. The landholders on those islands and reserves remain under the local council that has jurisdiction, if any. For islands that are not within any council area, being excluded from outback means they are not subject to any local government authority under this regime, potentially creating a governance gap unless another body has jurisdiction.

Authorised persons appointed by the Authority gain powers of entry, inspection, and enforcement under the modified Local Government Act provisions, but they cannot enforce by-laws (since by-law provisions are deleted). Their powers are confined to the outback area, and the modifications add “in the outback” to sections 236 and 237 for anti-pollution and section 254 for anti-nuisance.

The primary duty is to pay rates. Under regulation 5, the provisions of Chapter 10 Part 1 of the Local Government Act apply with modifications. The Authority must declare a rate comprising an asset sustainability levy, and it may also declare a community contribution. Landholders must pay these amounts. The modifications delete section 153(2) to (4) and section 155, which provided for objections to a council’s declaration of rates. There is no longer an administrative objection process within the Authority. The only avenue for challenge is through the appeal process under section 257 as modified by regulation 7, which is now an appeal to the ERD Court rather than a review. That appeal route, however, is located in the anti-nuisance division of the Local Government Act; it is not clear whether it applies to rating decisions. The regulations do not expressly extend section 257 to rating matters. More likely, the only challenge to a rate is through non-payment and enforcement, or through judicial review. This is a gap: the deletion of internal review and the failure to preserve a specific rating appeal mechanism may leave ratepayers without an efficient remedy.

The Anti-pollution duty is set out in Chapter 11 Part 3. Section 236(1) (as modified) prohibits a person from depositing waste or other material on a public place in the outback unless authorised by the Authority. Section 237(1) prohibits a person from polluting water in the outback. The Authority may issue notices requiring compliance. A person served with such a notice must comply.

Under regulation 7, the Authority can issue an order under section 254 to require a person to abate a nuisance, adding “in the outback” to the provision. Section 256(1) is modified so that a person who fails to comply with an order is guilty of an offence, and the section itself creates the offence rather than relying on a broader “Act” reference. The right to challenge a nuisance order is now by appeal under section 257(1) to the ERD Court, not by review. This may affect procedure: an appeal is generally limited to errors of law or unreasonableness, whereas a review could reconsider the merits. The modification also provides that the Authority is treated as if it were a council for the purposes of Schedule 6 of the Local Government Act (which sets out enforcement procedures). This gives the Authority the same powers as a council to prosecute offences.

The right to service of documents is governed by regulation 9, which directs that service under any applied provision must follow sections 279 and 280 of the Local Government Act, with references to a council read as references to the Authority. This ensures that notices, orders, and rates demands are properly served, and the Authority must comply with those provisions.

The right to have an authorised person’s powers limited: regulation 8 deletes subsections 260(6) and (7), which presumably related to the exercise of powers, and removes references to by-laws. This means an authorised person cannot rely on by-law powers to enter land or demand information; their powers are limited to those expressly provided in the modified Part.

Penalties for non-compliance arise under the applied Local Government Act provisions as modified. For anti-pollution, section 236 and 237 are likely to contain penalty provisions in the original Act, but the regulations do not modify those penalties. They apply as part of Chapter 11 Part 3, so a person who breaches a prohibition or fails to comply with a notice is liable to the penalty set out in the Local Government Act. Similarly for nuisance: section 256(1) as modified makes non-compliance with an order an offence. The maximum penalty would be that specified in the Local Government Act for those sections.

The Authority can enforce rates through the recovery provisions in Chapter 10 Part 1 Division 9, which is modified to remove “and charges”. Section 175(1) substitutes the Authority for the council. The Authority can sell land for unpaid rates under the process in Division 9. However, the deletion of section 176 (repealed by modification (zr)) may remove a specific provision about rates recovery. We need to check whether section 176 was important; the text shows it is deleted. The remaining sections (177, 179, 180, etc.) are modified, including deletion of subsections that reference service charges. The enforcement options are narrower: without service charges, the Authority cannot use the specific recovery mechanisms for those charges.

