This regulation formally declares and names State land as different kinds of protected areas (national parks, conservation parks, resources reserves, nature refuges, coordinated conservation areas and special wildlife reserves), records those areas in schedules and links each area to maps and conservation agreements. It sets interim management intent, allowable uses and how long protections last. It primarily affects the department that manages parks, landholders who sign conservation agreements, visitors and commercial operators by prescribing permitted activities, access rules and inspection rights.
This Regulation lists, dedicates, declares and describes protected areas and related interim management intents for State land by means of schedules and specific provisions. Mechanically, it (1) records areas of State land to be, or taken to be, national parks (scientific) (s 3 and Schedule 1); (2) dedicates and names national parks and conservation parks set out in Schedules 2 and 3 respectively (s 4, s 5); (3) dedicates resources reserves in Schedule 3A (s 6); (4) declares and names specialised categories of protected land such as national parks (Aboriginal land) (s 6AAA, Schedule 3B), national parks (Cape York Peninsula Aboriginal land) (s 6AA, Schedule 4), indigenous joint management areas (s 6A, Schedule 4A), and special wildlife reserves (s 6B, Schedule 4B); (5) declares and records nature refuges subject to conservation agreements (s 7, Schedule 5) and sets out requirements about the conservation agreement’s content and accessibility (s 8, s 9); and (6) declares coordinated conservation areas and records interim management intent and duration via Schedule 6 and its parts (s 10-12; sch 6 Pt 1 and Pt 2).
The Regulation does not set out operational rules for day-to-day park management in statutory detail; rather it establishes legal recognition and basic management intent through schedules and references to conservation agreements and plans. Several provisions expressly tie the Regulation to the Nature Conservation Act and to instruments held by the responsible department: Schedules list areas “under the Act” (for example s 3(1) says Schedule 1 sets out the national parks (scientific) under the Act) and s 13 makes plan references in the schedules a reference to plans held and available for inspection in the department. Transitional provisions in pt 6 record name changes and provide that references in documents to former names may, where context permits, be taken as references to the new names (secs 14-19). The Regulation therefore functions as an administrative register and declaratory instrument: it converts entries in schedules into dedications, declarations and interim management intents and points readers to conservation agreements and departmental plans for operative detail (see s 8, s 6B and s 13).

Where the schedules permit particular uses, the Regulation records those permissions as part of the declared interim management intent. Examples appear in Schedule 6 entries: the Koala Bushland Coordinated Conservation Area will allow quarrying and commercial beekeeping on parts of the area, horseriding, educational activities and aircraft controls (sch 6 sec 4); the Rindoparr Coordinated Conservation Area will allow controlled, non-commercial cattle grazing, domestic living areas and low-impact tourist facilities (sch 6 sec 9). The conservation agreements are the operative instruments for nature refuges and coordinated conservation areas, and the Regulation makes those agreements inspectable at departmental offices (s 8, s 6B).
The Regulation is primarily an instrument of designation and transparency: it assigns names and legal categories to defined parcels of State land and records specific management intents and exceptions in schedules and conservation agreements, while depending on the underlying Act and departmental plans for the substantive rules, enforcement and operational detail.
Main concepts
The instrument organises protected land types and records management intents by reference to schedules, conservation agreements and departmental plans. Core legal concepts and mechanisms that recur through the Regulation are the dedication/declaration of land, naming, conservation agreements, interim management intent, duration linked to agreements or dedications, plan references held by the department, and transitional name-mapping.
Dedication and declaration by schedule. The Regulation dedicates areas of State land as particular kinds of protected areas by listing them in Schedules. For example, areas in Schedule 2 are dedicated as national parks and assigned names (s 4); Schedule 3 lists conservation parks and triggers dedication via s 5; Schedule 3A sets out resources reserves (s 6); Schedule 1 lists national parks (scientific) (s 3). Where the schedule includes State land that is “taken to be” a park under provisions of the Act (for instance, s 3(2) references section 207 of the Act for national parks (scientific)), the schedule functions both as a record and as the legal mechanism that brings the land within the protected category.
Conservation agreements and management intent. Nature refuges and some coordinated conservation areas are tied to conservation agreements. Section 7 records that each area in Schedule 5 is the subject of a conservation agreement. Section 8 requires the conservation agreement for each nature refuge to state the refuge’s significant cultural and natural resources and values, and stipulates that proposed management intent and permitted uses must be only in accordance with that agreement; it also provides for free inspection of a copy of each conservation agreement at the department’s office during office hours. Coordinated conservation areas have an express “interim management intent” recorded in Schedule 6 (s 11), and Schedule 6 separates out the area description, significant values, and allowed uses (for example sch 6 sec 3-5 and sch 6 sec 8-10).
