#### 109 Taking unseaworthy vessel to sea—owner
(1) The owner of a vessel must not take the vessel to sea, or cause or permit another person to take the vessel to sea, if the vessel is unseaworthy.
Fault‑based offence
(2) A person commits an offence if the person contravenes subsection (1).
Penalty: Imprisonment for 10 years or 600 penalty units, or both.
Civil penalty
(3) A person is liable to a civil penalty if the person contravenes subsection (1).
Civil penalty: 6,000 penalty units.