Authorised persons have power to enter land and inspect under Chapter 12 Part 3. Modification (b) deletes “or a by-law under this Act” from section 261(1) and (c) similarly from section 262(1). This means an authorised person cannot use by-laws to gain entry or demand information; their powers are solely under the Act. The deletion of subsections 260(6) and (7) might remove restrictions on when powers can be exercised, possibly widening enforcement discretion.

The appeal mechanism under section 257 is a right to appeal to the ERD Court. The modification changes “review” to “appeal”, which might affect the court’s standard of review. Under the Local Government Act, a review under section 257 typically allows the court to confirm, vary, or reverse the decision. An appeal may be more limited. The regulations do not specify the grounds of appeal, so the general law of appeals applies. The modification also adds that the Authority is treated as if it were a council under Schedule 6, which deals with enforcement of court orders and penalties.

Failure to comply with a court order on appeal could lead to contempt proceedings. The Authority can also prosecute offences summarily: sections 257(5)(b) as modified refers to Schedule 6 of the Local Government Act, which allows a council (here the Authority) to prosecute. The penalty for an offence under the applied provisions would be as set out in the Local Government Act, unless the regulations change them (they do not). For example, pollution offences can carry significant fines.

The regulations operate under the Outback Communities (Administration and Management) Act 2009, specifically sections 21(6)(g), 22(d), 23(e), and 24(2)(c). Those sections allow the Governor to make regulations applying Local Government Act provisions with modifications. The parent Act establishes the Authority and defines the outback. The regulations are part of a hierarchy: the parent Act sets the framework; the regulations fill in the details. If there is any inconsistency between the parent Act and the regulations, the parent Act prevails. However, the regulations purport to apply Local Government Act provisions “as if they formed part of Part 3 of the Act”, meaning they become statutory provisions under the Outback Communities Act.

The Local Government Act 1999 is incorporated by reference but with extensive modifications. The regulations do not apply the whole Local Government Act, only specific chapters and parts. For example, Chapter 10 Part 1 (rates) is applied, but Part 2 (regional ratepayers’ associations) is not. The modifications delete many sections, so the applied law is not identical to the Local Government Act as in force. Practitioners working with outback matters must look at the regulations, not the Local Government Act, to know the applicable provisions. The regulations explicitly modify section 256(1) by deleting “Act” and substituting “section”, meaning that section 256 operates as a standalone provision without reference to other parts of the Local Government Act.

The Environment, Resources and Development Court is the appellate body for nuisance orders. Section 257(1) as modified provides for an appeal to that court. The provisions of the ERD Court Act will govern the appeal procedure. The regulations also refer to Schedule 6 of the Local Government Act for enforcement, which contains provisions about penalties, infringement notices, and court procedure. That schedule applies as if the Authority were a council.

The regulations interact with the common law of nuisance and pollution. The statutory anti-nuisance and anti-pollution provisions do not replace common law rights; they add a regulatory layer. A person affected by a nuisance can still seek common law remedies or rely on other statutes such as the Environment Protection Act 1993. The regulations confine the Authority’s powers to the outback area, so a person on excluded land (e.g., an island) would not be subject to the Authority’s orders but could still be subject to council powers.

The service of documents provisions (regulation 9) incorporate sections 279 and 280 of the Local Government Act. Those sections deal with how documents may be served (personally, by post, etc.) and when service is deemed to occur. The modification ensures that any notice or order under the applied provisions is served in accordance with those rules, providing procedural consistency.

The repeal of the 2010 regulations under Schedule 1 means that any references in other instruments to the old regulations will need to be updated. The new regulations do not contain transitional provisions, so ongoing matters under the old regulations may be affected if they were not concluded by 1 September 2025. This is a potential gap.

The Outback Communities (Administration and Management) Regulations 2025 are entirely new regulations. They repeal the 2010 regulations (the Outback Communities (Administration and Management) Regulations 2010) effective from 1 September 2025. The 2010 regulations were made under the same parent Act and likely contained similar but not identical provisions. The 2025 version updates the list of excluded areas (for instance, the islands list may have been expanded or altered) and modifies the application of the Local Government Act to reflect amendments to that Act since 2010, such as the insertion and deletion of sections. The 2025 regulations also make substantive changes: the valuation basis is changed from current to capital value (modification (zza) is new); the deletion of internal review mechanisms (section 153(3) and (4), 155) is more aggressive; the change from review to appeal in section 257 is a shift in procedural character. The 2010 regulations may have preserved some review rights that the 2025 version removes.