Plans and departmental records. Section 13 sets a concrete rule about references in schedules to plans: prefixes NPW or PA indicate plans held by the department; FTY indicates plans that deal with Forestry Act 1959 matters; other prefixes are plans dealing with Land Act 1994 matters, held and inspectable in the department (s 13). This centralises the repository of operative maps and plans within the department and treats the schedules as shorthand referring to those departmental plans.
Duration and linkage to other instruments. The Regulation ties the legal life of declarations to the duration of the underpinning instrument. For nature refuges the declaration’s duration is the duration of the conservation agreement (s 9). For coordinated conservation areas the duration is stated in Schedule 6 (s 12) and for the coordinated areas in sch 6 Pt 1 (sch 6 sec 5), duration may be the duration of the conservation agreement or the dedication of a national park, depending on the parcel.
Transitional name and reference rules. The Regulation contains multiple transitional provisions that allow older references in documents to be taken as references to renamed parks where context permits (sec 14-oc.2, secs 15-19). This mitigates the need to update private documents after administrative renaming, by legalising a flexible mapping between old and new names.
Permitted uses recorded in schedules. The Regulation does not universally prohibit private or commercial uses; instead some schedules explicitly permit specific uses as part of interim management intent. Examples: sch 6 sec 4 permits quarrying and commercial beekeeping on parts of Koala Bushland Coordinated Conservation Area, sch 6 sec 4 allows various recreational uses and aircraft landing control; sch 6 sec 9 allows controlled cattle grazing that is not on a commercial basis, domestic living areas and low environmental impact tourist facilities for Rindoparr. Those permissions are recorded at schedule level and are to be implemented via the conservation agreements and departmental plans.
Relationship to the Act and other statutes. The Regulation repeatedly frames its schedules and declarations as being "under the Act" and cross-references Act sections (for example s 3 refers to s 207 of the Act; s 5 to s 208; s 6 to s 209). Section 11 says interim management intent is subject to sections 17 and 23 of the Act. Schedule 6 sec 8 cross-refers to the Vegetation Management Act 1999 schedule for the definition “of concern regional ecosystem”. Section 13 explicitly references Forestry Act 1959 and Land Act 1994 for plan prefixes. The Regulation therefore functions within an interlocking statutory architecture rather than as a standalone corpus of rules.
Inspectability and transparency. The Regulation requires that conservation agreements be inspectable free of charge at departmental offices (s 8); sch 6 sec 4 and s 6B require copies of special wildlife reserve conservation agreements and approved management programs to be inspectable at the department’s head office. Section 13 requires plans referenced in schedules to be available for inspection in the department. The instrument therefore provides a statutory pathway to access the operative documents that set out permitted activities and management detail.
In short, the main concepts are schedule-based legal designation, conservation agreements as operative management instruments, departmental plans as the mapping layer, duration tied to agreements or dedications, explicit schedule-level permissions for certain private uses, and transitional mechanisms to map historical names to current names.
Who it affects
The Regulation affects several categories of stakeholders by operation of its schedule-based dedications, declared management intents and the existence of conservation agreements and plans.
State and departmental actors. The department responsible for nature conservation holds and makes available the plans referenced in the schedules (s 13) and holds the conservation agreements and management programs for inspection (s 8, s 6B). The Regulation therefore directly affects departmental workflows for record-keeping, inspection access, and implementing the recorded management intents. The Regulation also interfaces with the Nature Conservation Act, so agencies charged with enforcing that Act are administratively involved even though enforcement provisions do not appear in this text.
Landholders subject to conservation agreements. Nature refuges listed in Schedule 5 are each the subject of a conservation agreement (s 7). Coordinated conservation areas in Schedule 6 may also be subject to separate conservation agreements (sch 6 sec 4(1) expressly states the coordinated conservation area comprises three areas each subject to a separate conservation agreement). The Regulation records that the management intent must be consistent with the conservation agreement (s 8). Landholders who are parties to those agreements retain enumerated interests (for example sch 6 sec 4(g) states the coordinated conservation area will maintain the interests of the landholders who are parties to the agreements). Therefore private landholders who enter conservation agreements will be directly affected in terms of permitted uses, duration, and obligations.
Commercial operators and permit applicants. The schedules explicitly permit certain commercial or quasi-commercial activities in particular coordinated conservation areas where the conservation agreement or interim management intent allows them. For example, sch 6 sec 4 permits quarrying and commercial beekeeping on parts of the Koala Bushland Coordinated Conservation Area; sch 6 sec 9 allows low-impact tourist facilities and guiding services in Rindoparr. Those specific permissions create business opportunities for quarry operators, beekeepers, tourist operators and potentially contractors providing infrastructure, subject to the conservation agreement and other statutory approvals. Conversely, operators seeking other uses not recorded in the schedules will need to engage with the Act and departmental processes.
