#### 83 Impairment of person’s capacity to carry out duties as seafarer or pilot (1) A person contravenes this subsection if: (a) the person is a seafarer or a licensed pilot on board a regulated Australian vessel or a foreign vessel; and (b) the person is under the influence of alcohol or any other drug (whether medicinal or otherwise) to such an extent that his or her capacity to carry out the duties of a seafarer or pilot is impaired. Fault‑based offence (2) A person commits an offence if the person contravenes subsection (1). Penalty: 60 penalty units.
