43Confidentiality

#### 43 Confidentiality A person commits an offence if: (a) the person obtains information in, or in connection with, the performance of the person’s function or duty for the purposes of this Act; and (b) the person makes a record of or discloses that information; and (c) the record or disclosure: (i) is not made in the course of performing that, or any other, function or duty for the purposes of this Act; and (ii) is not required or permitted by any other law. Penalty: Imprisonment for 2 years. > Note: Chapter 2 of the Criminal Code sets out the general principles of criminal responsibility.