Community and recreational users. The Regulation records permitted recreational uses in schedules: sch 6 sec 4 allows a range of recreational activities, including horseriding, and sch 6 sec 4 allows educational activities. That affects local recreational users and clubs who use or intend to use the lands. Where the schedules permit domestic living areas or recreational campgrounds (sch 6 sec 9), residents and tourists are affected.
Indigenous peoples and cultural heritage interests. Several parts of the Regulation concern Aboriginal land and indigenous joint management areas: s 6AAA dedicates and names national parks (Aboriginal land) in Schedule 3B; s 6AA and s 6A declare national parks and indigenous joint management areas in Cape York Peninsula schedules. Schedule 6 sec 8 for Rindoparr records significant indigenous cultural heritage values and areas of indigenous cultural heritage interest, and the management intent includes conserving those values. Parties with indigenous interests are therefore specifically identified stakeholders.
Adjacent protected area managers and environmental stakeholders. Schedule entries may identify linkages to adjacent parks and their values. For example sch 6 sec 8(e) records that Rindoparr supports the cultural and natural values of the adjacent Rinyirru (Lakefield) National Park (Cape York Peninsula Aboriginal Land). This creates cross-boundary management considerations for park managers and environmental groups.
Document users and legal practitioners. The Regulation’s transitional provisions (secs 14-19) and the central role of departmental plans (s 13) affect legal practitioners, conveyancers, lenders and others who rely on naming, plan references or land descriptions. The transitional provisions permit older references to be read as references to new names where context permits, which reduces the need for immediate updating of private instruments but requires careful contextual interpretation.
Governance and planning bodies under other Acts. The Regulation cross-refers to the Forestry Act 1959, Land Act 1994 and Vegetation Management Act 1999 (s 13; sch 6 sec 8 note). Bodies or private parties operating under those Acts will be affected where the Regulation identifies plan prefixes (FTY and others) or where a regional ecosystem classification (from the Vegetation Management Act schedule) is used to describe significant values.
In sum, the Regulation affects governmental departments responsible for parks and records, private landholders who enter conservation agreements, specified commercial operators where schedules permit particular activities, indigenous groups associated with Aboriginal land dedications, recreational users where permitted, adjacent protected area managers, and legal and conveyancing actors reliant on the registered designations and name-mapping.
Key duties and rights
This Regulation primarily creates duties of recording, disclosure and limitation of use, and rights to inspect documents or to have land hold a particular protected status; it delegates substantive operational duties and powers to the underlying Act and to conservation agreements and departmental plans.
Duties to dedicate, declare and name. The Regulation creates the legal effect of dedication or declaration by listing areas and assigning names in schedules. Sections 3, 4, 5 and 6 perform that mechanical duty: Schedule 1 sets out national parks (scientific) (s 3); Schedule 2 areas are dedicated as national parks and named (s 4); Schedule 3 areas are dedicated as conservation parks (s 5); Schedule 3A areas are dedicated as resources reserves (s 6). For each such entry the Regulation requires that the area be dedicated/declared and assigned the stated name, so the departmental duty is to record and maintain the schedule entries.
Duty to state management intent in conservation agreements for nature refuges. Section 8 imposes a duty: for each nature refuge the conservation agreement must state the significant cultural and natural resources and values of the refuge, and the proposed management intent and use must be only in accordance with the conservation agreement. That places an affirmative duty on the parties to the conservation agreement and on the department to ensure the agreement contains those statements. Section 8 also obliges the department to make copies of the conservation agreements available for inspection, free of charge during office hours, which is a disclosure duty.
Right to inspect conservation agreements and special wildlife reserve documents. Section 8 grants public inspection rights for nature refuge conservation agreements at the department’s office. Section 6B grants inspection rights, free of charge during office hours at the department’s head office, for copies of the conservation agreement and approved management program for each special wildlife reserve (s 6B). These are statutory rights of access to the operative documents describing management intent and permitted uses.
Duty to reference departmental plans and to follow plan-defined descriptions. Section 13 requires that references in schedule descriptions to plans with particular prefixes be read as references to departmental plans held and available for inspection. This creates a duty for users to consult those departmental plans to get operative spatial descriptions, rather than relying solely on the schedule text. The departmental obligation is to hold those plans and make them available for inspection.
