The regulations assemble a small taxonomy and a set of operational rules that structure how gas‑fitting occupational licensing works in practice.

Key definitional and structural concepts

• Prescribed work and its scope. Regulation 4(1) determines that the work specified in Part 1 of Schedule 1 is "prescribed work" for the Act’s purposes, while regulation 4(2) classifies the items in Part 2 of Schedule 1 as not prescribed work. Part 1 enumerates a broad set of activities relating to gas installations and gas storage systems (design, installation, testing, commissioning, decommissioning, conversion, modification, relocation, repair, alteration, servicing, maintenance and related piping and equipment) and includes work necessary or incidental to automotive gas fuel systems (Schedule 1, Part 1 items 1-2).
• Practitioner and contractor classes. The regulations define multiple practitioner categories: gas‑fitter practitioner (certifier), certifier restricted, provisional, provisional restricted, restricted, and parallel categories for automotive gas‑fitting (regulation 3). Contractor licences are separately defined (gas‑fitting contractor, automotive gas‑fitting contractor) and linked to section 34(1)(a) of the Act.
• External determinations and standards as legal sources. Many operative definitions depend on administrative determinations: the gas‑fitting work determination and the automotive gas‑fitting work determination made under section 30 of the Act (regulation 3). "Relevant standards" are those specified in the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice established under section 53 of the Act. AS/NZS 5601 is expressly adopted for meanings like "mobile appliance" and "portable appliance" (regulation 3).
• Record keeping. A licence holder must keep records in an approved form of all gas‑fitting work and automotive gas‑fitting work and associated work for at least 10 years after completion (regulation 6). The regulation specifies maximum fines for bodies corporate and individuals for non‑compliance.
• Defective work and rectification. Regulation 7(1) treats prescribed work that does not comply with the Act or the relevant standards as defective; regulation 7(2) imposes documentary consequences after compliance with a rectification order under section 57 of the Act, including providing certificates of compliance or approved forms to the Administrator and owners. Regulation 8 sets out that the person against whom a rectification order is made must bear all rectification costs, subject to limited exceptions where the Administrator is satisfied another party caused the defect or approves recovery.
• Gratuitous work. Regulation 5 substantially curtails gratuitous practice by non‑certifier practitioners, imposing an offence (fine up to 75 penalty units) for a person who performs gas‑fitting or automotive gas‑fitting work gratuitously unless they are a certifier (or certifier restricted), and requires prior notification to the Administrator in an approved form.
• Fees and fee units. Regulation 9 prescribes that fees in Schedule 2 are inclusive of GST and are payable to the Administrator; Schedule 2 lists fee units for major licence types and additional transactions (e.g. duplicate certificate, inspection of register).
• Enforcement and administrative tools. Regulation 15 prescribes which offences under the Act and the regulations are eligible for infringement notices and sets the infringement penalty units for corporate and natural person offenders (Schedule 3). The regulations also modernise procedural rules (warrant applications by email, reg 14) and allow temporary delegations to police during a state of emergency (reg 13).

Conceptual dependencies and delegated instruments

• Much of the operational content is dependent on administrative determinations (section 30 determinations) and a Code of Practice (section 53 instrument) that are external to the regulations and can be amended separately. The definitions expressly subject practitioner roles and scopes to those determinations (regulation 3). This means the practical obligations on licence holders will change as the determinations or the Code of Practice are amended.

The instrument therefore functions as a scaffold: it sets compulsory administrative processes, penalties and fees while channel‑linking detailed technical and scope decisions to other instruments and standards. The practical compliance profile for licence holders will be shaped by both the text of these regulations and the content of the referenced determinations and Code of Practice.

The regulations create obligations and rights that affect identifiable groups, and they allocate costs and decision points between them.