The legislative history note in the regulations merely refers to the principal regulation and its gazettal. There is no published explanatory statement in the source text. Amendment history of the parent Act is not provided. The regulations themselves do not amend the parent Act; they are subordinate legislation.

For practitioners, the key point is to ensure that any advice or compliance system that relied on the 2010 definition of outback or the 2010 modifications to the Local Government Act is updated. Specifically, the list of excluded islands has changed, and the valuation method is new. The repeal of the 2010 regulations means that any transitional provisions in those old regulations are also repealed, so matters that were pending under the old regime may need to be restarted or continued under the new regime, but the new regulations do not provide for that.

The regulations are not yet in force as of the date of this deep dive (commencement 1 September 2025). There is no litigation history under these specific regulations. However, the parent Act and the previous 2010 regulations have likely been subject to interpretation. The parent Act was enacted in 2009, and the outback definition has been litigated in cases concerning the boundary of the outback for rating or service provision. The exclusion of specific reserves and islands may have been contested. The modification of section 257 from review to appeal is likely to be a point of contention: if the ERD Court treats an appeal more narrowly than a review, a party may challenge the validity of the modification or seek judicial review of the regulation itself. The regulation is made under the Governor’s regulation-making power, and if it exceeds the power granted by the parent Act, it could be struck down. For example, the parent Act allows regulations to apply Local Government Act provisions “with modifications”. Changing “review” to “appeal” is arguably a modification, but if it alters the jurisdiction of the ERD Court or abolishes a right of review without clear authorisation, it could be ultra vires.

The change in valuation basis from current to capital value might also attract litigation if a ratepayer argues that the capital value is not a proper basis for rating land in the outback, or that the regulation is inconsistent with the Land Valuation Act or the parent Act’s objectives.

The deletion of internal review mechanisms (section 153(3) and (4) and section 155) could lead to challenges based on procedural fairness. The Authority might be required to provide a fair hearing even if the statutory objection process is removed. Courts may imply natural justice requirements.

The extensive list of islands excluded from the outback may cause disputes about which specific parcels are excluded. The descriptions are by Hundred or “Out of Hundreds” name, which may not correspond precisely to cadastral boundaries. Litigation could arise over whether a particular island falls into the excluded category.

Any prosecution under the anti-pollution or nuisance provisions will likely test the modifications. For instance, the insertion of “in the outback” in sections 236(1) and 237(1) may raise issues about whether the Authority can enforce against pollution that originates outside the outback but affects the outback. The geographical limitation might be litigated.

Capital value rating is a significant shift. Modification (zza) to section 185(1) replaces “current valuation of land” with “capital value of the land”. The Authority is no longer bound by the Valuer-General’s current valuations; instead, it can use capital values. But the Local Government Act’s Chapter 10 Part 1 assumes a system of valuations under that Act. The regulations do not specify how capital value is to be determined. The deletion of sections 186(2) and (2)(b) removes references to valuations and reviews, leaving a gap. The Authority must determine capital value, possibly by reference to the Land Valuation Act or by obtaining independent valuations. Landholders may face inconsistent or challenged values.

No service charges means the Authority cannot recover the cost of specific services (e.g., water supply, waste collection) directly from users who benefit. This may lead to cross-subsidisation or under-provision of services. Landholders who do not use a service still pay for it through the asset sustainability levy. Conversely, heavy users pay no more than others. This reduces economic efficiency and may discourage conservation of services.

Appeals instead of reviews in nuisance orders narrows the scope of challenge. Under the Local Government Act, a review under section 257(1) allows the ERD Court to consider the matter afresh. An appeal under the modified provision will likely be limited to errors of law or unreasonable decisions. Landholders who receive a nuisance order may have fewer grounds to contest the merits. Practitioners must advise clients that the procedural right is weaker.