Rights and permitted uses recorded in schedules. Schedules record permitted or allowed uses as part of interim management intent. For example, sch 6 sec 4(ii) allows recreational activities including horseriding; sch 6 sec 4(v) allows quarrying and commercial beekeeping on parts of the Koala Bushland area; sch 6 sec 9 allows controlled cattle grazing that is not on a commercial basis, domestic living areas, and low-impact tourist facilities for Rindoparr. These schedule entries create rights to engage in specified activities, subject to the conservation agreement and any other statutory requirements.
Duration-linked rights. The duration of a nature refuge’s declaration is the duration of the conservation agreement (s 9); coordinated conservation area duration is stated in Schedule 6 (s 12) and sch 6 sec 5 specifies the duration mechanics for that coordinated area. This links the temporal existence of the statutory rights and duties to the duration of underpinning agreements or dedications.
Interplay with the Act. The Regulation delegates enforcement, offences, and other operational duties to the Nature Conservation Act by referencing that Act. For example s 3(2) notes that Schedule 1 includes areas of State land taken to be national parks (scientific) under section 207 of the Act, and s 11 states that interim management intent has effect subject to sections 17 and 23 of the Act. The Regulation does not itself spell out offences or enforcement mechanisms; those are left to the Act and associated instruments.
Transitional duties on document interpretation. Sections 14-19 provide transitional rules about name changes and references, permitting older document references to be taken as references to the new names if the context permits. That creates a legal duty on practitioners and courts to interpret historical documents consistently with the transitional mapping.
Administrative duties to maintain schedules and to make conservation agreements/management programs inspectable follow from the Regulation’s structure and the specific disclosure requirements (s 8, s 6B, s 13). Parties proposing activities should therefore, as a practical matter, consult the relevant schedule entry, the conservation agreement or management program, and the departmental plans referenced under s 13 to determine both permissions and constraints.
Penalties and enforcement
The Regulation, as provided, does not itself set out offences, penalty amounts or enforcement procedures. The text supplied records dedications, declarations, management intents and inspection rights, but it contains no provisions that specify civil or criminal penalties, or administrative enforcement mechanisms, within the Regulation’s own text.
That absence is evident across the Regulation: key operative sections assign names and declare protected area status (for example s 3, s 4, s 5, s 6) and require conservation agreements to state values and be available for inspection (s 8, s 6B), but there are no penalty clauses, infringement notices, or express enforcement powers in the Regulation. Where the Regulation ties obligations or effects to the Nature Conservation Act, it also makes the management intent subject to specified Act provisions (s 11), and Schedule 1 entries are “under the Act” (s 3). Those references indicate that enforcement and penalties are intended to be handled under the Act rather than within the Regulation.
Practically, this means enforcement, compliance monitoring, permitting, and sanctioning for breach of protected area rules will be governed by the Nature Conservation Act and any delegated instruments, management programs and conservation agreements enacted under that Act. Section 11 makes the interim management intent subject to sections 17 and 23 of the Act, which shows the Regulation’s intent to defer to the Act for substantive regulatory effect. The Regulation also makes departmental plans available for inspection (s 13), enabling enforcement actors and regulated parties to access the operative maps and details needed for compliance work, but it does not itself create enforcement machinery.
Because no enforcement provisions are included in the Regulation text provided, stakeholders should consult the Nature Conservation Act and departmental policies and guidance for details on offences, penalties, permit regimes, compliance processes and enforcement powers. The Regulation’s role is declaratory and administrative: it creates and records protected area designations and management intents, and links those entries to conservation agreements and departmental plans that will be the functional bases for permitting and enforcement under the Act.
How it interacts with other laws
The Regulation explicitly operates within a network of statutes and departmental instruments. It cross-references the Nature Conservation Act, the Forestry Act 1959, the Land Act 1994 and the Vegetation Management Act 1999, and it relies on conservation agreements and departmental plans as operative documents.
Primary link to the Nature Conservation Act. Multiple sections frame the Regulation as implementing or recording areas “under the Act.” Section 3(1) says Schedule 1 sets out the national parks (scientific) under the Act; subsections of s 3 refer to State land that is taken to be national parks (scientific) under section 207 of the Act. Sections 5 and 6 contain parallel language for conservation parks and resources reserves, referencing sections 208 and 209 of the Act respectively. Section 11 explicitly states that the interim management intent for coordinated conservation areas has effect subject to sections 17 and 23 of the Act. Those cross-references indicate that the Regulation is an implementing instrument that relies on the statutory framework and powers in the Nature Conservation Act for legal effect, enforcement and the substantive rights and duties of protected area status.
