In making an AER ring fencing determination the AER must have regard to the likely costs that may be incurred by, as the case requires— an efficient service provider; or an efficient associate of a service provider, in complying with an additional ring fencing requirement specified in the determination. s 144 amd 2022 No. 21 (SA) s 68

• (a) an efficient service provider; or
• (b) an efficient associate of a service provider,