Primary affected parties

• Licence holders: Individuals and bodies corporate holding gas‑fitting contractor licences, gas‑fitter practitioner licences (various classes) and the parallel automotive licences are the primary addressees. Licence holders must retain records (regulation 6), notify the Administrator of specified changes within prescribed timeframes (regulation 12), pay fees in Schedule 2 (regulations 9-11), and comply with defective work rectification procedures (regulation 7).
• Contractors and nominated managers: Gas‑fitting contractor and automotive gas‑fitting contractor licence holders have specific notification obligations (regulation 12(2)) that include details of nominated managers, registered business names and principal places of business, with higher fines for non‑compliance than individual licence holders. Schedule 3 (Part 1) references numerous sections of the Act imposing duties on contractors and nominated managers, cross‑referencing to the infringement notice regime.
• Practitioners undertaking prescribed work: Those who actually perform the work listed in Schedule 1 Part 1 , including designers, installers, repairers and maintainers of gas installations and automotive gas fuel systems , are affected because that work is regulated as "prescribed work" under regulation 4(1). The scope of what work counts depends on the gas‑fitting work determination and automotive gas‑fitting work determination, which the regulations import by reference (regulation 3).
• Owners and occupiers: The instrument imposes duties indirectly on owners/occupiers under the Act (see Schedule 3 Part 1 entries, such as section 24 on ensuring engaged persons hold the required licence). The post‑rectification information obligations in regulation 7(2) explicitly require the person against whom a rectification order was given to provide certificates to owners/occupiers.
• The Administrator and Department of Justice: The Administrator is given notification, approval and decision roles (notification of gratuitous work, approval of cost recovery, receipt of compliance certificates, delegations under emergency, and collection of fees). The instrument also provides the Administrator with enforcement options (infringement notices, requiring certificates, approving cost recovery).
• Police and emergency services personnel: Regulation 13 permits the Administrator to delegate functions to police officers during a declared state of emergency (Emergency Management Act 2006), which affects the responsibilities of police in those periods.
• Consumers and the public: End users of gas installations and motor vehicles with gas fuel systems are indirectly affected by the rules that govern who can carry out prescribed work, record keeping (which aids traceability), and the requirement to rectify defective work.

Secondary and marginally affected parties

• Welding and fabrication trades: Schedule 1 Part 2 exempts certain welding of pressure vessels by welders certified under AS1796‑2001 or equivalent approval; this means certified welders performing that work will not be captured as needing a gas‑fitting licence for that task (Schedule 1, Part 2 items 1 and 2).
• Businesses structuring work to avoid prescribed work. The explicit listing of items that are not prescribed work (Schedule 1 Part 2) may incentivise reallocation of tasks to non‑licenced workstreams when legally permissible.

Who pays and who decides

• Who pays: Licence holders pay fees listed in Schedule 2 (regulation 10), and persons against whom rectification orders are made must bear rectification costs (regulation 8(1)), subject to Administrator discretion (regulation 8(2)). Fines and infringement penalties fall on non‑complying individuals and bodies corporate as specified in the Act and Schedule 3.
• Who decides: The Administrator exercises multiple decision points , approval of cost recovery under regulation 8(2), receipt and presumably processing of notifications (regulations 5 and 12), delegated administrative determinations (gas‑fitting work determination, automotive determination, Code of Practice), and the power to delegate functions to police in emergencies (regulation 13).

Net effect on markets and behaviours

• Restricting gratuitous practice and the strict definition of prescribed work concentrate lawful supply in licenced practitioners for most safety‑critical activities (regulation 5, Schedule 1 Part 1). This raises compliance costs for individuals and businesses wishing to provide these services, while exempting some narrowly defined activities (Schedule 1 Part 2) that can be done without licences or by other certified trades.

The regulations therefore redistribute decision authority to the Administrator and impose negotiated compliance and financial obligations on licence holders, contractors, nominated managers, and persons who carry out or commission prescribed gas‑related work.

This section lists the principal duties placed on actors by the regulations and the rights or procedural entitlements embedded in the text.

