sec.130 Application of this Chapter

This Chapter applies in relation to scheme pipelines and non-scheme pipelines. Also, this Chapter, or a provision of this Chapter, applies to a person other than a service provider as if a reference in the Chapter or provision to a service provider were a reference to the person— if— this Chapter, or the provision, is prescribed by the Regulations for the purposes of this subsection; and the person— is prescribed by the Regulations for the purposes of this subsection; or is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and subject to any modifications prescribed by the Regulations for the purposes of this subsection. s 130 prev s 130 om 2022 No. 21 (SA) s 52 pres s 130 ins 2022 No. 21 (SA) s 54 (sec.130-ssec.1) This Chapter applies in relation to scheme pipelines and non-scheme pipelines. (sec.130-ssec.2) Also, this Chapter, or a provision of this Chapter, applies to a person other than a service provider as if a reference in the Chapter or provision to a service provider were a reference to the person— if— this Chapter, or the provision, is prescribed by the Regulations for the purposes of this subsection; and the person— is prescribed by the Regulations for the purposes of this subsection; or is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and subject to any modifications prescribed by the Regulations for the purposes of this subsection.

• (a) if— (i) this Chapter, or the provision, is prescribed by the Regulations for the purposes of this subsection; and (ii) the person— (A) is prescribed by the Regulations for the purposes of this subsection; or (B) is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and
• (i) this Chapter, or the provision, is prescribed by the Regulations for the purposes of this subsection; and
• (ii) the person— (A) is prescribed by the Regulations for the purposes of this subsection; or (B) is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and
• (A) is prescribed by the Regulations for the purposes of this subsection; or
• (B) is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and
• (b) subject to any modifications prescribed by the Regulations for the purposes of this subsection.
• (i) this Chapter, or the provision, is prescribed by the Regulations for the purposes of this subsection; and
• (ii) the person— (A) is prescribed by the Regulations for the purposes of this subsection; or (B) is a member of a class of persons prescribed by the Regulations for the purposes of this subsection; and
• (A) is prescribed by the Regulations for the purposes of this subsection; or