Departmental plans, Forestry Act and Land Act mapping. Section 13 governs how plans referenced in schedule descriptions are to be read: plan prefixes NPW or PA indicate plans held by the department; the FTY prefix indicates plans that deal with Forestry Act 1959 matters and are held by the department; other prefixes indicate plans that deal with Land Act 1994 matters. This provision creates a direct mapping between plan-based land descriptions in the Regulation and the planning regimes under the Forestry and Land Acts, and centralises plan custody with the department. Parties needing precise spatial boundaries must therefore consult those plans rather than relying solely on schedule text; the Regulation delegates spatial definition to plans produced under other Acts.
Vegetation Management Act and regional ecosystem classification. Schedule 6 sec 8 uses the terminology “of concern regional ecosystem 3.2.13” and provides a note stating that “of concern regional ecosystem see the Vegetation Management Act 1999, schedule.” That annexing of ecological classification to the Vegetation Management Act links the Regulation’s description of significant values to the regional ecosystem categories defined in that Act. Where an area’s significant values are expressed using Vegetation Management Act terminology, any regulatory consequences that flow from that classification in the Vegetation Management Act (such as clearing controls) will intersect with the protective overlay recorded in the Regulation.
Conservation agreements and approved management programs. The Regulation repeatedly anchors operational management and permitted uses in conservation agreements and approved management programs, which are documents produced under or with reference to the Nature Conservation Act. Nature refuges in Schedule 5 are each the subject of a conservation agreement (s 7) and s 8 requires the conservation agreement to state significant resources and proposed management intent, and makes the agreement inspectable. Section 6B for special wildlife reserves requires that the conservation agreement and approved management program be available for inspection at the department’s head office. Those documents are the primary operative instruments through which activities, restrictions and management are implemented; their legal status and enforceability will derive from the Act and associated delegations.
Transitional amendments and name changes across statutes. The Regulation contains multiple transitional provisions that map prior names to new names (secs 14-19 and their subdivisions), thereby facilitating continuity across documents that may be governed by other Acts or instruments (for example land titles, planning approvals, environmental authorities). Because name changes are handled through these transitional provisions, documents under other statutes that reference old names may continue to be treated as referring to the new names where context permits.
Absence of penalties in the Regulation itself. As noted earlier, the Regulation does not set out penalties or enforcement mechanisms; those matters are governed by the Nature Conservation Act. Therefore the legal consequences of non-compliance with the management intents or misuse of protected areas will be found in the Act and any subsidiary instruments under it, rather than in this Regulation.
In short, the Regulation is a schedule-driven, plan-referenced instrument that records and links protected area designations to conservation agreements and departmental plans, while explicitly referencing the Nature Conservation Act and other statutes for definitions, spatial plans, classifications and, implicitly, enforcement. Parties must therefore read the schedules in conjunction with the Act, the Vegetation Management Act schedule (for ecosystem classification), the Forestry Act and Land Act plans (as indicated by plan prefixes under s 13), and the conservation agreements and approved management programs held by the department.
Amendment history
The Regulation’s text includes extensive marginal notes recording insertions, amendments and omissions across many years and subordinate legislation (SL) instruments. The original statutory structure and subsequent changes are recorded as in-line annotations beside sections and schedule items.
Initial enactment and early structure. The marginal note for s 1 shows the short title and cites “s 1 sub 1994 SL No. 475 s 4,” indicating the 1994 instrument that established the Regulation. Section 2 contains a history of multiple insertions and omissions with dates and SL numbers, reflecting definitional updates (for example insertion of definitions such as bioregion (1999) and Wet Tropics World Heritage Area (2001)).
Amendments recorded by year and SL number. The Regulation contains many recorded amendments across the 1990s, 2000s and 2010s. Examples include:
1994 SL No. 475 s 6 cited for initial insertions of dedicated sections (s 3-6);
1999 SL No. 279 s 5 and 1999 SL No. 336 s 3/4 cited in multiple schedule entries for amendments and insertions;
2001 (SL No. 42) insertions adding World Heritage, national park entries and schedule items;
2002 SL No. 267 s 6 referenced repeatedly for renumbering and relocation of schedule subsections;
2003 SL No. 82 and SL No. 238 insertions and amendments affecting schedules and new conservation agreement entries;
2004 SL No. 81 and SL No. 190 amendments updating definitions and schedules (for example insertion of regional ecosystem references);
2005 SL No. 137 and SL No. 319 entries adding schedule items and adjustments;
2006 SL No. 116 and SL No. 319 record numerous omissions and consolidations across schedule items and section renumbering; many schedule sections show "om 2006 SL No. 319 s 11";