Principal duties on licence holders and practitioners

• Keep records: Licence holders must keep records (in an approved form) of all gas‑fitting and automotive gas‑fitting work and associated work for at least 10 years after completion (regulation 6). Failure attracts specified fines (body corporate up to 125 penalty units; individual up to 65 penalty units) and an infringement penalty (Schedule 3 Part 2, item 1: 1 fee unit for a body corporate, 0.5 for a natural person).
• Compliance with prescribed standards: Work that does not comply with the Gas Safety Act 2019 or the relevant standards is classed as defective (regulation 7(1)), and licence holders must rectify defects if ordered under section 57 of the Act and then provide certificates or approved forms to the Administrator and owners (regulation 7(2)).
• Bear rectification costs: The person against whom a rectification order has been made must bear all costs of rectifying the defective work and complying with the rectification order (regulation 8(1)), subject to exceptions where the Administrator is satisfied that another party caused the defect or otherwise approves recovery (regulation 8(2)). Contravention is an offence with penalties (body corporate fine not exceeding 50 penalty units; individual not exceeding 25 penalty units).
• Notification of gratuitous work: A person who intends to perform gas‑fitting or automotive gas‑fitting work gratuitously must notify the Administrator in an approved form before commencing (regulation 5(3)); non‑certifier gratuitous practice is prohibited (regulation 5(1)-(2)), with fines up to 75 penalty units.
• Notify changes to licence details: Licence holders must notify the Administrator in writing within 21 days of specified changes to personal or business information (regulation 12). Different sets of particulars apply to general licence holders and contractor licence holders (regulation 12(1) and (2)). Failure attracts fines up to 10 penalty units for individuals and up to 50/25 penalty units for corporate/individual contractors.
• Pay fees: Applicants for issue or renewal of licences must pay the fee specified in Schedule 2 for the relevant licence (regulation 10). Additional occupations attract a fee of 100 fee units each (regulation 11 and Schedule 2).

Procedural rights, approvals and obligations

• Administrator’s approval and discretion: The Administrator has an approval role under regulation 8(2) for approving recovery of rectification costs and receives compliance certificates under regulation 7(2). The Administrator also prescribes the determinations (scope/ classes) and establishes the Code of Practice under the Act, thereby exercising indirect control over practitioners’ obligations (regulation 3 references to determinations and Code of Practice).
• Delegation and emergency scope: The Administrator may delegate functions to a police officer for the purpose of exercising powers under the Emergency Management Act 2006 while a state of emergency is in force; delegation may be with or without conditions and has effect only during the state of emergency (regulation 13). This creates a limited procedural pathway for expanded enforcement capacity in emergencies.
• Administrative modernisation: Applications for warrants under the Act may be made by email for the purposes of section 18(5) of the Act (regulation 14), which is a procedural right for authorised officers or the Administrator to use electronic means when seeking warrants.
• Infringement notice regime: Regulation 15 prescribes which offences under the Act and the regulations can be dealt with by infringement notices and attaches prescribed penalty units for bodies corporate and natural persons. The schedule differentiates penalties and lists many specific Act sections and regulatory contraventions.

Interplay with standards and determinations

• Compliance with standards becomes a de facto duty: Work that falls short of the Gas Safety Act 2019 or the "relevant standards" is treated as defective work (regulation 7(1)). "Relevant standards" are those specified in the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice established under s53 of the Act, thereby anchoring the duty in a Code of Practice that the Administrator may amend.

Ancillary obligations and liabilities

• Fines and infringement notices: The regulations cross‑refer to the Act's offence architecture and prescribe infringement notice penalties for both Act offences and regulation contraventions (Schedule 3). Many offences treat corporations more harshly than natural persons under the infringement scheme (Schedule 3 columns 3 and 4 show the different penalty units).
• Documentary obligations after rectification: After rectifying defective work under a rectification order, the person must provide a certificate or approved form to the Administrator and the building owner/occupier (for gas‑fitting work) or to the owner of the vehicle/forklift/industrial engine (for automotive gas‑fitting work) (regulation 7(2)).

Rights are largely procedural and administrative: licence holders can apply for renewals, pay prescribed fees, and interact with the Administrator through prescribed notification channels. The Administrator retains significant discretionary powers over recovery of rectification costs and the content of determinations and the Code of Practice, which materially shape licence holders’ duties.

The regulations embed a multi‑layered enforcement architecture that combines the Act’s enforcement powers, regulation‑level fines, and a prescribed infringement notice schedule.

Monetary penalties and criminal sanctions

• Regulation‑level fine caps: Several regulations specify maximum fines for contraventions. Examples include: performing gas‑fitting or automotive gas‑fitting work gratuitously when not permitted (regulation 5(1)-(2)), with a maximum fine not exceeding 75 penalty units; failure to keep records (regulation 6) , maximum fines of up to 125 penalty units for a body corporate and up to 65 penalty units for an individual; failure to bear rectification costs where ordered (regulation 8(1)) , fines up to 50 units for a body corporate and up to 25 units for an individual; and notification failures under regulation 12 with tiered fines (regulation 12).
• Offence categorisation and enforcement mechanisms: The regulations do not replace the Act’s enforcement regime but operate alongside it. Regulation 15 prescribes which offences under the Act (Schedule 3 Part 1) and which offences under the regulations (Schedule 3 Part 2) can be dealt with by infringement notices, and fixes the corresponding penalty units for bodies corporate and natural persons.

