What it does
This Act gives the City of Melbourne a narrow, statutory power to lease and to use a specified parcel of land at North Melbourne that was originally the subject of a Crown grant containing use restrictions. Mechanically the Act does three things.
First, it authorises the Lord Mayor, councillors and citizens of the City of Melbourne to grant leases over the land described in the Schedule (or any part of it), but only “subject to and in accordance with the provisions of section one of Act number eight hundred and thirty-eight” and with sections two and three of that Act applying to any such leases (s 2(1)). In short, the City may lease the Schedule land, but the form, scope or terms of those leases are constrained by the referenced provisions of Act No. 838 (the Act is explicit that the earlier Act’s s 1 and its ss 2 and 3 govern).
Second, the Act specifies the financial destination of receipts: all moneys received by the City as rent for the leased land are to form part of the City’s town fund (s 2(2)). That allocation is mandatory under this Act.
Third, the Act removes the Crown grant’s restrictive effect on municipal uses for the remaining land. The Act says, “Notwithstanding anything in the hereinbefore recited Crown grant”, the Corporation may use the land comprised in the Crown grant for works, services or installations that it is empowered to undertake under the Local Government Act 1958 or any Act relating to the City of Melbourne, but this power is subject to the recited lease (s 3). Thus, the Act both permits leasing of one part of the granted land and sanctions municipal uses of the remaining part, while acknowledging and subordinating municipal uses to the existing lease where relevant.
The Schedule describes the precise parcel (two roods and 94/10 perches, part of allotment 10, section 2, Parish of Jika Jika, County of Bourke) and gives metes and bounds tied to adjacent allotments and Errol Street. The Preamble records the title history the Act addresses: a Crown grant circa 1870, an 1882 lease (validated by Act No. 838) originally for post and telegraph offices and a court house, the lease now being held by the Commonwealth, and the later union of the borough with the City of Melbourne (Preamble). The Act took effect on assent, 28 May 1963 (Endnotes, General Information).