2008 SL No. 224 insertion of s 6AA (national parks (Cape York Peninsula Aboriginal land));
2023 SL No. 76 s 3 insertion of s 6AAA (national parks (Aboriginal land));
2024 SL No. 110 s 8 insertion of sec 18;
2025 SL No. 7 s 8 insertion of sec 19.
Schedule evolution. The annotated schedule entries show continuous additions, renumbering and relocations, particularly in Schedule 5 (nature refuges) and the heavy cross-referencing and omission notes in the schedules with the 2002 and 2006 instruments, indicating significant consolidation and restructuring. For example, sch 5 has dozens of subsections with “renum 2002 SL No. 267 s 6 (5)” and many insertions in 1999, 2001-2005 and 2006. Schedule 6 (coordinated conservation areas) has at least two distinct parts added at different times: sch 6 Pt 1 (Koala Bushland) ins 1996 SL No. 104 s 9, and sch 6 Pt 2 (Rindoparr) ins 2006 SL No. 116 s 5(2), with later amendments in 2010 (sch 6 sec 9).
Insertions for specialised categories. The Regulation records the creation of new categories by later instruments: s 6AAA (ins 2023 SL No. 76 s 3) dedicates national parks (Aboriginal land) in Schedule 3B; s 6AA (ins 2008 SL No. 224 s 3) for Cape York Peninsula Aboriginal land parks; s 6A (ins 2011 SL No. 308 s 4) declares indigenous joint management areas; and s 6B (ins 2020 SL No. 195 s 7) establishes special wildlife reserves. These insertions show that the Regulation has been used to register and recognise evolving forms of protected area designation and indigenous co-management over time.
Transitional provisions and name changes. The Regulation has a sequence of transitional provisions added across instruments to address renaming or reclassification of parks. Examples include sec 14-oc.2 (ins 2018 SL No. 220 s 3) and secs 15-19 (ins 2019, 2021, 2024, 2025 instruments), which allow references in documents to earlier park names to be taken as references to the updated names where context permits. These provide legal continuity for documents that pre-date renaming and are repeated in the amendments log.
Practical reading of amendment history. The marginal notes attached to each section in the Regulation act as a compact amendment history. For a practitioner, the presence of multiple renumbering and omission annotations (particularly around 2002 and 2006 instruments) means that caution is required when tracing older references. The Regulation’s schedules have been subject to many iterative changes; the amendment notes identify the primary instruments and years that enacted those changes and should be consulted where a historical chain of title, naming or conservation agreement chronology is needed.
In summary, the Regulation has been subject to continual adjustment and expansion since its 1994 origin, with many insertions of new categories and schedule items, renumberings in 2002 and 2006, and later additions to capture indigenous land categories and special reserve types. The marginal notes provide the primary record of that amendment history within the Regulation text.
Litigation history
The text of the Regulation supplied does not record, cite or describe any litigation, judicial decisions or appellate determinations concerning its provisions. There are no case names, litigation citations or references to judicial interpretation within the Regulation’s content or marginal notes. The Regulation is a schedule-based declaratory instrument and its text, as provided, confines itself to dedicatory, naming, management intent, inspection and transitional provisions without reciting litigation.
Because the Regulation cross-refers repeatedly to the Nature Conservation Act and to conservation agreements and departmental plans (for example s 3, s 7, s 8, s 11 and s 13), disputes about the meaning, effect, enforcement or scope of terms in the Regulation are likely to arise in litigation under those parent instruments and in proceedings that test the validity or interpretation of conservation agreements and management programs. However, the Regulation itself does not include a litigation history or case law references.
For any litigation research or case law tracking, practitioners should:
consult decisions under the Nature Conservation Act that interpret the consequences of declarations, dedications and conservation agreements referenced in this Regulation, because enforcement and offences are provided for in the Act rather than in this Regulation itself (the Regulation has no penalty clauses in the text supplied);
examine judicial decisions dealing with the interoperability of protected area designations and adjoining land-use regimes (for example disputes concerning Forestry Act or Land Act interactions where plans are referenced under s 13), although the Regulation itself does not supply such cases;
track disputes arising from conservation agreements listed in Schedule 5 or approved management programs for special wildlife reserves, since those are the operative documents that govern permitted uses and may be the subject of contractual or administrative law challenges.
Because the Regulation provides rights of inspection (s 8, s 6B) and records permitted uses in particular schedules (for example sch 6 sec 4 and sch 6 sec 9), factual disputes about permitted activities on particular parcels and the compliance of particular actors with the conservation agreement terms may give rise to administrative or civil proceedings. None of those proceedings or decisions is recorded in the Regulation text provided.
In short, the Regulation itself contains no litigation history or case citations. Any judicial treatment of the instrument will be found in case law concerning the Nature Conservation Act, conservation agreements, departmental decisions and management programs; those sources are outside the Regulation text provided here.
