136 Taking vessels to sea without pollution certificates—master

(1) The master of a vessel must not take the vessel to sea, or cause or permit another person to take the vessel to sea, if: (a) the vessel is required by the regulations to have a pollution certificate of a specified kind; and (b) a pollution certificate of that kind is not in force for the vessel. Fault‑based offence (2) A person commits an offence if the person contravenes subsection (1).

Penalty: Imprisonment for 10 years or 600 penalty units, or both.

Civil penalty (3) A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty: 6,000 penalty units.