Geographic limitation of enforcement. Regulations 6 and 7 insert “in the outback” into anti-pollution and anti-nuisance provisions. This means the Authority can only issue orders for conduct occurring in the outback. If a pollution source is outside the outback but affects the outback, the Authority may have no power to act. The excluded islands and reserves are also outside the outback, so the Authority cannot enforce against nuisances on them, even if they affect outback land.

No transitional provisions. The repeal of the 2010 regulations is immediate. Anyone who was subject to a notice or rate under the 2010 regulations may find that the legal basis for that notice ceases. The new regulations do not save ongoing matters. The Authority should re-issue any notices that remain in force after 1 September 2025. Landholders should check whether old obligations are still valid.

Service of documents under regulation 9 must follow sections 279 and 280 of the Local Government Act. Those sections require personal service or post to the last known address. If the Authority serves by email or fax, it may not be valid unless the Local Government Act permits it. The modifications do not update service methods for modern communication.

Reference to “capital value” may not be defined in the applied provisions. The Local Government Act defines “capital value” in a specific context, but after the modifications, some definitions may be deleted. The Authority may need to rely on external definitions or create its own approach, increasing uncertainty.

The list of islands is exhaustive but may contain errors. The regulation names over 100 islands by name, but some islands may have been omitted or misnamed. If an island is not on the list but also not within a council area, it would be outback, subject to the Authority. Conversely, if an island is listed, it is excluded, even if it is uninhabited and not within any council. This creates a rigid boundary.

For landholders: Determine whether your land is within the outback by checking the excluded areas in regulation 4. If your land is not on the exclusion list and is not within a council area, you are subject to the Authority. You must pay any asset sustainability levy or community contribution declared by the Authority. Pay rates by the due date to avoid recovery action. If you receive an anti-pollution notice under section 236 or 237, comply within the specified time. If you receive a nuisance order under section 254, either comply or appeal to the ERD Court within the appeal period specified in section 257 as modified. The appeal must be made to the court, not to the Authority. Seek legal advice on the grounds of appeal, as it is not a merits review. Maintain records of any communications with the Authority regarding rates or orders. If the Authority attempts to serve documents, ensure your address is current, as service is valid if posted to the last known address.

For the Authority: Adopt a new rating scheme based on asset sustainability levies and community contributions. Do not attempt to impose service charges or service rates; those are deleted. Determine the capital value of all rateable land in the outback. You may need to engage a valuer or use valuation data from the Valuer-General. Publish the rate declaration and provide notices to landholders. Ensure that any authorised persons appointed under Chapter 12 Part 3 understand that they cannot use by-law powers. Their powers are limited to the sections as modified; they cannot enter land based on a by-law. For anti-pollution enforcement, ensure the conduct occurred in the outback before issuing a notice. For nuisance orders, ensure the nuisance is in the outback and that the order is served under sections 279-280. When issuing orders, include the right to appeal under section 257(1) as modified, stating that the appeal is to the ERD Court. For any enforcement action, follow the procedures in Schedule 6 of the Local Government Act, as made applicable by regulation 7(e). Review all existing orders and rates from before 1 September 2025 and re-issue them under the new regulations if they are to continue.

For practitioners: Update your reference materials to cite the 2025 regulations, not the 2010 regulations. When advising a client on outback land, check the exclusion list carefully, especially the island list. When challenging a rate, note that the internal objection process has been removed; consider judicial review or a direct constitutional challenge if the regulation is invalid. When appealing a nuisance order, file an appeal in the ERD Court; the time limit is likely still 30 days under the Local Government Act, but confirm the exact provision. Monitor any court decisions interpreting the capital value provision or the appeal versus review change.

For compliance officers: The regulations create a self-contained code. There is no discretion to use other Local Government Act provisions not applied. Do not refer to the Local Government Act directly; always check the regulations for the modified version. For service of process, comply strictly with sections 279 and 280. For enforcement, remember that by-law offences do not exist under this regime; only the statutory offences in the applied parts are enforceable.