Infringement notice regime (Schedule 3)

• The instrument lists a comprehensive table of Act offences for which infringement notices may be issued and prescribes different penalty units for bodies corporate and natural persons (Schedule 3 Part 1). The listed Act offences include core duties (e.g. sections 21, 22, 23, 25, 29) and procedural obligations (e.g. sections 38, 44, 47, 54, 57).
• The regulations themselves have an infringement schedule (Schedule 3 Part 2) which prescribes smaller penalty units for contraventions like failing to keep records (regulation 6; 1 unit body corporate, 0.5 natural person) and failing to notify Administrator of changes (regulation 12; 2.5/1 units).
• Where an infringement notice is served and not withdrawn, the authorised officer must forward a copy of the notice to the Administrator (regulation 15(4) in the instrument).

Administrative orders and powers

• Rectification orders: Regulation 7 implements section 57 of the Act by specifying that prescribed work which does not comply with the Act or relevant standards is defective and can attract a rectification order. The person subject to a rectification order must bear the rectification costs and comply with post‑rectification documentation obligations (regulations 7 and 8).
• Cost recovery limits: Although regulation 8(1) places the default cost burden on the person against whom a rectification order was made, regulation 8(2) allows cost recovery where the Administrator is satisfied that another person caused the defect or has otherwise approved recovery. This generates an administrative gatekeeping role for the Administrator when private parties seek to recover costs from third parties.
• Delegation to police in emergencies: Regulation 13 allows the Administrator to delegate functions to a police officer for the purpose of exercising powers or performing functions under the Emergency Management Act 2006 during a declared state of emergency. Delegations can be conditional or unconditional and only operate while a declaration of emergency is in force.

Procedural modernisation and record flow

• Warrant applications by email: Regulation 14 permits applications for warrants under section 18(5) of the Act to be made via email, which affects how authorised officers can operationalise search and seizure powers.
• Documentary flow to Administrator: Post‑rectification certificates and notifications are channelled to the Administrator, consolidating oversight information and providing a central enforcement record (regulation 7(2), regulation 5(3), regulation 12).

Penalty differentiation and enforcement incentives

• The infringement schedule establishes higher penalty units for bodies corporate than for natural persons in many instances. The schedule also aligns higher penalty units with safety‑critical conduct (e.g. carrying on business as a contractor without the appropriate licence, section 21, 20 units for corporate/10 for natural persons in Schedule 3 Part 1).
• The existence of small infringement penalties for administrative matters (e.g. record keeping, notification) provides a cost‑effective enforcement tool for regulators to address compliance lapses without full prosecution.

Information flows for enforcement

• The regulations require authorised officers to forward copies of infringement notices to the Administrator, consolidating enforcement intelligence (regulation 15). Certificates of compliance and approved forms are similarly required to be sent to the Administrator after rectification, creating administrative evidence trails.

In sum, the instrument combines criminal fines, civil‑style administrative orders (rectification), and a graduated infringement notice regime designed to give enforcement agencies options calibrated to the seriousness of contraventions. The Administrator wields significant discretion in approving recovery and setting standards through secondary instruments, while delegation and email warrant procedures provide operational flexibility for enforcement action.

The regulations are tightly integrated with several primary and secondary legal instruments. The text expressly references the Occupational Licensing Act 2005, the Gas Safety Act 2019, standards and Codes of Practice, and the Emergency Management Act 2006. The following notes the principal interaction points.

Primary statute interface

• Occupational Licensing Act 2005: These regulations are made under that Act and repeatedly reference its operative provisions. For example, the definition of "prescribed work" used in section 3(1) of the Act is implemented by regulation 4 which points to Schedule 1 Part 1; licence definitions refer to section 34(1)(a) (regulation 3 definitions). Rectification orders under section 57 of the Act are implemented and amplified by regulations 7-8. Regulation 15 directly engages the Act’s section 62(1) to prescribe which offences may be dealt with by infringement notices.
• Gas Safety Act 2019: Many obligations are anchored to compliance with the Gas Safety Act 2019. Regulation 3 imports definitions (e.g. "appliance", "gas storage system", "capacity" cross‑reference to Gas Safety Regulations 2021) and regulation 7(1) treats non‑compliance with the Gas Safety Act 2019 as rendering work defective.

