sec.30W Trial waiver
Subject to this section, the AER may, on application by a person or body that proposes to undertake a trial project (a proponent ), make a determination to grant the proponent an exemption (a trial waiver ) from 1 or more of the following: section 91BJ ; section 91BRD ; section 91BRR ; section 91LB ; the Rules, or a provision of the Rules. Before making a determination to grant a trial waiver, the AER must have regard to the innovative trial principles and any matter required by the Rules. An application for a trial waiver must be made in accordance with the Rules. Nothing in this section operates to prevent the granting of an exemption in accordance with a rule made under section 148A . s 30W ins 2022 No. 22 (SA) s 35 amd 2023 No. 36 (SA) s 19 (sec.30W-ssec.1) Subject to this section, the AER may, on application by a person or body that proposes to undertake a trial project (a proponent ), make a determination to grant the proponent an exemption (a trial waiver ) from 1 or more of the following: section 91BJ ; section 91BRD ; section 91BRR ; section 91LB ; the Rules, or a provision of the Rules.