Gotchas
Several practical and legal traps are embedded in the Regulation’s architecture. They arise from the schedules-as-source-of-dedication approach, reliance on conservation agreements and departmental plans, permitted exceptions recorded in schedules, transitional name rules, and the absence of penalty provisions within the Regulation itself.
Schedules, not the body text, effect dedication. The Regulation dedicates and names parks by schedule entry (for example s 4, s 5, s 6 and s 3). This means the operative legal status of a parcel is determined by whether it appears in the relevant schedule and how the schedule cross-refers to departmental plans. Relying on a textual description in the body of the Regulation without checking the referenced departmental plan can mislead; s 13 makes plan references (NPW, PA, FTY and other prefixes) a repository rule. Practitioners must therefore inspect the departmental plan that the schedule references to ascertain exact boundaries and avoid mismatches during conveyancing, permitting or compliance checks.
Conservation agreements and approved management programs are the operative instruments for permitted uses. For nature refuges the conservation agreement must state significant values and the proposed management intent is to be only in accordance with that agreement (s 8); for special wildlife reserves the conservation agreement and approved management program are inspectable (s 6B). A schedule entry that appears permissive (for example sch 6 sec 4 permits quarrying on parts of Koala Bushland) must be read against the conservation agreement and approved management program; permissions recorded in a schedule may be qualified by the operational detail in those agreements. Failure to consult those documents before commencing activities is a practical risk.
Permitted extractive or commercial activity within conservation areas. The Regulation explicitly permits quarrying and commercial beekeeping in parts of Koala Bushland Coordinated Conservation Area (sch 6 sec 4) and allows domestic living areas, non-commercial cattle grazing and low-impact tourist facilities in Rindoparr (sch 6 sec 9). Those permissions create potential for focused economic activity within protected areas. The "gotcha" is that schedule-level permission is specific and limited to the stated area and conditions; commercial actors who assume broad rights across a coordinated conservation area will be mistaken. The schedule permissions are also constrained by conservation agreements and the Act; permissions in the schedule do not obviate the need for other statutory approvals or for compliance with the conservation agreement.
Duration linkage causes temporal uncertainty. The declaration of a nature refuge lasts for the duration of the conservation agreement (s 9). Parties must check the conservation agreement’s term. A change in the underlying conservation agreement or its expiry can alter the refuge’s legal status. Practitioners and parties with interests in or adjacent to a refuge should monitor agreement durations and any renewal or variation processes.
Transitional name mapping can mask historical discrepancies. Sections 14-19 provide that references in documents to former names may be taken as references to new park names if the context permits. That flexibility is helpful but creates interpretive risk: whether “the context permits” may be contested in transactions, leases, covenants or litigation. Conveyancers should not assume that older references automatically map without checking departmental records and, where necessary, updating documents.
Plan prefixes and cross-Act implications. Section 13 makes a prefix such as FTY a reference to a plan dealing with the Forestry Act 1959, while other prefixes reference Land Act 1994 plans. Confusion over which plan governs a particular parcel or over competing interests recorded under different Acts can lead to administrative delay or conflict. Always verify the plan held by the department using the prefix indicated in the schedule.
Public inspection mechanics are limited to departmental offices. While s 8 and s 6B make conservation agreements and approved management programs available for inspection “free of charge during office hours” at departmental offices or head office, they do not require online publication. This creates a practical access cost and time burden for remote stakeholders who need to consult operative documents. Failure to consult these documents because of access assumptions is a frequent compliance hazard.
Absence of penalty clauses in the Regulation. The Regulation does not set out enforcement or penalties. Parties should therefore consult the Nature Conservation Act for offences and enforcement powers. An error that clients sometimes make is assuming the Regulation alone governs sanctions; the Act provides the enforcement framework.
Concentration of permitted benefits. Schedule-level permissions for quarrying, beekeeping or tourist facilities concentrate economic opportunities in specified parcels. That creates a risk of localized contestation among stakeholders (for example neighbouring landholders, indigenous interests, conservation NGOs) and an administrative burden on the department in adjudicating approvals consistent with conservation agreements. The Regulation documents those permissions but does not itself specify the approval steps.
Finally, the schedules and marginal amendment history show frequent renumbering and relocations (notably in 2002 and 2006). Relying on older citations without cross-checking the amendment notes can produce mistaken references. Practitioners should always use the Regulation text together with the marginal notes and confirm current schedule numbering and plan references with the department.
How to comply
Compliance with this Regulation requires a schedule-first approach, inspection of conservation agreements and departmental plans, attention to duration and transitional name mappings, and engagement with the Nature Conservation Act and other relevant statutes for permitting and enforcement.