Secondary legislation and instruments

• Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice: The instrument defines "relevant standards" as those specified in the Code of Practice established under section 53 of the Act (regulation 3). This gives the Code of Practice legal effect by incorporation. Amendments to the Code of Practice will change the regulatory content applicable to practitioners without needing to amend these regulations.
• Gas‑fitting work determination and Automotive gas‑fitting work determination: Regulation 3 repeatedly relies on the determinations made under section 30 of the Act to define classes, scopes and procedural requirements for practitioners. Those determinations sit alongside these regulations and can be amended administratively, shifting scope and obligations.
• AS/NZS 5601 and other standards: The regulations adopt AS/NZS 5601 (Gas installations , General installations) and make various meanings contingent on it (regulation 3). They also import AS1796‑2001 for welding certification in the exemption schedule (Schedule 1 Part 2 item 1).
• Gas Safety Regulations 2021: Cross references to definitions such as "capacity" indicate interplay with the Gas Safety Regulations 2021 (regulation 3).
• Emergency Management Act 2006: Regulation 13 links delegation of Administrator functions to police to a state of emergency declared under that Act. The delegation has effect only while a declaration is in force, integrating emergency powers into the occupational licensing enforcement architecture.

Administrative law and discretion

• The regulations vest the Administrator with approval and discretionary roles (recovering rectification costs, determinations and Code of Practice content). These are subject to principles of administrative law (natural justice, reasonableness) but those controls are not restated in the regulations; statutory review rights and merits review avenues would be governed by the Act and relevant administrative law frameworks.

Criminal and civil liability interfaces

• The instrument works with the Act’s offence structure and prescribes some offences for infringement notices (regulation 15 and Schedule 3). Other offences in the Act not listed in Schedule 3 remain prosecutable through standard criminal or regulatory processes.

Data, privacy and records law

• Records retention for 10 years aligns with evidentiary and safety‑traceability needs. Records must be kept "in an approved form" (regulation 6), implicating procedural rules about form and accessibility. The regulations do not explicitly reference privacy or information‑sharing regimes, but the Administrator’s receipt of compliance certificates and infringement notices creates data flows that would be subject to public sector information management rules elsewhere.

Practical overlap and potential friction

• Because the detailed technical standards and class definitions are tied to determinations and Codes of Practice (which can change more quickly than primary regulations), practitioners must track instruments across a range of legislative and non‑legislative sources. The distinction between prescribed work (Schedule 1 Part 1) and exempt work (Schedule 1 Part 2) requires reading both the regulations and the Gas Safety Act 2019 to determine whether a specific task is upstream or downstream of the gas supply point, for example.

In short, the regulations operate as a focal procedural and penalty framework that is intended to be read in conjunction with the Occupational Licensing Act 2005, the Gas Safety Act 2019, Codes of Practice and technical standards. Practical compliance therefore requires navigating instruments across statute, regulation, Code of Practice and standards.

The text provided contains the following concrete amendment and commencement information.

• Commencement: The regulations commenced on 15 December 2021 (regulation 2). The instrument was notified in the Gazette on 14 December 2021 (final line of the text).
• No subsequent amendments shown: The provided text does not include any later amending instruments, schedules or notes indicating repeal, suspension or amendment beyond the commencement and Gazette notification. There are references to determinations and Codes of Practice that are "as amended from time to time" (e.g. gas‑fitting work determination, automotive gas‑fitting work determination, and the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice), but those are separate instruments and not amendments to these regulations themselves.

What is embedded by reference and thus amendable without changing the regulations

• The regulations incorporate, by reference, the contents of administrative determinations (gas‑fitting work determination, automotive gas‑fitting work determination under section 30 of the Act) and the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice under section 53 of the Act (regulation 3). Those instruments are expressly described as "as amended from time to time" in the text of the regulations. That procedural design means the practical legal obligations on licence holders can change when the Administrator amends those determinations or the Code of Practice without the need to amend the regulations themselves.
• Standards like AS/NZS 5601 are incorporated "as in force from time to time" (regulation 3), which again permits updates to technical obligations as standards are updated.

