sch.3-sec.63 Incompatibility between request for the making of Rule or Procedure and Minister-initiated Rule or Procedure
The AEMC or AEMO (as the case requires) may reject a request for making a Rule or Procedure if the request relates to a Rule that is to be revoked by a Minister-initiated Rule or Procedure that has been made but is yet to come into operation.
If an existing Rule is to be amended or substituted by a Minister-initiated Rule or Procedure that has been made but is yet to come into operation, the AEMC or AEMO (as the case requires) may treat a request for making a Rule or Procedure relating to the relevant existing Rule as if the request related to that Rule as amended or substituted.
If the AEMC or AEMO (as the case requires) decides to act under this clause, it must—
inform the person that made the request of the decision; and
give that person written reasons for the decision.
In this clause—
Minister-initiated Rule or Procedure means a Rule or Procedure made under Chapter 9 Part 2;
Rule includes (where the context admits) a superseded jurisdictional rule.
