The MCE may request the AER to conduct a review into, and report to it as to, whether this Chapter, or a provision of this Chapter, should apply to any person or class of persons to whom the Chapter or provision does not currently apply. A request under subsection (1) must be in writing. On receiving a request under this section, the AER must conduct the review. In conducting a review under this section, the AER must— have regard to— the national gas objective; and the effect the application of this Chapter, or a provision of this Chapter, to another person or class of persons would have on— the promotion of access to pipeline services and any other benefits that may be associated with the application; and the costs that are likely to be incurred by the person or class of persons if they were operating efficiently; and consult, in accordance with the Rules, with the public.