Administrative flexibility versus statutory change

• The result is a hybrid approach: the regulations fix the administrative architecture (fees, record retention periods, notifications, offence prescribing), while technical norms, scopes, and class details are flexible, sitting in determinative instruments that can be updated more rapidly. This speeds technical updates but also creates a shifting compliance landscape.

Practical steps for tracking amendments

• Practitioners and compliance officers must track amendments to: (a) the gas‑fitting work determination and automotive gas‑fitting work determination made under the Act; (b) the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice; and (c) the referenced Australian/New Zealand Standards (AS/NZS 5601 and AS1796). The regulations themselves have no in‑text amendment log beyond the commencement date in the material supplied.

In sum, the provided text shows this instrument was made and commenced in December 2021 and that subsequent substantive operational changes are expected to occur principally through amendments to the referenced determinations and Code of Practice rather than the regulations themselves.

The supplied text contains no case citations, judicial decisions, or references to litigation arising under these regulations. The instrument itself does not record any judicial or tribunal determinations.

What is absent in the supplied material

• There are no recorded appeals, judicial reviews, or reported cases attached to or mentioned in the regulation text. There is no administrative tribunal decisions list or appellate history included in the material supplied.
• Because the regulations incorporate determinations, standards and a Code of Practice, litigation could arise from those instruments or from enforcement actions (for example, challenges to rectification orders, disputes about whether work is prescribed or defective, or disputes over Administrator discretion to permit cost recovery). But no such litigation is recorded in the text provided.

What practitioners should expect

• Absent recorded litigation in this instrument, the first line of potential contestation is likely to be: (a) factual disputes about whether particular work falls within Schedule 1 Part 1; (b) whether work complied with the Gas Safety Act 2019 or the "relevant standards" specified in the Code of Practice; and (c) administrative exercises of discretion (for example, the Administrator approving recovery of rectification costs under regulation 8(2)). Those kinds of disputes typically generate administrative reviews or judicial review applications in other statutory contexts, but no decisions are cited here.
• Because the enforcement architecture relies on infringement notice powers and rectification orders, disputes about proportionality and process may be resolved administratively first and litigated only if substantial costs or sanctions are contested.

Practitioners should therefore treat the absence of litigation history in the instrument as a data point that the instrument is newly enacted (2021 commencement) and that legal challenges, if they occur, will be found in case law databases or tribunal records external to the regulation text.

This section flags concrete, source‑grounded pitfalls derived from the regulations’ wording, with practical consequences for compliance and risk management.

1. Prescribed work versus exempt work requires careful mapping

• Regulation 4(1) makes the work in Schedule 1 Part 1 prescribed work, while regulation 4(2) declares Part 2 of Schedule 1 is not prescribed work. A practitioner may mistakenly assume every task mentioned in Schedule 1 is prescribed; instead, consult the correct Part: Part 1 items are prescribed and Part 2 items are exempt. That matters for licensing exposure and potential prosecution under the Act (reg 4(1)-(2); Schedule 1 Parts 1 and 2).

2. Gratuitous work is not freely permitted

• The regulations prohibit performing gas‑fitting or automotive gas‑fitting work gratuitously unless the performer is a certifier or certifier restricted practitioner (regulation 5(1)-(2)). Further, anyone intending to perform such gratuitous work must notify the Administrator in an approved form before commencing (regulation 5(3)). Performing gratuitous work without meeting those conditions attracts a fine up to 75 penalty units. Volunteers or charitable organisations relying on unpaid tradespeople will need to ensure compliance.

3. Record keeping is long and specific

• Licence holders must keep records of all gas‑fitting and automotive gas‑fitting work and associated work for at least 10 years after the work is completed, "in an approved form" (regulation 6). The requirement is long‑tailed and applies to associated work as well. Failure attracts heavy maximum fines (up to 125 penalty units for bodies corporate, up to 65 penalty units for individuals) and an infringement notice penalty (Schedule 3 Part 2 item 1).

4. Rectification cost shifting is limited

• Regulation 8(1) places the cost burden for rectification on the person against whom a rectification order is made. Regulation 8(2) permits recovery only if the Administrator is satisfied another person caused the defect or otherwise approves recovery. Practitioners who expect to pass remediation costs to employers, clients, or subcontractors may be disappointed unless they secure Administrator approval or can satisfy the Administrator about causation, creating a potential cash‑flow risk.