Confirm the protected area status from the relevant schedule. Start by checking whether the parcel in question appears in Schedule 1 (national parks (scientific)), Schedule 2 (national parks), Schedule 3 (conservation parks), Schedule 3A (resources reserves), Schedule 3B/4/4A/4B (special Aboriginal or indigenous categories), Schedule 5 (nature refuges) or Schedule 6 (coordinated conservation areas). The Regulation’s sections that create dedication/declaration (s 3-6, s 6AAA, s 6AA, s 6A, s 6B, s 7, s 10) make the schedule entry the starting point.
Inspect any referenced departmental plan. If the schedule entry references a plan code using NPW, PA, FTY or another prefix, obtain and inspect the plan held by the department as required by s 13. The plan will show exact boundaries, lot identifiers and spatial detail that the schedule’s text may not fully convey. Do not rely solely on the schedule’s narrative description.
For nature refuges and special wildlife reserves, obtain the conservation agreement and approved management program. Section 7 states each area in Schedule 5 is the subject of a conservation agreement, and s 8 requires those agreements to state the refuge’s significant values and management intent; s 6B does the same for special wildlife reserves and approved management programs. The Regulation requires those documents to be inspectable, free of charge, at departmental offices (s 8, s 6B). Read the agreement to determine permitted activities, prohibitions, infrastructure conditions and durations.
Read the interim management intent in the relevant schedule entry. For coordinated conservation areas (Schedule 6) the schedule sets out the interim management intent (s 11) and specific permitted uses (for example sch 6 sec 4 and sch 6 sec 9). Those schedule-level permissions must be harmonised with the conservation agreement and the Act.
Check duration and renewal terms. The duration of a nature refuge declaration is the duration of its conservation agreement (s 9). For coordinated conservation areas check s 12 and the schedule for duration statements; sch 6 sec 5 explains the duration mechanics for that coordinated area. Ensure your proposed activities or interests fit within the declared timeframe and factor in renewal or variation processes.
Confirm cross-Act requirements and additional approvals. Because the Regulation cross-references the Nature Conservation Act, the Forestry Act, the Land Act and the Vegetation Management Act (s 13; sch 6 sec 8 note), confirm whether additional approvals under those Acts are needed for your activity. Permissions recorded in a schedule (for example for quarrying, beekeeping, grazing) do not exempt an operator from obtaining any required approvals under other Acts or local planning laws. Consult the Nature Conservation Act for enforcement and permit procedures.
Use the transitional provisions to interpret older documents. If documents, leases or certificates refer to older park names, consult the transitional provisions in pt 6 (secs 14-19) to determine whether the older name can be taken as a reference to the new name in your context. Do not assume automatic mapping without checking the specific transitional section relevant to the name change.
Inspectability logistics. Because s 8 and s 6B specify inspection at departmental offices and head office during office hours, factor in time and logistics if you are remote. Request copies well before deadlines. If you require certified copies or other administrative confirmations, make a formal records request to the department.
For proposed development or commercial activity, verify scope within the conservation agreement. Even where a schedule lists permitted activity (for example sch 6 sec 4(2)(e) permits quarrying and commercial beekeeping on parts), the conservation agreement or approved management program will specify locations, conditions, mitigation measures and any necessary approvals. Obtain written confirmation from the department or include explicit covenant/consent wording in contractual documentation.
Record-keeping and conveyancing. For conveyancing, leases or mortgages affecting a parcel in a schedule, ensure the title searches, certificates, encumbrances and relevant instruments refer to the departmental plan and the schedule entry. Where possible, obtain a written statement from the department confirming the schedule designation and any encumbrances or permitted uses, because the Regulation’s schedules may not be self-explanatory for transactional parties unfamiliar with departmental plans.
Monitor amendments. Given the regulation’s long history of insertions and renumbering (see marginal amendment notes), check the most recent consolidated text and marginal notes to ensure you act under the current schedule numbering and that any plan references have not been relocated or renumbered.
Legal and compliance counsel. Because the Regulation itself does not specify enforcement penalties, engage legal or compliance counsel to interpret obligations under the Nature Conservation Act and to navigate permit applications or dispute resolution should there be disagreement about the scope of permitted uses in a conservation agreement or in a schedule.
In practical terms, compliance is a three-step workflow: (1) confirm schedule inclusion and examine the referenced departmental plan (s 13), (2) obtain and read the conservation agreement or approved management program (s 7, s 8, s 6B) to understand permitted uses and constraints, and (3) secure any additional statutory approvals required under the Nature Conservation Act or other Acts before commencing the activity.