5. Administrator discretion is a central pivot

• Several compliance outcomes depend on Administrator satisfaction or approval (regulation 8(2), the determinations and Code of Practice referenced in regulation 3, and approval for forms and notices). That creates points of administrative discretion which can create uncertainty about outcomes for practitioners without further guidance from the Administrator.

6. Fee units and GST inclusivity require interpretation

• Schedule 2 lists fees in fee units (e.g. 330 for an annual contractor licence) and regulation 9(2) declares those fees inclusive of GST. The actual monetary amount of a fee unit is not stated in the regulations themselves; practitioners must consult the relevant fee unit value in the applicable jurisdictional finance legislation or schedule to convert fee units into dollars.

7. Delegation in emergencies is time‑limited but material

• Regulation 13 allows the Administrator to delegate functions to police only while a state of emergency declared under the Emergency Management Act 2006 is in force. That delegation gives police certain enforcement-related functions in emergencies, potentially changing how enforcement is conducted for the duration of the emergency (regulation 13).

8. External instruments can change obligations without amending these regulations

• Many operative duties derive from the gas‑fitting work determination, the automotive gas‑fitting work determination, the Code of Practice and AS/NZS standards (regulation 3). Those external instruments can be updated more readily than these regulations, altering the practical compliance landscape quickly.

9. Different notification lists and timelines

• Regulation 12 splits notification obligations: general licence holders (non‑contractor) must notify specified personal/contact changes (regulation 12(1)) within 21 days, while contractor licence holders must notify a longer list of business details including nominated manager and principal place of business, also within 21 days (regulation 12(2)). The penalties differ by licence type. Mixing up which list applies to which licence category is a common operational risk.

10. Infringement schedule is extensive and granular

• Schedule 3 lists many Act offences that may be dealt with by infringement notices and sets different penalty units for bodies corporate and individuals. Practitioners should not assume small penalties apply only to minor administrative lapses; Schedule 3 includes high‑penalty offences (e.g. section 22(1), carrying out prescribed work other than as permitted , 20 units corporate, 10 natural person). The presence of both infringement and larger fines in the regulations means non‑compliance can quickly escalate.

11. Post‑rectification documentary obligations differ for automotive work

• After rectification, if the defective work was "defective automotive gas‑fitting work", the person must complete an approved form and provide a copy to the Administrator and the owner of the motor vehicle, forklift or industrial engine (regulation 7(2)(b)). For building gas‑fitting work the post‑rectification requirement is a certificate of compliance or statement of compliance supplied to the Administrator and owner/occupier (regulation 7(2)(a)). Practitioners must follow the correct documentary pathway.

12. Exemptions are narrow and specifics matter

• Schedule 1 Part 2 item 6 exempts service or repair work on automotive gas fuel systems only if the work does not require working on the pressurised gas system or performing gas system tuning or adjustment. Minor errors in scope assessment could transform an exempt task into prescribed work.

These "gotchas" are concrete operational risks embedded in the regulations’ wording, and they point to areas where front‑line compliance procedures, client engagement, and record systems should be tightened.

This section provides a practical compliance checklist that follows directly from the regulations. It is organised as actionable items with the supporting regulation citation.

1. Determine whether the work is prescribed

• Read Schedule 1 Part 1 (prescribed work) and Schedule 1 Part 2 (exempt work) carefully (regulation 4). If work is downstream of the gas supply point or associated with a gas storage system, it is likely prescribed (Schedule 1 Part 1 item 1). For automotive work, check Schedule 1 Part 1 item 2 and Part 2 item 6 for the narrow service/repair exemption.

2. Hold and maintain the correct licence(s)

• Ensure you hold the appropriate licence class as defined in regulation 3 and as implemented in the gas‑fitting work determination and automotive determination under the Act. When applying for issue or renewal, pay the fee specified in Schedule 2 (regulation 10). For multiple occupations, pay the fee for each additional occupation listed in Schedule 2 (regulation 11).

3. Manage records to the 10‑year standard in an approved form

• Maintain records of all gas‑fitting and automotive gas‑fitting work and associated work for at least 10 years after completion, in the approved form required by the Administrator (regulation 6). Implement a records retention and retrieval system that supports audits and inspection; consider digital storage with backups and an index mapping work to certificate numbers.

4. Ensure compliance with technical standards and the Code of Practice

• Work must comply with the Gas Safety Act 2019 and the "relevant standards" specified in the Occupational Licensing (Standards of Gas‑fitting Work) Code of Practice (regulation 7(1) and regulation 3 definition of "relevant standards"). Implement procedures to keep abreast of updates to the Code of Practice, the gas‑fitting work determination, the automotive gas‑fitting work determination, and technical standards such as AS/NZS 5601.

5. Train staff and document scopes of competence

• Supervision and competence obligations are enforced (Schedule 3 entries cross‑referencing the Act). Ensure supervising practitioners only undertake or supervise work within their competence. Maintain written training plans for provisional practitioners and restricted scopes where applicable.

6. Procedures for gratuitous work

• If you or your staff intend to perform gratuitous gas‑fitting or automotive gas‑fitting work, check that you are a certifier or certifier restricted practitioner (regulation 5(1)-(2)). If permitted, notify the Administrator in an approved form before commencing (regulation 5(3)). Keep copies of the notification and any Administrator correspondence.

7. Prepare for rectification orders and cost risk

• Implement quality assurance and risk management to limit the likelihood of rectification orders. If a rectification order is issued, comply promptly and provide the required certificate of compliance or approved form to the Administrator and to the owner/occupier or vehicle owner as specified (regulation 7(2)). Expect to bear rectification costs unless the Administrator approves recovery under regulation 8(2). Where possible, collect evidence of causation and contractor/subcontractor responsibilities that could support an application to the Administrator for cost recovery.

8. Stay current with notifications to the Administrator

• Establish internal processes to notify the Administrator in writing within 21 days of changes specified in regulation 12. For contractor licences, ensure nominated manager changes, business names, registered office and principal place of business updates are covered. Retain proof of delivery of notifications.

9. Implement insurance and contractual practices

• Although not exhaustively detailed in these regulations, Schedule 3 references the Act’s insurance requirements (sections 29 and related). Ensure contractors hold the required insurance and maintain certificates of currency; be ready to produce them on request (Schedule 3 Part 1 items 21-24).

10. Billing and fees

• When applying for licences, budget for fees in Schedule 2 (payable in fee units and inclusive of GST , regulation 9). Convert fee units to dollar amounts using the jurisdictional fee unit value. Track triennial versus annual fees (Schedule 2 shows triennial fees for practitioner certifiers and annual fees for contractors and provisional licences).

11. Compliance with enforcement and administrative processes

• Prepare to receive and respond to infringement notices. Note that some offences are eligible for infringement notices (Schedule 3) and that an authorised officer must forward a copy of any served infringement notice to the Administrator (regulation 15). For warrant applications, authorised officers may use email under regulation 14 when seeking warrants under section 18(5) of the Act.

12. Emergency delegations and police interactions

• Be aware that during a declared state of emergency under the Emergency Management Act 2006, the Administrator may delegate functions to police (regulation 13). Ensure that your compliance policies account for a potential change in enforcement personnel and practices during such a period.

13. Maintain internal controls for post‑rectification documentary obligations

• Immediately on rectification, ensure the correct certificate or approved form is completed and sent to both the Administrator and the owner or owner/occupier as required (regulation 7(2)). Keep copies for the 10‑year records retention requirement.

14. Monitor external instruments

• Assign responsibility to monitor updates to the gas‑fitting work determination, automotive gas‑fitting work determination, the Occupational Licensing Code of Practice, AS/NZS 5601 and other referenced standards. Changes to these instruments will alter the compliance baseline without amendment to these regulations.

15. Audit readiness and enforcement response

• Conduct regular compliance audits to test record retention, licence coverage, insurance evidence and quality control procedures. Where rectification orders or infringement notices arise, retain legal counsel and compile documentation that supports compliance steps and mitigation.

Following the above steps aligns operational practices with the regulatory obligations in the instrument. The dominant practical risks are administrative: keeping pace with external determinations and standards, meeting the 10‑year records obligation, satisfying notification deadlines, and managing the potential financial exposure that flows from rectification orders unless the Administrator approves cost recovery.
